Since they \u2018Come in peace, they shall also leave in peace.\u2019 After all, they are to be seen by the citizens as \u2018Peace Makers.\u2019 Law enforcers shall know that only two ways they may enter such property; (i) \u2018Casually, by invitation of the owner\/occupier; and (ii) Lawfully by authority of the Court.\u2019 Such may be issuances of: (a) \u2018When \u2018Criminal Investigations\u2019 dictate \u2018Warrant to Search; and (b) When issued for \u2018Arrest\u2019- Warrant in the First Instance.\u2019<\/p>

LET THERE BE KNOWLEDGE<\/strong><\/p>\n

In the case of the former, when owner\/occupier request the absence of the person\u2019s presence, he\/she shall leave. In the course of \u2018Criminal investigations,\u2019 only upon completion of \u2018Search or Arrest.\u2019 Interference in the latter could result in arrest for \u2018Obstruction in the Execution of Duty.\u2019 Though not necessarily for reasons of plagiarizing \u2018Let There Be Light (Observer), but for re-phrasing and enlightenment for the benefit of \u2018Law enforcers,\u2019 it was coined; \u2018Let There Be Knowledge.\u2019<\/strong>\u00a0 If there was a time for \u2018Law enforcers\u2019 to improve upon their approaches to; (i)<\/strong> \u2018Crime and Violence; and (ii)<\/strong> Intervention into issues of a tortious domestic nature.\u2019<\/p>

PERSPECTIVE<\/p>\n

When law enforcers dabble in matters outside of \u2018Criminal Jurisdictions,\u2019 of which no legal authority exists, they are very likely to cause consternation and unnecessary difficulties for others and themselves. These ill-informed and ill-equipped officers, shall know the very \u2018Basics.\u2019<\/strong> They shall have the knowledge and ability in distinguishing the various judicial authorities. These shall guide them to an understanding of; (i) \u2018Summary and Criminal Jurisdictions; and (ii) \u2018Civil\/Tortious Jurisdiction.\u2019 They shall also know that when motorists veered off their \u2018Lane\u2019<\/strong> [Information; Water and Light Minister Melford Nicholas MP & CSP], accidents do occur.<\/p>

WEALTH OF KNOWLEDGE<\/p>\n

It has been for very good reasons that former \u2018Commandant of the then \u2018Langford Police Training School.\u2019 \u2018Sir Wright Fitz Henley George KCN, QPM, CVO, CPM\u2019 had constantly said to \u2018Police Trainees; \u2018Knowledge is power, but some people either wanted, or were given \u2018Power without Knowledge.\u2019 Positionally, these were, the people \u2018Sir Wright\u2019 had described as among the \u2018most dangerous and ruthless persons.\u2019 Then there was this \u2018Head Master,\u2019 Charles Emanuel Best.\u2019 Whether of superior or inferior intellect, he had never missed a teaching session without encouraging pupils to read. This he often said; \u2018Reading makes a ready man\u2019<\/strong> [Colonarie Roman Catholic School (CRCS): SVG].<\/p>\n

HALF THE TROUBLE<\/p>\n

Applied to a number of \u2018Police Services within the \u2018Organization of Eastern Caribbean States (OECS),\u2019 Half the Trouble\u2019<\/strong> with Law enforcers and the citizen were often caused, either by Law enforcers that seemed to have been knowledgeably affected by man\u2019s gravest enemies. Those that were seen through attitudes and behaviors, expressions and courses of actions, were easily identified as the \u2018half-trained, semi-illiterate and daft.\u2019 Invariably, these have been the law enforcers that general public have seen as projecting images as being intimidating and terrorizing. These were often the ones accused of senseless brutalization of the helpless, hapless and defenceless members of the society.<\/p>\n

JURISDICTIONAL KNOWLEDGE<\/p>\n

Many of these officers were often been seen as starved of \u2018Jurisdictional Knowledge.\u2019 Consequently, many appeared not to know and reckless not to know that matters of \u2018Family and Child Custody,\u2019 are strictly for consideration of the \u2018Magisterial Family Court.\u2019 Thus, matters of \u2018Child Welfare,\u2019 shall always be advised to have them referred by parents and Welfare officers to such jurisdiction. Given the growing incidences of \u2018Domestic disputes and related issues of \u2018Child Custody,\u2019 if there was ever a time when law enforcers shall distinguish between \u2018Summary and Criminal Jurisdictions\u2019 from \u2018Civil Jurisdiction,\u2019 it shall be now.<\/p>\n

