Not only are \u2018Fraudulent Acts\u2019 being perpetrated every day, but also everywhere. In the \u2018Legal Profession\u2019 to Banking Institutions.\u2019<\/p>\n

When this news portal reported that the \u2018FBI and the \u2018US Securities Exchange Commission (SEC)\u2019 were conducting \u2018Cross-Border Investigations\u2019 into financial institutions from the \u2018USA to the Bahamas to Antigua and Barbuda,\u2019 know some currency was suspected to have slipped out of some \u2018Bank\u2019s Vault\u2019 [November22, 2022].<\/p>

\"\"<\/a><\/div>\n

When people sought to divorce themselves from acts bordering activities often under the scrutiny of the \u2018ONDCP,\u2019 know that it would have been enough to pay more this \u2018Month\u2019s Salary.\u2019<\/p>

\"\"<\/a><\/div>\n

NOBLEST OF PROFESSIONS
\nNone may deny that the \u2018Legal Profession\u2019 has not only been considered prestigious, but also ranked as among the \u2018Noblest of Professions.\u2019 The majority of practitioners are legal scholars of professional ethics and integrity. These have been the ones that were often seen as exhibiting exemplary conduct. They are not only highly reputable and respectable, but also in high demand.<\/p>\n

Five days a week some \u2018Attorneys-at-Law\u2019 were to be seen immaculately attired in \u2018Jackets
\nand Ties.\u2019<\/p>

\"\"<\/a><\/div>\n

They stood before \u2018Magistrates sitting on \u2018Benches,\u2019 performing multiple Magisterial
\nRoles, either; (a) \u2018Conducting Summary trials; or (b) Adjudicating Civil proceedings; or (c)
\nHolding Committal proceedings for Criminal jurisdiction.\u2019<\/p>\n

PERSPECTIVE<\/p>

\"\"<\/a><\/div>\n

This commentary is neither intended to incur the \u2018Wrath of the Bar Council,\u2019 nor concerned
\nwith \u2018Banking Institutions\u2019 or \u2018Attorneys-at-Law\u2019 that appear not to have exhibited vulture-
\nlike instincts.<\/p>

\"\"<\/a><\/div>\n

Instead, its intention is to discourage those with such instincts. Moreover, it is
\nintended to bring awareness to the citizenry, of an apparent unwholesome legal practice. Such practice, by a very small minority, seems not to be consistent with provisions contained in the \u2018Legal Profession Act (LPA)\u2019 [No.22 of 2008].<\/p>\n

It shall, therefore, bring enlightenment to those that have been \u2018Intellectually\u2019 deceived and victimized, and\/or financially-deprived.\u2019<\/p>\n

It also looks at specific \u2018Rules\u2019 governing \u2018Professional Misconduct\u2019 and attendant consequences. It further looks at the experiences of the now \u2018Vacation-Leaved,\u2019 Director of Public Prosecutions (DPP), Anthony Armstrong.\u2019<\/p>\n

KLEPTOMANIAC PROPENSITIES<\/p>\n

None shall practice \u2018Criminal Law\u2019 without the capacity of legal understanding of \u2018Mischiefs
\nAimed by Parliament.\u2019 Conversely, none shall be elected to the \u2018Presidency\u2019 of \u2018Bar
\nAssociations\u2019 that is likely to adopt the \u2018Dog and Cat Idiom.\u2019<\/p>\n

This idiom says that the \u2018Dog licks him that it likes,\u2019 while the Cat scratches him that it dislikes.\u2019 In the \u2018Legal Profession Act,\u2019 that so \u2018Aimed,\u2019 could easily be explained by the \u2018Law-Degreed,\u2019 but not yet \u2018Bar- Called\u2019 to practice as an Attorney, \u2018Maria Bird-Browne MP\u2019 [ABS TV\/Radio: July 10, 2019.\u2019<\/p>\n

She, without a \u2018Shadow of Doubt,\u2019 would explain that \u2018Clients and Litigants\u2019 of whatever social status and financial standing, shall be protected from \u2018Attorneys-at-law\u2019 with
\n\u2018Kleptomaniac Propensities.\u2019<\/p>\n

PROFESSIONAL HONESTY
\nThat which seems not only to be at variance with \u2018Professional Honesty,\u2019 but also with \u2018Ethics and integrity,\u2019 have been allegations of rampant \u2018Fleecing of Clients\/Litigants.\u2019 Consequently, it is intended to enlighten victims and potential of the reported ignoble practice.<\/p>\n

Long before the present generation of \u2018Attorneys-at-Law,\u2019 Parliament had long anticipated that unscrupulous and depraved legal practitioners may seek to \u2018Deceive and Defraud\u2019 unsuspecting clients and itigants.<\/p>\n

