It has been widely preached and accepted by the nation and society that, \u2018Man shall not commit buggery on same, or members of opposite sex.\u2019 <\/strong>That has been heard by the \u2018Voice of the People.\u2019 Such Voice <\/strong>is that of \u2018God\u2019 (Vox Populi Vox Dei).\u2019 Through \u2018God\u2019s\u2019 inspiration, the people\u2019s <\/strong>Voices were heard throughout the nation and in the Diaspora [ABS TV:<\/strong> July 6, 2022]. <\/strong>This was when the \u2018Judiciary\u2019 appeared to have been called upon<\/strong> to destroy the Christian-dominated society. Making it legal for the abnormal sexual acts of \u2018Buggery and Indecency,\u2019 to be free of prosecutorial consequences, plane loads of visitors began to touch down at \u2018VC Bird International Airport (VCBIA)\u2019 [ANR: July, 12, 2022]. <\/strong><\/p>

BONDS OF FRIEENDSHIP<\/strong><\/p>

Today, the way has been paved a \u2018Men\u2019 that feel \u2018Gay\u2019<\/strong> to form \u2018Bonds of Friendship,\u2019 then go in private; have fun all day, then sing, \u2018Oh Happy Day\u2019 [Philip Doddridge: 1755]. Yester-year, <\/strong>the \u2018Shadow of Darkness\u2019 <\/strong>almost obscured the sun from shining down on the twin-island nation of \u2018Antigua and Barbuda.\u2019<\/strong> The citizenry, bereaved by the passing of these two \u2018National Heroes,\u2019 <\/strong>had been plunged into mourning. Today,<\/strong> the nation groans, as \u2018Sir Vere Cornwall Bird\u2019 and Sir George Hubert Walter\u2019<\/strong> turn in their graves at the \u2018National Heroes Park.\u2019 <\/strong>These men, the only males in that park has no time to discuss sex. They may have had enough of that. But they have been deeply disturbed, not with the \u2018Dissenting Row\u2019<\/strong> between the \u2018Commonwealth of Dominica\u2019 <\/strong>and its \u2018Apex\u2019 Caribbean Court of Justice\u2019 (CCJ)\u2019 [ANR: July 11, 2022],<\/strong> but by that which transpired within this nation\u2019s Judiciary.\u2019<\/strong><\/p>\n

PERSPECTIVE<\/strong><\/p>

\"\"<\/a><\/div>\n

This commentary is comprehensive. It seeks not to; (a)<\/strong> \u2018\u2026Criticize or condemn; (b)<\/strong> \u2026Reproach or recrimination; nor in any way, offering suggestions; nor to (c)<\/strong> \u2026Influence discriminatory practices against persons grouped as \u2018Sexual Minorities.<\/strong> It primarily looks at the \u2018State\u2019s\u2019 apparent unwholesome behavior,\u2019 by its use of the \u2018Clergy and Judiciary\u2019<\/strong> for \u2018Non-Divine Purposes.\u2019 <\/strong>Some came with stripes like uncaged tigers; Some with spots like leopards; Some as hungry lions. Those came as preachers in collars and robes; Some as lawyers in gowns, often showed a \u2018Love of Money.\u2019 <\/strong>These are the ones that often seen as wolves hiding in sheep clothing. They are ready to devour.<\/p>\n

SECULAR SHOCK AND AWE<\/strong><\/p>

\"\"<\/a><\/div>\n

Given recent developments within the \u2018Judiciary,\u2019<\/strong> the nation with a population of some \u2018100, 000\u2019<\/strong> people of various religious denominations, was plunged into \u2018Secular Shock and Awe.\u2019<\/strong> The overwhelming majority of the population who acknowledge \u2018God\u2019<\/strong> as the \u2018Supreme Being,\u2019 <\/strong>publicly took umbrage with a rather unpopular \u2018Judicial Decision.\u2019 <\/strong>According to the \u2018Judicial Decision,\u2019 a homosexual male \u2018Orden David\u2019<\/strong> and Executive Director of the organization \u2018Women Against Rape Incorporated (WARI)-Alexander Wong,\u2019 laid that their homosexual rights <\/strong>have been infringed by the \u2018Law\u2019 [ANUHCV2021\/0042].<\/strong><\/p>

\"\"<\/a><\/div>\n

SCRIPTURAL TEACHING<\/strong><\/p>\n

It has never been for the want of \u2018Scriptural Teaching.\u2019<\/strong>\u00a0 \u2018Men on the Pulpit\u2019 continue <\/strong>to caution; \u2018Whosoever lieth with a man as he would with a woman, or whichever woman allowed a man sexual pleasure not intended by \u2018God,\u2019 such in the Scriptures is considered \u2018an Abomination unto God\u2019 [Leviticus 22: 13]. <\/strong>\u00a0That would have been \u2018Yesterday and such could fitting be applied to those referred in the \u2018Jamaican Gospel – One Day Christians\u2019 [1989: Lloyd Lovindeer: YouTube]. <\/strong><\/p>\n

