Judiciary: Corrupting The Morals Of Society<\/strong><\/p>

The \u2018Judiciary\u2019<\/strong> is not only one of the free institutions alluded to in the \u2018Five Founding Constitution Principles<\/strong>\u2019 of \u2018Antigua and Barbuda,\u2019<\/strong> but also one of the three arms of governance. Its mantra includes; (a) \u2018Being the \u2018Vanguard of the nation; (b) Looking<\/strong> closely at the behavior of the two other arms, the \u2018Executive and Legislature; (b) <\/strong>To see there is no behavior incompatible with, or subversive to democracy, or actions oppressive to the will and adverse to the happiness and prosperity of the people.\u2019 In its Civil and Criminal Jurisdictions,\u2019 to <\/strong>interpret duly enacted domestic Laws. Then in the administration of justice, ensure fair, unbiased and equitable dispensation of justice to all litigants, defendants and accused persons. These are not only the will of the electorate, but also reasonable expectations of the people. \u00a0Therefore, in its juridical role, there shall reflect; (i) \u2018Sound judicial judgment;<\/strong> (ii)<\/strong> Rationality; and (iii) Making informed ethical and moral judicial decisions.\u2019<\/strong><\/p>

\"\"<\/a><\/div>\n

PERSPECTIVE<\/strong><\/p>

\"\"<\/a><\/div>\n

This commentary looks specifically at the \u2018Orders of Her Ladyship, Madame Justice Marissa Robertson.\u2019 <\/strong>Such is contained in the \u2018Joint Civil Claim by \u2018openly homosexual male Orden David and Alexandrina Wong\u2019 [Paragraphs 14 & 20], <\/strong>instituted against the \u2018State and People\u2019<\/strong> through \u2018Attorney General, Steadroy \u2018Cutie\u2019 Benjamin\u2019 [Claim No: ANUHC V2021\/0042].<\/strong> Incidentally, the holder of the office of such office, is also the \u2018Principal Legal Adviser to the Government.\u2019 <\/strong>It also looks at the apparent conniving behavior of the State, in \u2018Conceding\u2019<\/strong> that the law infringes \u2018Buggery Rights\u2019 [Sexual offences Act: Sections 12 and 15: No. 9 of 1995].<\/strong> The \u2018Second Claimant Alexandrina Wong,<\/strong>\u2019 was also identified as \u2018Executive Director\u2019<\/strong> of the organization duly registered as \u2018Women Against Rape (WAR).\u2019 <\/strong><\/p>\n

ADVOCATES OF SEXUAL DEPRAVITY<\/strong><\/p>

\"\"<\/a><\/div>\n

Whatever may have been the motivating factor or incentivized or vested interests, to all intents and purposes, the organization duly registered as \u2018WAR,\u2019 <\/strong>may have done the most unthinkable. Given the citizen\u2019s responses on national television, those whose consciences have been outraged, have now seen this \u2018Organization\u2019 <\/strong>as one composed of \u2018Hypocrites.\u2019 <\/strong>They are now seen as \u2018Advocates of Sexual Depravity.\u2019 <\/strong>For on the right side of their mouths, some have claimed to be virtuous and against \u2018Rape,<\/strong>\u2019 yet on the left side of their mouths, they have embraced the prohibited abnormal sexual act of \u2018Buggery. <\/strong>This was made abundantly clear when this organization, through a co-founding member and \u2018Executive Director,\u2019 deposed before, and petitioned the \u2018Judiciary\u2019 that the \u2018Sexual Rights of Homosexuals\u2019<\/strong> had been infringed by existing statutory provisions.<\/p>\n

SEXUALLY ADVENTUROUS<\/strong><\/p>

\"\"<\/a><\/div>\n

It may have been clear in the minds of Parliamentarians, that husbands and wives might become \u2018Sexually Adventurous.\u2019<\/strong> Whether or not they may have been so disposed, it may have been their collective belief that other persons, male and female, having attained the \u2018consensual age of 16 years and over,\u2019<\/strong> may also become sexually perverse. It appears also that keen attention was paid to the law as then existed, and still exists before the institution of litigious proceedings against the Defendant, \u2018Attorney General.\u2019 <\/strong>In view of the anticipatory perverseness, they inserted a permissible provision in the \u2018Sexual Offences Act\u2019 [No. 9 of 1995].<\/strong><\/p>