Consequently, in order protect those of inferior intellect, the \u2018Legal Profession Act
\n(LPA),\u2019 was enacted.<\/p>\n

BEST PROFESSIONBAL PRACTICE<\/p>\n

More specifically, the \u2018Act,\u2019 purposefully crafted is intended to guide \u2018Best Professional
\nPractice\u2019 among legal practitioner. The likely advantages are; (i) Reposing confidence by
\nClients\/litigants and members of the wider society; (ii) \u2018Embracing the legal practice of
\nscrupulous Attorneys-at-law; (iii) The Magistracy; (iv) The Judiciary; and most importantly (v) Strengthen belief in the administration and dispensation of Justice; and (d)
\nEngender respect for the \u2018Rule of Law.\u2019<\/p>\n

NOBILITY FROM RASCALITY<\/p>\n

From the author\u2019s perspective, as many \u2018Attorneys-at-law\u2019 may have been starved of
\nknowledge of the \u2018Legal Profession Act,\u2019 it was considered prudent to start with the
\n\u2018Governing Rules.\u2019 It specifically looks at \u2018Non-conformity by the \u2018Disciplinary Committee of
\nthe \u2018Rule\u2019 that speaks to making public a pronouncement on \u2018Disciplinary Findings\u2019 [Section
\n11: LPA: No.22 of 2008].<\/p>\n

To all intents and purposes, the \u2018Rules,\u2019 as contained in the \u2018Act\u2019 are intended; (i) \u2018To separate \u2018Nobility from Rascality: (ii) To guide the conduct of all Attorneys in the most professional practice: (iii) Ensuring Attorneys do not become \u2018Rascals;\u2019 and most importantly, (iv) To offer clients and\/or litigants legal protection from \u2018Abuse of Intellectual Fleecing.\u2019<\/p>\n

RAMPANCY OF RASCALITY
\nThe \u2018Rampancy of Rascality and \u2018Professional Misconduct\u2019 among a small minority of the
\nmembership of the \u2018Legal Profession,\u2019 have been of grave concern to a great many people
\nwithin the \u2018Organization of Eastern Caribbean States (OECS).<\/p>\n

Research has shown that the \u2018Four Most Prevalent Complaints\u2019 have been; (i) \u2018Attorneys receiving consultation fees, and not discharging obligations to \u2018Consulted Clients\/Litigants: (ii) Attorneys retained for trial\/hearing have not attended Court, neither with promptitude, nor punctuality; (iii) Attorneys seizing and withholding \u2018Litigious Files\u2019 for dissatisfied Clients\/Litigants; and (iv) Attorneys with increasing frequency were alleged to have fingered Client\u2019s money.\u2019 It has been the latter that has seen \u2018Attorneys in the Caribbean Community (CARICOM) jurisdictions of; (i) \u2018Barbados; and Jamaica\u2019 been frequently made amenable to law.<\/p>\n

CRIES OF CLIENTS\/LITIGANTS<\/p>\n

Though some \u2018Riff-Raffs\u2019 will have been disciplinarily sanctioned, fleecing was said to have
\ncontinued without abatement. Some have left many clients and litigants in \u2018Monetary
\nPurgatory.\u2019<\/p>\n

That which all a sundry shall know, is that the \u2019Legal Profession Act\u2019 [Antigua
\nand Barbuda], anticipates that \u2018Disciplinary Actions\u2019 shall be instituted against the
\nindiscipline.<\/p>\n

It shall be seen when Attorneys holding on to \u2018Clients\/Litigants Files or
\nDocuments,\u2019 they would have committed a \u2018Sanctionable Breach\u2019 of the very \u2018Rule\u2019 that
\ngoverns their \u2018Professional Conduct.\u2019<\/p>\n

A \u2018Magistrate\u2019 in mixed-up mood and attitude, could numerically increase the population at the penal institution. These have not only been the \u2018Cries of Clients\/Litigants.\u2019<\/p>\n

TENETS OF PROFESSIONALISM
\nSome \u2018OECS Bar Associations\u2019 may benefit from the \u2018Public Pronouncement\u2019 by the
\n\u2018General Legal Council (GLC) [Jamaica].\u2019 When the \u2018Disciplinary Findings\u2019 by that body
\nwas publicly pronounced and published at its website, it had conformed with the requirements of \u2018Jamaican Law.\u2019 This not only speaks to the \u2018Tenets of Professionalism,\u2019 but also to; (I) \u2018Due process of law; (ii) Public liability: (iii) Accountability; and (iv) Transparency.\u2019<\/p>\n

This appears to have starkly contrasted the apparent \u2018non-conformist behavior\u2019 of the \u2018Antigua and Barbuda Bar Association (ABBA).\u2019 Instructively, within the umbrella body is a structured administrative body called; (a) \u2018The Bar Council; and (b) A Disciplinary Committee\u2019<\/p>\n

