It has always been vexatious to the human spirit when a person, in describing human behavior or action, used the word \u2018Stupid.\u2019 Though it is no better using the coined words \u2018Wholly Idiotic,\u2019 it shall be considered the exception rather than the norm. That which a small minority of law enforcers and \u2018Joint Task Force (JTF)\u2019 members appeared not to have known, was that \u2018Execution of Duty,\u2019 never meant \u2018Executing the Citizens.\u2019\u00a0<\/span><\/p>\n

CONVERSANT AND COMPLIANT<\/span><\/p>

\"\"<\/a><\/div>
\"\"<\/a><\/div>\n

That which shall be understood by all a sundry, is that the fact that a citizen has been shot and injured or fatally wounded by law enforcement, has neither been justification, nor lawfulness for the use of a deadly weapon or force against the unarmed citizen, and one posing no danger to law enforcers. Should it be gently pointed out, as far as rendering \u2018assistance to the \u2018Civil Community, \u2018His Excellency\u2019 has a \u2018Functional Obligation\u2019 to be \u2018Conversant and Compliant\u2019 with provisions contained in the \u2018Defence Act\u2019 [No. 10 of 2006].<\/span><\/p>

PERSPECTIVE<\/span><\/p>\n

Speaking to \u2018Crime and Punishment,\u2019 both applicable to the lawless members of the wider society, equally as much as to the reckless few on the \u2018Joint Task Force (JTF),\u2019 whether or not sooner disbanded. This commentary provides a brief, but professional perspective of \u2018Military Aid to Civil Power.\u2019 It specifically looks at the \u2018Deadly Shooting of Mannie James 45\u2019 by; (a) \u2018The apparent overzealous: (b); partially trained; (c) Improperly briefed; (d) Unsupervised; and (e) Uncontrolled junior Police\/Military personnel.\u2019\u00a0 It also looks at; (i) Constitutional provisions respecting; (i) non-deprivation of life; (ii) non-deprivation of liberty: and (iii) The use of force that appeared starved for; (iv) Justification; and (v) Lawful authority; (vi) the Defence Act.\u2019\u00a0<\/span><\/p>

\"\"<\/a><\/div>\n

SUSPICION<\/span><\/p>\n

Privilege information suggested that \u2018Suspicion\u2019 may have been aroused when \u2018Police\/Military Shot and Killed\u2019 motorist \u2018Mannie James,\u2019 who reportedly turned around his vehicle before getting anywhere close to the temporary \u2018Security Force\u2019s Checkpoint\u2019 on the \u2018Lauchland Benjamin Drive\u2019 [July 31, 2023]. Though highly commendable of their behavior during the festive season, the citizenry may still find it ironical to hear \u2018Law Enforcement,\u2019 lauding; (i) \u2018Patrons; (ii) Revelers: and (iii) General public,\u2019 for the exhibition of behaviors that would have marked and exemplified by; (a) \u2018National and personal pride; (b) Sober respect for human dignity, worth and \u2018Sanctity of Life; and (c) Evidenced by a good sense of responsibility.\u2019\u00a0\u00a0<\/span><\/p>

\"\"<\/a><\/div>\n

ACTING SUSPICIOUSLY: MALADY OF MIND<\/span><\/p>

\"\"<\/a><\/div>\n

When law enforcers speak to \u2018Acting Suspiciously,\u2019 they are either speaking to behaviors that have spurred inquisitiveness or perceptions in the mind. This is universally known as \u2018Figment of Imagination.\u2019 This has been a \u2018Malady of the Mind\u2019 by those that; (a) \u2018Profiles; or (b) Those with \u2018Pre-conceived Ideas.\u2019 These may have played out in the several \u2018senseless and cold-blooded killings, including \u2018Mannie James.\u2019 These, as have been the practice of some law enforcers in some jurisdiction, have been the cause of many funerals and rare criminal prosecutions and non-completion of \u2018Coroner\u2019s Inquisitions.\u2019\u00a0<\/span><\/p>\n

ABSUSED NARRATIVE<\/span><\/p>\n

Not infrequently, law enforcers have found themselves subjected to rigorous \u2018Cross Examination.\u2019 This was often evident, when beads of perspiration gradually popped out of pores and ran like a stream on to their wearing apparel. Though not necessarily a demeanor, \u2018Defence Attorneys, Adjudicators and Court Prosecutors\u2019 are usually the first to make such observations. Frequently, it was when the apparent overly \u2018Abused Narrative\u2019 by the overzealous law enforcers, often seeing male persons \u2018Acting Suspiciously.\u2019 Today, these two coined words necessarily mean: (a) \u2018Arrest: (b) Detention: or (c) Death (ADD).\u2019\u00a0<\/span><\/p>\n

NON-FATAL CONSEQUENCES<\/span><\/p>\n

From professional prosecutorial experience, many \u2018Police Witnesses\u2019 were often placed under intense and sustained \u2018Cross Examination\u2019 by \u2018Criminal Defence Attorneys\u2019 who knows what the term \u2018Acting Suspiciously\u2019 is all about. The term now begs for disabuse from the mind of \u2018Police Press Liaison Officers.\u2019 As a consequence, it shall do no harm in conducting \u2018Refresher Courses\u2019 to guide proper understanding of the term and better perceptions of human behaviors, tolerance and restraint. These do not necessarily detract from the practice of using and developing a keener sense and greater \u2018Powers of Observation.\u2019 These often guide informed operational decisions and \u2018Non-Fatal Consequences.\u2019<\/span><\/p>\n

RETROSPECTION<\/span><\/p>\n

Though not necessarily for the overwhelming majority of law enforcers, the time for \u2018Carnival fun and frolic,\u2019 has now passed. This aspect of police work, called \u2018Policing Major Event (PME),\u2019 is now behind law enforcers. That which lies ahead, are the fundamentals of; (a) \u2018The Rule of Law; (b) Public safety and security; and (c) Crime and punishment.\u2019 The time has come for \u2018Retrospection- (i) \u2018Re-assessing; (ii) Streamlining; (iii) Re-focusing; (iv) Re-assigning; and (v) Re-assuring the citizenry of; (a) \u2018Safety and security; (b) Protection and Service; (c) Respect for human dignity and worth; and (d) Respect for the Sanctity of life.\u2019\u00a0<\/span><\/p>\n