\"\"<\/a><\/div>\n

MORAL DESTRUCTION<\/strong><\/p>\n

Some twenty-two days ago [July 5, 2022], and eleven days of a \u2018Judicial Ruling on Abortion\u2019 [US: June 24, 2022],<\/strong> this nation saw its Judiciary taking a most dangerous step. It slid down a slippery slope to \u2018Moral Destruction.\u2019 <\/strong>It became the first among the \u2018Organization of Eastern Caribbean States (OECS)<\/strong> to order \u2018State Legislators\u2019 to revisit the \u2018Sexual Offences Act.\u2019 <\/strong>This was either for the purposes of either; (i) \u2018Repealing Section 12; and (ii) Amending Section 15.\u2019 <\/strong>These Sections respectively refer to (a) \u2018Buggery; and (b) Serious Indecency.\u2019 <\/strong>The latter Section speaks generally to persons who commit an act capable of being cited for \u2018Serious Indecency, on or towards another person [Section 15 (1<\/strong>)]. Incidentally, without criminal sanctions, the law allows a provisional exception. Thus, such acts may be performed consensually by an adult male upon an adult female, and vice versa<\/strong>. These acts shall only be performed only in \u2018Private\u2019 [Section 15 (2)].\u00a0 <\/strong><\/p>\n

SERIOUS INDECENCY OVERLOOKED<\/strong><\/p>\n

The provision states; \u2018Subsection (1) does not apply to an act of \u2018Serious Indecency\u2019 committed in Private.\u2019 <\/strong>It excludes; (a) \u2018Husband and wife; and (b) Adult male and females.\u2019 <\/strong>This incidentally, may have been overlooked by the; (i) Attorney General: and Attorneys (ii) Dr. David Dorsett; and (iii) Carla brooks-Harris.\u2019 <\/strong>The \u2018Claimants; (i) \u2018Orden David; and (ii) Alexandrina Wong; and (iii) Attorneys Douglas Mendes SC: and (iv) Andrew O\u2019Kola\u2019 <\/strong>urged the Court to look at \u2018Same-Sex\u2019 per anum sexual acts.\u2019\u00a0 <\/strong>Instructively, the Court observed the provision that made exclusion for \u2018consensual privately performed acts of \u2018Serious Indecency\u2019 [Section 15 (2)].<\/strong><\/p>\n

LITIGIOUS SUGGESTION<\/strong><\/p>\n

Public perception may have been manipulated that citizen\u2019s may have believed that \u2018Buggery Rights\u2019 <\/strong>exist on \u2018Antigua and Barbuda.\u2019<\/strong> There may be no doubt of the inescapable gripping influence<\/strong> of the undaunted \u2018Prime Minister Gaston Browne.\u2019 <\/strong>A spell appeared to be all it takes. On the members of Cabinet, he appeared to have been endowed with the unique ability to make some members feel they are \u2018Goats,\u2019 while others feel like \u2018Sheep.\u2019 <\/strong>Thus, likened to \u2018former Prime Minister, Dr. Baldwin Spencer,\u2019 <\/strong>he apparently knows when to transform and separate them. Ironically, it was him that threw out the \u2018Litigious Suggestion\u2019<\/strong> to persons so affected that they may litigate against the \u2018State Law\u2019 [Video: Pointe FM-99.1: 2021].<\/strong> He was also quoted by a foreign news portal as \u2018supportive of the \u2018LGBTQ\u2019 [Loop: June 27, 2021].<\/strong><\/p>\n

AG CAUGHT IN MONKEY PANTS<\/strong><\/p>\n

By virtue of his constitutional positions, the \u2018Attorney General\u2019 <\/strong>within the Cabinet, has the dual role of; (i) \u2018Minister; and (ii) Legal Adviser.\u2019 <\/strong>The provision states; (a) \u2018There shall be an Attorney General of Antigua and Barbuds: and (b) He shall be the \u2018Principal Legal Adviser\u2019 to the Government\u2019 [CO: 1981: Section 82]. <\/strong>Logic therefore, dictates, that in the instant Case, it is the \u2019Attorney General\u2019<\/strong> with responsibility to advise the Government on \u2018Legal Matters.\u2019<\/strong> In the \u2018Claim against the office holder, \u2018Her Ladyship, Madame Justice Marissa Robertson\u2019<\/strong> was asked to look at the \u2018Buggery and Serious Indecency Sections,\u2019 <\/strong>as opposed to looking to see if the \u2018Sexual Offences Act\u2019 was <\/strong>inconsistent with the \u2018Supreme Law- the Constitution Order.\u2019<\/strong><\/p>\n