PUBLIC ATTITUDES<\/p>\n

A necessary part of the task of achieving organizational objectives, has always been the development of \u2018Public Attitudes,\u2019<\/strong> favorable to their attainment. Therefore, in order to improve membership\u2019s awareness, these has to be greater emphasis on training in public relations at all levels. This shall be included in \u2018Training Manuals for Police Recruits.\u2019 This has always been of critical importance.\u00a0 This has been particularly so, since in the handling of the public and members of the wider society, trainees shall be given guidance in the use of tact and discretion. Thus, if org<\/strong>anizational leaders, are to be seen as efficient and effective, there shall be few reasons for the populace to be distrustful and fearful of its members.<\/p>\n

INVASIVE SUB-CULTURES<\/p>\n

Though not necessarily intended to be used casually or rhetorically, in some situations term \u2018Leadership Matters,\u2019<\/strong> means something fundamental. From an organizational perspective, and specifically to \u2018Police Services,\u2019 it means having effective command and control, not only of the organization, but also of the behavior of its membership. It means effectively dealing with apparent \u2018Invasive Sub-Cultures\u2019<\/strong> that have the potential to affect its image and reputation. It also means eliminating behaviors and\/or courses of action that might be inimical to the interest of the organization, as well as to those it has a legal obligation to \u2018Protect and Serve.\u2019 <\/strong><\/p>\n

SPIRIT OF LAW<\/p>\n

In the eyes of the citizenry, law enforcers are to be seen as actin \u2018professionally, knowledgeably; lawfully; civilly; sensitively and discretely,\u2019 and in the \u2018Spirit of Law.\u2019<\/strong> These, inter alia, not only speak to several pre-requisites necessary for improvement of knowledge of the law, but also of high professional standards and competence. From this \u2018Perspective,\u2019<\/strong> it was voluntarily decided, through this news portal, to offer a few \u2018Serialized Public Lessons.\u2019 It shall offend no senses to revisit the \u2018Law Enforcement Code of Ethics.\u2019 Guided by knowledge, both citizens shall have commonality of understanding of the nature of Police work and the services enforcers are often called upon to perform. Those with professional and procedural knowledge, are always better positioned to make informed decisions. Those without, are more like to cause confusion and misunderstanding.<\/p>\n

LESSON 1: CODE OF ETHICS<\/strong><\/p>\n

In most organizations- formal and informal, not only shall they have rules and precepts for organizational control, but also \u2018Codes of Ethics\u2019<\/strong> for behavioral guidance and disciplinary control. This \u2018Lesson,\u2019 provides a look at the \u2018Law Enforcement Code of Ethics (LECE).\u2019 In the light of recent developments, it should do no harm for law enforcers to revisit a few of the fundamental principles. Therefore, with knowledge of their individual and collective roles and an understanding of the environment in which they work, their approach to situations that may occur outside of criminal jurisdiction.<\/p>\n

AUTHORITY AND BRUTALITY<\/p>\n

This necessarily means that in order to improve their image, as well as that of the \u2018Police Service,\u2019 law enforcers shall not only demonstrate by their attitude, expressions and behavior, but also, courses of action that speak to abuse of \u2018Authority and Brutality.\u2019<\/strong> These, undoubtedly, should show that they are worthy of citizen\u2019s respect, trust, confidence and cooperation with members of society. That which each member shall know, is that every action taken, individually or collectively, has a bearing on their relationship with members of the public and owners\/occupiers of privately-owned property.<\/p>\n

SPIRIT OF DISCERNMENT<\/p>\n

Recent developments within the nation, speak to a behavioral pattern capable of inviting the wrath of the public. Those with the \u2018Spirit of Discernment,\u2019<\/strong> have to capacity to see that a very small minority of apparent misguided, uncouth and overly officious, hostile, aggressive and combative Law enforcers.\u2019 This not only speaks to an urgency, but also a dire need for \u2018Re-Training\u2019 of officers identified with such behavior. These law enforcers, have not only incensed the feelings of otherwise peaceful and law-abiding citizens, but also seemed to have provoked the devil deep down in hell.<\/p>\n

EGOISTIC ZEAL <\/strong><\/p>\n

Law enforcers shall know that when \u2018Requested\u2019<\/strong> to intervene in matters for \u2018Civil Jurisdiction,\u2019 some \u2018stiff-necked officers,\u2019 might just be walking on the street paved with litigation. Intrusiveness, not only constitutes unlawful entry, but may also prompt civil lawsuit for \u2018Unlawful Trespass.\u2019 Advisably, law enforcers shall never be seen as being \u2018overzealous, over-officious and misguided. Parliament had long anticipated that, either out of \u2018Egoistic Zeal,\u2019 ignorance or sheer stupidity, some law enforcers may exercise powers not residing in their office.<\/p>\n

