The nation- \u2018Antigua and Barbuda,\u2019 from space, represents almost an invisible dot. On Earth, and within the community of nations, it is a nation with its own \u2018Sovereignty and \u2018Parliamentary Democracy.\u2019 Geographically, it is located in the \u2018Sea of the Eastern Caribbean.\u2019 It has an area of some \u2018108 Square miles and census-population of some \u2018100, 000 people. A nation experiencing impoverishment, among the world\u2019s populations, it has the friendliest people, peace-loving and law-abiding.<\/p>\n

MODERN CIVILIZATION<\/p>

\"\"<\/a><\/div>\n

As it was in ancient civilization, so it continues in \u2018Modern Civilization.\u2019 Though some people appeared enlightened, well-schooled, highly educated and degreed, frequently they were to be seen exhibiting behaviors far removed from human civilization. Some behavioral exhibitions speak to aggressiveness; hostility; \u2018Animosity and Acrimony.\u2019 Such traits are not peculiar to any one civilized society. Research has revealed that in nations where governance is all about communism, totalitarianism or authoritarianism or \u2018Mob or Criminal Gang Rule,\u2019 as opposed to the democratic \u2018Rule of Law,\u2019 has brought upon the law-abiding perilous consequences of all kinds.<\/p>

\"\"<\/a><\/div>\n

SEEDS OF DISCORD<\/p>\n

Relate to the membership of legislative bodies, where \u2018Seeds of Discord\u2019 are sown and allowed to fester and grow on biasness and partiality, those that have never managed organizations with \u2018Statutorized Codes of Conduct,\u2019 often found themselves in \u2018Monkey Pants.\u2019 When so found, decisional rulings often produced negative reactions, particularly if those so aggrieved were given reasons so to feel. Even in \u2018Parliamentary Democracy,\u2019 some decisions and some behaviors must attract consequences proportionate to the Rules infringed or the Orders disobeyed. None may deny that such is necessary to ensure orderliness within the \u2018Sacred Institution\u2019 called \u2018Parliament.\u2019 Be it sideways or cross-way, to the \u2018Chair\u2019 respect flows up, and from the Chair, the same shall flow down, again, side-ways or cross-ways.<\/p>

DRAMATIC AND PUNITIVE CONSEQUENCES<\/p>\n

Though it may not have been officially-sanctioned or arranged, an occurrence within the bicameral \u2018Chambers of Parliament,\u2019 could not be considered a pre-event to the national summer festival called \u2018Carnival.\u2019 Though not necessarily that often associated with the festival, there was \u2018Bacchanal in the Chamber\u2019 during a meeting of the House of \u2018Representatives.\u2019 This occurred while the parliamentary membership met to revisit the controversial and contentious; \u2018Criminal Prosecutions Service Act (CPSA),\u2019 now called the \u2018Act of Confusion\u2019 that seemed to have resulted in \u2018Dramatic and Punitive consequences.\u2019<\/p>

\"\"<\/a><\/div>\n

PUNISHMENT WITHOUT MOTION<\/p>

\"\"<\/a><\/div>\n

Today, though the voice of the \u2018House Majority\u2019 was only heard saying \u2018AYE,\u2019 the apparent vengeance-like voice was that of the indomitable \u2018House Speaker, Sir Gerald Anderson Watt KCN, KC,\u2019 with pleading insistence of \u2018Members of the Government (Video), that \u2018Action\u2019 be taken against a then apparent recalcitrant Member of Parliament, Asot Michael.\u2019 Incidentally, fingered in the \u2018Parliamentary Drama\u2019 had been among the membership of both \u2018Lower and Upper Houses.\u2019 Those videographed as among the instigators of subtly disorderliness,\u2019 were easily identified Members; (i) Asot Michael: and (ii) Steadroy \u2018Cutie\u2019 Benjamin.\u2019<\/p>\n

