It has now been to the knowledge of some \u2018Legislators, that making the \u2019DPP\u2019 a \u2018Creature of Statute, the \u2018Acting DPP\u2019 knew that it was \u2018Unnecessary and Duplicitous\u2019 [Criminal Prosecutions Service Act (CPSA): No; 28 of 2017]. That which they shall have known; deemed to have known; or reckless not to have known, was that the \u2018DPP\u2019 was already a \u2018Creature of the Constitution.\u2019 <\/strong>They shall have known that he\/she enjoyed overriding authority in; (i) \u2018Instituting criminal proceedings; and (ii) Undertaking criminal prosecutions, irrespective of the person or authority that had so acted\u2019 [CO: 1981: Section 87]. These, of course, \u2018Acting Director of Public Prosecutions (DPP), Shannon Jones-Gittens.\u2019<\/p>

PERSPECTIVE<\/p>

This commentary primarily looks at; (a) \u2018Human Distance\u2019 in open public spaces; (b) Section 51 of the Police Act; (c) Some of the things \u2018Acting Director of Public Prosecutions (DPP), Shannon Jones-Gittens \u2018Knows.\u2019 Though the issues under reference shall not be treated lightly, they are interspersed with a bit of humor. Dedicated to our Governor General, His Excellency, Sir Rodney Williams KGN GCMG; His Lordship Justice Keith Thom (Retired); Dr. Dave Ray; Ras Smood and Melly; Attorneys-at-law, Charlesworth Tabor; Wendell Robinson and Ken Kentish; along with Senior officers Deputy Commissioner of Police Albert Wade; Assistant Superintendents Rodney Ellis and Jeffrey Morgan, and just about everyone that likes to read and laugh. It is especially dedicated to \u2018Shannon Jones-Gittens and her Legal Staff.\u2019 Though her head might be filled with all kinds of \u2018Prosecutorial Scenarios,\u2019 none will ever see or hear \u2018Shannon Jones,\u2019 stiffens (not her name-Gittens), complains, frowns or groans. But should \u2018Push comes to shove,\u2019 she shall do as those cute, little \u2018Cubans Jumpers.\u2019<\/p>\n

HUMAN SOCIETY: 2-FEET DISTANCE<\/p>

Since the birth of human society, in people to people contact, there have always recognition for demarcated spaces. As society and human understanding developed, humans know of the demarcation and limitation of \u2018Space.\u2019 This may be seen every day. For instance, between \u2018Person to Person,\u2019 there has been an approximate \u20182 feet Distance.\u2019<\/strong> Except family and familiarity to greet with a caress or hug, automatically, people stay outside of that distance. From informal professional training- \u2018Introduction to Sociology,\u2019 such distance was often reduced without observance or confrontation.<\/p>\n

SPACE INTRUSION<\/p>

\"\"<\/a><\/div>\n

The video footage showed \u2019Prime Minister Browne,\u2019 giving clear indications that any further \u2018Space Intrusion\u2019<\/strong> could result in the hands doing the rest of the \u2018Talking.\u2019 The only animals, one feathered and the other hairy that were known to have spoken to one human being was; (i) \u2018Balaam Donkey\u2019 [\u2026\u2026.]. Human cruelty made it talk. The other that continues to talk to humans are \u2018Parrots.\u2019 Whether or not there were other issues, the \u2018Demarcated 2 Feet Distance\u2019<\/strong> appeared to have provoked such reaction. From professional investigative experience, in situations as such, how people may counter certain hostile reactions, was often dependent on what they have in their position.<\/p>

INTOLERABLY PROVOCATIVE<\/p>\n

The \u2018Prime Minister\u2019 was adamant, that if the intrusion continued to exist, such may have been considered \u2018Intolerably Provocative.\u2019 It was obvious that the \u2018Officially-assigned Security Detail\u2019 could have caused the \u2018Devil\u2019 to leave the \u2018Bridge\u2019 beyond the \u2018Willikies\u2019 community to go down to Pares Village, and either go into \u2018Prime Minister\u2019s head or into his hands.\u2019 As humans interact and socialize, this has been seen, and experienced every day. Except when the \u2018Covid-19 Pandemic\u2019 was constantly dropping people like mosquitoes, the entire nation saw the approximate recognized \u20182 Feet Distance\u2019 being extended to a \u20185 Feet Distance.\u2019<\/p>\n

