From time immemorial, it has been the innate nature of humans to apportion blame to his fellow-men. This has been so, even when they became victims of their own folly, stupidity or misdeeds. The assertions and vile attempts at \u2018Scapegoating\u2019 the often public-battered \u2018Antigua and Barbuda Electoral Commission (ABEC),\u2019 in the \u2018Shugy Fiasco,\u2019 poignantly makes the point. Concerning the questioned, and \u2018Election-Petitioned Nomination\u2019 of then \u2018Candidate \u2018Kelvin \u2018Shugy\u2019 Simon 42,\u2019 a serious procedural glitch may have been occasioned.<\/p>\n

IGNORANCE OR NEGLIGENCE<\/p>

\"\"<\/a><\/div>
\"\"<\/a><\/div>\n

This might be inferred from the following; (i) \u2018Ignorance on the part of candidate; (ii) Gross negligence or impotence on the part of the organizational leadership and advisers, legal or otherwise; or (iii) Rendered advice that may have been considered \u2018advisably irrelevant; inapplicable and fatally unsustainable\u2019 [LD]. As former \u2018School\u2019s Guidance Counselor, and Member of Parliament, Kelvin \u2018Shugy\u2019 Simon\u2019 surprisingly dropped out of the \u2018House of Representatives.\u2019 This has led to widespread speculations of a course of action, either due to; (a) \u2018Misguidance; (b) Environmental influence; and\/or(c) Organizational coercion.\u2019<\/p>

\"\"<\/a><\/div>\n

SHROUDED IN SECRECY – LANGUISHING IN MISERY<\/p>\n

This development appeared reminiscence of the \u2018cash-strapped \u2018Leeward Island Air Transport (LIAT),\u2019 that once dropped out of the \u2018Eastern Caribbean\u2019 skies. It also reminds of the ill-fated and defunct \u2018Antigua Airways\u2019 that appeared \u2018Shrouded in Secrecy.\u2019 Even more current, has been the adversities facing the \u2018Cameroonians,\u2019 several of whom, their lifeless bodies suspectedly submerged in \u2018Watery Graves\u2019 in the \u2018Caribbean Sea.\u2019 Then more recently, the several said to be \u2018Languishing in Misery\u2019 in \u2018St. Kitts\/Nevis and British Virgin Islands (BVI) Penitentiaries.\u2019<\/p>

\"\"<\/a><\/div>\n

PERSPECTIVE<\/p>\n

This commentary is not about their \u2018Miseries,\u2019 but that of \u2018Shugy. It looks at the experiences of the \u2018former \u2018Student Guidance Counselor and Member of Parliament.\u2019 It particularly looks at; (a) \u2018The apparent overlooked \u2018Civil Service Regulations (CSR)\u2019 [Sections 10 and 28]; as they affect (ab) The \u2018Disqualification\u2019 pertaining to the \u2018Nomination of Candidates\u2019 as contained in the Constitution Order [CO: 1981: Section 39 (1) (g)]; (c) Election Petition: and (d) Resignation as Member of the House of Representatives\u2019 that have left constituents gravely perplexed and deeply disappointed. They have witnessed the decisions they have earnestly made with their \u2018Index Fingers,\u2019 and the \u2018Mandate\u2019 they have accorded the victorious Candidate, dissolved as fast as brown \u2018Sugar,\u2019 with nothing to be \u2018Sweetened or savored.\u2019 Dedicated to \u2018JP and AP.\u2019<\/p>

\"\"<\/a><\/div>\n

ELECTORAL DEMOCRACY<\/p>

\"\"<\/a><\/div>\n

In the nation\u2019s political history and \u2018Electoral Democracy,\u2019 the inapplicability of \u2018House Standing Orders\u2019 has not only been made to be seen as \u2018Mockery,\u2019 but also being used punitively. Such observation by the citizenry, might reasonably be attributed to the \u2018non-reading and starved-for-knowledge Members of the \u2018House of Representatives.\u2019 Collectively and\/or unanimously or by majority, the elected membership has seemingly allowed the dominant and forceful \u2018House Speaker Sir Gerald Owen Anderson Watt KCN, KC,\u2019 to harbor a particular troubling false belief. Such belief speaks to him being the only \u2018Member\u2019 who possesses an intellect of a superiority, unmatched by the other Members.<\/p>\n

