Acclaimed to have been the world\u2019s greatest social commentator, \u2018Slinger Francisco \u2018Mighty Sparrow\u2019<\/strong> has long foreseen that which has, and continues to bring upon the lives of many people manifold consequences and unending miseries. Today, he would be less than amused to know that though the world has become more of an enlightened place, and \u2018British fabled writer J.O. Cutteridge\u2019<\/strong> has long transitioned into oblivion, \u2018Illiteracy\u2019<\/strong> continues to be among man\u2019s gravest enemy. Added to this, is \u2018Ignorance,\u2019 <\/strong>that he also said, \u2018Impedes progress.\u2019<\/strong> Respecting \u2018Illiteracy,\u2019 this may have been the most fundamental reason he sang; \u2018Stamp it out completely.\u2019 <\/strong><\/p>\n

PERSPECTIVE<\/strong><\/p>

\"\"<\/a><\/div>
\"\"<\/a><\/div>\n

While the social commentary of the \u2018Mighty Sparrow\u2019<\/strong> speaks generally to \u2018Our Rising Population,<\/strong>\u2019 this commentary speaks to the \u2018Motoring Public.\u2019<\/strong> Thus, it looks at two pieces of legislation that are intended to address the behavior and manner of driving by motorists. These are; (i) \u2018\u2026The Vehicles and Road Traffic Act\u2019 [Chapter 460; and (ii) \u2026The Vehicles Road Traffic (Enforcement and Administration) Act [Chapter 461]. <\/strong>It specifically looks at; (a)<\/strong> \u2018\u2026Dangerous Driving and elements of the offence\u2019 [Section 55]; (b) \u2026Failing to Conform with Traffic (Signs) Regulations\u2019 [Section 29: Chapter 461];<\/strong> and (c)<\/strong> \u2018\u2026The behavior of Traffic officers; and (d)<\/strong> \u2026Non-adjudicating practice of some Magistrates.\u2019<\/strong> From motorists \u2018Expressions of Dissent,\u2019<\/strong> many appeared to have come to the realization that there has been a concerted effort that enforcement of the \u2018Vehicular Traffic Regulations,\u2019 appeared not to have been consistent with the \u2018Vehicles and Road Traffic (Enforcement and Administration) Act.\u2019 <\/strong><\/p>

\"\"<\/a><\/div>\n

TRAFFIC AND COURT TRAVESTY: <\/strong><\/p>\n

Such dissent has been said to have resulted from reasonably suspected influenced or induced \u2018Guilty Pleas\u2019 <\/strong>for alleged \u2018Dangerous Driving.\u2019<\/strong> This will have been observed from a seeming \u2018Magisterial Mindset,\u2019 <\/strong>whereby acceptance of non-evidentiary facts, that seemed to have superseded trial and adjudication. Such unwholesome practice, clearly speaks to \u2018Sheer Travesty\u2019 <\/strong>within the \u2018Traffic Court.\u2019 <\/strong>Even more of grievous concern to the \u2018Self-convicted motorist,\u2019<\/strong> has been the \u2018Every-day On-the-Road Conclusion\u2019<\/strong> by \u2018Traffic Personnel.\u2019 <\/strong>Not infrequently, the manner of driving alleged has almost, always been \u2018Dangerous to the Public.\u2019<\/strong> Yet there have been; (a) \u2018\u2026No formal investigations: (b) \u2026No attendance of independent witnesses of members of the public to testify on Oath, that arresting officers have alleged have been so endangered; and (c) \u2026Neither trials, nor adjudication done by Magistrates.\u2019<\/strong><\/p>

\"\"<\/a><\/div>\n

PRESUMPTION OF GUILT<\/strong><\/p>\n

Research has revealed that defendants were frequently called upon to offer explanations to adjudicators, after they had pleaded \u2018Not Guilty.\u2019 <\/strong>In most \u2018OECS\u2019<\/strong> jurisdictions the approved \u2018Magisterial Procedure\u2019 <\/strong>has been the prosecutors to advise the adjudicator that they are ready to proceed with the prosecution. From dissenting voices of aggrieved motorists and some attorneys, even before the \u2018Plea\u2019<\/strong> was put to the defendants, they have been \u2018Presumed Guilty. <\/strong>This was said to have been obtained through the subjective opinions of those enforcing the \u2018Vehicular Traffic Regulations,\u2019<\/strong> including contents of the offence on the \u2018Complaints Without Oath\u2019 <\/strong>that shall be read to the defendants.<\/p>

\"\"<\/a><\/div>\n

BREACH OR PRACTICE<\/strong><\/p>

\"\"<\/a><\/div>\n

Framers of the \u2018Constitution Order\u2019<\/strong> anticipated that even when \u2018Prima Facie Evidence\u2019<\/strong> may not so suggest, and the prosecution may not be evidentially positioned to establish a \u2018Prima Facie Case,\u2019<\/strong> the innocent, as well as the constitutionally presumed innocent, may suffer \u2018Grave Injustice.\u2019<\/strong> The provision clearly states that; \u2018\u2026Every person who is charged with a criminal offence, shall be presumed innocent, until; (a) \u2018\u2026He\/she is tried; or (b) \u2026Has pleaded guilty\u2019 [CO: 1981: Section 15 (2)]. <\/strong>Research has revealed that either out of exuberance or ignorance, some non-adjudicating, but \u2018Facts-Taking Magistrates\u2019 <\/strong>were reported to have been frequently observed more in \u2018Breach\u2019<\/strong> of this provision, than in recognizing, respecting and showing evidence of its \u2018Practice.\u2019 <\/strong><\/p>\n

