REAL NEWS: Based on the recent High Court ruling on the Criminal Prosecutions Service Act \u2013\u00a0<\/em>which restricts the Commissioner of Police from unilaterally charging persons \u2013 attorneys reportedly are calling for their clients\u2019 cases to be thrown out.<\/p>

According to attorney Leon Chaku Symister,\u00a0a number of lawyers who have appeared in the Magistrates Court since the ruling have sought to have their clients discharged.<\/p>\n

However, he says, the prosecution is pleading with the Court to adjourn these cases until the situation is sorted out \u2013 and instructions on how to proceed are received from the relevant authorities.<\/p>

\"\"<\/a><\/div>\n

Controversy arose over the 2017 law \u2013 which was effected on November 15, 2021 \u2013 after attorney Wendel Robinson filed a writ of\u00a0habeas corpus<\/em>\u00a0on behalf of a client who was being held at His Majesty\u2019s Prison.<\/p>

\"\"<\/a><\/div>\n

Robinson challenged the police commissioner\u2019s authority to bring charges\u00a0without first obtaining the written consent of the Director of Public Prosecutions\u00a0(DPP),\u00a0<\/em>as the law prescribes \u2013 but which, apparently, was not being followed.<\/p>\n

As a result, Symister says, requests by both the prosecution and the defence attorneys have left the magistrates scratching their heads.<\/p>

\"\"<\/a><\/div>\n

Any magistrate who continues to hear cases that fall within the affected period \u2013 from November 2021 until the High Court\u2019s ruling \u2013 would, inadvertently, be continuing the illegal act, Tabor states.<\/p>\n

However, summary matters that fall within the six-months grace period can be rectified easily, he says, by re-filing the charges with the requisite\u00a0fiat<\/em>\u00a0from the director of public prosecutions.<\/p>

\"\"<\/a><\/div>\n

Further, according to Symister, those matters that do not have a statute of limitation on the charges can be replaced with an identical charge under the correct procedure.<\/p>

While some residents believe that the Police are unable to initiate legal proceedings because of the Court\u2019s decision, Symister says this is not the case. \u00a0What is necessary, however, is the prior approval of the DPP.<\/p>\n