EXPLOITED IGNORANCE<\/p>\n

Though this may not necessarily be so, the \u2018Honourable Speaker\u2019 appeared to have shaped their minds and guided their beliefs, that the only \u2018Bible\u2019 and the only \u2018Word,\u2019 are that which he has quoted from the \u2018Erskine May Journal.\u2019 Cleary, if the \u2018House Membership,\u2019 was not so guided, then there may not have been the apparent acrimonious \u2018Suspension\u2019 of an unmistakably \u2018Disorderly Member.\u2019 It was obvious that he had \u2018Exploited\u2019 their \u2018Ignorance\u2019 of \u2018House Standing Order No. 50 (7).\u2019 This may have been evident when coercively acting upon his insistence; (a) \u2018Without a \u2018Motion\u2019 being moved; and (b) Seconded by a \u2018Member,\u2019 the \u2018House\u2019 misguidedly breached procedures contained in the said \u2018Standing Order\u2019 [2020: HSO: No. 50 (7): ANR: May 18, 2023].<\/p>\n

SECULAR ORGANIZATIONS<\/p>\n

Not infrequently the choices that humans have made, were often looked at through the lens of \u2018Faith.\u2019 Those with little or no \u2018Faith,\u2019 must face the inevitability of consequences filled with perils and disappointments. Invariably, in \u2018Secular Organizations,\u2019 among other things, \u2018Apostles\u2019 must; (a) \u2018Take off the \u2018Cloth of Holiness; and (b) Abandon the Holy Scriptures\u2019 to preach the \u2018Unholy Gospel of Politics.\u2019 Though not necessarily practicing the \u2018Deeds of the Devil,\u2019 very often people were known to forego \u2018Scriptural or Apostolic\u2019 teachings to learn traits that speak not to honesty and integrity.<\/p>\n

DEVIL OF PARLIAMENT<\/p>\n

On the \u2018List of Electors,\u2019 his christened name has been registered as \u2018Kelvin Simon 42.\u2019 That may be one way of describing their former \u2018Parliamentary Representative. The constituents reportedly saw in him a good sense of responsibility, purpose and direction, as well as prospects in becoming a future leader. Whether or not \u2018Shugy\u2019 has connotations for \u2018Sugar,\u2019 if it was not in his smile or on his lips, \u2018Sweetness,\u2019 surely could not to have been enjoyed, neither in taste nor feelings.<\/p>\n

SPIRITUALITY OR SECULARITY<\/p>\n

That which was often seen as making a difference in the life of the \u2018Spiritual Man,\u2019 has often been his peculiar interests and pursuits in the world of \u2018Secularity.\u2019 These, for the most part has been based upon the scriptural concept called \u2018Faith.\u2019 There have been numerous scriptural references. The one preferred for this commentary edifies and implored; \u2018Let us hold fast the profession of our \u2018Faith\u2019 without wavering (for \u2018He\u2019 is \u2018Faithful\u2019 that promised)\u2019 [Hebrews 10: 23]. Seemingly, with other ambitions, \u2018Kelvin \u2018Shugy\u2019 Simon\u2019 pursued another interest. Thus, he reportedly qualified himself as a \u2018Guidance Counselor.\u2019<\/p>\n

HARSH REALITIES OF LIFE<\/p>\n

In life, there are as many callings, as there have been, and continue to be innumerable challenges. While some callings speak to \u2018Divinity,\u2019 others speak to \u2018Satanism.\u2019 Even with calls for \u2018Divine Interventions,\u2019 humans were known to have still encounter challenges of one kind or another. Conversely, in the life of man, there have been, and will continue to be as many \u2018Urgings\u2019 that speak to a life lived on \u2018Secularity.\u2019\u00a0 These were not only known to have impacted the will and resolve of humans, but have also brought inescapable \u2018Trials and Tribulations.\u2019 These have been the \u2018Harsh Realities of Life.\u2019<\/p>\n

APOSTLE OF GOD<\/p>\n

Still, not infrequently, those in quest of that which \u2018Secularity,\u2019 provides were often said to have been derailed from that which \u2018God\u2019 has commanded. Many that have forsook the \u2018Straight and Narrow Way,\u2019 were said to have fallen along the way. Research has revealed that an apparent \u2018Divine Call\u2019 to be \u2018an Apostle of God,\u2019 has seen \u2018Kelvin \u2018Shugy\u2019 Simon,\u2019 attending an overseas \u2018Seminary.\u2019 Reportedly a \u2018Student of Theology,\u2019 he also underwent studies in \u2018Guidance and Counseling.\u2019\u00a0 This has been a discipline that has long been part of the curriculum of many institutions of learning. As has often been the human experience, for reasons best known to man, other interests were to be considered.<\/p>\n