MORALLY UPSTANDING JUSTICES<\/strong><\/p>\n

Though obtained recently in another jurisdiction, one shall not fail to appreciate the courageous, ethical, and moral stance of the \u2018Supreme Court of the United States (SCOTUS).\u2019 <\/strong>One shall also not fail to recognize the tenacity and forthrightness of \u2018<\/strong>Justice Samuel Alito.\u2019 On a \u2018Writ of Certiorari\u2019<\/strong> to roll back \u2018Abortion Rights,\u2019 then conceptually and literally believed that such was entrenched in the \u2018United States Constitution Order,\u2019 five \u2018Morally-Upstanding Justices,\u2019<\/strong> believed it was against \u2018God and Morality\u2019<\/strong> to turn wombs into reservoirs and churn fetuses to flow as \u2018Streams of Blood.\u2019 <\/strong>The Justices, c<\/strong>learly did not wish their souls to be perished in purgatory, or to be seen as \u2018Sinning Against God\u2019 <\/strong>and to offend those that have, and continues to acknowledge \u2018GOD\u2019s Supremacy.\u2019<\/strong><\/p>\n

IN GOD WE TRUST<\/strong><\/p>\n

We truly and affirm our belief in the national motto; \u2018In God We Trust\u2019 [1956: Wikipedia]. <\/strong>We are \u2018Legal Luminaries.<\/strong>\u2019 We are appointed Justices to protect you from all forms of injustices, including discriminatory practices and acts of immorality. Still, we will not support or counsel the works of devils.\u2019 Though we are \u2018Social Animals,\u2019<\/strong> we are neither political prostitutes, nor hypocrites. On the issue of \u2018Abortion and Abortion Rights,\u2019<\/strong> this was what \u2018Justice Samuel Anthony Alito\u2019 <\/strong>wrote; \u2018The authority to regulate abortion is returned to the people and elected representatives\u2019 [USA: No. 19 -1392: Pp 8-79: June 26, 2022]. <\/strong>Then \u2018Chief Justice John G. Roberts Jr.\u2019<\/strong> and four other Justices, including \u2018Amy Coney Barrett\u2019 <\/strong>responded; \u2018\u2026We are associated with this opinion; \u2026We concur.\u2019<\/strong>\u00a0 These are the Justices that have made the historic decision for the majority of the \u2018332, 403, 650 people.\u2019<\/strong><\/p>\n

PRO-ABORTIONISTS<\/strong><\/p>\n

For the \u2018Pro-Abortionist,\u2019<\/strong> it may have been well reinforced in their minds having seen the litigious ruling in the Case of; \u2018Roe v Wade\u2019<\/strong> that was judicially sanctioned five decades ago\u2019 [410 US: 113: January 22, 1973].<\/strong> Unlike the \u2018overwhelming 7-2 majority in that<\/strong> Judicial Decision,\u2019<\/strong> modern-day morally and spiritually-thinking \u2018Justices\u2019 appeared guided by Christian upbringing and principles, and regard for the \u2018Rule of Law.\u2019<\/strong> Though lessened to a \u20185-4 majority, they have properly directed themselves in overturning that which had been long ingrained in the minds of many activists and \u2018Abortionists.\u2019 Likened to the Judges that made the earlier Ruling, that the \u2019United States Constitution Order\u2019 guarantees a \u2018Right to Abort\u2019<\/strong> the life of the \u2018Unborn\u2019 [NPR: June 24, 2022], this \u2018Justice Samuel Alito- authored Judicial Decision,\u2019<\/strong> says it was an illusion.<\/p>\n