STUPID AND INDUSTRIOUS<\/span><\/p>\n

That which shall also be understood, is that a person if there existed any actual or perceived danger, the citizen \u2018Running Away\u2019 from law enforcers no longer posed a danger, even when in hot pursuit. The behavioral pattern of those \u2018State Agents,\u2019 intent on \u2018Running Down and Gunning Down\u2019 unarmed and defenceless citizens and categorized as the \u2018Stupid and Industrious,\u2019 they shall be removed with immediacy [Management Strategy: German General: Kurt Von Hammerstein Equod: 1878 – 1943].<\/span><\/p>\n

FUNCTIONAL COOPERATION<\/span><\/p>\n

The two recent tragedies in which the most junior ranks have been criminally implicated, speaks to the need for; (i) \u2018A \u2018Memorandum of Understanding (MOU); (ii) The need also for \u2018Standard Operating Procedures (SOP\u2019s).\u2019 These often guides \u2018Functional Cooperation\u2019 of the supporting or supplemental role militarily-trained personnel shall play when giving \u2018Military Aid to Civil Power.\u2019 Most troubling, however, has been the religiously hurried removal of \u2018Motionless Bodies\u2019 from possible \u2018Crime Scenes\u2019 when \u2018Joint Operations\u2019 have resulted in fatalities. This speaks to the apparent woeful lack of professional training on the part of law enforcers and lack of knowledge on the part of the \u2018Military\u2019 personnel.<\/span><\/p>\n

MILITARY AID TO CIVIL POWER<\/span><\/p>\n

It appears obvious that more time might be studiously spent familiarizing oneself with the \u2018Constitution Order.\u2019 This appears more useful to junior personnel, than time spent fiddling with the deadliest of weapons in hands with \u2018trigger-happiness.\u2019 The most recent \u2018Run Down and Gun Down\u2019 \u2018shooting and killing of \u2018Mannie James\u2019 [July 31, 2023], speaks to a dire need for education and understanding of the concept: \u2018Military Aid to Civil Power.\u2019 Such \u2018Aid\u2019 clearly does not include complete take over the \u2018Civil\u2019 role of Law Enforcement. Likened to the \u2018Police,\u2019 the role of the \u2018Military\u2019 has been clearly defined in the \u2018Defence Act.\u2019\u00a0<\/span><\/p>\n

DEPRIVATION: LIFE AND LIBERTY<\/span><\/p>\n

Commanders will have seen the results of \u2018Joint Task Force Operations (JTFO)\u2019 in which; (a) \u20184-Military Personnel-(Lance Corporal and 3 Privates): and 2-Police Constables\u2019 have been implicated in the serious \u2018Capital Offence of Murder\u2019 [April 9, 2020: and July 31, 2023]. That which the \u2018JTF Commanders\u2019 may seek to address, is to impress upon the minds of members of their respective commands to devote some time in familiarizing themselves with the constitutional provisions that speak to two \u2018Fundamental Rights of the Individual.\u2019 These fundamentals are: (i) \u2018Deprivation of Life: and (ii) Deprivation of Liberty\u2019 [CO: 1981: Chapter II: Sections 4 and 5].\u00a0<\/span><\/p>\n

SENSELESS KILLINGS: NO IMMUNITY<\/span><\/p>\n

It shall be reminded that there is \u2018No Immunity\u2019 from criminal prosecution for the \u2018Senseless Killings\u2019 of member of civil society. That which appeared evident among \u2018Joint Task Force (JTF)\u2019 personnel, has been the woeful want of knowledge of the \u2018Fundamental Rights and Freedoms of the Individual,\u2019 as guaranteed by the \u2018Constitution Order\u2019 [1981: No. 1106]. Lack of such knowledge poses as much danger to society, as adjudicators that have deprived Juries of the opportunity in developing their comprehension and reasoning skills, to determine a verdict of; (a) \u2018Guilt: or (b) Innocence.\u2019\u00a0<\/span><\/p>\n

VICTIMS OF POLICE GUN WRATH<\/span><\/p>\n

Among the victims of \u2018Police Gun Wrath,\u2019 have been: (i) \u2018Avie Howell-Mullaney killer\u2019 [The Guardian: June 21, 2014]: (ii) Ronald Bloodman 28; (iii) Kendal Joseph 34; and Chad Bloodman 36-Killed in a \u2018Cooks Hill\u2019 dwelling house-APUA Credit Union\/Toy Box Store robbers [Freedom FM: 106.5: January 27, 2015]. (iv) Kurt \u2018Shabba\u2019 James-Dominican Fugitive from Justice\u2019 [DNO: January 3, 2016]: (v) Jamele Marlo\u2019 Hurst; (vi) Travis \u2018Ten Pound\u2019 Martin-\u2019 Alleged \u2018East Light Foote Police\u2019 foiled robbery attempt [ANR: October 5, 2017]; (vii) Shanell \u2018Mabz\u2019 Thomas 34- Prison Farm Escapee\u2019 [Loop: January 10, 2022]; and now (viii) \u2018Mannie James 45-No known or reported crime\u2019 [ABS TV: August 31, 2023].\u00a0<\/span><\/p>\n

DISSIMILAR ROLES: RPFAB\/ABDF<\/span><\/p>\n

That which \u2018Joint Task Force (JTF) Commanders; Public Safety and Police Minister; National Security Minister; and Governor General, His Excellency, Sir Rodney Errey Williams KGN, GCMG, MBBS\u2019 shall be forever mindful of, is the distinguished and dissimilar roles. Thus, they shall encourage themselves to know the defined statutory responsibilities that are charged to these agencies. For instance; (i) \u2018The Police not only enforces \u2018Criminal Law,\u2019 but also have responsibility for the \u2018Prevention and Detection of Crime\u2019 [Sections 6: 22 and 23: Police Act: Chapter 330].\u00a0<\/span><\/p>\n