CONSTITUTIONAL PRINCIPLE<\/strong><\/p>\n

The \u2018Judiciary\u2019<\/strong> appeared to have ignored the very \u2018Founding Constitutional Principle\u2019 <\/strong>that states; \u2018Whereas the \u2018People of Antigua and Barbuda\u2019 proclaim that they are a Sovereign nation founded upon the principle that acknowledge the \u2018Supremacy of God\u2019 [CO: 1981: Principle: \u2018A\u2019].\u00a0 <\/strong>Given man\u2019s desire for sexual gratification, man was known to have embarked upon certain \u2018Adventurism.\u2019 <\/strong>Frequently man has been seen to have done the unthinkable. There has been no fear of consequences. Modern civilization has dictated punishment for \u2018Abnormal Sexual Activities\u2019 be limited to \u2018Custodial Sentences.\u2019 <\/strong><\/p>\n

LAW- DEFINED<\/strong><\/p>\n

Prominent British jurist \u2018Sir William Blackstone\u2019<\/strong> defines \u2018Law\u2019<\/strong> as; \u2018A rule of conduct, prescribed by a Superior (Parliament) by which an \u2018Inferior (People) is bound to obey\u2019<\/strong> [July 10, 1723-February 14, 1780]. The Judiciary does not make law. However, \u2018Interpretations and Practice Directions\u2019<\/strong> are said to have the force of law. State, but more so, people may face peril of \u2018Judicial Sanctions\u2019<\/strong> for non-compliance. Unlike the \u2018Magistracy,\u2019 the Superior Courts; (i) \u2018First Instance (High Court) t: (ii) Intermediate (Eastern Caribbean Supreme Court (ECSC); and (iii) Apex Court (Privy Council,\u2019 <\/strong>may cite and commit to prison the disobedient for \u2018Contempt of Court.\u2019 <\/strong>Given this definition, likened to the citizenry, including the \u2018Sexual Minorities,\u2019 the \u2018State is also subject to the law\u2019 [CO: 1981: Principle: \u2018D\u2019].<\/strong><\/p>\n

MISCHIEF AIMED BY PARLIAMENT<\/strong><\/p>\n

The law by, and in itself, cannot be accused of infringing or intruding upon the \u2018Fundamental Rights and Freedoms of the Individual.\u2019 <\/strong>Neither shall Courts call upon the State justify an enactment, when the \u2018Mischief Aimed by Parliament\u2019 <\/strong>shall be \u2018Judicially Noticeable\u2019 by \u2018State-sanctioned appointment of competent Judicial officers.\u2019 <\/strong>From professional training, knowledge and practical experience, though a \u2018Law\u2019<\/strong> exists, and creates various criminal offences, such \u2018Law\u2019<\/strong> is harmless to the citizenry until enforced. Such enforcement is guided by; (a) \u2018\u2026On view by an officer: or (b) \u2026Duly afforded reasonable grounds for suspicion: or (c) \u2026On charge of a third person. This charge shall be well founded.\u2019 <\/strong>From the \u2018Judgement,<\/strong>\u2019 the Claimants appeared not to have deposed that there had been some infringements, either by the \u2018Defendant or Agencies or Agents of the State.\u2019<\/strong><\/p>\n

SPOUSE \u2013 BUGGERY – INDECENCY<\/strong><\/p>\n

It has been in the individual depositions of \u2018Orden David and Alexandrina Wong\u2019<\/strong>, that \u2018Adult Men and Women\u2019<\/strong> shall have, and reserve the right to engage in \u2018Buggery,\u2019 <\/strong>without criminal sanctions\u2019 [Paragraphs 14, 19, 22 & 23]. <\/strong>Many may recall the controversy surrounding the legislative attempt to give a \u2018Fictional Definition of Spouse,\u2019<\/strong> Though not necessarily the perceived intention for giving it legal effect, public outrage, uproar and disquiet, forced Members of Parliament to abort that which then appeared to have been misconstrued as the primary purpose. The enactment was for the defined purpose of preventing concealment of \u2018Criminal Proceeds.\u2019 <\/strong>Talk radio programme hosts referred to it as \u201918: 6.\u2019 <\/strong>Today, \u201812: 15\u2019 are \u2018Buggery and Indecency\u2019 [SOA: No.9 of 1995].<\/strong><\/p>\n

BUGGERY\/INDECENCY RIGHTS<\/strong><\/p>\n

The Judgement discloses that the \u2019Claimant\u2019 works with populations identified by the \u2018International Health Organization<\/strong> and the Ministry of Health\u2019 on the most vulnerable to \u2018HIV\/AIDS\u2019 [Overview: Paragraph 5]<\/strong>. The \u2019Second Claimant\u2019<\/strong> was identified as the co-founder and Executive Director of an incorporated organization nationally known as \u2018Women Against Rape (WAR).\u2019 <\/strong>Though not referred in the \u2018Judgment,\u2019<\/strong> the other co-founding member has been then practicing attorney \u2018Samantha Marshall.\u2019\u00a0 C<\/strong>urrently a serving \u2018Member of Parliament, <\/strong>she is also a member of the sitting Government. It may have boggled the mind if she lacked organizational knowledge that the \u2018Executive Director<\/strong>\u2019 had filed a \u2018Buggery and Indecency Rights Claim\u2019<\/strong> against: (a) \u2018Her Government: (b) Attorney General; and (c) \u2026Her Parliamentary and Cabinet colleagues.\u2019 <\/strong><\/p>\n