CRIMINALIZED CONSEQUENCES<\/p>\n

Ensuring that such distance was maintained, there were either drawn lines or marked symbols. There were also Criminalized Consequences for the non-compliant. When \u2018Prime Minister Gaston Browne\u2019 issued stern warning to \u2018friend\/foe, Asot Michael,\u2019 he may have felt that he had intruded upon his personal space.<\/strong> Though no \u2018physical threat may not have existed, he made his position clear, that the intruder shall be told; \u2018Get out of my face\u2019 or suffer \u2018Physical Wrath\u2019 of the hands [ANU December, 30, 2022]. Sure the \u2018PM\u2019 could have bitten him as well. That may have been dangerous if he did not visit the \u2018Pioneer Kennel of \u2018Dr. Radcliffe Robbins.\u2019 It has been the knowledge that a \u2018bite\u2019 of such might just be rabid. Therefore, any clinic, humans or animals after a \u2018Dog Bite.\u2019<\/p>\n

2- FEET DISTANCE<\/p>\n

When there were no national health existing risks, the \u20182 Feet Distance\u2019 is reduced to shoulder to shoulder.\u2019 This has been the experience of people everywhere and every day. Some places have been; \u2018At airports; On passenger planes; Public Service Vehicles; Banks; Supermarkets; Public Markets; Health Pharmacies; Sports events; Marine excursions; Boating Public protestations; Fetes; Parties Cinemas; Night Clubs; Educational institutions; Churches; and even at Cemeteries.\u2019 Members of society know, that when the \u2018Spirit of God,\u2019 was not thriving with man, whenever and wherever the \u2018Devil\u2019 enters, \u2018All hell is likely to break loose.\u2019<\/p>\n

WIDER SOCIETY: PRIVATE PROPERTY<\/p>\n

It was well known that in human relations, everyone exhibits a dominant pattern of behavior. People often wrongly assumed a right of entry, where they had no business with the owner\/occupier. This has been a frequent occurrence in the wider society. Those, unlawfully entering, intruding or trespassing on \u2018Private Property,\u2019 run the risk of forceful ejection. Few, including Law enforcers, have been finding this difficult. It has been well-documented in; (i) \u2018The Constitution Order-Supreme Law; and (ii) The \u2018Small Charges Act-Statute Law,\u2019 that no person has no right of entry or access without: (a) \u2018Consent: (b) Invitation; or Lawful authority.\u2019<\/p>\n

INTRUSIVENESS OF HUMANS<\/p>\n

Likened to today\u2019s national territorial borders, with war-mongering nations fighting, people everywhere are forced to fight off the \u2018Intrusiveness of Humans.\u2019 Provocatively, some have not only made their presence felt or seen, but have also caused property owners or occupiers to feel, they were acting like their \u2018Landlords or Landladies,\u2019 coming to collect due and payable Rent. Then there are those that came to pick unchallenged fights. Relating this scenario to recent developments at the private residence of \u2018Dean Jonas,\u2019 it speaks to nothing but the \u2018Truth.\u2019 This manifested itself when apparent procedurally knowledge-starved, misguided or mis-instructed Law enforcers, appeared not to know, or appreciate the difference between: (a) \u2018Criminal Jurisdiction;<\/strong> and (b) Civil Jurisdiction.\u2019<\/strong><\/p>\n

CRIMINAL AND CIVIL JURISDICTIONS<\/p>\n

When Police officers reportedly visited his home to assist a \u2018Mother\u2019 with the return of an 8-year-old boy child, Law enforcers, though clearly inept, and seemingly over-officious, exercised powers, simply because they appeared to know not the difference between those to \u2018Magisterial Jurisdictions.\u2019 While they left the little boy where he seemingly wanted to be, they left with his father where he did not wish to go. Before his wife could say \u2018Satan,\u2019 off they went with her husband, \u2018Dean Jonas\u2019 to St. John\u2019s Police Station\u2019 [February 23, 2023]. <\/strong>Then, the apparent ill-advised course of action sparked national outrage. An apparent leaked video footage reportedly reached \u2018Africa and China.\u2019 Still, that appeared not to have scared anyone wishing to travel to Antigua to America.<\/p>\n