CALLED AWAY FROM GOD<\/p>\n

Seemingly foregoing a calling to \u2018Preach the Scriptures\u2019 or the \u2018Gospel of Jesus Christ,\u2019 he may have been \u2018Called Away from God,\u2019 to instead, walk in the path of secularity and unrighteousness and the Ungodly.\u2019 When he may have thought that he was running from \u2018God,\u2019 he had run straight into the \u2018Devil of Parliament.\u2019 Somewhere in the \u2018Holy Scriptures,\u2019 it speaks against \u2018Serving Two Masters.\u2019 Shall it be accepted that there is a \u2018God\u2019 and \u2018He\u2019 is the \u2018Supreme Being,\u2019 then logic suggests that an adversary would most likely be \u2018Satan or the Devil.\u2019 Logic also dictates, that neither of the two can be served by any one person at the same time.<\/p>\n

FAILURE AND DISAPPOINTMENT<\/p>\n

Thus, likened to the song; \u2018Torn Between Two Lovers\u2019 [1976: Mary MacGregor: YouTube], humans have invariably found themselves; \u2018Torn Between God and the Devil.\u2019 This has been among the everyday human experiences. Clearly, no matter how carefully thought-out, these often speak to the inevitability of \u2018Failure and Disappointment.\u2019 Thus, whatever the endeavors or the adventures, calculatedly cautious or adventurously risky, these experiences were often said to have occurred, when the human spirit, body and mind, were transfixed on wishful thinking, vain glory and illusions of grandeur.<\/p>\n

SECULAR URGINGS<\/p>\n

Moreover, and most frequently, the \u2018Secular Urgings,\u2019 were invariably made to clash or cause conflicts not only with \u2018Peace of Mind,\u2019 but also with man and the \u2018Callings of Divinity.\u2019 It has been the experience that many career persons, have prostituted on the will of the people in entering into the political arena. This has been the path taken by many \u2018Noble\u2019 men and women. It has also been the knowledge that many that have entered into the \u2018Ignobility\u2019 of an occupation of politics, have given the populace \u2018Dreams to Remember\u2019 [August 18, 1998: tis Redding].<\/p>\n

RETIRE AND TAKE-OVER<\/p>\n

When his affiliated organization \u2018Fired the Hatchet\u2019 that beheaded \u2018Corthwright Marshall,\u2019 this was what its executive purportedly wrote; \u2018The time and physical efforts that will be called for\u2026the leadership of the party concluded that it simply cannot subject you to the physical hardship\u2019 [Observer: July 22, 2022]. However, when the \u2018Hatchet\u2019 eventually fell, was when the \u2018General Council\u2019 met. Holding firmly and finally decided that \u2018Corty Must Retire,\u2019 the \u2018Council decided that \u2018Shugy Must Take-over\u2019 [August 21, 2022]. He was counted upon to take off the skirt of \u2018Samantha Marshall.\u2019 But certainly not to do anything you might just be thinking. \u2018Shugy\u2019 is not like that and the incumbent, now a \u2018Senator,\u2019 is well-positioned to buy \u2018Spice and Sugar.\u2019<\/p>\n

GOD WAS WATCHING \u2018SHUGY\u2019<\/p>\n

Though a person may firmly hold on to his \u2018Apostolic Faith,\u2019 when he\/she decidedly and consciously abandoned his \u2018Apostolic Creed\u2019 to enter into the \u2018Ignoble Kingdom\u2019 to dwell among persons with checkered backgrounds, then he\/she runs the risk of being seen as playing \u2018Warri for the Devil.\u2019 When \u2018Apostle Kelvin \u2018Shugy\u2019 Simon\u2019 appeared to have shelved the \u2018Holy Scriptures,\u2019 to \u2018Preach\u2019 the \u2018Unholy Gospel of Politics,\u2019 he shall have known that \u2018God Was Watching\u2019 his \u2018faithfulness\u2019 to Him. The one thing that \u2018God\u2019 may not have advised him on, was; \u2018There shall be consultation with previously designated-candidate \u2018Corthwright Uriah Marshall.\u2019<\/p>\n