INTIMATE CHOICE<\/strong><\/p>\n

In the \u2018Judgement\u2019 High Court Judge, \u2018Her Ladyship, Madame Justice Marissa Robertson\u2019<\/strong> revealed her findings. The findings speak to, inter alia, the \u2018Selection of an Intimate Partner,<\/strong>\u2019 in the \u2018Introduction and Findings,\u2019<\/strong> she considers it; \u2018An Intimate Choice\u2019 <\/strong>Secularly, when he took instructions to represent \u2018Attorney General Steadroy \u2018Cutie\u2019 Benjamin\u2019<\/strong> in litigious proceedings, he may have sold his own Soul. Subdued by demons and induced into partaking of the \u2018Tree of Knowledge and Evil,<\/strong>\u2019 he had allowed \u2018Satan\u2019<\/strong> to lead him away from \u2018God\u2019s Pulpit\u2019<\/strong> into \u2018Pit,\u2019 <\/strong>not too far from the devil and not too far from fire and brimstone.\u2019 <\/strong><\/p>\n

ABSTINENCE \u2013 PREVENTION -DETERRENCE<\/strong><\/p>\n

The \u2018State\u2019s Parliament\u2019<\/strong> duly considered certain prescriptive measures to control \u2018Eroticism\u2019<\/strong> as it affects abnormal sex. Purposefully aimed at \u2018abstinence; prevention; and Deterrence,\u2019<\/strong> but specifically intended to inculcate a deepened \u2018Sense of Morality.\u2019<\/strong> The \u2018State\u2019s Parliament\u2019<\/strong> duly considered certain prescriptive measures to control \u2018Eroticism\u2019<\/strong> as it affects abnormal sex. The law, purposefully aimed at \u2018Abstinence; Prevention; and Deterrence,\u2019<\/strong> and specifically intended to inculcate a deepened \u2018Sense of Morality,\u2019 <\/strong>has been un-challengeably struck down.<\/p>\n

MEASURED RESPONSE<\/strong><\/p>\n

Man, woman and child, they have seen the gate into immorality opened to all sexually-oriented persons for \u2018Same-Sex\u2019<\/strong> cohabitation and gratification. Most vocal has been \u2018Religious Leadership and affiliate bodies. But standing firmly on \u2018Scriptural and Christian Principles,\u2019<\/strong> has been \u2018Church Leader, Pastor and Educator Dr. Hensworth Jonas.<\/strong>\u2019 He provided a \u2018Measured Response.\u2019 Articulating his personal and congregational thoughts, he was video-captured. Adamant that the \u2018Judicial Decision\u2019<\/strong> outraged the public conscience and offended \u2018Public Morality,\u2019<\/strong> passionately, he said; \u2018No one Judge should decide for the nation, and the Government should appeal the decision\u2019<\/strong> [Observer: July 8, 2022]. The conscientious-objector shall know that the \u2018Attorney General\u2019 never countered the Claim made by the Claimants.<\/p>\n

DENOMINATIONAL STATISTICAL DATA<\/strong><\/p>\n

Looking at the \u2018Christian-Dominated society (CDS),\u2019 Religious Leader, Dr. Hensworth <\/strong>Jonas\u2019 clearly has good reasons for his reaction. Research has revealed \u2018Denominational Statistical Data\u2019 <\/strong>of the societal make-up of the Churches within the nation. Among the populace, it has been referred to as the \u2018Christian Society.\u2019 The data consists of: (i)<\/strong> \u2018Anglican-17.6%: (ii)<\/strong> Seventh Day Adventist-12.4; (iii<\/strong>) Pentecostal 12.2%: (iv)<\/strong> Moravian-8.3%: (v) Methodist-5.6%; (vi)<\/strong> Wesleyan Holiness-4.5% (vii) Church of Gog of Prophecy 4.1%: (viii)<\/strong> Baptist 3.6%;<\/strong> (ix)<\/strong> Roman Catholic 3.2%; (x) Other- 12.2%; (x)<\/strong> Unspecified-5.5%; and None-5.9%<\/strong>\u2019 [2011 Est Source: Index Mundi]. Given these Data, it can be inferred that the \u2018Sexual Minority\u2019 with no affiliation to any of these Denomination might be among the \u20185.9 Percentage.\u2019<\/strong><\/p>\n

FIERY BAPTISM<\/strong><\/p>\n

From a pastoral perspective, \u2018Religious Leader, Assistant Church Pastor, Dr. David Dorsett,\u2019<\/strong> may have secularly offended \u2018God.\u2019 <\/strong>He may also have unwittingly and blasphemously positioned himself for a \u2018Fiery Baptism.\u2019 <\/strong>Among the citizenry, he will have caused outraged to the \u2018Moral Conscience\u2019 <\/strong>of the \u2018Christian Community.\u2019<\/strong> Such outrage may also have been provoked among, members of the wider society. In his \u2018Pastoral Capacity,\u2019<\/strong> he shall have known that the \u2018Sexual Rights\u2019<\/strong> claimed by the litigants were not in comport with the Scriptures he preached.\u2019 Seemingly faced with \u2018Moral Turpitude\u2019 <\/strong>and starved of wisdom and cornered by \u2018Reason and Conscience.\u2019 <\/strong>Congregants have not only been spiritually edified, revived, uplifted and filled.<\/p>\n

