Though not actually feeling the effects of \u2018Fire or Sun and facing no Jury of her peers or the nozzle of a gun, \u2018Acting Director of Public Prosecutions (DPP),\u2019 Shannon Jones-Gittens\u2019<\/strong> could very well be feeling the \u2018Heat of Criminal Prosecutions.\u2019 Given her position, with an apparent bad piece of prosecutorial legislation, backing her up against at a \u2018dead-end,\u2019 there is just no place to run.<\/p>\n

PROSECUTORIAL MISERY<\/p>

Seemingly, with a mind in a state of confusion and perplexity, whether by happenstance or expediency, the \u2018Acting DPP,\u2019 appeared to have found herself in \u2018Comedic Prosecutorial Quandary.\u2019 <\/strong>Such, as inferences may reasonably and safely be drawn, resulted when \u2018Criminal Defence Attorney Wendell Robinson,\u2019 made a \u2018Submitted \u2018In Limine\u2019 <\/strong>certain legal points on behalf of Summary-trial-Defendant, Dean Jonas\u2019 [March 3, 2023]. This has been the \u2018Submission\u2019 that triggered \u2018Prosecutorial Misery,\u2019<\/strong> for everybody-\u2019 Magistracy: Defendants\/Accused\/ Defence Attorneys\/ Police\/DPP Prosecutors and Witnesses. The \u2018Magisterially-Fixed Summary trial, the Prosecution was said to have been ill-prepared to commence \u2018Examination in Chief,\u2019 by calling witness to give \u2018Evidence on Oath\u2019<\/strong> against Defendant Dean Jonas.\u2019 Such ill-preparedness for the commencement of trial, forced an adjournment to \u2018April 3, 2023.\u2019<\/p>

FORTUITOUS RULING<\/p>\n

Previously advancing certain legal points involving the controversial and seemingly unconstitutional enactment -The \u2018Criminal Prosecutions Service Act (CPSA)\u2019 [No. 28 of 2017]. Craving the Court\u2019s indulgence, he sought unsuccessfully to persuade \u2018Chief Magistrate, Joanne Walsh\u2019 to dismiss the unlawfully and unwittingly-filed-Complaints.\u2019 <\/strong>Through an apparent \u2018Fortuitous Ruling,\u2019<\/strong> clearly suggestive of an attempt to save prosecutorial embarrassment of; (i) \u2018Acting Director of Public Prosecutions (DPP) Shannon Jones-Gittens; (ii)\u2019Commissioner of Police, Attlee Rodney QPM: (iii) Then Head of Police Prosecutions, Assistant Superintendent, Dane Bontiff.\u2019<\/p>

SCUFFLED ARREST<\/p>\n

The Defendant, slapped with four Summary charges, including the most ridiculously mundane \u2018Disorderly Conduct,\u2019 when in firm, stern audible voice. He repeatedly ordered Police officers of his \u2018private property, as they sought to assist the mother of \u2018an-8-year-old boy child, he undisputedly and putatively fathered. That night, and at his private premise, pandemonium broke out. So too, was a \u2018Scuffled Arrest,\u2019<\/strong> that saw him being subdued to suffer the indignity of being \u2018Handcuffed\u2019 and carted off to the \u2018St. John\u2019s Police Station.\u2019 He was not only charged, but \u2018unlawfully,\u2019 and out of gross professional ignorance, \u2018finger printed and photographed and subsequently released on \u2018Station Bail.\u2019<\/p>