ACT OF CONFUSION<\/p>\n

The latter, \u2018Principal Legal Adviser to his Government, had moved a \u2018Bill\u2019 to amend the contentious Sections, depriving the Police of \u2018Functional Authority.\u2019 Such deprivation appeared to have been observed by Members with \u2018non-legal background\u2019 [CPSA: Section 27 (2): No. 28 of 2017].\u2019 Though not necessarily by \u2018Unanimity,\u2019 with no \u2018Motion\u2019 put to the \u2018House for consideration by the membership, \u2018House Speaker,\u2019 appeared transfixed on \u2018punishment, put the \u2018Punishment\u2019 to the House. Before the \u2018apparent dumb-founded Members could ask \u2018Whose punishment, \u2018Asot or Gerry?\u2019 likened to the \u2018Crucifixion of Jesus Christ,\u2019 treachery or acrimony, the Majority,<\/strong> voted the stipulated \u20183-Meetings Suspension for Asot\u2019 [ANR: YouTube Video].<\/p>\n

DEPRIVATION OF AUTHORITY<\/p>\n

Likened to other nations, it has many challenges- some economic and some with activities, bothersome to; (i) \u2018The law-abiding, hapless, helpless and defenceless people; (ii) Public administrators no exerting pressure upon Law enforcers to end the \u2018Criminal Spree\u2019 being currently enjoyed by criminals, so as to bring immediate respite to the citizens. That which is equally as important to \u2018Law enforcers\u2019 is to give make Legislative Restitution\u2019 of the apparent wanton and reckless \u2018Deprivation of Authority,\u2019 necessary to bring \u2018robbers; rapists and gunmen to criminal justice. In spite of the economic challenges, there have been evidence of; (i) \u2018A controllable growing culture of youth violence.\u2019 There exists an otherwise tranquil and stable society and an enabling socializing environment and spectacular sceneries and beaches, ideally attractive to tourists and visitors alike.<\/p>\n

DEMAGOGUERY OR DEMOCRACY<\/p>\n

The nation, founded upon certain principles, practiced a \u2018Parliamentary Democracy,\u2019 that in recent years speaks to \u2018Demagoguery\u2019 than of \u2018Democracy.\u2019 Though social commentator, Sir Paul \u2018King Obstinate\u2019 sings; \u2018In my land, I can attack the Government: and \u2026Tomorrow walk through the Parliament.\u2019 To glean an understanding of the concept \u2018Democracy,\u2019 is to listen to the lyrical content of the social commentary \u2018Land of Democracy\u2019 [1985: Land of Democracy: You Tube]. Today, not even \u2018Members of the House,\u2019 can attempt to do that. Not even over the dead body of \u2018Sir Gerry.\u2019<\/p>\n

PARLIAMENTARIANS TO DEMAGOGUES<\/p>\n

Whatever the intent, none can attack \u2018Sir Gerald\u2019 so long as he holds \u2018Parliamentary Authority\u2019 vested in the parliamentary position of \u2018Speaker for a \u2018House,\u2019 with members seemingly transformed from \u2018Parliamentarians\u2019 to \u2018Demagogues.\u2019 It might safely be said that when the history of the \u2018Police Service\u2019 and the \u2018Legislative Behavior of Parliamentarians,\u2019 would have been recorded, for the benefit of knowledge of posterity, they will have read of occurrences, neither in harmony with unity and \u2018Parliamentary Democracy.\u2019 Some might be seen as; \u2018intriguing and appalling; some that speak to despicability, while some might be seen as divisively-orchestrated and provocatively annoying.<\/p>\n

TRANSFORMATIONAL CHANGE<\/p>\n

The \u2018Lower Houses of Parliament,\u2019 seemingly being widely viewed by the law-abiding people, as fast transforming into \u2018an incubator for societal violence and lawlessness. Moreover, the religious community saw its Chambers being used for \u2018Bureaucratic Bullying,\u2019 with non-observance and compliance with the \u2018House Standing Orders-2020.\u2019 Dissatisfied with certain rulings of the \u2018Chair,\u2019 aggrieved Members, and by extension, members of the wider society as being; (i) \u2018Pregnant with biases and partiality; and (b) A Parliament that responsible citizens have expressed firm belief, requires \u2018Transformational Change\u2019 from being used as a \u2018Bureaucratic Bullying Chamber\u2019 to one that may engender respect and decorum among the parliamentary membership in exchanges with the \u2018Speaker of the House.\u2019<\/p>\n