VIOLENCE AND UNLAWFUL ARREST<\/strong><\/p>\n

It has been for these particular reasons \u2018Parliamentarians\u2019 then inserted into the \u2018Police Disciplinary Regulations (PDR)\u2019<\/strong> the particular provision as herein referred. To all intents and purposes, the disciplinary provision states, that an officer commits a breach of discipline; (i)<\/strong> \u2018If without good and sufficient cause makes any \u2018Unlawful Arrest;\u2019<\/strong> and (ii)<\/strong> If he uses any \u2018Unnecessary Violence\u2019 <\/strong>to any prisoner or other person with whom he\/she may be brought into contact in the \u2018Execution of Duty\u2019 [Police Discipline: Paragraph \u2018H:\u2019 Chapter 330]. \u00a0These disciplinary offences, if pursued, may very well save the day, not only for; (i) \u2018Franklyn James<\/strong> [ABS TV: December 16, 2022]: and (ii) Dean Jonas\u2019<\/strong> who have alleged to have been \u2018Victims of Police Excesses\u2019 [ABS: January 31, 2023], <\/strong>but also other potential victims.<\/p>\n

PROFESSIONAL KNOWLEDGE<\/p>\n

While the system continues to criminalize and penalize the indigent or poverty-stricken members of society, the \u2018Good Citizen,\u2019 suffered no indignities of \u2018deprivation of liberty; handcuffs, painful brutality.\u2019 Several, likened to \u2018Vultures,\u2019 can be seen roving around depressed communities, looking for victims to prey on. These have been the ones that seemed to have suffered from nigeritis, when the subject; \u2018Law Enforcement Code of Ethics\u2019 may have been explained. Having missed that lesson, this may very well be an opportune time for chronically inclined to be viciously, senselessly and mercilessly brutal, to reflect upon their behavior and action that begs for rationality, justification and \u2018Professional Knowledge.\u2019<\/strong><\/p>\n

FUNDAMENTAL DUTY<\/strong><\/p>\n

From vivid recollections of formal \u2018Law enforcement Training,\u2019 bringing a wealth of knowledge from the \u2018Regional Police Training Center (RPTC) [Barbados], and imparting it to his students, \u2018Sir Wright\u2019 instructed every \u2018Police Trainee\u2019 to become conversant with the \u2018Law Enforcement Code of Ethics.\u2019 That which each wrote were: \u2018As a Law enforcement officer, my \u2018Fundamental Duty,\u2019 is to; (a) \u2018Serve mankind; (b) Safeguard life and property; (c)<\/strong> Protect the innocent against deception: (d) The weak against oppression and intimidation: (e) Peaceful against violence or disorder: and (f) Respect the constitutional rights of men\/women.\u2019 Most importantly, a legal undertaking an extended duty to ensure their; (a) \u2018Liberty: (b) Equality; and (c) Justice.\u2019<\/strong><\/p>\n

OBJECTIVES AND IDEALS<\/strong><\/p>\n

While these may have been accepted as the \u2018Objectives\u2019<\/strong> aimed at in the \u2018Law Enforcement Code of Ethics,\u2019 it was also clear in the minds of those that crafted these, saw other \u2018Ideals.<\/strong>\u2019 Considering the purpose of this \u2018Lesson,\u2019 it makes good sense, but only to the extent that good use will be made of it, by those being targeted within the \u2018Police Service.\u2019 Among the most important of \u2018Ethical Behavior,\u2019 has been those which states: (i) \u2018I will never act officiously; or (ii) Permit personal feelings; (iii) Prejudices; (iv) Animosities; and (v) Friendships to influence my decisions.\u2019 Not infrequently, those in depressed communities have been forced to speak to the wrath that had descended upon them by a small minority, capable of being described as constantly exhibiting \u2018roguish and brutish behavior.\u2019<\/p>\n

CONCLUSION<\/p>\n

Finally, in concluding this \u2018First Lesson – No. 1,\u2019 the \u2018Law Enforcement Code of Ethics,\u2019 further states for the conscientious law enforcers that they shall; (a)<\/strong> \u2018Enforce the Law courteously and appropriately; and (b)<\/strong> Shall do so without; (i)<\/strong> \u2018Fear; (ii)<\/strong> Favor; (iii)<\/strong> Malice; or (c) Ill-will; and (iv)<\/strong> \u2026I WILL NEVER EMPLOY UNNECESSARY FORCE OR VIOLENCE AGAINST ANY PERSON.\u2019 This appears consistent with that which the \u2018Police Disciplinary Regulations\u2019 ANU: Chapter 330], not only seek to prevent and ensured, but also to penalize those a \u2018Police Disciplinary Tribunal\u2019 so found in serious breaches of organizational discipline of this nature. \u00a0This, therefore, ends the \u2018First Open Public Lesson: No. 1.\u2019\u00a0 To be continued\u2026\u2026. ***<\/p>\n