[Section 3: Legal Profession Act: No. 22of 2008].<\/p>\n

DISCIPLINARY FINDINGS<\/p>\n

A particular \u2018Disciplinary Rule,\u2019 purposefully inserted in the \u2018Legal Profession Act,\u2019 and given
\nacute legislative consideration, appeared not to have been applied. Research has been
\nunsuccessful in showing that the \u2018Bar Council and Disciplinary Committee\u2019 has ever conform
\nto the \u2018Rule\u2019 on \u2018making public \u2018Disciplinary Findings.\u2019<\/p>\n

This shall not only be done as the \u2018Rule\u2019 dictates, but also as public interest demands. Such appeared to have been among the \u2018Considerations of Parliament.\u2019 Thus, a \u2018Bar Council President\u2019 that harbors a contrary view, may run the risk of the \u2018Chief Justice of the Eastern Caribbean Supreme Court (ECSC)\u2019 and the \u2018Attorney General\u2019 and general public saying;<\/p>\n

\u2018The President appeared not sufficiently informed or au fait with the \u2018Disciplinary Rules.\u2019<\/p>\n

INTEREST AND CURIOSITY<\/p>\n

Whatever the \u2018Disciplinary Findings\u2019 may be, the \u2018Rule\u2019 dictates that \u2018Public Pronouncements\u2019 \u2018shall be made after \u2018an application for disciplinary hearing\u2019 against a duly
\ncited, summoned and heard offending \u2018Attorney-at-law.\u2019 It is universally known that the public often have vested or keen interest in \u2018Attorney Misconduct,\u2019 whether or not alleged or
\nperceived.<\/p>\n

Therefore, in satisfying both \u2018Interest and Curiosity,\u2019 at the conclusion of the trial, the verdict of the jury- \u2018Convicted and Sentenced\u2019 or \u2018Acquitted and Discharged,\u2019 are made public. The Jurisdictions of \u2018Jamaica and Barbuda\u2019 make for; (a) \u2018Liability: (b)
\nTransparency: and (c) Accountability.\u2019<\/p>\n

BUCKLED AND DELIVERED<\/p>\n

Supporting reports of \u2018File Seizures,\u2019 apart from \u2018Clients\/Litigants, \u2018Chief Magistrate Joanne
\nWalsh,\u2019 may lend attestation.<\/p>\n

When a male Defendant appeared before the Court of; (a) \u2018Summary: (b) Civil; and (c) Criminal Jurisdictions,\u2019 he invited the \u2018Court\u2019s intervention in recovering \u2018Documents\u2019 said to have been withheld by a \u2018Money- Hawk.\u2019<\/p>\n

The accompanying presence of a \u2018Court Orderly\u2019 with the \u2018Defendant, saw the practicing attorney, \u2018Buckled and Delivered\u2019 the Documents. That which \u2018Attorneys-at-Law\u2019 continue to initiated for \u2018Clients\/Litigants,\u2019 the said \u2018Legal Profession Act\u2019 provides \u2018Litigious Recourse\u2019 to
\nthemselves.<\/p>\n

The \u2018Act\u2019 not only states that; \u2018An Attorney is entitled to practice law, but also
\nto sue and recover \u2018Fees\u2019 for services rendered\u2019 [Section 20: LPA: No. 22 of 2008].<\/p>\n

CREATIVELY ACQUISITIVE<\/p>\n

Even amidst non-refutable \u2018Street Whispers,\u2019 there have never been \u2018Public Pronouncements\u2019 that corrective measures have been taken for any alleged \u2018Professional Misconduct.\u2019<\/p>\n

In recent times, this is the small minority have given their \u2018Clients and Litigants,\u2019 reasons to believe they are as exploitive as they have been \u2018Creatively Acquisitive.\u2019 This minority group, has given the clearest indications that they are in it for \u2018Wealth Acquisition.\u2019 Many may not have been when Prime Minister Gaston Browne,\u2019 issued admonishment to his potentially \u2018Acquisitively Creative Ministers.\u2019<\/p>\n

They were advised that at all material times, they shall show legitimacy for
\nthat which they may acquire, while in public life.<\/p>\n

INTELLECTUAL SKULLDUGERY<\/p>\n

This was particularly highlighted to; (a) \u2018Bring public awareness; (b) Bring some measure of respite to victims of \u2018Intellectual Skullduggery: (c) Assist the \u2018Bar Council\u2019 to better
\n\u2018Manage\u2019 its organizational affairs; and for (d) The \u2018Association\u2019 to have greater \u2018Disciplinary
\nControl\u2019 of errant members.\u2019<\/p>\n