\"\"<\/a><\/div>\n

BENEFIT OF KNOWLEDGE<\/strong><\/p>

\"\"<\/a><\/div>\n

It shall neither considered physically harmful, nor to the \u2018Knowledge\u2019<\/strong> for law-abiding citizens to be enlightened about the taking of \u2018Fingerprints and Photographs.\u2019 It has been made sufficiently clear, even for \u2018Prime Minister Browne\u2019s \u2018Little Princess\u2019 to know that; \u2018The Police officer in charge of a Police station may cause; (a)<\/strong> \u2018The measurements; (b)<\/strong> Photographs; (c)<\/strong> Fingerprints; (d)<\/strong> Palm impressions; and (e)<\/strong> Foot impressions to be taken for the purposes of (i) Identification; (ii) Use; Use; or (iii) Record.\u2019 The qualifications; (a)<\/strong> \u2018The person must be in \u2018Lawful Custody;\u2019<\/strong> and (b).<\/strong> For any \u2018INDICTABLE\u2019<\/strong> offence\u2019 [Section 30: Police Act: Chapter 330].<\/p>\n

DUTY AND AUTHORITY<\/p>\n

The \u2018Judicial Committee of the \u2018Privy Council\u2019 were very careful in differentiating for the benefit of \u2018Legislators and the Police\u2019 that which was; (a)<\/strong> \u2018A statutorily imposed Duty\u2019<\/strong> upon the Commissioner of Police; and (b)<\/strong> That which was \u2018Exercisable Authority\u2019<\/strong> by the DPP.\u2019 In their collective legal and judicial reasoning and wisdom; (i) \u2018Lady Brenda Hale: (ii)<\/strong> Lord John Kerr: (iii)<\/strong> Lord Richard Wilson; (iv)<\/strong> Lord Anthony Hughes; and (v) Lord Roger Toulson.\u2019 Their dictum states: \u2018If the DPP exercises his \u2018Power,\u2019 he does so in his own name: It is a \u2018Power\u2019<\/strong> rather than a \u2018Duty; He can elect not to exercise it, that is: Not to institute such proceedings.\u2019<\/p>\n

CONFERRED POWER v EXERCISE OF AUTHORITY<\/p>\n

The \u2018Lady and Law Lords\u2019 were adamant that; \u2018No express power is given to the \u2018DPP\u2019 to control the \u2018Exercise of Power\u2019<\/strong> of any other \u2018Person or Authority\u2019<\/strong> to institute criminal proceedings\u2019 against an offending person.\u2019 The learned and esteemed Jurists not only speaks to the \u2018Conferred Power\u2019<\/strong> upon the Police by \u2018Common Law,\u2019 but also that which sought to buttress it by Statute Law.\u2019 In support of their dictum, they have cited the \u2018Judicial Authority; \u2018R (Gujra) v Crown Prosecution Service\u2019 [2012: UKSC: 52: 2O13]. But then if \u2018Legislators\u2019 failed to inform themselves before sitting in Parliament, they may become as judicially adept, as \u2018Her Ladyship and Their Lordships.\u2019<\/p>\n

MISGUIDED AND ILL-ADVISED<\/p>\n

The prosecutorial difficulty lies not only in the apparent; (i)<\/strong> \u2018Misguided and ill-Advised\u2019 Enactment- \u2018Criminal Prosecutions Service Act (CPSA)\u2019 [No. 28 of 2017]; (ii)<\/strong> A \u2018Criminally-Suspect Letter,\u2019 purportedly authored by estranged, but still substantive holder of the office of DPP, Anthony Armstrong; (iii)<\/strong> A pre-existed \u2018Appellate Ruling\u2019 by the \u2018London Privy Council; and (iv) An embarrassing and woefully starved of knowledge of an on point and irrefutable \u2018Appellate Ruling\u2019<\/strong> by the Judicial Committee of the Privy Council (JCPC)\u2019 [UKPC 8: PCAPPL: 2014: No. 0083\/2011].<\/p>\n

LEGAL DUMMIES<\/strong><\/p>\n

Authoritatively, this has been the judicial ruling of the 5-Member Jurists that included four males and one female. The eminent British Jurists, identified in the \u2018Appellate Judicial Ruling,\u2019 included; (i)<\/strong> Her Ladyship Brenda Hale; and \u2018Their Lordships; (ii)<\/strong> John Kerr: (iii) Richard Wilson: (iv)<\/strong> Anthony Hughes; and (v)<\/strong> Roger Toulson.\u2019 The nation\u2019s constitutionally-status and universally respected \u2018Judicial Committee of the Privy Council (JCPC), then comprised of four distinguished \u2018Law Lords and one Law Lady,\u2019 in very cogent, concise and comprehensible legal language dictaed for those that are not \u2018Legal Dummies.\u2019 <\/strong><\/p>\n