HEAVENLY KINGDOM<\/strong><\/p>\n

Saving his Soul from purgatory, this may have easily presented by his assistant \u2018Carla Harris-Brooks-Harris\u2019<\/strong> have done. This attorney clearly has no desire to spend eternity, anywhere else, but in \u2018Heavenly Kingdom.\u2019<\/strong> No one enters that \u2018Kingdom\u2019<\/strong> with impurities. Though he had been \u2018Divinely Called\u2019 <\/strong>to \u2018God\u2019s Sanctuary and Pulpit.<\/strong>\u00a0 A spiritually-acclaimed Leader and \u2018Assistant Pastor<\/strong> of the Church of God of Prophecy (COGOP), Dr. David Dorsett,\u2019<\/strong> in the \u2018World of Secularity,\u2019<\/strong> he is also a \u2018Prominent Practicing<\/strong> Attorney\u2019 <\/strong>within the nation\u2019s Judiciary.\u2019 In his three-points \u2018Sunday Sermons,\u2019<\/strong> he has always provided through the \u2018Word of the Living God,\u2019<\/strong> spiritual enlightenment to \u2018Souls Sick with Sin.\u2019<\/strong><\/p>\n

REASONABLENESS AND JUSTIFICATION<\/strong><\/p>\n

The \u2018Founding Constitution Principle\u2019<\/strong> has also alluded to the behavior of the State. It states; \u2018The State is subject to the law.\u2019 [CO: 1981: Principle: \u2018D\u2019].<\/strong>\u00a0 Litigants shall know that constitutional rights come with duties and responsibilities. The citizenry shall also know that constitutionally entrenched rights, are subject to \u2018Statutory Limitations.<\/strong>\u2019 In clear and precise language, the \u2018Constitution\u2019<\/strong> states; \u2018…Nothing contained in, or done under the \u2018Authority of any Law\u2019 shall be held to be inconsistent with the constitutional provisions. The Constitution expects that those enforcing law in the interest of the public and protection of society, shall act with \u2018Reasonableness and Justification.\u2019<\/strong> While the \u2018Law\u2019<\/strong> is neither a person, agent, nor agency of the State,\u2019 logic dictates that no citizen can be offended by a law not enforced by \u2018State agencies or agents.\u2019<\/strong><\/p>\n

ACTUAL INFRINGEMENTS<\/strong><\/p>\n

The \u2018Judgment\u2019<\/strong> refers to \u2018Sections; 3, 5. 7. 12, 14, 15 and 18\u2019<\/strong> of certain \u2018Constitutionally Entrenched Rights\u2019 [Chapter II]. <\/strong>It also cites the \u2018Criminalize Offences; \u201912 and 15\u2019<\/strong> [Sexual Offences Act: No. 9 of 1995].\u2019 These speak to \u2018Buggery and Serious Indecency.\u2019<\/strong> The Court appeared to have concentrated only on the law as opposed to seeking to ascertain if the Claimants had experience \u2018Actual Infringements\u2019 <\/strong>by agencies or agents of the \u2018State.\u2019<\/strong> For an understanding of these offences, the \u2018Statute\u2019<\/strong> interprets the former as; (a) \u2018Sexual intercourse per anum by a male person with a male person or by a male person with a female person.\u2019<\/strong> Instructively, the \u2018Judicial Notes\u2019<\/strong> reflect no deposed evidence of alleged \u2018State<\/strong> Infringements,\u2019<\/strong> including \u2018Intrusion into personal privacy.\u2019<\/strong><\/p>\n

CONCERNS AND INTERESTS<\/strong><\/p>\n

Given the litigants Claim to engage in homosexual acts, there will have been \u2018Good and Sufficient Reasons\u2019 <\/strong>to cite \u2018Buggery and Indecency\u2019<\/strong> that may have the potential to affect; (a) \u2018Public Health; and (b) Public Morality.\u2019<\/strong> These shall have been sufficient to persuade the Court that the prohibitive law, if enforced by \u2018State agencies or agents, may have affected; (a) \u2018Intrusion of privacy: (b) Infringement; and (c) Limitations,\u2019<\/strong> on fundamental rights.\u2019 Instructively, neither of these occurred. The provisions contained in the Constitution,\u2019 specify that which might be reasonably required in the national interest. The \u2018State\u2019 appeared to have ignored the concerns and interests of the overwhelming majority of the citizenry. Though the Constitution speaks to these, the enforceable provisions are contained in; (a) \u2018The Public Health Act\u2019 [Chapter 353]; and (b) The Sexual Offences Act\u2019 [ No. 9 of 1995].<\/strong><\/p>\n