WINDOW OF UNDERSTANDING<\/p>\n

The author\u2019s \u2018Researched Paper\u2019 on the \u2018Executive Development Course\u2019 at the \u2018Royal Canadian Mounted Police\u2019 (RCMP) Training Academy\u2019 [December 15, 1997], may provide those at the \u2018Executive Level\u2019 a small \u2018Window of Understanding.\u2019 Specific to \u2018Police\/Community Relations,\u2019 are as critical as the air Law enforcers breathe. Reiss, a researcher observed; \u2018\u2026Many citizens consider the function of the Police in everyday life to extend beyond their \u2018Law enforcement and Peace keeping roles; \u2026The lower classes, in particular, call upon the Police to perform a variety of services; \u2026They depend upon Police assistance in times of; (a) \u2018Trouble; (b) Crises; and (c) Indecision\u2019 [Reiss: 1971: P 63].<\/p>\n

RUDE AND DOMINEERING<\/p>\n

This was what another researcher, Banton\u2019 unearthed; People widely held the beliefs that; (a) \u2018Policemen are uneducated; (b) Are of low mentality; (c) Are of doubtful honesty and integrity; (d) Are often \u2018Rude and Domineering;\u2019 and (e) They often get angry easily\u2019 [Banton: 1964: 78a]. The researcher may have been speaking to \u2018Commissioners of Police\u2019 everywhere. However, should they not read, they could never know what \u2018Banton\u2019 had discovered some \u201857 years ago.\u2019\u00a0 Citizens, like \u2018Dean Jonas,\u2019 clearly not starved for resources, will take them to a place where they might be shown \u2018Just how it will go.\u2019<\/p>\n

TINKERING MORONICALLY<\/p>\n

Whether or not, it reflected their individual philosophical beliefs, or misguidedly influenced to \u2018Tinker Moronically\u2019 with the \u2018Police Act,\u2019 Lawmakers within the \u2018Bi-cameral Chambers,\u2019 overwhelmingly supported the enactment of the \u2018Criminal Prosecutions Service Act (CPSA)\u2019 [No.28 of 2017]. From professional basic Law enforcement training; On-the-Job and advanced overseas Law enforcement training in various aspects of Policing; Criminal investigations; and Police Summary Court prosecutions, though the actions of Corporal Joseph appeared suspect, the \u2018Legislative Body\u2019 owes to him a Debt of Gratitude.\u2019<\/p>\n

CHIPPED AND CHISELED<\/p>\n

When Legislators, clearly and imprudently, they may have consumed a wee bit more than they allowed the \u2018Rastafarian Community\u2019 for use as \u2018Sacrament,\u2019 many members, including \u2018Ras Smood\u2019 Shouted; \u2018Haile Selassie; Rastafari; Jah.<\/strong>\u2019 When \u2018Legislators skillfully \u2018Chiseled out Section 31\u2019 and clinically \u2018chipped \u2018Sub-section 23 (1) (e)\u2019 of the said \u2018Act,\u2019 their artistry speaks to \u2018Legislative Gymnastics.\u2019 They may have achieved comparability to Sculptors in \u2018Cameroon and Ghana, and skills of fraudsters in Nigeria.\u2019 When they made \u2018Director of Public Prosecutions ((DPP)\u2019 Anthony Armstrong\u2019 a \u2018<\/strong>Creature of Statute,\u2019 only the apparent unlawful action of Corporal Joseph\u2019 illuminated the \u2018Flaws in the Law\u2019 to \u2018Defence Attorney Wendel Robinson.\u2019<\/p>\n