OTHER DUTIES: LEGITIMACY<\/span><\/p>\n

Conversely; (ii) The duties of the \u2018Antigua and Barbuda Defence Force (ABDF)\u2019 states: \u2018The Antigua and Barbuda Defence Force is responsible for the defence of Antigua and Barbuda, and such other duties as the \u2018Defence Board\u2019 determines\u2019 [Section 6 (1): Defence Act: No.10 of 2006]. Providing legitimacy to \u2018Other Duties,\u2019 the Statute Law\u2019 states; \u2018In the event of \u2018Public Emergency,\u2019 the Governor General may, on the advice of the \u2018Prime Minister, by proclamation direct that the \u2018Antigua and Barbuda Defence Force,\u2019 or part thereof be employed in aid of \u2018Civil Community\u2019 [Section 6 (2): Defence Act: No.10 of 2006].<\/span><\/p>\n

STATE OF NORMALCY\u00a0<\/span><\/p>\n

Instructively, the \u2018ABDF\u2019 is comprised of three parts; (i) \u2018The Regular Force: (ii) A Reserve Force, called \u2018Antigua and Barbuda Defence Force Reserve Force; and (iii) Such other Units as the Governor General may, \u2018from time to time\u2019 considers necessary to be formed\u2019 [Section 4: Defence Act: No.10 of 2006]. Consequent upon these \u2018Statutory Provisions,\u2019 it was not clear what continues to guide the \u2018Governor General and his \u2018Deputy and Alternate Deputy: (i) Sir Clare K. Roberts; and (ii) Dr. Errol Cort\u2019s decision in continuing with the \u2018Joint Military\/Police Operations,\u2019 while the national life has returned to a \u2018State of Normalcy\u2019 [ABS TV].\u00a0<\/span><\/p>\n

PUBLIC KNOWLEDGE<\/span><\/p>\n

For the benefit of \u2018Public Knowledge,\u2019 the \u2018Defence Act\u2019 unambiguously states; \u2018Where it appears to the \u2018Governor General\u2019 that it is necessary in the public interest that a Unit should be deemed to be on \u2018Active Service,\u2019 he may by proclamation declare a period not exceeding three (3) months commencing with the date of the coming into force of the proclamation, that Unit shall be deemed to be on \u2018Active Service\u2019 [Section 3 (1): Defence Act: No. 10 of 2006]. Though not necessarily related to any of the planned events of Carnival, the festive season was marred only by the apparent senseless and extra-judicial killing of the motorist.\u00a0<\/span><\/p>\n

JOINT MILITARY\/POLICE OPERATIONS<\/span><\/p>\n

Given recent \u2018Joint Military\/Police Operations,\u2019 and allegations of \u2018Choking and Shooting,\u2019 it could never be said that; (i) \u2018Bruce Greenaway; and (ii) Mannie James,\u2019 were about to; (a) \u2018Commit; or (b) Had committed a known \u2018Capital offence.\u2019 The true professional law enforcers have invariably, guided themselves in making informed decisions.\u00a0 Now, when four \u2018Joint Task Force (JTF)\u2019 personnel, for no clear and justifiable reasons allegedly; (a) \u2018Choked and Murdered Bruce Greenaway 43 [April 9, 2020]; and (b) Shot and Killed\u2019 the \u2018Innocent and Unarmed\u2019 citizen \u2018Mannie James\u2019 [July 31, 2023].\u00a0<\/span><\/p>\n

COMMUNITY OUTRAGE<\/span><\/p>\n

They have been deprived of life, while families were left to grieve. These tragedies have not only triggered \u2018Community Outrage,\u2019 but also national concern, over the apparent wanton and reckless \u2018Shootings\u2019 by members of the \u2018Security Forces. The society\u2019s call for swift \u2018Criminal Justice,\u2019 reflected such concern. In criminal investigations, nothing shall be left to chance or speculation. That which is required is in depth, thorough, meticulous and painstaking investigations.\u2019 That which shall now be said is that none is above the Law.\u00a0<\/span><\/p>\n

LUCKLESS: CONSTABLE NELSON<\/span><\/p>\n

There is no immunity to any \u2018Law enforcer or \u2018JTF\u2019 members, nor is it a defence in criminal prosecutions for \u2018Gunnin Down\u2019 unarmed citizens.\u2019 Had it been so, then former \u2018Police Constable Kevil Nelson\u2019 may not have been prosecuted for \u2018Shooting and Killing\u2019 of \u2018Liberta resident \u2018Denfield \u2018Tody\u2019 Thomas\u2019 [October 24, 2006]. The clearly \u2018Luckless Constable,\u2019 having been tried for the \u2018Capital Offence of Murder,\u2019 and duly convicted by a \u2018Jury of his Peers,\u2019 he may never have been sanctioned with a \u201822-year term of imprisonment\u2019 [October 30, 2009]. The Jury found no \u2018Reasonability or Justification\u2019 for the force used against the \u2018unarmed victim.\u2019<\/span><\/p>\n

GUN TRIGGER-HAPPINESS<\/span><\/p>\n

The misguided law enforcer, often appeared not to have been mindful of the critical element called; \u2018Reasonability.\u2019 That which some only knew was the use of \u2018Deadly Force.\u2019 The several apparent trigger-happy \u2018State Agents,\u2019 that have left families grief-stricken and the citizenry enraged, very often have not been made accountable for \u2018Shootings and Killings\u2019 that more frequently seen as starved of justification. Whatever \u2018Happiness\u2019 that may have been derived from \u2018Gun Trigger,\u2019 it has brought, and continues to bring grief and sorrow to families, while in rare instances, prosecutorial consequences to \u2018Joint Military\/Police Task Force (JMPTF)\u2019 members.\u00a0<\/span><\/p>\n

OPERATIONAL PRACTICE<\/span><\/p>\n

The \u2018Operational Practice\u2019 of the apparent \u2018trigger-happy law enforcers,\u2019 has raised serious concerns among the citizenry. Either the reported removal or the dragging away suspected \u2018Fatally Wounded\u2019 persons on the road way from possible \u2018Crime Scenes,\u2019 has been observed in recent years. None was more evident than that viewed in an amateur viral on social media. It recorded the \u2018Motionless Body of Mannie James\u2019 being dragged along the roadway to a marked Police vehicle [July 31, 2023]. That which most trained criminal investigators know, is that the cold-blooded killers, with disguised intention to \u2018Derail Criminal Investigations,\u2019 often attempt to rush the \u2018Dead to Hospital.\u2019<\/span><\/p>\n