NUMERICAL VALUE<\/p>\n

The annals of history may not correctly show that in the most recent sitting of the \u2018House of Representatives,\u2019 preceding the parliamentary, after Religious Leader of the denominational Salvation Army, Captain Maxam,\u2019 invited the \u2018Divine Presence\u2019 of the Lord,\u2019 in the \u2018Temple of the Devil.\u2019 There was peace, as there was quietude. Though not necessarily a place for, and of \u2018Divine Service\u2019 to the Lord, it was a place to provide \u2018Legislative Service to the nation and the common good of the people and the \u2018Rule of Law.<\/p>\n

ACRIMONIOUS VENGEANCE<\/p>\n

There had been reverence, as there was solemnity. There was enmity, as there was evidence of disunity and disharmony.\u2019 All these represents not only \u2018Poor Democracy,\u2019 but also \u2018Sheer Hypocrisy.\u2019 There were expressions, clearly starved of respect for the \u2018Chair,\u2019 as there was a \u2018Chair,\u2019 that to some members, speak to \u2018an Argumentative Mentality.\u2019 That which also appeared to some Members, seemed capable of being described as vexatious to the \u2018Spirit of man, as to offend parliamentary decorum, unity and harmony.\u2019 \u00a0There was banality, as there was frivolity, evidenced by animosity and actions that speak to \u2018Acrimonious Vengeance\u2019 (coined for this commentary).<\/p>\n

VOTES IN IGNORANCE<\/p>\n

That which might also recorded in the historical annals, may be the apparent bullying tactics and domineering behavior of some \u2018House Speakers.\u2019 There have also some Members; Senate Presidents and some \u2018Numerically-Valuable\u2019 and docile\u2019 Senators. With or without \u2018Motions\u2019 properly put to the \u2018House\u2019 for a \u2018Vote,\u2019 these are among the ones that shall say \u2018AYE.\u2019 These are the \u2018Ayes Men and Women.\u2019 Some see no wrong; hear no wrong, and because they have considered themselves \u2018Minions,\u2019 nothing is ever wrong. They knew not it was wrong for the \u2018Chair\u2019 to have appeared to \u2018Coercively Bullied\u2019 (coined), them out of their \u2018Reluctance\u2019 to cast votes in \u2018Ignorance.\u2019 Some \u2018Members\u2019 are \u2018Threat to Parliamentary Democracy.\u2019<\/p>\n

PARLIAMENTARY CONSEQUENCES<\/p>\n

Though his behavior could never have escaped \u2018Parliamentary Consequences,\u2019 \u2018Suspended Member of the House of Representatives, \u2018Asot Michael\u2019 appeared to have offered more to the parliamentary debate, than of many that sat like \u2018Dummies\u2019 in their seats as \u2018Lame Ducks\u2019 chickens,\u2019 not fit for human consumption or Barbecue Grills.\u2019 While Members shall have and show respect to the \u2018Parliamentary Chair,\u2019 such \u2018Chair\u2019 shall create enabling environments conducive to the exhibition of \u2018Parliamentary Discipline; Compliance and good order of the House.\u2019<\/p>\n

INCUBATION IN PARLIAMENT<\/p>\n

Such \u2018Coercive Bullying,\u2019 when seen to have been \u2018Incubated in Parliament,\u2019 and practiced for the Youth population and the citizenry to see, not only has the potential for overflowing into educational institutions, but also in permeating the wider society. Those in disagreement with these assertions, may invite attestations from \u2018Principals; (i) \u2018Dr. Collin Green: (ii) Foster Robert; and (iii) Ashworth Azille; (iv) Former Principal Denise Mills and Director of Education.\u2019<\/p>\n

Certainly, had they familiarized themselves with \u2018House Standing Order,\u2019 they may have quietly requested a \u2018Butcher\u2019- not just any \u2018Butcher;\u2019 a \u2018Market Butcher\u2019 that removes \u2018Cattle Tongues,\u2019 to remove quarter- of- an ounce of their tongues. That Order says; \u2018\u2026A member shall move a Motion for Suspension\u2019 [HSO: No. 50 (7)].<\/p>\n