Additionally, given the apparent \u2018Gravity and Rampancy\u2019 among certain practitioners, this may now occupy the \u2018Investigative Attention\u2019 of the \u2018Appropriate Authority- Office of National Drug and Money Laundering Policy (ONDCP).<\/p>\n

PARASITIC TENDENCIES<\/p>\n

Few may deny that outside of \u2018Illiteracy and Stupidity,\u2019 few things are more expensive than
\n\u2018Education.\u2019 To the affluent or those with visible means and affordability, educational
\nopportunities are easily within their grasp.<\/p>\n

As a consequence, those with affordability are well- positioned to aspire and achieve. To the indigent, life has always been a battle. It has always been up-hill battle and financial struggle has been an unsurmountable challenge.<\/p>\n

When \u2018Survival Strategies\u2019 forced them into situations whereby they have made the conscious decision \u2018Necessity knows no law,\u2019 the law somehow, was always there to prove them wrong in both their thoughts and actions.<\/p>\n

PROTECTION AGAINST DECEPTION<\/p>\n

In the wider society, and as seen in two jurisdictions, \u2018Barbados and Jamaica,\u2019 law enforcers
\nwithin this jurisdiction need no reminder of the \u2018Law Enforcement Code of Ethics;\u2019 (a) \u2018My fundamental duty is to serve the community; (b) To protect the weak against oppression and intimidation; and most importantly, (c) Protecting the innocent and ignorant, against
\n\u2018Deception and Fraud\u2019 [LECE: October 1957].<\/p>\n

Consequent upon this \u2018Truth,\u2019 one may harbor little fear of contradiction, that most \u2018Bar Associations; Bar Councils and Presidents\u2019 within the \u2018Organization of Eastern Caribbean States (OECS),\u2019 fits the description ascribed to these Statutorily-established organizations, including the \u2018Disciplinary Committee of ABBA,\u2019 by \u2018Sir Gerald Owen Anderson Watt KCN, King\u2019s Counsel (KC).\u2019<\/p>\n

PUBLIC INFORMATION<\/p>\n

This \u2018Committee,\u2019 is not only guided by the \u2018Rules of Procedures,\u2019 but also shall conform to
\nthe \u2018Disciplinary Control Rules.\u2019 These impose a \u2018Legal Duty\u2019 on its membership to publish
\ntheir \u2018Findings\u2019 for \u2018Public Information.\u2019<\/p>\n

There were times when litigants, clients and general public quietly quizzed; (i) \u2018Why were there no action initiated against criminally- offending Attorneys? and (ii) \u2018Why criminal prosecutions\u2019 have not been instituted against \u2018Attorneys for \u2018Rascal Behavior\u2019 within \u2018Antigua and Barbuda\u2019 and other \u2018OECS Jurisdictions?\u2019<\/p>\n

The answer may very well lie in the description given by \u2018House Speaker and veteran Attorney-at- Law,\u2019 the feisty, indomitable and unconquerable and verbally ruthless, \u2018Sir Gerald.\u2019<\/p>\n

To all intents and purposes, having been publicly chided, he once described the \u2018ABBA\u2019 as a – Useless lot.\u2019<\/p>\n

FRAUDULENT CONDUCT<\/p>\n

Five days a week, practicing \u2018Attorneys-at-law,\u2019 are seen impeccably attired in \u2018White collars
\nand black gowns.\u2019 Among these \u2018Good and Noble Officers of the Court,\u2019 were said to be a
\nhandful of depraved ones. These, in their practice, are the unexpected, unsuspected and
\nundetected criminals.<\/p>\n

A small minority have been accused of \u2018Fleecing\u2019 unsuspecting and vulnerable persons.\u2019 Before clients and litigants could say; \u2018Jesus Wept,\u2019 many will have seen their finances being gobbled down, likened to a \u2018Turkey\u2019 gobbling down a wormy lunch. Then there are those appearing at the \u2018Magistrate\u2019s Courts,\u2019 clad in \u2018Jacket and Ties,\u2019 have also been accused of exhibiting \u2018Fraudulent Conduct\u2019 that speaks to depravity.<\/p>\n

PARASITIC TENDENCIES<\/p>\n

At the higher level of the \u2018Judiciary,\u2019 those dressed in \u2018White Collars and Black Gowns,\u2019 are
\nthe ones that stand before \u2018Judges and Juries.\u2019 These are the ones that often represent persons at the \u2018Bar.\u2019 These are the ones under \u2018Criminal Indictments.\u2019 Likened to those appearing before the \u2018Magistracy,\u2019 a few seemed to have developed a \u2018Private Practice,\u2019 that speaks to \u2018Deception and Fraud.\u2019 They are often accused of using their \u2018Intellectual Knowledge.\u2019<\/p>\n