DEVINE PURGATORY<\/p>\n

That which man has often misunderstood, has been that which has been \u2018Divinely Determined.\u2019 A community in a constant state of indigence, \u2018Shugy Simon\u2019 understood the perennial hardship of community life. Whatever troubles the members may have experienced, the impact on their lives, is also the impact on his life. From research, he appeared always committed and ready to lay down his life for members of the community. With all the potentials, out of; (a) \u2018Public office; and (b) Out of Parliament,\u2019 likened to the \u2018Cameroonian Migrants,\u2019 \u2018Shugy\u2019 as well, seems to be in \u2018Divine Purgatory.\u2019<\/p>\n

SOCIAL JUSTICE<\/p>\n

Likened to the rest of the citizenry, he believed in \u2018Social Justice.\u2019 Thus, likened to the overwhelming majority, he asserted a conviction that his happiness and prosperity can best be pursued in a democratic society, in which all persons to the extent of their capacity, play some part in the national life [Constitution Order: 1981: Principle: \u2018C\u2019]. As far as these concepts are concerned, the \u2018Constitution Order\u2019 appears to be a brute to educators and other public officers. For instance, persons entering onto the political landscape, and are in the employ of the Government, shall resign their positions to vie for elective office or to engage in governance.<\/p>\n

LIFE OF THE NATION<\/p>\n

Contrastingly, persons with a profession, \u2018Medical or Legal,\u2019 and engage in \u2018Private Practice,\u2019 they are not so required to tender their resignation. Thus, persons desirous of playing a role in the \u2018Life of the Nation,\u2019 and holding a \u2018Public Office,\u2019 by virtue of which, they a defined as \u2018Public officers,\u2019 shall always be mindful of the \u2018Constitutional Provision\u2019 that speaks to \u2018Disqualification\u2019 from being elected\u2019 [CO: Section 39 (1) (g)]. Ironically, when incumbents were rejected at the \u2018Polls,\u2019 with no loss of income or gainful employment or opportunities to be offered privilege positions, the very next day, they could be appointed as \u2018Senators or Ministers.\u2019<\/p>\n

EGREGIOUSLY OPPRESSIVE<\/p>\n

Now, if the way certain constitutional provisions are being interpreted and applied, then it offends a fundamental \u2018Founding Constitutional Principle of \u2018Social Justice\u2019 and the asserted right to earn a livelihood. For the benefit of knowledge, the \u2018Principle\u2019 unambiguously states; \u2018The people of Antigua and Barbuda assert their conviction that their happiness and prosperity can be best pursued in a democracy society\u2019 [CO: 1981: FCP: \u2018C\u2019]. This then suggests that some people holding \u2018Privilege Parliamentary Positions,\u2019 runs the risk of being seen as being \u2018Egregiously Oppressive\u2019 to people like \u2018Shugy.\u2019<\/p>\n

CONTENTION OF PETITIONER<\/p>\n

Now, the \u2018Resignation\u2019 of \u2018House Member \u2018Kelvin \u2018Shugy\u2019 Simon,\u2019 appeared to have supported the \u2018Contention of Petitioner Casworth Aaron.\u2019 Such speaks to \u2018Non-conformity to \u2018Section 10\u2019 of the \u2018Civil Service Regulations.\u2019 These \u2018Regulations\u2019 not only have the force of law, but also requires \u2018Appointees\u2019 to govern themselves, by acting in strict accordance with them. Such conformity not only guides timely administrative actions, but also protection of \u2018Appointees\u2019 interests and\/or benefits. The particular \u2018Section\u2019 speaks to the \u2018Terms of Appointment\u2019 within the \u2018Civil Service.\u2019 It states; \u2018An officer may be appointed to the Civil Service\u2019 on; (a) \u2018Permanent terms; (b) Temporary terms; and (c) Contractual terms\u2019 [Civil Service Regulations: Section 10: No. 1 of 1993].<\/p>\n