ACTING DPP: SHANNON JONES-GITTENS<\/p>\n

As news broke reporting that the office of the \u2018Director of Public Prosecutions (DPP)\u2019 distanced itself from: (i) \u2018Institution of criminal proceedings; and (ii) Under her \u2018Directions,\u2019 FIAT\u2019 was directed to \u2018Police Court Prosecutor, Assistant Superintendent Dane Bontiff.\u2019 That which \u2018Acting Director of Public Prosecutions (DPP), Shannon Jones-Gittens knew that:\u2019 (i) \u2018The substantive holder of the office, \u2018DPP Anthony Armstrong\u2019 vacated the office to attend to personal matters in his homeland Jamaica\u2019 [November 5, 2022]; (ii) She was appointed to act in such capacity, and while he was, and still in absentia, she assumed responsibilities for the office [ABS: November 7, 2022].<\/p>\n

SPECIFICS OF CASES<\/p>\n

That which might be said \u2018early-o-clock\u2019 is this; \u2018Granting Permission to Assistant Superintendent Dane Bontiff, and some five other Police Court Prosecutors. That which remains questionable was that the tersely written letter; (a) Lacked specifics of the Cases to be prosecuted; (b) Made no reference to the \u2018Criminal Prosecutions Service Act (CPSA).\u2019 Thus, it may have been likened to the issuance of a \u2018Signatured-Blank Cheque\u2019 to a person without particularities.<\/p>\n

TROUBLING QUESTIONS<\/p>\n

These beg these \u2018Troubling Questions;\u2019 (i) \u2018Unless he possessed exceptionally special psychic powers, \u2018Dean Jonas enquired \u2018How did \u2018Director of Public Prosecutions (DPP), Anthony Armstrong\u2019 know that absenting from this jurisdiction, \u2018Dean Jonas\u2019 would have been arrested at his \u2018Scotts Hill\u2019 home? (ii) How did he know that charges he would have been served Charges of Disorderly conduct at his garage; Threatening Language; Assault: Resisting Arrest; Battery on Police: (ii) How did the \u2018DPP\u2019 know of the \u2018Magisterial Fixture,\u2019<\/strong> that he may have been issued with an \u2018Authorizing FIAT\u2019 to undertake the prosecutions?\u2019 The \u2018Police Prosecutor\u2019 shall now know that \u2018St. Peter\u2019 may have been watching over him.<\/p>\n

DEBT OF GRATITUDE<\/p>\n

Though not a \u2018Legislator,\u2019 the \u2018Acting DPP\u2019 was well-positioned in an office, where reading is a must. She also has the legal background to guide informed interpretation of the Law, as her \u2018Knowledge\u2019 allows.\u2019 Whether or not she knew before, she too, \u2018Owes a Debt of Gratitude\u2019 to Corporal Jason Joseph.\u2019 She may have assigned a \u2018Crown Counsel\u2019 to offer whatever \u2018Legal Assistance\u2019 to the \u2018Commissioner of Police, Atlee Rodney QPM.\u2019 This was in the light of him \u2018Unlawfully instituting criminal proceedings without a \u2018FIAT\u2019 and specifically addressed to him in his official capacity, and not a \u2018Letter Granting Permission without \u2018Specifics\u2019 to \u2018Assistant Superintendent Dane Bontiff.\u2019<\/p>\n

PROPERLY HUFFED BY DPP<\/p>\n

The \u2018Acting DPP Shannon Jones-Gittens\u2019 knew, and still knows that the \u2018Constitution Order\u2019 of Antigua and Barbuda is the \u2018Supreme Law\u2019 of the nation [Section 2]. She knows that the office holder was already empowered and authorized her to \u2018Snatch\u2019 any Case. Though instituted by \u2018Commissioner of Police, Atlee Rodney QPM,\u2019 or any \u2018Private\/Criminal Proceedings\u2019 were instituted by \u2018Defence Attorney, Wendell Robinson,\u2019 if considered \u2018PROPER,\u2019 that too, could have been \u2018Properly Huffed\u2019 [CO: 1981: Section 88]. Though news broke that the \u2018Office of the \u2018DPP\u2019 would take prosecutorial responsibility in the \u2018Dean Jonas\u2019 Summary Trial Case,\u2019 the \u2018Acting DPP, Shannon Jones-Gittens\u2019 not only knew, but knows that the \u2018DPP\u2019 has never given any \u2018Crown Counsel \u2018PERMISSION\u2019 to perform their \u2018Legally-assigned or delegated duties.<\/p>\n