RULE OF LAW<\/strong><\/p>\n

These may be any one or more of these; (i) \u2018\u2026In defence of the nation: (ii) \u2026Necessary for public Safety: (iii) \u2026Maintaining public order; (iv) \u2026Upholding public morality; and \u2026Ensuring public health\u2019 [CO: 1981: Section 3]. Most importantly, to ensure that the \u2018Rule of Law prevails.\u2019 <\/strong>The Constitution provides an entire \u2018Chapter\u2019<\/strong> of the entitlement and enjoyment of fundamental rights and freedoms\u2019 [CO: 1981: Chapter II]. <\/strong>Abnormal sex acts, including: (i) \u2018\u2026Buggery: and (ii) \u2026Indecency,\u2019 <\/strong>are not so constitutionally-entrenched. These sexual acts are capable of being looked at from two civilized perspectives; (i) \u2018Protection of public health; and (ii) \u2026Prevention of public immorality.\u2019 <\/strong><\/p>\n

FORBIDDEN TREE<\/strong><\/p>\n

Those called to \u2018Devine Service\u2019<\/strong> outside of that which God commanded, \u2018Religious Leaders and Preachers\u2019 <\/strong>shall know that they shall not serve God and Satan.\u2019 <\/strong>When God <\/strong>created the \u2018Heaven and Earth, \u2018He\u2019 <\/strong>not only had \u2018Purity of Mind,\u2019<\/strong> but also mindful of two things. He knew that; (i) \u2018\u2026The flesh is weak; and (ii) \u2026Adam and Eve will be led into temptation.\u2019 <\/strong>These, he knew before \u2018He\u2019 them into the \u2018Garden of Eden,\u2019 <\/strong>\u2018He also knew that they would become disobedient and \u2018Yield to Temptation.\u2019<\/strong> So \u2018He\u2019<\/strong> commanded and warned; \u2018You shall eat from all trees, except the tree of the<\/strong> \u2018Knowledge of Good and Evil,\u2019<\/strong> God also forewarned them of the consequences of disobedience. He said; \u2018Be warned that both of you \u2018Yield to Satan,\u2019 both of you shall die, eating from the \u2018Forbidden Tree\u2019<\/strong> [NIV: Genesis 2: 16-17]. <\/strong><\/p>\n

BLASPHEMOUS TO GOD<\/strong><\/p>\n

Though not necessarily part of the decision-making regime, moving away from the \u2018Pulpit<\/strong>,\u2019 where preaching the \u2018Word of God\u2019 <\/strong>has been a \u2018Divine Calling and Practice,\u2019 <\/strong>reasonable inferences might be drawn that \u2018Beloved Swetes Church of God of Prophecy (COGOP), Pastor Dr. David Dorsett\u2019<\/strong> may have committed a \u2018Cardinal Sin.\u2019 <\/strong>Appearing at the \u2018High Court of Justice,\u2019 <\/strong>albeit in a professional capacity of \u2018Legal Practitioner,\u2019 <\/strong>with litigious instructions positioned, though not cannibalistic, such appearance speaks to committing \u2018Evil to the Flesh.\u2019<\/strong> Moreover, \u2018Conceding\u2019<\/strong> that \u2018Homosexuals reserves the right to \u2018Buggery,\u2019 further positioned to be seen as committing an act \u2018Blasphemous to God.\u2019<\/strong><\/p>\n

BLASPHEMOUS INSTRUCTIONS<\/strong><\/p>\n

That which \u2018Her Ladyship Madame Justice Marissa Robertson\u2019<\/strong> notes as being asked of the Court to give \u2018Judicial Consideration.\u2019 <\/strong>She looked at legislation criminalizing \u2018certain sexual activities between \u2018Same-Sex,\u2019 <\/strong>but consenting adults\u2019 [Paragraph 1]. <\/strong>The Claims of possible infringement of right and invasion of privacy,\u2019 appears more \u2018Imaginary and Anticipatory\u2019<\/strong> than of reality or actuality. <\/strong>As it affects \u2018Indecency\u2019 <\/strong>this is interpreted as \u2018An act other than sexual intercourse (whether natural or unnatural) by a person involving the use of the genital organ for the purpose of arousing, or gratifying sexual desire.\u2019 <\/strong><\/p>\n

EXISTENCE OF LAW<\/strong><\/p>\n

The citizenry is not alone in harboring thoughts far removed from reality. The \u2018Judiciary and public administrators, invariably gives the impression that they do. It appears some \u2018Courts\u2019 are sufficiently advanced in \u2018Sexual Science.\u2019<\/strong> Some seem to possess the unique capacity to see when two adults in privacy groping or fondling each other\u2019s genitals. Clearly, outside of \u2018Figment of Imagination,<\/strong>\u2019 it would make \u2018Mockery of the Judiciary,\u2019<\/strong> to conclude that the mere \u2018Existence of Law\u2019<\/strong> infringes the rights of persons. That which shall be known by all a sundry, is that the law exists, not only to curb societal lawlessness, but also abnormal sexual conduct that offends and\/or pose \u2018Public Health risks and Public Morality.\u2019 \u00a0<\/strong><\/p>\n