DPP:\u00a0 NO MEMBERSHIP \u2013 NO PART OF IT <\/strong><\/p>\n

\u2018The composition and command structure of the \u2018Royal Police Force of Antigua and Barbuda,\u2019 as contained in, and statutorily provided in the \u2018Police Act\u2019 [PA: Section 6: Chapter 330], does not make the Director of Public Prosecutions (DPP)\u2019 a member of the Police Force; and (ii) The Constitution does not make the \u2018DPP\u2019 a member of the Police Force and he has no right of command over it.\u2019 <\/strong>This is where those with \u2018Legal Minds\u2019 fear as the \u2018Prosecutorial Bug.\u2019<\/p>\n

FUTILE ATTEMPT: HUFFING FROM VERE BROWNE<\/p>\n

Huffing is a very dangerous act. It is like war. In that involving President Putin, he seems to be on a mission to \u2018Huff\u2019 the whole of Ukraine.\u2019 Commissioner Atlee Rodney\u2019 was somewhat lucky.\u2019 He was only \u2018Huffed\u2019 of one Section-31\u2019<\/strong> and two Sub-sections from Section 23.\u2019 These dealt with; (i) \u2018\u2026Institution of criminal proceedings; and (ii) \u2026Undertaking criminal proceedings.\u2019 The \u2018Acting DPP, if prudence so dictates, and she endeavors to know how, and where \u2018Huffing\u2019 started. Discrete diligence may guide her thoughts to know why the office had attempted to \u2018Huff\u2019<\/strong> some of the \u2018Police Powers\u2019 then residing with \u2018Commissioner of Police, Vere Browne\u2019 [June 2, 2008 & August 7, 2008].<\/p>\n

QUESTION FOR JCPC<\/p>\n

Seemingly, not an easy \u2018Nut to Crack,\u2019 with every sinew and muscle, and by a steely resolve, purposefully, firmly, decisively and determinedly, he resisted. Then with the intervention of the office of \u2018former Attorney General, Justin L. Simon KC,\u2019 <\/strong>that provided the necessary legal assistance, in staving off the ambitious and apparent collusive attempt. The \u2018Question\u2019 then for the \u2018London Privy Council\u2019 was; \u2018Does the Director of Public Prosecutions have \u2018General Power\u2019 to prevent the Police from instituting criminal proceedings.\u2019<\/strong><\/p>\n

HUFFED FROM ATLEE RODNEY<\/p>\n

Fourteen years later, it has been \u2018Huffed\u2019 from an apparent docile \u2018Commissioner of Police, Atlee RODNEY QPM.\u2019 There was no attempt to fight any battle for anyone that is only interested to travel on any \u2018Gravy Train.\u2019 From professional knowledge, understanding, and actuality of administrative use and guidance by the \u2018Police Act\u2019 among the provisions every person from \u2018Sir Wright Fitzhenly George KCN, QPM, CPM, CVO\u2019 to Commissioner of Police, Atlee Rodney QPM,\u2019 there were provisions that were of particular; (i) Administrative; and (ii) Operational interests\u2019 to each \u2018Commander.\u2019<\/p>\n

COMMAND: SUPERINTENDENCE: CONTROL<\/p>\n

The provisions as contained in the \u2018Police Act\u2019 that most officers at that level; (a): \u2018Had to know; (b) Deemed to know; and would have been considered (c) Reckless not to know,\u2019 are; \u2018Sections 6: 22; and 23.\u2019 The former speaks to; (i)<\/strong> \u2018Composition of the Police Service and designated ranks; (ii)<\/strong> Command and control; General directions of Minister. \u2018For ease of reference, it states; \u2018The Police Force shall consist of a Commissioner of Police.\u2019 He is to be subject to the Law: (i) \u2018The provisions of Law, as contained in the Police Act; and (ii) General Directions of the Minister with responsibility for the Police\u2019 [Section 6 (1) (a)].<\/p>\n