SQUARE PEGS \u2013 WRONG HOLES<\/p>\n

Those that manage organizations or public affairs, are usually challenged with positioning or assigning Staff. Not infrequently, \u2018Square Pegs are placed in \u2018Wrong Holes.\u2019 Frequently, systems where incompetent and inefficient people are assigned, have caused more embarrassment as obtained in some \u2018State\u2019 institutions. Some given privilege positions, were known to have become \u2018Organizational Bullies\u2019. Members with pent-up feelings of apathy and stored up for other members, often saw manifestations in \u2018biasness, partiality, animosity and acrimony.\u2019 Many were seen to have created environment within these institutions, enabling only to disharmony, divisiveness and disunity. There may be many ways in handling situations like this.<\/p>\n

CLEVER – DILIGENT – STUPID – LAZY<\/p>\n

Research has shown that for command and control; Administrative and operational efficiency; Assignment; and Deployment, \u2018German General, Kurt Von Hammerstein Equod,\u2019 developed his own strategies. Philosophically, he was quoted saying; \u2018I divide my officers into four groups; (i) \u2018Clever: (ii) Diligent; (iii) Stupid; and (iv) Lazy.\u2019 These he saw as among the characteristics in humans. For each group, he combined two of these characteristics this way; (a) \u2018The \u2018Clever and Diligent\u2019 for \u2018General Staff; (b) The majority of the personnel, estimated to be about 90% of every Army. These are the \u2018Stupid and Lazy\u2019 and suited for routine duties.\u2019 In many national institutions, and even in Government, there are people with such characteristics.<\/p>\n

STUPID AND DILIGENT<\/p>\n

He was not only mindful of \u2018Administrative Efficiency,\u2019 but also \u2018Operational Effectiveness.\u2019 He opined; (c) \u2018The clever and lazy are to be given the highest leadership position. He harbored the view that they have the intellectual qualities and the composure for difficult decisions. He was not unmindful of those that may cause people to harbor negative perceptions of his \u2018Leadership.\u2019 He decided that; (d) For the \u2018Stupid and Diligent,\u2019<\/strong> these are not to be entrusted with any responsibility, for they will only cause mischief\u2019 [QUOTES: 1878 – 1943]. Some \u2018OECS\u2019 Leaders could learn from this philosophy. There may be no reasons for \u2018Hitches and Glitches.\u2019<\/p>\n

DEVON BENJAMIN: GRANDSON- 10<\/p>\n

It is provided for the benefit of knowledge and clarity and commonality of understanding, particularly for that of the studious and well-read \u2018Devon Benjamin.\u2019 Research revealed, and it was confirmed that he is the 10-year-old grandson of Attorney General; Justice and Legal Affairs; and Principal Legal Adviser to the Government. Some governmental institutions, could learn from him. They shall make space for the youth [Sir Mc Lean: short<\/p>\n

IMPOSED DUTY – CONFERRED AUTHORITY<\/p>\n

The sixty-nine (69)- year operational-existence of Sections of the Police Act that statutorily \u2018Imposed Duty\u2019 and Conferred Authority\u2019 upon the \u2018Commissioner of Police\u2019 to: (i) \u2018Institute criminal proceedings against persons; (a) \u2018Arrested; or (b) Summoned to appear before the Magistracy; and (b) To be prosecuted by assigned Police Court Prosecutors.\u2019 Such \u2018Dischargeable Duty\u2019 and such \u2018Exercisable Authority\u2019 unambiguously states: (i) \u2018It shall be the \u2018Duty\u2019 of all Police officers to apprehend (Arrest) and bring before a \u2018Magistrate\u2019 persons found committing any offence; and (ii) To summon before a \u2018Magistrate\u2019 and to prosecute persons found committing any offence\u2019 [Section 23 (1) (b) and (e): Police Act: Chapter 330].<\/p>\n