ROMANTICISM TO EROTISM<\/strong><\/p>\n

Likened to other parts of the world, men and women who appeared psychologically and sexually confused, have been seeking societal and political acceptance not only of the overwhelming way they feel, but also of their \u2018Sexually Preferences.\u2019 <\/strong>Those so disposed, are not alone. Others came in all manner, and to society, they have perpetrated all kinds of evil against the \u2018Will of God\u2019<\/strong> and \u2018Secular wishes and electoral mandates\u2019<\/strong> of the people. Men avoiding the pleasures of \u2018Romanticism\u2019 <\/strong>with members of the opposite sex, seem to have found themselves under the \u2018Influence of Eroticism\u2019 <\/strong>with those of the \u2018Same-Sex.\u2019<\/strong> In the eyes of \u2018God and Man\u2019 <\/strong>they will have been guilty of \u2018Abomination.\u2019 <\/strong><\/p>\n

FICTIONALIZED CONSTITUTIONAL RIGHT<\/strong><\/p>\n

Reflected in a recent Judgement, \u2018Her Ladyship\u2019s wrote; \u2018The Respondent in these proceedings has \u2018CONCEDED\u2019 <\/strong>that the understanding of fundamental rights has EVOLVED.\u2019 <\/strong>In making the point sufficiently clear to the Court, it continues; \u2018So that the provisions of Sections 12 and 15 (Buggery and Indecency) <\/strong>do infringed the rights of the Claimants (Orden David\/Alexandrina Wong) <\/strong>and others so circumstanced (Tasheka Lavann: Prince Warren (Assylumed in Canada) and Washington Bramble.\u2019 <\/strong>\u00a0The assumed, but \u2018Fictionalized Constitutional Right\u2019<\/strong> to indulgence in the scripturally declared \u2018Sin\u2019 has been judicially made legal [St. Vincent Times: July 6, 2022]. <\/strong><\/p>\n

LITIGANTS\/CLAIMANTS<\/strong><\/p>\n

Looking at the recent \u2018Judgment\u2019<\/strong> on the Claims made by litigants, the Claim speaks to the consensual adult right to be indulged in \u2018Buggery and\/or Indecency.\u2019 This, as currently obta<\/strong>ins in the \u2018United Kingdom,\u2019 is legally permitted in private. Within this jurisdiction, there has been any search of private premises. INSTRUCTIONAL APPROACH<\/strong><\/p>\n

Consequent upon the need for social control and that of immoral behaviors, certain abnormal sexual acts were defined as \u2018Buggery and Indecency.\u2019<\/strong> For discouragement, it criminalizes these acts and made both punishable\u2019 [Sexual Offences Act: No. 13 of 1995: Sections 12 and 15]. <\/strong>\u00a0The \u2018State Conceded that the law by itself had <\/strong>infringed the rights of the Claimant. Satisfied with the inferred \u2018Instructional Approach\u2019<\/strong> by \u2018Counsel for the State,<\/strong> \u2018Her Ladyship\u2019<\/strong> gratuitously wrote; \u2018The Court expresses gratitude to the Counsel for the Defendant (Attorney General Steadroy \u2018Cutie\u2019 Benjamin) for their approach to the conduct of these proceedings.\u2019 Contrastingly, \u2018Her Ladyship,\u2019<\/strong> showered praises on Counsel for the Claimants. It wrote; \u2018The Court expresses its gratitude to Counsel for the Claimants for their very thorough submissions\u2019 [Paragraph 90]. <\/strong><\/p>\n

SECTIONS: \u201818: 6\u2019 – FIRE AND STEEL<\/strong><\/p>\n

Yester-year, controversy reigned when \u2018former Attorney General Justin L. Simon QC<\/strong>\u2019 introduced a new meaning of \u2018Spouse\u2019 to the Parliament. This was defined as; \u2018Two persons of <\/strong><\/p>\n

the same sex, living together.\u2019<\/strong> That was called \u201918: 6.\u2019<\/strong> Surprised a shocked, then \u2018Prime Minster Baldwin Spencer\u2019<\/strong> chucklingly quizzed; \u2018What is this saying?\u2019<\/strong> The \u2018Chief Legal Adviser to the Government,\u2019 responded, \u2018It is a \u2018Legal Fiction.\u2019<\/strong> Then \u2018Education Minister Bertrand Joseph,\u2019 <\/strong>a devout Christian, interjected, \u2018Concubinage;<\/strong> \u2026It covers everybody.\u2019<\/strong> A gleeful \u2018House Speaker D. Giselle Isaac\u2019<\/strong> chimed in, \u2018\u2026That\u2019s privilege progressive.\u2019<\/strong> Making the definition both political, and an issue against \u2018Public Morality,\u2019<\/strong> devout Christians Molwyn Joseph and Lionel \u2018Max\u2019 Hurst,\u2019<\/strong> popularized it on their radio programme; \u2018Fire and Steel\u2019 as \u201918: 6]. <\/strong>Today, with the ruling against \u2018Sections 12: 15\u2019 that decriminalized \u2018Buggery and Indecency,\u2019 <\/strong>controversy still reigns among the citizenry-Christian community and Religious Leadership.\u2019<\/p>\n