CONSTITUTIONAL: POWERS\/AUTHORITY<\/p>\n

To all a sundry, and those that erroneously believed they have \u2018Permission\u2019 to prosecute, the \u2018Supreme Law\u2019 states; \u2018The function of the \u2018DPP;\u2019 (i) \u2018May be exercised by him in person.\u2019 The \u2018Acting DPP\u2019 knows about the exercisable \u2018Constitutional Powers and Authority\u2019 of the \u2018DPP.\u2019 Besides, the \u2018Acting DPP\u2019 knows that no person, and no Police officer, who, whether or not ate \u2018Obsti\u2019s Hog Foot,\u2019 could ever request \u2018PERMISSION,\u2019 whether or not to prosecute \u2018Dean Jonas\u2019 or any person he accused of, according \u2018Obsti,\u2019 \u2018Police Thief Me Hog.\u2019<\/strong> [YouTube]. That which supports this assertion, could easily be verified when the \u2018Bodyless Murder Trial\u2019 against \u2018Mikhail Gomes\u2019 had been, to all intents and purposes, contracted to \u2018Montserrat\u2019s Director of Public Prosecutions (DPP), Attorney Orris Sullivan\u2019 [\u2026\u2026]. None may brag of the prosecutorial result.<\/p>\n

PROSECUTORIAL TRAGEDY<\/p>\n

Framers of the \u2018Constitution Order\u2019 anticipated that the workload may increase. Consequently, they provided for the \u2018DPP\u2019 to delegate \u2018AUTHORITY\u2019 to his \u2018Legal Staff.\u2019 Thus; (ii) Through other persons Acting under, and in accordance with his; (a) \u2018General; or (b) Special instructions\u2019 [CO: 1981: Section 88 (4)]. Clearly, \u2018Shannon Jones-Gittens\u2019 had no intention of causing embarrassment to the \u2018Legal Affairs Minister; House Speaker; Senate President; Legislators (With legal backgrounds); Governor General; Office of \u2018DPP;\u2019 Crown Counsels; and of course, no reputational and professional damage to herself.<\/p>\n

PROSECUTORIAL TRAGEDY<\/p>\n

The \u2018Acting DPP, Shannon Jones-Gittens,\u2019 was au fait with those constitutional provisions. Thu, avoided or averted \u2018Prosecutorial Tragedy,\u2019 for either \u2018Crown Counsel \u2018Rilys Adams\u2019 or one of her male counterparts. It shall now be clear in her mind, as to what powers reside with her at Section 88 (1) (c)\u2019 CO: 1981]. Then \u2018Defendant Dean Jonas and Defence Attorney, Wendell Robinson\u2019 may know without speculating, just what kind of \u2018Fortitude\u2019 she possesses, be it testicular or \u2018Abdominal.\u2019 Since there might there might be an opposite word, a prominent Jurist suggested this word. Certainly, it could never be anything the \u2018Good Lord\u2019 did not so provided to Dame Sherese\u2019 (Washington Bramble).<\/p>\n

TRESPASS ON LAND<\/p>\n

The statutory provisions have made it clear for the \u2018Acting DPP\u2019 to know and understand that; \u2018Any person who; (i) \u2018Unlawfully enters in an insulting, annoying, or threatening manner upon any lands or premises belonging to, or in the possession of any other person.\u2019 In slightly different language, the said provisions state that; (ii) \u2018Any person who unlawfully enters upon any such lands or premises after having been forbidden so to do.\u2019 The Legislators anticipated that some \u2018Trespassers\u2019 were likely to make life difficult for the owners\/occupiers, further inserted this provision; (iii) \u2018Any person who unlawfully enters and remains having being required to depart therefrom; (iv) Having lawfully entered misconducts him\/herself by behaving thereon, in an insulting; annoying; and threatening manner.<\/p>\n