MEDICAL ATTENTION FOR THE DEAD<\/span><\/p>\n

That said, it could never be said that there was not something fundamentally idiotic, rushing the \u2018Fatally Wounded\u2019 the \u2018Sir Lester Bird Medical Center (SLBMC),\u2019 under the guise of securing urgent \u2018Medical Attention for the Dead.\u2019 If it was not professionally pointed out, it may continue to the detriment of \u2018Criminal Justice.\u2019 Emergency medical personnel know that only the \u2018Injured\u2019 is rushed to Hospital. From professional criminal investigation training, \u2018Motionless Bodies,\u2019 or those that appear lifeless, shall remain in the original positions.\u2019<\/span><\/p>\n

PROBING PROCEDURES: AFTER DEATH<\/span><\/p>\n

The only surgical \u2018Probing Procedures\u2019 these victims will have seen, was after when the \u2018Pathologists\u2019 dissected their bodies (Post Mortem) to officially ascertain the \u2018Causes of Death,\u2019 and certainly not that which will seek to restore life.\u00a0 That which the untrained law enforcer appeared not to know or appreciate, is that \u2018Forensic Experts\u2019 shall at all material times, be positioned to properly process all possible \u2018Crime Scene\u2019 to recover scientific and other physical evidence.\u00a0<\/span><\/p>\n

PERVERTING COURSE OF JUSTICE<\/span><\/p>\n

From professional knowledge, no life of anyone has ever been restored or preserved having been \u2018Shot Dead\u2019 at a scene. Thus, summoning an ambulance or seeking to rush a dead person to the \u2018Sir Lester Bird Medical Center,\u2019 constituted; (unlawful removal of body\u2019 from the \u2018Scene of the Crime.\u2019 The deceased, as seen in the video being \u2018dragged\u2019 away from the possible \u2018Crime Scene,\u2019 could never have been said to have been alive, nor intended to preserve life [Observer Media: August 4, 2023]. From professional criminal investigative training and knowledge of the \u2018Classification of Crime,\u2019 such constitutes the serious \u2018Common Law\u2019 criminal offence, \u2018Perverting the Course of Justice.\u2019\u00a0<\/span><\/p>\n

INVESTIGATIVE DIFFICULTIES<\/span><\/p>\n

From a purely professional perspective, and by those that understand the nature, sophistication and complexity with which some acts of criminality were perpetrated against victims, have often posed \u2018Investigative Difficulties.\u2019 Many people may not have been readily observant that a \u2018Motionless Body,\u2019 does not necessarily mean a \u2018Comatose Condition.\u2019 Invariably, it means a \u2018Post Mortem.\u2019 Clearly, the experiences of \u2018Mannie James\u2019 have given rise for the seemingly \u2018Operational Practice\u2019 to be ceased with immediacy.\u00a0<\/span><\/p>\n

CRIME SCENES<\/span><\/p>\n

The disadvantages to \u2018Crime Scene Investigators and Forensic Experts,\u2019 include; (i) \u2018Serious impediments to effective criminal investigations; and (ii) \u2018Inability to properly cordon off; (a) Have effective control; (b) Management; and (c) Marking the \u2018Scenes\u2019 (later in criminal trials- Locus Inquo). More fundamental to these would be the inability of members of the \u2018Forensic Evidence Recovery Unit,\u2019 headed by \u2018Inspector Gregory Williams,\u2019 to effectively function at \u2018trampled or disturbed \u2018Crime Scene.\u2019 The \u2018Forensic Experts\u2019 know that there were often \u2018Extended or Secondary Scenes of Crime.\u2019 Likened to the original \u2018Crime Scenes,\u2019 they shall also process such scenes for possible \u2018Recovery of Scientific Evidence.\u2019\u00a0<\/span><\/p>\n

WRATH OF POLICE GUNS<\/span><\/p>\n

Neither from the isolated \u2018English Harbor Military Outpost,\u2019 nor from the Police motor vehicles, none that has suffered the \u2018Wrath of Police Guns,\u2019 has ever been taken into the \u2018Intensive Care Unit (ICU)\u2019 for emergency surgical procedures. That which professional training reminds and knowledge of law guides, is that for reasons of expediency, and clear motive that invariably suggested the criminal offence; \u2018Perverting the Course of Justice,\u2019 has been the ploy among the professionally crooked and corrupt law enforcers, seeking to consequences associated with unlawful killings. Evidence of the practice of removing the \u2018partially dead or actually dead\u2019 from where they were \u2018Shot and injured or Killed,\u2019 may have been observed in several cases. The tendency to attempt to cover up, has been a universal phenomenon.<\/span><\/p>\n

REMOVAL OF MOTIONLESS BODIES<\/span><\/p>\n

Except \u2018Ronald Bloodman,\u2019 [721 News: March 20, 2021], no other, including; (i) \u2018Choke and murdered Falmouth resident Bruce Greenaway-Curfew Detainee,\u2019 had ever been medically-treated. He was suspectedly killed elsewhere, but body disposed of at the isolated \u2018Indian Creek Bay\u2019 [April 9, 2020]. As it relates to \u2018Removal of Motionless Bodies,\u2019 two persons with that may lend \u2018Personal Attestations of Truth\u2019 of the body from the place he was reportedly \u2018Gunned Down,\u2019 have been the brutally frank \u2018Bishop Charlesworth Browne\u2019 and a distraught and grieving mother, \u2018Winifred Thomas\u2019 [April 9, 2022].\u00a0<\/span><\/p>\n

OBSERVATIONS AND EXPERIENCES<\/span><\/p>\n

The \u2018Bishop,\u2019 appeared well-positioned to speak to his personal \u2018Observations.\u2019 In a recent conversation, she spoke to the demise of \u2018Mannie James,\u2019 as reminding her of the \u2018cold-blooded Police killing\u2019 of her son, \u2018Shanell Thomas\u2019 by the Police. Seemingly \u2018ambushed\u2019 and peppered by one of the \u2018Ambushers,\u2019 he reportedly succumbed instantly to gunshot injuries to his body. Yet hurriedly, the bullet-riddled body of \u2018Shanell Mabz\u2019 Thomas\u2019 was reportedly removed from the deserted bushy scene to the \u2018Sir Lester Bird Medical Center (SLBMC).\u2019 There was no need for application of anesthesia, and certainly not for any \u2018Surgical Procedures.\u2019<\/span><\/p>\n