MORALITY\/COMMON DECENCY<\/strong><\/p>\n

Looked at from the perspective of an act Against \u2018Public Morality and Common Decency,\u2019<\/strong> society has long criminalized \u2018Buggery and Indecency\u2019<\/strong> as unwholesome \u2018Social Vices.\u2019<\/strong> It has also specified prescriptive legislative punishment of varying terms of imprisonment, including a possible custodial sentence of life imprisonment. There has been a war with the \u2018Moralists\u2019<\/strong> opposing this particular \u2018Vice,\u2019 with the \u2018Immoralists\u2019<\/strong> that have embraced it. Conscious of societal denunciation and\/or uprising and electoral punishment, those vying for an electoral privilege in sitting in the Legislative Chambers, have been mortally afraid of tabling a \u2018Bill\u2019 in Parliament to bring some measure of respite to the participants.<\/p>\n

KING ONYAN<\/strong><\/p>\n

Dependent upon inner feelings and thoughts, the song was capable of being interpreted many ways. They condemned both the artiste and the song. They huffed and puffed; rant and rave. ANTI-RAPE WOMEN<\/strong><\/p>\n

Whatever may have been the underlying reasons or incentivization, \u2018Drama and Hypocrisy\u2019 unfolded.\u2019<\/strong> These occurred when one of the \u2018Anti-Rape Women<\/strong>\u2019 supported now advocating and saying that it is right for a \u2018Man\u2019 <\/strong>of their fancy and sexually-disposed, to \u2018Kick\u2019 <\/strong>in the \u2018Back Doors.<\/strong> To these \u2018Litigants,\u2019<\/strong> given the population make-up of the nation, whether or not homosexual males migrate from \u2018Australia, Burma, <\/strong>Canada, China, Dominica, Grenada, India, Russia, Sri Lanka or Syria,\u2019 they have secured a \u2018Legal Right\u2019 <\/strong>to enter \u2018Guyanese Homes\u2019<\/strong> from the \u2018Back Door.\u2019<\/strong> Such invitation has been extended by those born \u2018Men,\u2019<\/strong> but claimed to be<\/p>\n

CRAZY ONYAN<\/strong><\/p>\n

Even as some women were born \u2018Men,\u2019<\/strong> they have harbored the belief that they are \u2018Men.\u2019 In these grouping, there is now no gender discrimination. Yester-year some \u2018Against Rape Activists\u2019<\/strong> went frantic when musician\/social commentator \u2018Toriano Edwards,\u2019<\/strong> musically known as \u2018King Onyan,\u2019<\/strong> sang; \u2018Kick Een She Back Door\u2019 [July 11, 2012: Antigua Summer Festival].<\/strong> The \u2018Women Against Rape,\u2019 <\/strong>yet with minds of \u2018Carnality and Depravity,\u2019<\/strong> ascribed sexual meaning to the song. This group, then thought that they want to have no dealings with \u2018Crazy Onyan.\u2019<\/strong> His suggestion was not in keeping with gentlemanly behavior. But now, they seemed to have been \u2018Perceptively Correct.\u2019<\/strong><\/p>\n

SEXUAL IMMORALITY<\/strong><\/p>\n

While some societal behaviors appear reprehensible and objectionable, it shall be accepted that such exhibitions are all part of human nature and experience. Instinctively and repulsively, humans sometimes exhibit beast-like behavior. The \u2018Sexually Immoral and Rebellious\u2019<\/strong> was often let loose on society. While some conduct appears not to have been consistent with; (i) \u2018\u2026Society\u2019s customs and practices; (ii) \u2026Mores and values; and (iii) \u2026Not in keeping with the scripturally-prescribed \u2018Ten Commandments.\u2019 <\/strong>Though not necessarily so, it has been made sufficiently clear that irrespective of social and legal consequences, some of mankind have taken the conscious decision to be disobedient to \u2018God\u2019<\/strong> and whatever social laws promulgated to check man\u2019s behavior.<\/p>\n

FUNDAMENTAL RIGHTS<\/strong><\/p>\n

As it affects \u2018Protection\u2019 <\/strong>of the \u2018Fundamental Rights and Freedoms of the Individual,<\/strong>\u2019 the Constitution provides recourse, how citizens may seek redress. It states it this way; \u2018Any person who is unlawfully arrested or detained by any other person, subject to such defences as may be provided by law, be entitled to compensation for such unlawful arrest or detention\u2019 [CO: 1981: Section 5 (7)].<\/strong> That which appears capable of being inferred from this provision, is that offended or aggrieved citizens, reserve the right to cause the \u2019Judiciary\u2019<\/strong> to be visited upon any person. This also included the \u2018State.\u2019<\/strong> Incidentally \u2018Buggery and Indecency,\u2019 <\/strong>as criminalized in the \u2018Sexual Offences Act,\u2019 <\/strong>are not entrenched as constitutional rights [SOA: No. 9 of 1995: Sections 12: 15].<\/strong><\/p>\n