DISCRETE AND TACTFUL INTERVENTION<\/p>\n

This is a \u2018Section\u2019 of particular interest to Law enforcers. This is particularly so; an enforcer might be \u2018REQUESTED\u2019 to go where \u2018Angels Fear.\u2019 There was no \u2018Recorded \u2018DUTY-BOOK ASSIGNED\u2019 of duty to be performed by the Corporal. There was no legal support.\u2019 Yet, a small, but \u2018Discrete and Tactful Intervention,\u2019 could avert a criminal act. Up to this point, he could not have been accused of \u2018Trespassing.\u2019 The owner\/occupier anticipates that at some point in time, Law enforcer may visit expectedly, particularly if there was some dispute involving himself and a third party.<\/p>\n

SPIRIT OF DISCERNMENT<\/p>\n

The trained officer must have the \u2018Spirit of Discernment,\u2019 one that may silently warn him\/her of \u2018Foreseeable Consequences.\u2019 When a \u2018Cockroach\u2019 crawls or flies around at nights, anything could drop it on the floor. Some enforcers do exhibit this kind of mentality. Back then, \u2018Sir Wright Fitzhenly George KCN, QPM, CVO, CPM,\u2019 could easily identify trainees that may graduate with \u2018Cockroach Mentality.\u2019 Thus, he would warn, that all it would take the \u2018Cockroach\u2019 to drop, was a single spray of \u2018Bop.\u2019<\/p>\n

LAWFUL: ENTRY\/DEPARTURE<\/p>\n

Whether or not he is familiar with the Law, the duty of the Law enforcer is to \u2018KNOW\u2019 how far he would be allowed to go, and not necessarily where he\/she wants to go. The provision states; \u2018Any person who, having \u2018LAWFULLY\u2019 entered on any such lands or premises \u2018PERSISTENTLY\u2019 remains thereon, having been \u2018LAWFULLY\u2019 required to depart therefrom, shall be liable to; (a) \u2018A fine of \u2018EC$750.00; or (b) Imprisonment for 3 months\u2019 [Section 51 (e) Small Charges Act: Chapter 405]. This has been the only \u2018Sub-section that speaks to \u2018Lawfully\u2019 required to leave. As far as \u2018Prosecutions for these mundane Summary Trial Charges are concerned, these have no \u2018Priority to the office of the Director of Public Prosecutions, which office appeared to have misguided given added responsibility for \u2018Magisterial Prosecutions, through a partly Unconstitutional enactment- \u2018Criminal Prosecutions Service Act (CPSA)\u2019 [Section 27 (2): No. 28 of 2917].<\/p>\n

The need has come upon Law enforcement to build bridges of friendship. This shall be buttressed by mutual understanding, sensitivity and respect. Moreover, it is imperative that Law enforcers create a climate in which the citizenry would cooperate and develop an appreciation of their role and function that each law-abiding citizen may feel compel to obey the law and accord them respect, and obligingly, render every member of the \u2018Police Service,\u2019 the fullest cooperation.\u2019 Further research revealed; \u2018The responsibility of the Police Department, is not merely to upgrade the attitudes and behavior of individual officers, but also to identify and use community resources which will help to influence the attitude and behavior of the citizens\u2019 [ International Association of Commissioners of Police: Volume 8: 11].<\/p>\n

CONCLUSION<\/p>\n

The citizens would never show hostility to \u2018Law Enforcers,\u2019 if the perceptions of their knowledge, speak to \u2018courtesy; politeness; respect and helpfulness, tact and discretion. Such appeared not to have been properly instilled, and if they were in fact taught, there may have been of little significance to the understanding or appreciation of their value. These, with an appeasing mind, may be used in any kind of investigation. Those that are expected to know the provisions contained in \u2018The Supreme Law; Statue and Common Law,\u2019 are \u2018Enforcers of Law.\u2019 When death comes upon a family, trespassing restrictions are inapplicable to the \u2018Police officers; Doctors; and Undertakers.\u2019 The latter were often called after the formalities have been completed. Likened to the Law Enforcers; criminal investigators; Doctors; Undertakers; and Crown Prosecutors,\u2019 each has his\/her special role to play.