SYMPATHETIC AND OBLIGING<\/span><\/p>\n

The rushing appeared to have been a \u2018Disguised Formality,\u2019 that allowed only for the pronouncement of death by the \u2018On-Duty Casualty Medical officer.\u2019 Stricken with grief and anxiety and outraged for reasons of \u2018Police Insensitivity,\u2019 the traumatized, frantic, wailing, weeping mother, \u2018Winnifred Thomas\u2019 reportedly pleaded in vain to see her son\u2019s \u2018bullet-ridden body. Subsequently, an understanding officer, \u2018Sympathetic and Obliging,\u2019 brought relief to her anxieties. She was allowed brief viewing of the \u2018\u2019Motionless Bullet-Pierced Body\u2019 of her son. Subsequently, it was reportedly shuttled off to the \u2018Irwin Barnes Funeral Home\u2019 [January 9, 2020].\u00a0<\/span><\/p>\n

SURRENDERING TO PRISON AUTHORITIES<\/span><\/p>\n

Instructively, when tragedy struck, both were said to have been in a telephone conversation. Fearing his demise, he was said to have been making arrangements to surrender himself to \u2018Prison authorities.\u2019 This was intended to be done through his mother and safe hands of \u2018Bishop Charlesworth Browne.\u2019 The \u2018Bishop\u2019 was not only known to both \u2018Mother and Son\u2019 as associated with Her Majesty\u2019s Prison, but also in the capacity as \u2018Chairperson\u2019 of the \u2018Prison Visiting Committee.\u2019 The deceased mother had reposed confidence in the \u2018Bishop\u2019 in seeing her son\u2019s safe return to his then institutionalized residence.\u00a0\u00a0<\/span><\/p>\n

MEN ON FEET<\/span><\/p>\n

Among two of the fastest \u2018Men on Feet,\u2019 are Jamaican and Olympic sprinter \u2018Usain Bolt and legendary social commentator, \u2018Sir MacLean Emmanuel KCN, \u2018King Short.\u2019 The former continues to live to explain his feats and accomplishments, due to his athleticism. However, long before the \u2018Olympic Sprinter\u2019 was the artiste and performer, who in an early social commentary, explained that he had to \u2018Run for his life.\u2019 Making light humor of his experience, he sings; \u2018A motor car without load, couldn\u2019t catch \u2018Shorty\u2019 on the road.\u2019 Seemingly, other than medals or \u2018Calypso Crown, \u2018King Short Shirt\u2019 may have been searching for \u2018things\u2019 that may have kept him running to save his life.<\/span><\/p>\n

RUNNING FOR HIS LIFE<\/span><\/p>\n

This appeared not to have been the case for \u2018Bendals resident Mannie James.\u2019 He was neither seeking to accomplish \u2018Gold Medals,\u2019 nor that which may have caused \u2018Sir MacLean\u2019 to run. Even so, with two \u2018State Gunmen\u2019 in hot pursuit in the \u2018Grays\/Green Community,\u2019 he was clearly \u2018Runing for his Life.\u2019 While many patrons and revelers may have been seen having fun and frolic, in a video, and likened to \u2018King Short Shirt and Usain Bolt, the deceased could have been seen \u2018Running for his Life\u2019 [ABS TV: August 1, 2023]. Unfortunately, having seemingly out-ran a \u2018Police Constable and a Military Private,\u2019 he was brought down by their presumably, issued \u2018Service Weapons.\u2019<\/span><\/p>\n

IMMINENCE OF DEATH<\/span><\/p>\n

Whatever may have been the reasons for not advancing to a \u2018JTF Check Point,\u2019 given his ultimate demise, it could safely be said that \u2018Mannie James\u2019 may have been a \u2018Fatalist.\u2019 Inferentially, he may have sensed the \u2018Imminence of Death.\u2019 Reported to have been under the supervision of an apparent \u2018Laissez-faire Corporal of Police,\u2019 for no known acts of criminality, two youthful and seemingly overzealous or overly exuberant members of the \u2018Joint\/Police Military Task Force (JPMTF)\u2019 left to their own devices, hotly pursued a motor vehicle. Such was to have been travelling on the \u2018Lauchland Benjamin Drive,\u2019 and had reportedly turned and travelled in an opposite direction<\/span><\/p>\n

EXTREMELY POOR SUPERVISION<\/span><\/p>\n

Then the driver of a \u2018White Suzuki\u2019 motor vehicle, he reportedly abandoned the same and sprinted away from the pursuers. Undoubtedly, \u2018Extremely Poor Supervision,\u2019 has contributed to the tragedy. The fatal demise came upon him, suddenly and shockingly. This was said to have been in full view of residents and by-standers in the \u2018Grays\/Green\u2019 community. The shooting and killing came at the hands of the two most junior unsupervised; non-commanded and uncontrolled \u2018Security Forces\u2019 members; (i) \u2018A Police Constable (RPFAB)\u2019 and (ii) A lowly-ranked \u2018Private\u2019 (ABDF).\u2019 [ABS TV: August 1, 2023].\u00a0<\/span><\/p>\n

VEHICULAR\/FOOT PURSUIT<\/span><\/p>\n

Prior to the \u2018Vehicular and Foot Pursuit,\u2019 that which may not be easily established was the identity of the occupant\/s of the white \u2018Suzuki Vitara\u2019 and the \u2018crime, if any, they may have committed or about to be committed. That which the professionally trained law enforcer shall know is that to \u2018Prevent Escape,\u2019 a person must first, either be; (a) \u2018Arrested; or (b) Detained\u2019 [CO: 1981: Section 4 (5) (b)].\u00a0 The questions that those in authority might be impelled to ask are; (i) Was it lawful for a Police Constable and Military Private to \u2018Run Down and Gunned Down Mannie James,\u2019 as reportedly witnessed by members of the Grays\/Green community? (ii) Was it justifiable to shoot at the back and killed him?\u2019 These are also questions better left to a Jury.<\/span><\/p>\n