WE CONCUR<\/strong><\/p>\n

With a lifetime achievement and longevity of tenure until death, the \u2019Justices\u2019<\/strong> on the \u2018Supreme Court of the United States (SCOTUS),\u2019 <\/strong>could afford to say; \u2018<\/strong>We are not politicians; We do not vie for elective office; We do not go into homes and communities soliciting or canvassing electoral votes; We do not go on political platform to preach the \u2018Gospel of Politics.\u2019<\/strong> In fact, we do not even go on Pulpits to preach the \u2018Gospel of Jesus Christ.\u2019<\/strong> We have studied and practiced law; We are not like the two other arms of governance; They are about the most dangerous institutions. We are not subordinate, nor subservient to them. We are not here to do the biddings of those in a \u2018Morally Bankrupt\u2019<\/strong> political system. Those on the other two other arms, do not always agree with our judicial decisions. Conversely, we also do not always agree with their administrative policies and legislative or despotic actions.<\/p>\n

ABOMINATION UNTO GOD<\/strong><\/p>\n

Instructively, the nation has a population of some \u201899, 594 people.\u2019<\/strong> The estimated community of \u2018Morally Upright People,\u2019<\/strong> was said to be \u2018well over 94%.\u2019\u00a0 <\/strong>The \u2018Civil Claim\u2019<\/strong> was brought by two people. Then \u2018One Judge\u2019<\/strong> foisted upon the \u2018Legislature\u2019<\/strong> and by extension, the populace an unpopular decision to accept a practice the \u2018Holy Scripture\u2019<\/strong> has declared \u2018an Abomination unto to God.\u2019 <\/strong>The Court identified a male as \u2018First Claimant\u2019 <\/strong>\u2018an openly homosexual male \u2018Orden David.\u2019<\/strong> The \u2018Second Claimant\u2019<\/strong> was only identified as a female \u2018Alexandrina Wong\u2019<\/strong> of the organization called \u2018Women Against Rape Incorporation (WARI).\u2019 <\/strong>\u00a0She was one of the co-founders of the organization called \u2018Women Against Rape Incorporation (WARI).\u2019 <\/strong><\/p>\n

DISCRIMINATORY AND UNCONSTITUTIONAL<\/strong><\/p>\n

Ironically, the other \u2018Co-founding members have been (i) \u2018Member of Parliament Samantha Marshall; (ii) \u2026Senator Gail Christian: and (iii) former School Principal Monica Isaac,\u2019 <\/strong>These women, devoted themselves and bravely took on the challenge of fighting \u2018War Against Rape\u2019 <\/strong>of women and girls. They were particularly concerned with the frequent reports of sexual assaults perpetrated against the vulnerable females in the lower strata of society. Opportunistically, well-positioned as \u2018Executive Director\u2019 <\/strong>of the organization, the Executive Director,\u2019<\/strong> appeared surreptitiously seizing the opportunity in going forward with a homosexual male to petition the Court. Both litigants have asked the Court to review the prohibitive law of \u2018Buggery,\u2019<\/strong> and hold it \u2018Discriminatory and Unconstitutional.\u2019<\/strong><\/p>\n

MEN OF CLOTH<\/strong><\/p>\n

The \u2018State\u2019<\/strong> not only appeared to have failed itself miserably, but also the majority of the citizens not disposed to be engaged in certain abnormal sexual behaviors. It has always been that \u2018Men of Cloth\u2019<\/strong> shall not have one foot on the road to \u2018Heaven\u2019<\/strong> and one foot on the road to \u2018Hell.\u2019<\/strong> They could never arrive at both places at the same time. Still, in the secular world, those that cannot be used \u2018politically\u2019 to take the message to the electorate, then other uses shall be made of them. The Scripture may have been contradicted, when \u2018Church Pastor\u2019<\/strong> deviated from the \u2018Straight and Narrow way. He may have abandoned his \u2018Theological Calling,\u2019<\/strong> and may have been under illusion that his \u2018Law Firm of Associates\u2019<\/strong> had been solely retained for the purposes of representing the personal interests of the \u2018Attorney General.\u2019<\/strong><\/p>\n