The few have made it demonstrably clear, that their law practice, is to be guided by a \u2018Tendency,\u2019 seen only in \u2018Parasites.\u2019 Those familiar with the \u2018Legal Profession Act,\u2019 know that such practice neither enjoys \u2018Legality\u2019 nor \u2018Legitimacy.\u2019<\/p>\n

UNTOUCHABLE AND UNPROSECUTABLE<\/p>\n

Irrespective of \u2018Dress Code,\u2019 their conduct infrequently placed them in the category of \u2018White- Collar Criminals.\u2019 They were often being seen \u2018Untouchable and Unprosecutable.\u2019 Among the populace, this was more of \u2018an Observation than a Wish.\u2019 However, from professional knowledge, understanding and practical enforcement of \u2018Criminal Law,\u2019 these practitioners, in actuality, will have been living off the \u2018Proceeds of Crime\u2019 [POCA: No. 13 of 1993].<\/p>\n

Today, it has not necessarily been for the lack of concern for the plight of others.<\/p>\n

ACADEMIC EDUCATION<\/p>\n

None may deny how costly \u2018Illiteracy and Stupidity,\u2019 has been for the person of indigence.
\nSuch costliness has taken second place only to \u2018Education.\u2019 The point that has to be clearly
\nmade is that, those that have invested thousands of dollars in pursuit of \u2018Academic Education,\u2019 not only know the value of such investment, but shall also seek legitimate ways in earning a living.<\/p>\n

In many jurisdictions, including \u2018Antigua and Barbuda,\u2019 that which Clients\/Litigants
\nhad often been complained of, were \u2018Attorneys-at-law,\u2019 that rightly or wrongly, were
\nconsidered to have possessed \u2018Vulture-like instincts.\u2019<\/p>\n

These are the ones that were often accused of preying on the \u2018Innocence\u2019 of the semi-illiterate, unsuspecting and vulnerable.<\/p>\n

OVER- POPULATED LEGAL INDUSTRY<\/p>\n

Situationally, whether or not considered the desirable thing to do, some \u2018Attorneys\u2019 could adopt no undertaking in representing the indigent. For, in an almost over-populated \u2018Legal Industry,\u2019 with a fraternity of \u2018some 200 Attorneys-at-law,\u2019 \u2018Private Legal Practice\u2019 has entered a \u2018Dangerous Zone.\u2019<\/p>\n

A small minority was reported to have been \u2018Fleecing\u2019 the innocent and ignorant,\u2019 as if there will be no \u2018December.\u2019 Competition is tight, thus reducing a legal practice to \u2018Opportunism.\u2019 Not infrequently, this has been the among the causes of \u2018Human and Financial Miseries.\u2019<\/p>\n

MAN MUST LIVE<\/p>\n

While the \u2018Legal Profession Act\u2019 speaks to certain behavior as \u2018Professional Misconduct,\u2019 in
\nthe wider society, this has been criminally classified as \u2018Fraudulent Behavior.\u2019 Likened to
\nothers, many will have followed the social commentary of \u2018Alphonsus Cassell, \u2018Mighty Arrow\u2019 Man must Live\u2019 [1978: YouTube]. Still, \u2018Man shall not live by bread alone\u2019 [KJV: Matthew 4: 4].<\/p>\n

The Scripture commanded; \u2018Thou shalt not steal\u2019 [Exodus 20: 15]. Today, while the
\n\u2018Needy\u2019 that lives in \u2018Despairing Misery,\u2019 snatched a pittance to eat, is dispatched to the
\npenitentiary, the \u2018Greedy\u2019 that huffed \u2018Billions\u2019 from Banks, lives in \u2018Enviable Luxury.\u2019<\/p>\n

ISSUE OF FRAUD<\/p>\n

The issue of \u2018Fraud\u2019 has always been a statutorily-defined criminal offence. It has always been the function of \u2018Law Enforcement.\u2019 Legal practitioners, therefore, shall not only be mindful of conduct that may negatively impact \u2018Client\/Litigant Relations,\u2019 but they shall also know that likened to other jurisdictions, they are subject to the \u2018Rule of Law.\u2019<\/p>\n

While some behavior exhibited by some Attorneys-at-Law,\u2019 may border criminality, it was often best dealt with internally by a \u2018Disciplinary Committee.\u2019 The purposes contained in the \u2018Legal Profession Act,\u2019 shall be better understood from the contents that state; \u2018An Act to provide for; (i) \u2018The regulation of the Legal Profession; (ii) Qualification of Practitioners; (iii) Enrolment of Practitioners; (iv) Discipline of its members; and (v) For incidental and connected purposes\u2019 [Section 11: LPA: No. 22 of 2008].<\/p>\n