CABINET PRESS BRIEFINGS<\/span><\/p>\n

Such killing appeared not to have the comport of justification.\u2019 With the constitutional provisions, for the benefit of knowledge of; (i) \u2018Law-abiding citizens; (ii) The Military in defence of the nation: (iii) Police, including every \u2018Assistant Commissioner and Superintendent of Police, attending \u2018Cabinet Press Briefings,\u2019 and charged with \u2018Prevention and Detection\u2019 of crime; and (v) Officialdom\u2019 with respect and having concern for the \u2018Sanctity of Life.\u2019 The \u2018Constitutional Provisions\u2019 unambiguously states; \u2018No person shall be deprived of his life intentionally, save in the execution of the \u2018Sentence of a Court\u2019 in respect of; (i) A crime of Treason: or (ii) T of which he has been convicted\u2019 [CO: 1981: Section 4 (1)].<\/span><\/p>\n

TENACITY AND FORTITUDE<\/span><\/p>\n

That which some members of the \u2018Association of Caribbean Commissioners of Police (ACCP)\u2019, particularly those within the Organization of Eastern Caribbean States (OECS),\u2019 appear to have little or no appreciation for are; (i) \u2018Independence; and (ii) Integrity.\u2019 It seems little wonder that some have subjected themselves to; (a) \u2018Subserviency; (b) Environmental abuse; and (c) Exploitation.\u2019 These, some may say are factors that speak to \u2018Security of Tenure.\u2019 Few appear to have the independence of mind and \u2018Tenacity and Fortitude\u2019 of even the notorious \u2018Randolph Burroughs\u2019 [Trinidad: 1978 – 1987]: Sir Wright Fitzhenly George KCN, MVO, QPM, CPM\u2019 [1974 – 199I: Antigua and Barbuda]; Darwin Dottin\u2019s [2003 – 2013: Barbados]; and Francis Forbes\u2019 [1997-2005: Jamaica]. Most have given the impression of being exploitable and wimpy.<\/span><\/p>\n

DECLINE OR RESIST<\/span><\/p>\n

Whether at \u2018Cabinet\u2019s request of insistence, having a law enforcer at the \u2018Cabinet Press Briefing,\u2019 may have been seen as sending mixed signals to the citizenry. Instructively, rather than holding an independent \u2018Press Briefing,\u2019 at \u2018Police Headquarters\u2019 he may have been awkwardly positioned to \u2018Decline\u2019 the invitation or \u2018Resist\u2019 any insistence. Cabinet may have quietly said to \u2018Commissioner of Police Atlee Rodney QPM;\u2019 (a) \u2018You have deployed members of the \u2018Joint Task Force (JTF): (b) You will have briefed team members on that which shall be done.\u2019 Though not necessarily what, or how it shall be done, a male citizen was allegedly killed by \u2018JTF\u2019 team; and (c) Cabinet knows that you are seized of pertinent facts.\u2019\u00a0<\/span><\/p>\n

ADVICE AND STARTLED REVELATIONS<\/span><\/p>\n

There must have been good reasons for the \u2018Geneva-based International Security Advisor Team (ISSAT) to have issued this \u2018Advice to Governments\u2019 of the world community. To all intents and purposes, it states; \u2018Government shall ensure the Police Force is both; (i) \u2018Transparent; and (ii) Accountable\u2019 [ISSAT: February 1, 2015]. As regards to \u2018Police Shootings and Killings,\u2019 a critical piece of information was captured from the \u2018St. Lucia Death Squad Report.\u2019 Investigators engaged by the \u2018St. Lucian Government\u2019 had \u2018Startled Revelations\u2019 for those that \u2018Needed to Know.\u2019 Investigators had determined that; \u2018Faked encounters were staged\u2019 by the St. Lucian Police to; \u2018To legitimize their actions\u2019 [The Guardian: March 9, 2015].\u00a0<\/span><\/p>\n

ISSAT ADVICE: CHECKS AND BALANCES<\/span><\/p>\n

Given the advice of \u2018ISSAT,\u2019 and as \u2018Police Shootings and Killings,\u2019 has come under public scrutiny in recent times, this should now put the \u2018Shooting Behavior\u2019 of law enforcers under; (a) Transparency; and (b) Accountability.\u2019 That which the \u2018Government\u2019 may not know that appears non-functional, has been the machinery that shall provide \u2018Checks and Balances.\u2019 Such machinery is the \u2018Coroner\u2019s Court.\u2019 Though not so specified in the law, it guards against the \u2018Propensity for Violence\u2019 by some members of some trigger-happy \u2018Agents of the State.\u2019\u00a0<\/span><\/p>\n

CORONER\u2019S INQUISITIONS<\/span><\/p>\n

From a professional perspective, there are some \u2018Police Shootings and Killings\u2019 where the circumstances are well-known to criminal investigators. Parliament so anticipated, and thus, enacted the \u2018Coroner\u2019s Act\u2019 [Chapter 105]. Foremost in the minds of legislators were that \u2018Coroner\u2019s Inquisitions\u2019 were necessary to ascertain inter alia: (i) \u2018The circumstances under which a person came to his\/her death: (ii) Whether or not there is \u2018Liability\u2019 on the part of a person\/persons, including \u2018Agents of the State\u2019 [Section 32]. Then if criminally charged; (iv) Whether or not the killing was justifiable or lawful.\u2019\u00a0<\/span><\/p>\n

CONSTITUTIONAL PROVISIONS<\/span><\/p>\n

Among the reasons contained in the \u2018Constitution Order\u2019 are: (i) \u2018In defence of oneself, family or property against violence; or (ii) \u2018In defence of other persons subjected to violence\u2019 [CO: 1981: Section 4]. These speak to the circumstances necessary to use force in reasonable proportion to that used or faced at the given time. It now begs the question; \u2018Was the killing of \u2018Mannie James\u2019 resulted from; (a) \u2018The defence of a person subjected to violence? and (b) Was his death in defence of property as provided for in the Constitution Order? [CO: 1981: Section 4 (2) (b)].\u00a0<\/span><\/p>\n