NOTICES OF INTENT<\/p>\n

Such appointment provided for the enjoyment of \u2018monthly-salaried emoluments\u2019 for providing his professional services to one of the community\u2019s and nation\u2019s institutions of learning. Incidentally, that which the organizational leadership and decision-making body, appeared to have inadvertently overlooked, may have been the \u2018Statutorily Specified Time\u2019 that \u2018Notice of Intention to resign\u2019 shall be given. Though the \u2018Civil Service Regulations\u2019 make no reference to the electoral process, it provides for \u2018Notices\u2019 to be given by the \u2018Employee\u2019 to the \u2018Employer within a certain time frame. Somewhere between these two paragraphs, \u2018Shugy\u2019 may have committed a \u2018Cardinal Error.\u2019 The only people who seemed to know just what it is, are; (i) \u2018Shugy himself; and (ii) The \u2018Battery of Lawyers.\u2019<\/p>\n

STATUTORY SPECIFIED TIME<\/p>\n

Even as the identified \u2018Regulations\u2019 made no particular reference to \u2018an Electoral contest, it states that: (i) \u2018An officer appointed on permanent terms shall give at least \u2018THREE MONTHS\u2019 notice\u2019 of his intention to resign; (ii) An officer appointed on temporary terms, shall give at least \u2018ONE MONTH\u2019 notice of his intention to resign; and (ii) An officer appointed on contract, if he intends to resign, shall give notice of his intention in \u2018ACCORDANCE\u2019 with the terms of his \u2018CONTRACT.\u2019 A most interesting \u2018Sub-Section\u2019 states; \u2018The service of an officer shall be terminated on such terms and conditions as the \u2018Public Service Commission (PSC)\u2019 directs, if the officer seeks to resign in terms of this Regulation\u2019 [CSR: Section 28 (1): (2): (3); & (5): No 1 of 1993].<\/p>\n

POLITICAL LANDSCAPE<\/p>\n

Notwithstanding a well-secured tenure, seemingly not sufficiently guided, be it personally, organizationally and legally, the ambitious \u2018Kelvin \u2018Shugy\u2019 Simon\u2019 reportedly ventured onto the political landscape. With keenness of desire to be of service to; (a) \u2018His \u2018Bolans\u2019 community; (b) Nation; and (c) The rest of humanity,\u2019 he pursued other interests. Such interest was that of governance. It saw him entering onto the \u2018Political Landscape.\u2019 Given his reported status at a Seminary, that which was well known, was that teachings at a \u2018Seminary\u2019 were never the same as that being taught in secular organizations or in the political arena.<\/p>\n

PLIGHT OF POVERTY<\/p>\n

Whether or not for his personality or mannerism, coming from humble beginnings, the overwhelming majority seemed to have gravitated to him. He was reported to have associated himself with the \u2018Plight of Poverty.\u2019 In the \u2018Bolans\u2019 community, residents and fans, well-wishers and followers, as well as organizational colleagues, they have all fondly called him \u2018Shugy.\u2019 He is not dread. He is baldheaded; mustached and thickly bearded. Photogenic, and imposing, he sports an infectious and captivating smile. Members of the community revered him.<\/p>\n

RESIGNATION OF HESITANCY<\/p>\n

The rivalling Candidate \u2018Kelvin \u2018Shugy\u2019 Simon\u2019 successfully contested the \u2018General Elections\u2019 [ABS TV: May 18, 2023].\u2019 He took off the skirt of incumbent \u2018Samantha Marshall.\u2019 Except that, nothing else happened. Thus, there was no need for \u2018Lying Excuses\u2019 [Mighty Sparrow: YouTube]. This saw the timely filing of the statute-barred \u2018Elections Petition.\u2019 The Petitioner, \u2018Casworth Aaron\u2019 challenged the \u2018Validity of his Nomination.\u2019 This has sparked controversy and prompted widespread national debates and media coverage. The mystifying and abrupt resignation of hesitancy, speaks to the\u2019 Truth\u2019 of that which has been the subject of proceedings duly instituted by \u2018an Elector\/Nominator\/Petitioner, Casworth Aaron\u2019 has asserted.<\/p>\n

INJUNCTIVE RELIEF<\/p>\n

Since his election to the \u2018House of Representatives,\u2019 \u2018Member Kelvin \u2018Shugy\u2019 Simon\u2019 was not only known to have been bedeviled by assertions\u2019 that he was not \u2018Validly Nominated\u2019 to contest the \u2018General Elections,\u2019 but also may have been deeply worried that at the appropriate time and hearing, the \u2018Elections Court\u2019 would have so declared. Incidentally, through the same forum, the petitioner also sought \u2018Injunctive Relief\u2019 in preventing him from subscribing to the \u2018Oath of Allegiance and taking his Seat in the \u2018House of Representatives. Neither \u2018Petitioner,\u2019 nor Respondent\u2019 succeeded in their adversarial endeavors.<\/p>\n