SPIRITUALLY TREACHEROUS<\/strong><\/p>\n

In the capacity of a practicing attorney for the Government, \u2018Dr. David Dorsett\u2019<\/strong> may have been professionally reckless and \u2018Spiritually Treacherous.\u2019<\/strong> In such capacity, he shall have known that he would have been advocating more for the devil than the \u2018Government.\u2019 <\/strong>This came when he undertook the job of \u2018Conceding to the Court\u2019<\/strong> that \u2018Sections 12 and 15\u2019<\/strong> of the \u2018Sexual Offences Act,\u2019<\/strong> infringed the \u2018Evolutionary Rights\u2019<\/strong> of \u2018Homosexual Claimant Orden David\u2019 and Women Against Rape\u2019 Executive Director, \u2018Alexandrina Wong\u2019 [Paragraph 87].<\/strong> He appeared, not only to have compromised the \u2018Word of God,\u2019 <\/strong>but also runs the risk of sacrificing his \u2018Soul and Salvation\u2019 <\/strong>to the devil. All have not only \u2018Sinned\u2019<\/strong> and come short of the \u2018Glory of God,\u2019<\/strong> but have also become \u2018Fugitives from God.\u2019 <\/strong><\/p>\n

COMICAL CONCESSION<\/strong><\/p>\n

Such sexual act, whether or not by consenting adults, it was never considered a \u2018Right\u2019<\/strong> of any male or female citizen to be so engaged. In as much as \u2018Church of God of Prophecy (COGOP) Pastor Dr. David Dorsett,\u2019<\/strong> Attorney for the \u2018State,\u2019 contended that \u2018fundamental rights<\/strong> do evolve,\u2019 no abnormal sexual acts have never been the \u2018Scriptural and Theological Teachings\u2019 <\/strong>to any \u2018Church Pastor or Congregant<\/strong>.\u2019 It appeared more of a \u2018Comical Concession,\u2019<\/strong> when the \u2018State Attorney,<\/strong> Pastor Dr. David Dorsett and Carla Brooks-Harris\u2019 \u2018CONCEDED\u2019<\/strong> that \u2018Sections 12 and 15\u2019<\/strong> infringed the \u2018Buggery Rights\u2019<\/strong> of the Claimants \u2018Orden David and Alexandrina Wong\u2019 [Paragraph 87: ANUHCV2021\/0042].<\/strong> Moreover, \u2018Ministers of Religion\u2019<\/strong> shall not seek \u2018Vain Glory,<\/strong>\u2019 by kneeling in prayer to \u2018God\u2019 <\/strong>at night, and walk with the \u2018Devil\u2019<\/strong> in the \u2018Day.\u2019 <\/strong>\u00a0\u00a0<\/strong><\/p>\n

COST TO CLAIMANTS<\/strong><\/p>\n

Then adding insult to injury, \u2018Her Ladyship, Madame Justice Marissa Robertson,<\/strong>\u2019 ordered; \u2018It is ordered that the Defendant shall pay the Costs of the Claimants in an amount to be assessed, if not agreed within 21 days\u2019 [Paragraph 89]. <\/strong>As it relates to \u2018Sodomy\u2019<\/strong> and other sexual acts considered \u2018Serious Indecency\u2019<\/strong> on men and women, the \u2018Judiciary\u2019<\/strong> following a foreign cultural practice that these are entrenched rights in the \u2018Constitution Order of Antigua and Barbuda.\u2019<\/strong> It appears it wants to transform the nation into the ancient cities of \u2018Sodom and Gomorrah\u2019 [KJV: Genesis 19: 1-29].<\/strong> Consequent upon a recent \u2018Order\u2019 by \u2018Her Ladyship, Madame Justice Marissa Robertson,\u2019<\/strong> there may have been a mischaracterization and an unfounded belief that the \u2018Constitution Order\u2019<\/strong> guarantees \u2018Consensual homosexual conduct\u2019<\/strong> to heterosexual male and female and \u2018Same-sex males\u2019. <\/strong><\/p>\n