FALLING TO DEADLY FORCE<\/span><\/p>\n

From the perspectives of; (a) \u2018Self-protection; and (b) Crime Prevention,\u2019 these are well documented. Given the apparent gross lack of knowledge, this could see many more \u2018Mannie James\u2019 \u2018Falling to Deadly Force\u2019 by \u2018Jointly-Operating State Agencies\u2019 [July 31, 2023]. These certainly have consequences of \u2018Criminal Sanctions\u2019 to the apparent \u2018Reckless Shooters and Killers.\u2019 After all, \u2018Government Ministers\u2019 do not publicly, and cannot as \u2018Legislators,\u2019 utter any such advocacy of \u2018Extra-judicial Killings,\u2019 as have been in recent years.\u00a0<\/span><\/p>\n

FUGITIVE FROM JUSTICE<\/span><\/p>\n

The properly trained law enforcers have always given acute considerations to these before placing the index finger on the trigger. That which shall be said, is that \u2018Killing\u2019 not justified in law, or ordered by the Court, is fraught with as much danger to the society, as it is to \u2018Criminal Justice.\u2019 Consequent upon the recent demise of a constitutionally-presumed innocent citizen, it could never be officially said that; (i) \u2018Mannie James was a \u2018Fugitive from Justice;\u2019 (ii) He was on the run from law enforcers; (iii) Reported to be \u2018Armed and Dangerous;\u2019 (iv) Combative to law enforcers; and (iv) Terrorizing members of the community.\u2019\u00a0<\/span><\/p>\n

PREVENTING ESCAPE<\/span><\/p>\n

The provision contained in the \u2018Constitution Order\u2019 clearly states for the knowledge of the citizenry, including \u2018Police Constables and Military Privates\u2019 is that; \u2018A person shall not be regarded as having been deprived of his\/her life, if he\/she dies as a result of the use, to such extent and such circumstances as are permitted by law, of such force as is reasonably justifiable in order; (a) \u2018To effect a lawful arrest; or (b) \u2018Prevent the Escape\u2019 of a person lawfully detained\u2019 [CO: 1981: Section 4 (2)].\u00a0<\/span><\/p>\n

PASSING THE BUCK<\/span><\/p>\n

Yet it shall be seen as a \u2018Communications Strategic Move.\u2019 There may have been no need for the \u2018Cabinet\u2019 to say; (d) \u2018We are \u2018Ministers of Government; (e) You are the \u2018Commissioner of Police; and (f) Since the citizens needed answers, you shall address and take reporters\u2019 questions at \u2018Cabinet\u2019s Weekly Press Briefing.\u2019 Though there was a \u2018STRATCOM Press Liaison Officer,\u2019 a commissioner boasting a degree in \u2018Mass Communication,\u2019 runs the risk in being seen as \u2018Passing the Buck\u2019 to his subordinates. Some things often worked for the good of humanity and some against those accused of serious and heinous acts of criminality.<\/span><\/p>\n

MASS COMMUNICATION: DEGREED EXPERTISE<\/span><\/p>\n

Speaking to acts of criminality, he had vindications for \u2018Mannie James.\u2019 His \u2018Run Down and Gunned Down Death\u2019 showed he possessed no firearms or other forms of offensive weapons. This was made sufficiently clear by non-appointed \u2018Head of the Criminal Investigations Department (CID), Superintendent Lisborn Michael,\u2019 of all event, and to whatever intent and purposes, at the \u2018Cabinet Press Briefing\u2019 [ABS TV: August 1, 2023]. Maybe, the time has come upon the \u2018Police Service\u2019 to engage the services of professionals to assist members in communicating properly martialed facts to an ever anxious; suspicious and inquisitive citizenry.<\/span><\/p>\n

DANGEROUS \u2018STRATCOM\u2019 RELEASE<\/span><\/p>\n

There has often been danger when the untrained, ill-informed and incompetent \u2018Press Liaison Officer,\u2019 sought to do injustice to a \u2018Reputation for Truthfulness.\u2019 In view of \u2018Strategic Communications (STRATCOM) Press Release,\u2019 it begs the question, \u2018What may have been said to the obvious \u2018Motionless\u2019 driver when the \u2018Release\u2019 states; \u2018When he (Mannie James) was apprehended, he had two bullet injuries to his body\u2019 [Observer Media: August 1, 2023]. The \u2018Non-Head of the CID,\u2019 Superintendent Lisborn Michael\u2019 appeared to have avoided such pitfall. He may have cleared public doubts, and that of officialdom that at the time of \u2018Mannie James\u2019 tragic death, he possessed no firearm and\/or ammunition \u2018[ABS TV: August 2, 2023].<\/span><\/p>\n

MOST DAMNING<\/span><\/p>\n

That which may have been among the \u2018Most Damning\u2019 to the apparent misguided \u2018Police Constable and Military Private,\u2019 may have been the suggestion that under the \u2018Cover of Darkness,\u2019 and without the aid of infrared night vision devices, \u2018STRATCOM\u2019 informed that the \u2018Joint Task Force\u2019 that the two-man \u2018Hot Pursuit Team\u2019 was able to \u2018See three occupants in the vehicle acting suspiciously\u2019 [Observer Media: August 1, 2023]. There are many have competent \u2018Mass Communication\u2019 professionals outside the \u2018Police Service.\u2019 Among whom with similar degreed expertise, as that of \u2018Commissioner of Police, Atlee Rodney QPM,\u2019 was former \u2018Cabinet Minister, Dr Jacqui Quinn.\u2019 Either could better serve the interest of the \u2018Police Service,\u2019 than that currently obtained.<\/span><\/p>\n