SUPREME LAW<\/p>\n

The \u2018Criminal Prosecutions Service Act,\u2019 seems not to show \u2018Harmonizing Consistency\u2019<\/strong> with the \u2018Supreme Law- the Constitution,\u2019<\/strong> the universally-respected \u2018Appellate Judicial Ruling\u2019 by the \u2018London Privy Council.\u2019 For ease of reference, the part of the \u2018Dictum\u2019 that seemed most profound, is contained herein. To all intents and purposes, the esteemed \u2018British Jurists\u2019 ended their judicial review on the historic judicial dictum of eminent \u2018British Jurist, Lord Denning, Master of the Roll.\u2019<\/p>\n

MISGUIDED \u2013 MIXED-UP – MESSED UP<\/p>\n

It seemed a \u2018Comedy of Errors\u2019 has been made, and so may have been wimps and puppets. For instance, \u2018Criminal Complaints\u2019 were filed in the name; \u2018Commissioner of Police,\u2019 but absurdly, if not ludicrously, the \u2018Commissioner\u2019 required authorization (FIAT) from \u2018Acting Director of Public Prosecutions\u2019 to undertake prosecutions, when she executed \u2018NO\u2019 Law. A dog with a bone will always be seen as being better positioned than a person without brain. Clearly, the Legislators; \u2018Director of Public Prosecutions; Crown Councils; and the Commissioner of Police,\u2019 all appeared to have been \u2018Misguided; Mixed-up and Messed up.\u2019<\/p>\n

ILLUSIONS OF AUTHORITY<\/p>\n

There have been widespread suggestions that the \u2018Acting DPP\u2019 seemed to be under \u2018Illusions\u2019<\/strong> that she enjoys \u2018Authority over the Commissioner\u2019<\/strong> not residing in the \u2018Office of the \u2018DPP.\u2019 Harboring such \u2018Illusion,\u2019 could easily be equated with the \u2018Figment of Imagination.\u2019 This might be bad for the mental-wellbeing of a person, so led to believe. Notwithstanding, she may avert exploitative or environmental influences, but only to the extent that she endeavors to properly inform herself of this most important \u2018Appellate Judicial Ruling.\u2019 Given serious implications for; (i) \u2018The \u2018Institution\u2019 of criminal prosecutions; and (ii) Undertaking or directing the undertaking of criminal prosecutions, no \u2019DPP\u2019 that worths his\/her \u2018Salt- Sea or Epsom,\u2019 could be internally or externally advised, or could be so daft, as to be seen as ignoring, or acting contrary to such \u2018Judicial Ruling.\u2019<\/p>\n

BENEFIT OF KNOWLEDGE<\/p>\n

For the \u2018Benefit of Knowledge\u2019<\/strong> of \u2018Acting DPP Shannon Jones Gittens; and Crown Counsels; \u2018Rilys Adams and Rashida Jonas, and male counterparts, including Crown Counsel Dyer,\u2019 it states;\u2019 \u2018I hold to be the duty of the Commissioner of Police to enforce the Law of the Land that citizens may go about their affairs in peace; \u2026He is not the Servant of anyone;\u00a0 \u2026He must decide whether or not suspected persons are to be prosecuted \u2026He is not the servant of anyone, including the DPP; \u2026He is responsible to the Law, and the Law alone; Thus, \u2018\u2026No Minister of the Crown and no Police authority\u2019 [R v Commissioner of the Metropolis, Raymond Blackburn ex p \u2018[1968: QB 118: 136].\u00a0 To be continued\u2026\u00a0 ***<\/p>\n