INTELLECTUAL SKILLS<\/p>\n

The \u2018Legal Practitioner\u2019 that may not even have been familiar with these, will have been among the few that, unsuspecting to Clients\/Litigants will have been accused of using \u2018Intellectual Skills,\u2019 thereby causing the innocent to act to their detriment.<\/p>\n

These have often sought to leave \u2018Clients or Litigants\u2019 with \u2018One Arm or One Leg.\u2019 Incidentally, these will have seen the profession mainly for its; (a) \u2018Commercialization; than of its; (b) Nobility; and (c) For \u2018Creative Acquisition\u2019 than \u2018Service to Humanity.\u2019<\/p>\n

In this jurisdiction, shall one speak to the issue of such \u2018Service,\u2019 then the names that memorably stands out, must be those in the persona of; (i) \u2018The) Ralph Francis\u2019 [Deceased: ANR: March 2, 2021]; and (ii) John Eli Fullers\u2019 [Deceased: ANR: September 28, 2022].<\/p>\n

SENSE OF SERVICE<\/p>\n

These were not only men of high repute, but also known for their honesty and integrity. These were practitioners of exemplary professional behavior. They were always willing and ready to assist the \u2018Undefended Indigent.\u2019 who They had clearly shown that they were endowed with \u2018Reason and Conscience.\u2019 These they had seemingly allowed to be their \u2018Guiding Principles.\u2019<\/p>\n

Today, their \u2018Legacy\u2019 lives on. Today, in many, as in this jurisdiction, that culture and \u2018Sense
\nof Service\u2019 have changed. Today, the yesteryear practitioners, are not only being remembered, but also being emulated. Shared information provided an understanding that there are several other practitioners of \u2018Noble Intent and Deed.\u2019<\/p>\n

PRO BONO SERVICES<\/p>\n

Those widely-known were identified as \u2018Attorneys\u2019 in the persona of the (i) \u2018Charlesworth
\nTabors; (ii) Kenny Kentish\u2019s;( iii) Wendell Robinsons: (iv) Andrew O\u2019Kolas; and (v) Lawrence Daniels.\u2019<\/p>\n

These shall not be viewed as overshadowing legal services rendered by
\nothers, not so identified. Conscious of the plight of some \u2018Defendants\/Litigants,\u2019 relying solely on \u2018Dock Briefs,\u2019 they have provided \u2018Pro Bono Services\u2019 to those viewed as not only living at the \u2018Edge of Poverty,\u2019 but also in complete financial misery. Lest it be misconstrued, \u2018Truth\u2019 be told, such has never been a dischargeable social responsibility of any \u2018Practicing Attorneys.\u2019<\/p>\n

A FEW SCALLYWAGS<\/p>\n

Dissatisfied with the \u2018Professional Conduct,\u2019 they have reportedly caused disciplinary actions
\nto be instituted against \u2018A Few Scallywags.\u2019 Those discretely disclosed and listed in this
\ncommentary, included (i) \u2018An Everette Christian; (ii) A Samuel Peters; and (iii) A Yanick
\nBeazer.\u2019 These became victims, when \u2018Trusted Attorneys,\u2019 reportedly employed \u2018Intellectual
\nStealthiness\u2019 and allegedly \u2018Fingered their Monies.\u2019<\/p>\n

On this particular issue, though a very small minority of attorneys may have been \u2018Secretly disciplined, there has been no public disclosure as the \u2018Legal Profession Act (LPA)\u2019 dictates [Section 11: No.22 of 2008]. That said, the \u2018Disciplinary Records\u2019 within this jurisdiction, shall reflect recent \u2018Harrowing Experiences\u2019 of \u2018Applicants.\u2019<\/p>\n

INTELLECTUAL RASCALITY<\/p>\n

Irrespective of him\/her that held\/holds the \u2018Bar Presidency,\u2019 rightly or wrongly, arrogantly or feisty, mincing not his words, \u2018Sir Gerald\u2019 had indirectly made the point of \u2018Presidential
\nImpotency.\u2019<\/p>\n

If it were not so, both \u2018Clients and Litigants\u2019 that have engaged the services of
\ncertain \u2018Legal Practitioners,\u2019 and by extension, the general public, will have heard of
\n\u2018Findings\u2019 of the \u2018Disciplinary Committee.\u2019<\/p>\n

They will have heard of sanctions justly and properly imposed upon those found guilty of professional impropriety or \u2018Intellectual Rascality.\u2019 The recently-elected \u2018President, Cherissa Roberts-Thomas,\u2019 shall not only be mindful of \u2018Sir Gerald\u2019s\u2019 uncomplimentary utterings, but shall also follow the dictates of the \u2018Rule\u2019 as contained in the \u2018Legal Profession Act\u2019 [Section 11: No 22 of 2008].<\/p>\n