FIGMENT OF IMAGINATION<\/span><\/p>\n

Though \u2018Dead man does not and cannot tell tale,\u2019 There were always some \u2018Damning Circumstances.\u2019 Seemingly by \u2018Figment of Imagination,\u2019 STRATCOM released information that; \u2018During the chase shots were fired at the Police vehicle, and the Police returned fire\u2019 [Observer Media: August 1, 2023]. Yet no member of the public or the \u2018Grays\/Green community\u2019 lend corroboration. The \u2018Head of the \u2018CID,\u2019 attempted to inform the citizenry through a \u2018Media Briefing\u2019 as to what may have transpired on the \u2018Lauchland Benjamin Drive.\u2019 Except being repetitious of that contained in the \u2018Dangerous STRATCOM Press Release,\u2019 those communicating with the media may either not have been properly briefed or officially seized of pertinent facts.\u00a0<\/span><\/p>\n

EMBELLISHING TRUTH<\/span><\/p>\n

The gunned-downed \u2018Mannie James\u2019 was no longer alive to give his \u2018Version of Events.\u2019 Professional training in \u2018Managing the Press,\u2019 guides against \u2018Embellishing Truth\u2019 with falsity. While the deceased will be laid to rest, that which may still pose evidentiary challenging, might very well be these; (i) \u2018How do two \u2018possible gunmen jumped out of a fast-moving vehicle to escape on foot with their firearms and no chase was given to apprehend one or both? (ii) How were there no penetrating bullet holes to the driver\u2019s seat of the Suzuki Vehicle? (iii) How were there no penetrating bullets-piercing holes in the front fender of the Police-driven vehicle from the front?\u2019\u00a0\u00a0<\/span><\/p>\n

FIRST STATION DIARY ENTRY<\/span><\/p>\n

That which were revealed through; (i) \u2018STRATCOM Press Release; and (ii) An investigative \u2018Consolidated Entry\u2019 may have been \u2018Corruptible Inconsistencies.\u2019 Though not necessarily relied upon as \u2018Facts,\u2019 from professional knowledge, whether or not pregnant with truth, has always been the very \u2018First Station Diary Entry.\u2019 This was often accepted as among the most genuine entries. To all intents and purposes, \u2018STRATCOM\u2019 revealed that; \u2018While on the scene, a vehicle was spotted with three occupants inside acting suspiciously?\u2019 [ANR: July 31, 2023]. This appeared not to have been consistent with the \u2018Holy Scripture – Jesus Wept\u2019 [John:11: 35]. Those of \u2018STRATCOM\u2019 would quicker see \u2018Prime Minster Gaston and Maria Browne\u2019 joining revelers [WIC News: July 31, 2023], and \u2018Africans dancing on the streets of \u2018St. John\u2019s\u2019 than see \u2018Jesus Weeping\u2019 [ANR Video: August 9, 2023].<\/span><\/p>\n

ATTESTATIONS OF TRUTH<\/span><\/p>\n

When \u2018Superintendent Lisborn Michael\u2019 disclosed that; (a) \u2018No arms or ammunition were found on the deceased body; and (b) None was found in the vehicle he was said to have been driving, he shall be credited with \u2018Attestations to Truth.\u2019 Though he provided no details, and for what reasons, he disclosed through State-media that the deceased was under the \u2018Police Radar\u2019 for some time\u2019 [ABS TV: August 2, 2023]. Even so \u2018Confusion and Inconsistencies\u2019 appeared to have reigned over: (a) \u2018The \u2018First Entry\u2019 logged in the official Station Diary. Such \u2018Entry\u2019 often concerns the contemporaneous \u2018Version of Events.\u2019<\/span><\/p>\n

CORONERS INQUISITIONS\u00a0<\/span><\/p>\n

None shall deny the existence of a \u2018Statute Law\u2019 that provides for the duality of functions of Magistrates.\u2019 That which the overwhelming majority of the citizenry appears not to know, is apart from their: (i) \u2018Summary: (i) Civil; and (iii) Criminal jurisdictions,\u2019 they are also \u2018District Coroners.\u2019 Acting in the unique position of \u2018Coroner,\u2019 they are statutorily required to hold inquisitions into; (a) \u2018Tragic; or (b) Sudden Deaths; or (c) Where the body of a human was discovered.\u2019 If only for the benefit of knowledge or academic interest \u2018Coroner\u2019s Inquisitions\u2019 are intended primarily to ascertain the \u2018Circumstances\u2019 under which a person dies.<\/span><\/p>\n

PROSECUTORIAL LIABILITY<\/span><\/p>\n

These \u2018Inquisitions\u2019 also seek to ascertain \u2018Prosecutorial Liability\u2019 for (i) \u2018Murder; (ii) Manslaughter; or (iii) Infanticide.\u2019 They also provide for \u2018pertinent data for the public registers of \u2018Births and Deaths.\u2019 There shall be no deceptive intent, nor derailing talks on procedures concerning \u2018Coroner\u2019s Inquest.\u2019 This judicial process does not negate liability for the death of \u2018Mannie James\u2019 to face judicial sanctions for an apparent \u2018Extra-judicial criminal act\u2019 [July 31, 2023]. It will have been seen that there were no \u2018Coroner\u2019s Inquisitions\u2019 into the deaths of: (i) \u2018Liberta resident Denfield \u2018Tody\u2019 Thamas [October 24, 2006]; and (ii) Falmouth resident Bruce Greenaway\u2019 [April 9 – 13, 2020].\u00a0<\/span><\/p>\n

CONCLUSION<\/span><\/p>\n

Given the interest of the public, none shall live with a \u2018Soul\u2019 free of torment. Thus, for reasons of; (a) Transparency; and (b) Accountability, none shall escape being called upon to show inter alia; (i) \u2018Lawfulness of force used; (ii) Justification for the senseless and apparent unprovoked killing; (iii) Face prosecutorial consequences for \u2018Murder.\u2019 Though it is still early days with investigating the \u2018Circumstances\u2019 under which the \u2018Bendals resident\u2019 came to his tragic death, the sorrow-filled hearts of members of his family; his outraged community; friends; and members of the wider society, not only continue to ache with agony, but all are hoping for early closure. Whatever else serves the public interest, with due regard to criminal consequences, they shall comport with the judicial concepts of; (a) Prevention; (b) Deterrence; (c) Retribution; and (d) Rehabilitation.\u2019 Most importantly, those enforcing \u2018Criminal Law,\u2019 except where circumstances so dictate, they shall also show due respect for the \u2018Sanctity of Life.\u2019\u00a0\u00a0<\/span><\/p>\n