NO CONSEQUENCE<\/p>\n

Though the apparent pre-emptive course of action\u2019 was of \u2018No Consequence\u2019 to the pending \u2018Elections Petition,\u2019 constituents, attorneys not connected to the \u2018Petition\u2019 proceedings, and members of the wider society appeared to have been left bewildered, disappointed and deeply dissatisfied. Bedeviled by assertions that his \u2018Nomination\u2019 was not validly, he knew that things had begun to \u2018Turn Sour.\u2019 Through a battery of lawyers led by; (i) \u2018Lead Counsel Kenny Kentish of the Law Firm of \u2018Lake and Kentish: (ii) Harold Lovell: (iii) Charlesworth Tabor: (iv) Leon \u2018Chaku\u2019 Symister; and (v) Sherrie-Ann Bradshaw,\u2019 they unsuccessfully sought to have the \u2018Elections Petition\u2019 by \u2018Petitioner Casworth Aaron,\u2019 struck out.<\/p>\n

MARSHALL\/SMITHEN-HENRY<\/p>\n

These distinguished and well-learned attorneys came up against attorneys for the \u2018Petitioner: (i) \u2018Hugh Marshall Jr.; and (ii) Andrea Smithen-Henry.\u2019 The Court, having entertained advanced legal arguments by the two \u2018Legal Teams\u2019 representing the Respondent; (i) \u2018Kelvin \u2018Shugy\u2019 Simon; and (ii) Petitioner Casworth Aaron.\u2019 Seemingly finding no merit, the \u2018Elections Court\u2019 reportedly dismissed the \u2018Respondent\u2019s Application to have the \u2018Petition\u2019 dismissed. At the end of the preliminary proceedings, the \u2018Elections Court\u2019 favoring the legal arguments advanced on behalf of the \u2018Petitioner,\u2019 ordered the \u2018Respondent\u2019 to pay \u2018Court Costs of EC$1, 000\u2019<\/strong> to him [Observer: February 9, 2023].<\/p>\n

JUDICIAL VENTILATION<\/p>\n

This \u2018Judicial Order\u2019 may have been viewed as a clear indication to both the \u2018Respondent\u2019 and his \u2018Legal Team.\u2019 That which may have been discerned was that the \u2018Elections Court\u2019 was minded to ensure full judicial ventilation of the issue\/s surrounding his suspected \u2018Invalid Nomination\u2019 [December 28, 2022]. Such ventilation necessarily allows for the \u2018Elections Court to arrive at a logical conclusion, and a well-informed \u2018Decision\u2019 on the issue at Bar. Ironically, the \u2018Respondent Kevin \u2018Shugy\u2019 Simon,\u2019 reportedly excused the delayed resignation, to the avoidance of costly and lengthy Court proceedings [Observer: January 31, 2023].<\/p>\n

SUDDEN TURN OF EVENTS<\/p>\n

Consequent upon his successful showing at the Polls [January 18, 2023], a dissatisfied elector\/nominator\/petitioner \u2018Casworth Aaron\u2019 sought through the \u2018Elections Court\u2019 to have his \u2018Nomination\u2019 declared invalid. This was one of the democratic ways of ousting an elected \u2018Member of Parliament\u2019 from his\/her parliamentary Seat.<\/p>\n

BLUNDER-MAKING SPEAKER<\/p>\n

Whether or not it was done involuntary or voluntary and in earnest, \u2018Shugy\u2019 has tendered a \u2018Resignation of Truth,\u2019 thereby ending his membership in the \u2018Lower House of Parliament.\u2019 Adding to his miseries, an apparent senility-afflicted condition, has seemingly guided a \u2018Flawed Interpretation,\u2019 as well as an apparent warped understanding of \u2018House Speaker, Sir Gerald Owen Anderson Watt KCN, KC.\u2019 Such may have been occasioned when the \u2018Blunder-Making House Speaker,\u2019 cited a procedural glitch with the \u2018Tendered Resignation\u2019 of \u2018House Member, \u2018Kelvin \u201cShugy\u2019 Simon 42\u2019 [ANR: June 13, 2023].<\/p>\n