COSTS AND FEES<\/p>\n

Consequent upon certain discussions, it appeared that very often \u2018suspicion or misunderstanding or miscommunication\u2019 has been among other reasons for \u2018Attorney\/Client\/Litigant\u2019 turpitude.<\/p>\n

Frequently, it seems that suspicious or inflated sums have triggered, either \u2018Necessary or
\nUnnecessary\u2019 queries and\/or arguments. With only \u2018Lopsided Knowledge\u2019 of the \u2018Legal
\nProfession Act,\u2019 as well as \u2018Perceived Suspect Legal Advice\u2019 tendered.<\/p>\n

Those so aggrieved
\nand so dissatisfied with the \u2018attitude, interest shown and performance\u2019 of the \u2018Attorney,\u2019 have seen many \u2018Clients\/Litigants\u2019 severing the \u2018Legal Services\u2019 offered and engaged. The \u2018Legal Profession Act\u2019 interprets \u2018Costs\u2019 as include; (a) \u2018Fees for any Legal Business\u2019 done by an Attorney-at-Law.\u2019<\/p>\n

SHUTTLING BETWEEN COURTS<\/p>\n

Conversely, it interprets \u2018Fees\u2019 as includes; (i) \u2018Remuneration: (ii) Charges; (ii)
\nDisbursements; and (ii) Expenses.\u2019 The latter appears to have been the source of
\n\u2018Clients\/Litigants Troubles and Financial Woes.\u2019 That which \u2018Clients\/ Litigants\u2019 shall be
\nsufficiently made to understand, is that the \u2018Cost for Consultation\u2019 (Talking), is not the same as \u2018Fees\u2019 for \u2018Court Appearances,\u2019 That which \u2018Attorneys-at-Law\u2019 shall be mindful of, is that when the name of a \u2018Defendant\/Plaintiff\u2019 is called, punctuality demands that they are present to identify themselves to the Court as their \u2018Legal Representatives.\u2019 Attorneys\u2019 \u2018Shuttling Between Courts\u2019 simply to \u2018Crave indulgence for Adjournments,\u2019 not only run the risk of being told of biting more than can be chewed,\u2019 but also likely to provoke and incur the \u2018Wrath of Clients\/Litigants.\u2019<\/p>\n

FATEFUL AND AGONIZING<\/p>\n

A \u2018Fateful and Agonizing\u2019 decision saw the \u201917- year prosecutorial tenure of Director of
\nPublic Prosecutions (DPP), Anthony Armstrong,\u2019 now hanging in the balance. The position
\nwas as prestigious, as it was enviable. There is testament that he has discharged his
\n\u2018Prosecutorial Duties\u2019 professionally and faithfully.<\/p>\n

In a hostile and vicious environment, it was the effective discharge of his \u2018Constitutional Duties\u2019 that saw attitudinal change in some members of the wider society. Even so, he remained undaunted and demonstrated a resolve that he was committed to discharge his prosecutorial duties, not only according to the dictates of the \u2018Rule of Law,\u2019 but also int public and national interests.<\/p>\n

SENSATIONALIZING ADVERSITY<\/p>\n

Some two weeks recently, State and national, regional and international media, have been fixated on \u2018Antigua and Barbuda Director of Public Prosecutions (DPP), Anthony Armstrong.\u2019
\nThis resulted, when unwittingly, he travelled to his native-Jamaica following, either a peculiar request or advice apparently void of wisdom [November 7, 2022].<\/p>\n

Undoubtedly, the \u2018Jamaican- born national\u2019 has now been the subject of criminal prosecutions. His life, legal career, prosecutorial practice and future, now hang in the balance. That which disturbingly and disappointingly followed, was the disingenuous way news reporters, casters and portals chose to \u2018Sensationalized his Adversity.\u2019<\/p>\n

DOUBLE JEOPARDY
\nThis was made worse with headlines that states; (a) \u2018Antigua DPP Charged with Fraud; and
\n(b) Antigua DPP Hit with Additional Fraud Charges\u2019 [Jamaica Gleaner: The Jamaica
\nGleaner: ABS Television\/Radio et al].<\/p>\n

In the instant case the unfortunate \u2018Anthony Armstrong\u2019 may have become a \u2018Victim of Double Jeopardy.\u2019 Consequential to \u2018an Adverse Decision\u2019 delivered against him, and the imposition of a Fine,\u2019 by a \u2018Disciplinary Tribunal,\u2019 should there be a criminal trial, he may very well be advised to \u2018Plea Autrefois Convict.\u2019<\/p>\n

It has been well established in law that an accused person shall not be tried and punished twice for the same offence.\u2019<\/p>\n