OPPOSITION TO CONCESSION<\/strong><\/p>\n

The Cabinet Members said to have expressed strong \u2018Opposition to the Concession\u2019<\/strong> for the \u2018Claimants Orden David and Alexandrina Wong\u2019<\/strong> to have \u2018Buggery Rights,\u2019 <\/strong>reportedly numbered less than the fingers on one hand. For the annals of history and posterity,<\/strong> those so identified were; (i) \u2018Sir Molwyn Joseph: (ii) E. Paul \u2018Chet\u2019 Greene; and (iii) Dean Jonas.\u2019 <\/strong>Fortified in \u2018Christianity and their religious beliefs,\u2019<\/strong> they are edified and guided by Scriptural teaching that states; \u2018When a man has sexual intercourse with another man, as with a woman, both men are doing something disgusting, and must be put to death\u2019 [God\u2019s Word: 1996 Edn: Leviticus 20: 13]. <\/strong>These members may not necessarily need \u2018Spiritual Advice\u2019 or be called upon to \u2018Repent.\u2019<\/strong> Though not necessarily \u2018Paragons of Virtue,\u2019 <\/strong>these three members still live by a \u2018platform of morals and religious principles.\u2019<\/strong><\/p>\n

SPIRITUAL ADVICE <\/strong><\/p>\n

The \u2018Orders\u2019 so made, have the potential to undermine confidence in the \u2018Judiciary. <\/strong>Not mounting a legal fight, the Court has ordered \u2018Legal Costs\u2019<\/strong> against the \u2018State and People.\u2019<\/strong> A mere \u2018Concession\u2019<\/strong> has come at the expense of the people, who have become unnecessarily indebted to the \u2018Law Firm Watt and Associates\u2019 for \u2018Legal Services\u2019 <\/strong>rendered and \u2018Legal Costs\u2019 to the Claimants for the \u2018Concession.\u2019 Now \u2018Members of Cabinet\u2019<\/strong> were reported to be seeking \u2018Spiritual Advice\u2019 [ABN: July 14, 2022]. <\/strong>These members shall have sought such \u2018Guidance from God\u2019<\/strong> through \u2018Church Pastor Dr. David Dorsett.\u2019 <\/strong>Instead, he was made to be seen as having \u2018No Spiritual Authority\u2019 as well as no \u2018Ethical Scruples\u2019 or Moral Integrity,\u2019 [Soca Artist: Wanski: 2009].<\/strong><\/p>\n

SECRET WHISPERS<\/strong><\/p>\n

What appeared unthinkable, was that in \u2018Her Ladyship\u2019s\u2019<\/strong> interpretation of \u2018Fundamental Rights of the Individuals\u2019<\/strong> as entrenched in the \u2018Constitution Order, she may also have harbored beliefs different to that of the populace.\u2019<\/strong> These came when \u2018Her Ladyship\u2019<\/strong> wrote; \u2018Specifically, Section 15 excludes from the offence consenting heterosexual adult couples and specifically targets same-sex adults.<\/strong>\u2019 Even when homosexual conduct was not rooted in the history and tradition of the nation. Even so, no inferences, however reasonable or unreasonable, shall be drawn on any member on the \u2018Judiciary.\u2019 <\/strong>It shall be known to the \u2018Judiciary,\u2019 that the \u2018Orders\u2019<\/strong> had provoked \u2018Secret Whispers,\u2019<\/strong> when it was further written; \u2018It is ordered that Subsection 15 (2) (b) <\/strong>of the Act be read as if the words \u2018a male person and a female person\u2019<\/strong> were deleted and replaced with the word \u2018Persons\u2019<\/strong> [Paragraph 82]. This allows for the \u2018Sexual Minority\u2019<\/strong> to have as many encounters.<\/p>\n

COURT ORDERS<\/strong><\/p>\n

Before the \u2018Court\u2019s Orders,\u2019<\/strong> the people of \u2018Antigua and Barbuda\u2019<\/strong> not only acknowledged \u2018God\u2019 as a \u2018Supreme Being,\u2019<\/strong> the people also recognize that the law symbolizes the public conscience, and that the \u2018State\u2019<\/strong> is subject to the law. It shall not be perceived as \u2018Corrupting the Morals of Society.\u2019<\/strong> Unlike the \u2018Frenchmen; Europeans; Canadians; and Americans,\u2019<\/strong> we are not yet \u2018Twenty Million Antiguans and Barbudans.\u2019 <\/strong>But we are still a nation with morals, values, pride and dignity. \u00a0GOD SAVE THE NATION<\/p>\n