EXCEPTION v CONFERRED AUTHORITY<\/p>\n

While the \u2018Transitional Provisions\u2019 [Section 27 (2): Criminal Prosecution Service Act: No. 28 of 2017] speaks to \u2018Exception\u2019 of; (i) The Police; and (ii) ONDCP,\u2019 for \u2018Institute criminal proceedings and to Prosecute Cases before the Magistracy, seems more of \u2018Buffoonery\u2019 than of \u2018Conferred Authority.\u2019 It now prompts two fundament questions; (i) \u2018Have these Law enforcement ever executed duties or operated under \u2018Conferred Authority\u2019 of the Criminal Prosecution Service Act; and (i) \u2018Were they ever been subjected to the \u2018Written Authority\u2019 of the DPP?\u2019<\/p>\n

AUTHORITY: LEGISLATIVE TREACHERY<\/p>\n

When the Legislators, in their apparent \u2018Collective Ignorance or Stupidity\u2019 tinkered with the Law that had: (i) \u2018Imposed a Duty; and (ii) Conferred Authority\u2019 for the lawful execution of their \u2018Statutory duties, and gave them to the \u2018DPP,\u2019 they may have committed \u2018Legislative Treachery.\u2019 This had gravely affected their ability to perform their duties. Moreover such \u2018Treachery,\u2019 in fact a grievous act against the \u2018Rule of Law.\u2019 No responsible and law-abiding citizen may deny that it had significantly impacted their safety and peace of mind. No other \u2018Act,\u2019 not even the \u2018Enactment of, and Amendments\u2019 thereto the \u2018Criminal Prosecution Service Act (CPSA),\u2019 has neither (a) \u2018Imposed a Duty; nor (b) Conferred Authority\u2019 upon any Police officer.<\/p>\n

LEGISLATIVE FUNCTIONARY<\/p>\n

The \u2018Criminal Prosecutions Service Act (CPSA),\u2019 appeared to have been \u2018Purposefully Designed.\u2019 Those drawing inferences, reasonably or unreasonably, have harbored thoughts of obscurity of intentions. The \u2018Act\u2019 vests \u2018Administrative and Operational Authority\u2019 in the \u2018DPP.\u2019 Without ambiguity, it provides specifics on; (i) The legal status of the DPP as \u2018Principal officer; (ii) Functions of the DPP- Sole \u2018Legislative Functionary\u2019 in; (a) \u2018Instituting criminal proceedings; and (b) Conducting criminal prosecutions, including the insignificant non-person\/property street offence of \u2018Indecent Language\u2019 [CPSA: Sections 5, 6 and 12: No. 18 of 2017].<\/p>\n

CLOGGED-UP AND BACKLOGGED<\/p>\n

A \u2018DPP\u2019 has more \u2018Serious criminal offences that have \u2018Clogged-up or Backlogged\u2019 the \u2018Criminal Justice System\u2019 than wasting valuable prosecutorial time on frivolous \u2018Eddie Murphy movie expressions. The grievously offensive and offending Sections are; (i) 27 (2) and 29]. These have removed the \u2018Statutorily Functional Authority\u2019 from Commissioner of Police Atlee Rodney, easier than pluck the feathers of a \u2018Turtle Dove.\u2019 When the Legislators stripped him of his \u2018Prosecutorial Authority,\u2019 they have shown total disregard to his statutory role and functions. They will have also shown no \u2018Love\u2019 for their protection from criminals, nor concerns for their security.<\/p>\n

FUNCTIONAL AUTHORITY<\/p>\n

If it were not so; (a) \u2018The Principal Act, could not have been the \u2018CPSA;\u2019 and (b) They require no \u2018Written Authority\u2019 from the \u2018DPP.\u2019 That which shall be pointed out are these \u2018Irrefutable and Undeniable \u2018Truths and Facts; (i) \u2018Since the \u2018Authoritative Sections of the \u2018Police Act; Sections 23 (i) (b) and (e) (Instituting criminal proceedings) and 31(Prosecuting Cases) have been \u2018REPEALED\u2019 and the \u2018Criminal Prosecutions Service Act\u2019 vests \u2018Functional Authority\u2019 only in the \u2018DPP.\u2019 In actuality, the \u2018DPP\u2019 is a Prosecutor of the most serious crimes \u2018Against the Person,\u2019 including rape, and those serious offences against property, including robbery, with or without violence.<\/p>\n