FAKE NEWS<\/p>\n

As the saga unfolded, some news portals, possibly deceived and\/or fed \u2018Fake News\u2019 have
\ndisseminated information that his \u2018Fate and Future\u2019 now lies in the hands of the St. Lucia-
\nbased Judicial and Legal Service Commission (JLSC)\u2019 [ANU: November 10, 2022].<\/p>\n

That which \u2018Cabinet Minister and Spokesperson\u2019 appeared not to have been apprised was that the embattled \u2018Anthony Armstrong\u2019 was said to be enjoying his \u2018Vacation\/Pre-Retirement Leave Entitlement\u2019 on his native \u2018Jamaica\u2019 [November 2022].<\/p>\n

Confidential sources have revealed that he is likely to demit office immediately thereafter. Incidentally, there was reported to have been a \u2018Pending Disciplinary Appellate Decision,\u2019 prior to the institution of criminal proceedings against him.<\/p>\n

DISCIPLINARY CONTROL BODY<\/p>\n

Whatever has been his \u2018Professional Transgressions,\u2019 the records of the \u2018Jamaica General
\nLegal Council (GLC),\u2019 shall show these were alleged to have been committed in a \u2018Private
\nLaw Practice\u2019 on his native \u2018Jamaica\u2019 almost two decades ago\u2019 [2003 -2004]. None has stated, and could not have stated as fact that his entanglement with the law, occurred since assuming the prosecutorial position within the jurisdiction of \u2018Antigua and Barbuda\u2019 jurisdiction.\u2019<\/p>\n

However, likened to a magician, exploiting the sleight of hands to affect the illusory senses,
\npulled a \u2018Trick from his sleeve,\u2019 criminal proceedings were initiated against the \u2018Chief Crown
\nProsecutor\u2019 for the twin-island sovereign nation of \u2018Antigua and Barbuda.\u2019<\/p>\n

PUBLIC PERCEPTION
\nSince he had not been cited for \u2018Professional Misconduct\u2019 during his \u2018Prosecutorial Tenure\u2019
\n[Antigua and Barbuda: October 17, 2005 \u2013 November 6, 2022], that which might militate
\ncontinuance in the position, may be that of \u2018Public Perception.\u2019 The professional practice and disciplinary control body,\u2019 is a \u2018Creature of Statute.\u2019<\/p>\n

Its powers are derived from the parliamentary enactment, cited as \u2018The Legal Profession Act\u2019 [Jamaica]. Consequent upon such enactment, not only have powers reside in \u2018the \u2018Disciplinary Committee,\u2019 of three upstanding members of the \u2018Legal Profession,\u2019 but the \u2018Enactment\u2019 also provides for the establishment of \u2018Disciplinary Tribunals\u2019 to hear and determine allegations of \u2018Professional Misconduct.\u2019<\/p>\n

PRESIDENTIAL DUTY<\/p>\n

As it has been the \u2018Duty\u2019 of other \u2018Bar Presidents,\u2019 the \u2018Disciplinary Rule,\u2019 as contained in the \u2018Legal Profession Act,\u2019 makes it sufficiently clear for the \u201820-year legal veteran President
\nCherissa Roberts-Thomas\u2019 (ABBA) to enforce the \u2018Rule\u2019 for making \u2018Public Pronouncements on Disciplinary Findings,\u2019 as the law so dictates. Given the authority-at-law, \u2018Disciplinary Findings,\u2019 however serious or grievous, such \u2018Findings\u2019 shall never be left to wild public speculations.<\/p>\n

If it should be considered a gentle reminder, the \u2018Rule\u2019 unambiguously
\nstates; (a) \u2018The Committee shall hear all Applications in camera; and (b) It shall pronounce
\nits findings in public\u2019 [Section 11: Legal Profession Act: No. 22 of 2008]. Such reflects a
\nconsistency with judicially-practiced \u2018in-camera criminal trials for Rape.\u2019<\/p>\n

CONCLUSION<\/p>\n

Logic, therefore, suggests that had there been \u2018Conformity\u2019 to existing and enforceable law,
\nmay not only have seen significant improvement in \u2018Professional Conduct,\u2019 but also less
\ndisciplinary hearings for serious breaches that constitute \u2018Professional Misconduct.\u2019<\/p>\n

Looked at unbiased, and objectively, every member of the \u2018Legal Fraternity\u2019 owes it to be so reminded of this particular \u2018Rule; \u2018The purposes of the \u2018Association\u2019 is to maintain and improve the standards of \u2018Professional Conduct in Antigua and Barbuda.\u2019 Since it would assist in reinforce \u2018\u2026Nobility in the Legal Profession,\u2019 and at the same time help in reducing
\n\u2018\u2026Rascality in the Professionals,\u2019 thereby strengthen waned or shattered public confidence,
\nClients and Litigants, and by extension, the citizenry so urged.<\/p>\n