ACCEPTANCE REFUSED<\/p>\n

Media reports of a purportedly authored letter revealed that the Member whose reported tendered \u2018Resignation\u2019 was reportedly refused acceptance by the \u2018House Speaker.\u2019 In the view of some legal luminaries and legal practitioners, a provision cited was said to have been inapplicable, as the Member had only resigned from the membership of the \u2018Lower House,\u2019 while maintaining his affiliation with his organization. The \u2018Constitutional Provision\u2019 that many legal practitioners have looked at reads; \u2018Where an elected member of the House vacates his Seat\u2026is vacant for any other reason, except a dissolution of Parliament, there shall be a \u2018By-election\u2019 to fill the seat in the House vacated by that member\u2019 [CO: 1981: Section 41 (3)].<\/p>\n

HEAVEN \u2013 HELL – HAVEN<\/p>\n

Now, as the curtain is being drawn, it has never been said, at least not up to the time of authoring this commentary, that whenever they would have been transitioned, all politicians will go to \u2018Heaven.\u2019 Though they shall not be painted with the same brush, some may not see the \u2018Face of God.\u2019 Hence, a reasonable inference might be drawn that many are most likely to be destined to \u2018Hell.\u2019 Even so, many noble and honest politicians though they seemed not wanting to go to \u2018Heaven,\u2019 none wants to go to \u2018Hell.\u2019 Dependent upon the trend of thought, many appear to have harbored the belief that life on Earth is both \u2018Hell and Heaven.\u2019 Some social commentators appeared to have harbored differing views about these two places. Frankly, it is of no consequence to the \u2018Soul of the Nation,\u2019 who really goes to \u2018Hell.\u2019<\/p>\n

CATCHING HELL<\/p>\n

While the indigent sees, and \u2018Catches\u2019 nothing but \u2018Hell,\u2019 the affluent acquiring wealth, appeared to have made some people believe that on \u2018Earth and Haven,\u2019 are as much the same as \u2018Hell and Heaven.\u2019 To all intents and purposes, the plight of the indigent, appears almost always in misery. Through his vocal cord, the world\u2019s most prolific and revered social commentator, \u2018Slinger Francisco \u2018Mighty Sparrow,\u2019 looked at \u2018Honesty and Dishonesty\u2019 in politicians.<\/p>\n

HONESTY<\/p>\n

CONCLUSION<\/p>\n

When one of the constituency-registered electors, \u2018Casworth Aaron\u2019 petitioned the \u2018Elections Court,\u2019 he contended that \u2018Member of Parliament, Kelvin \u2018Shugy\u2019 Simon 42,\u2019 was not \u2018Validly Nominated\u2019 to contest the \u2018General Elections.\u2019 In actuality, he was one of three \u2018Candidates that entered the electoral contest for the \u2018St. Mary\u2019s South constituency. At the close of the Polls and counting of the votes, he was declared victorious [January 18, 2023].<\/p>\n

While his \u2018Nomination\u2019 became an issue before the \u2018Elections Court,\u2019 that which remains undisputed were: (a) \u2018An actively pending \u2018Election Petition;\u2019 and (b) A judicial determination and ruling as to the \u2018Validity or Invalidity\u2019 of his nomination. The proceedings were reportedly instituted by an elector\/nominee\/petitioner, \u2018Casworth Aaron\u2019 [Between January 18 and 25, 2023].<\/p>\n

Inferentially, when the elected Member of the House of Representatives,\u2019 tendered his resignation, he sought to abort the \u2018Substantive Hearing\u2019 of the \u2018Election Petition.\u2019 That which he, as well as his team of attorneys appeared not to have considered, were two fundamentals; (i) \u2018\u2026There was an active \u2018Election Petition\u2019 to be heard; (ii) \u2026His Resignation was not before the Court; (iii) \u2026It was not part of the \u2018Election Petition\u2019 proceedings; (iv) \u2026The \u2018Elections Court\u2019 could not have been petitioned to do anything, but to declare his apparent \u2018Untimely Resignation\u2019 from \u2018Public office, a \u2018Nomination\u2019 that reeks of \u2018Invalidity; and (v) \u2026No relief was directly sought to remove him as a Member of the House of Representatives.\u2019\u00a0 Even with all the \u2018House Speaker\u2019s shenanigans, these are all part of what was being called \u2018Parliamentary Democracy.\u2019 ***<\/p>\n