DEPRIVATION OF AUTHORITY<\/p>\n

Commonsense and logic, therefore dictates that a \u2018Police Service\u2019 shall be vested with the authority necessary, and without hindrance or \u2018Deprivation of Authority.\u2019 That which \u2018Legislators appeared to have failed to understood, was the discernible \u2018Legislative Threat\u2019 to the \u2018Commissioner of Police Statutorized Authority. This had long been dangling when accused persons held the misguided and mis-conceptualized view that the \u2018Commissioner of Police\u2019 was subordinate to the \u2018Director of Public Prosecutions (DPP). This was made \u2018Settled Law\u2019 since \u20181968.\u2019 Her Majesty\u2019s, now His Majesty\u2019s London Privy Council with a \u2018Judicial Committee\u2019 of \u2018Law Lords and Law Ladies\u2019 with no antecedents that speak to depravity or rascality or skullduggery.<\/p>\n

STATUTORILY-CONFERRED AUTHORITY<\/p>\n

That which every Law enforcer knows has been their \u2018Status\u2019 as \u2018Statutorily Conferred.\u2019\u00a0 When Legislators appeared to have misguided themselves in \u2018Repealing\u2019 critical authoritative \u2018Sections\u2019 of the \u2018Police Act,\u2019 likened to de-feathering a \u2018Whistling Black Duck,\u2019 \u2018Commissioner of Police Atlee Rodney QPM,\u2019 was left \u2018Authoritatively and prosecutorally Weak;\u2019 (i) To lawfully institute criminal charges against persons arrested and charged with criminal offences; and (ii) Prosecute persons so charged.\u2019<\/p>\n

STATUTORY CONFERRED STATUS<\/p>\n

That which \u2018Legislators of the House of Representatives; House Speakers; Senate Presidents and some Attorneys\u2019 within Executive or Cabinet positions, appeared not to have known, and legislatively reckless not to know, was the \u2018Statutory Conferred Status\u2019 on members of the \u2018Police Service.\u2019 It states; \u2018Every person for the time being in the Force shall be deemed a member of the Force, and shall have and enjoy all the; (a) \u2018Rights; (b) Powers; (c) Authorities; (d) Privileges; and (e) Immunities \u2018CONFERRED\u2019 on a member of the Force by any Law which is now in force, or may herein after be passed\u2019 [Section 16: Police Act: Chapter 330].<\/p>\n

FATAL LEGISLATIVE BLUNDER<\/p>\n

The \u2018Criminal Prosecutions Act\u2019 \u2018CONFERS\u2019 no power or authority on any Police officer [CPSA: No: 8 of 2017]. All such \u2018Authority\u2019 is vested only in the Director of Public Prosecutions (DPP)\u2019 [Sections 5, 6, and 27]. The apparent \u2018Fatal Legislative Blunder\u2019 were made when the contentious and controversial enactment \u2018Criminal Prosecutions Services Act\u2019 was accorded legislative consideration and majority-passage through both \u2018Lower and Upper Houses of Parliament. These have resulted in the recent institutional and prosecutorial confusion at the Magistrate\u2019 Courts, as well as the pandemonium that broke out within one of the two \u2018Sacred Chambers of Parliament- the House of Representatives or Lower House.\u2019<\/p>\n

ASOT AND SIR GERALD: SUPREMACY OF GOD<\/p>\n

When, by an apparent \u2018Uncontrolled Burst of Emotions,\u2019 he made; (i) The \u2018Legislative Chamber; (ii) Reminded Sir Gerald; (iii) Informed the young people and citizenry; (iv) Mainstream; social media; (v) The Diaspora; and (vi) The world community know, how fortunate the \u2018House Speaker\u2019 has been with the \u2018Blessing of God,\u2019 and still \u2018kicking and fighting with his mouth.