STATE INSTRUCTIONS<\/strong><\/p>\n

These have not only been unique to this nation, but have been an international phenomenon. As far as the \u2018Judiciary\u2019 has<\/strong> ruled, there have been open public dissent and disquiet over certain decisions. None more evident to the society, than that contained in a recently delivered \u2018High Court of Judgement.\u2019 <\/strong>Left \u2018Litigiously Unchallenged,\u2019<\/strong> these sexually immoral acts, not only became \u2018Reality,\u2019 <\/strong>but also permissible. The only people that appeared not to have been dismayed, were the overwhelming majority of Legislators.\u2019<\/strong> The citizenry frowned in disgust, were left distressed and distraught.\u00a0 These occurred when \u2018Religious Leader and Church of God Pastor, Dr. David Dorsett,\u2019 <\/strong>seemingly used as a conveyor of \u2018State Instructions,\u2019<\/strong> conceded that though clearly seen as act against \u2018Public Immorality,\u2019 <\/strong>the \u2018Powerless-Law\u2019<\/strong> had infringed the rights of \u2018Homosexuals and Lesbians.\u2019<\/strong><\/p>\n

LEGAL DUTIES \u2013 LEGAL AUTHORITY<\/strong><\/p>\n

The Defendant appeared to have failed to shock the \u2018Conscience of the Court\u2019 with contrary, factual, credible, persuasive and believable legal arguments. <\/strong>The Court, also appeared not to have find as facts that in actuality that the \u2018State,\u2019 through; (i) \u2018Its Attorney General and Chief Legal Adviser to the Government; (ii) \u2026Law enforcement agencies; or (iii) \u2026Agents\u2019 intruded or invaded the Claimants; (a) \u2018Privacy; (b) \u2026Restricted their freedom of expression, movement or liberty,\u2019<\/strong> whether by arrest or detention, as the Constitution allowed with \u2018Reasonableness<\/strong>.\u2019 The Police Act\u2019 not only imposes \u2018Legal Duties,\u2019<\/strong> but also provides \u2018Legal Authority\u2019<\/strong> for the enforcement of the \u2018Criminal Law\u2019 [Sections 22 and 23: Police Act; Chapter 330].\u2019<\/strong><\/p>\n

PUBLIC INTEREST<\/strong><\/p>\n

It is well known that the \u2018Pubic Interest\u2019<\/strong> has always supersede all other interests. Most \u2018Attorneys General\u2019 are familiar with this \u2018Universal Principle.\u2019 If no one else knows, both Cabinet Members, Attorney General Steadroy \u2018Cutie\u2019 Benjamin\u2019 <\/strong>and Attorney-at-law and Co-founder of the organization \u2018Women Against Rape Incorporated (WARI), <\/strong>are not unmindful of this principle. Given the recent developments, one with the \u2018Spirit of Discernment\u2019<\/strong> may conclude that the outcome of these proceedings, appeared to have been a Foregone Conclusion.\u2019<\/p>\n

CONCLUSION<\/strong><\/p>\n

With no countering Claim, there may have been no other significant issue to be determined by \u2018Her Ladyship.\u2019 <\/strong>She wrote; \u2018The position of Counsel resulted in Counsel adopting a particular course regarding the impugned Sections 12 and 15 of the Sexual Offences Act\u2019 [Paragraph 87: Judgment]. <\/strong>Nome shall impute or impugn the \u2018Integrity,\u2019<\/strong> neither of the \u2018Judicial officer,\u2019<\/strong> nor the \u2018Judiciary.\u2019<\/strong> None may also quiz the author who shall be apportioned blame or who might be guilty of \u2018Calculated Negligence.\u2019 This commentary is neither about blame, negligence nor incompetence. Even so, it begs two \u2018Fundamental Questions;\u2019<\/strong> (i) <\/strong>\u2018What the State attorneys, \u2018Dr. David Dorsett and Carla Brooks-Harris\u2019 <\/strong>were called upon to respond as it relates to \u2018Limitation of Rights:\u00a0 <\/strong>and (ii) <\/strong>\u2026What informed the decision to \u2018CONCEDE\u2019<\/strong> that the law has the capability to enforce itself?\u2019 Moreover, the Defendant appeared to have failed to shock the \u2018Conscience of the Court\u2019 <\/strong>with evidence, so cogent and so persuasive the legal arguments, that \u2018Her Ladyship, Madame Justice Marissa Robertson\u2019<\/strong> shall have been felt compelled to give acute judicial considerations, balancing the \u2018Individual Rights of the Claimants\u2019<\/strong> and the \u2018Interest of the Public.<\/strong>\u2019 A non-contesting Defendant will have strengthened the Claims of the Claimants by its ill-advised or misguided Concession\u2019 <\/strong>that the \u2018Impugned Sections 12 and 15,<\/strong>\u2019 factually infringed their rights.\u2019 Spared further adjudication and satisfied that the Claimants have made out a \u2018Prima Facie Case\u2019 [Paragraph 86], \u2018Her Ladyship,\u2019 appeared to have <\/strong>encountered no difficulty in making an unchallengeable \u2018Judicial Decision.\u2019 <\/strong>All have sinned and come short of \u2018God\u2019s Glory.\u2019 When the Roll is Called up Yonder.\u2019 <\/strong>Some will go to \u2018Heaven\u2019 <\/strong>and some will go to \u2018Hell.\u2019 Blessed be His Name.\u2019 ***<\/strong><\/p>\n