PRINCIPLE OF NATURAL JUSTICE<\/strong><\/p>\n

This provision anticipates that the \u2018Principle of Natural Justice\u2019<\/strong> shall be seen to be at work at all material times. Thus, when criminal or traffic offenders are brought before the \u2018Court,\u2019<\/strong> they shall always be given an opportunity to be heard, not only in their defence, but also upon conviction. These procedures often follow either after an adjudicator was satisfied that a \u2018Prima Facie Case\u2019<\/strong> has been made out by the prosecution, or if he was fully satisfied that the evidence adduced was not only sufficient, but also \u2018SAFE\u2019<\/strong> to convict. That which often seemed to have provoked consternation, has been a particular practice at some Courts.<\/p>\n

NON-ADJUDICATING MOCKERY<\/strong><\/p>\n

While some motorists may have experienced confusion over the \u2018Amber Signal Light,\u2019<\/strong> some adjudicators continue of make \u2018Non-Adjudicating Mockery.\u2019<\/strong> This might be seen when in the proceedings for an offence of \u2018Dangerous Driving,\u2019<\/strong> only; (i) \u2018\u2026A single Police officer writes the facts as he saw them; (ii) \u2026A Police Prosecutor presents them as they are written; and (iii) \u2026A non-adjudicating Magistrate accepting and believing them as facts.\u2019<\/strong> The situation was said to have been compounded when \u2018Police Prosecutors\u2019<\/strong> have only been called upon to give \u2018Brief Facts of the Case,\u2019 <\/strong>as opposed to calling upon the \u2018Prosecutors\u2019 to present their cases for adjudication. While such practice might be considered good for expediting some matters, many motorists have viewed it as bad for the \u2018Administration of Justice.\u2019<\/strong><\/p>\n

WHEN TRAFFIC COP CLAPS<\/strong><\/p>\n

There may be no denial that through mainstream media, \u2018Traffic Regulators\u2019<\/strong> have been daily offering \u2018Traffic Tips\u2019<\/strong> to all road users, and specifically to motorists. Motorists shall now know that whether or not; (i) \u2018\u2026Influenced by arresting officers;\u2019<\/strong> or (ii) \u2026Mis-advised by lawyers in waiving their right to a \u2018Full Trial\u2019 <\/strong>or ignoring the constitutional right to the \u2018Presumption of Innocence\u2019 to<\/strong> plead guilty to the charge of \u2018Dangerous Driving,\u2019<\/strong> they are in fact begging \u2018Magistrates\u2019<\/strong> to incarcerate them. They shall always remind themselves that when the \u2018Traffic Light\u2019 <\/strong>moves from \u2018Green\u2019 <\/strong>and signals \u2018Amber,\u2019 <\/strong>it means one thing; and one thing only- \u2018Prepare to STOP.\u2019 <\/strong>This is in fact is an \u2018ALERT\u2019 that in few seconds, the \u2018Red Signal Light\u2019 <\/strong>will be self-automated. Most importantly, they shall remember that \u2018RED\u2019<\/strong> means \u2018Danger,\u2019<\/strong> and at the junction of the \u2018Sidney Walling Highway and American Road,\u2019 <\/strong>if a \u2018Traffic cop Claps,\u2019<\/strong> that too, is \u2018Mucho Peligro\u2019 [ANR Video: April 8, 2022].<\/strong> \u00a0<\/strong><\/p>\n

JUDICIAL SCRUTINY<\/strong><\/p>\n

Unfortunately, having regard to the contents and the \u2018Facts of the Case,\u2019<\/strong> a pattern of \u2018Non-Adjudicating Behavior\u2019<\/strong> seemed to have been developed in some adjudicators. They were said to have an appreciable delight in: (a)<\/strong> \u2018\u2026One attendance: (b) \u2026One Guilty Plea:\u2019 and (c) \u2026One final disposal practice.\u2019<\/strong> Though not necessarily \u2018Magisterial Watchdogs,\u2019<\/strong> seemingly finding the situation rather untenable, some legal luminaries have taken umbrage with such practice. As every defendant seemed to have been considered guilty as complained by the \u2018Traffic Commissioner.\u2019<\/strong> They have shared the collective view that if public confidence is to be maintained, then the time has come for such practice to be given corrective judicial scrutiny.<\/p>\n

ILLITERACY AND STUPIDITY<\/strong><\/p>\n

Although the \u2018Mighty Sparrow,\u2019<\/strong> may have been speaking to \u2018Children\u2019<\/strong> in the impoverished \u2018English-speaking Caribbean,\u2019<\/strong> he may also have been speaking to every adult man and woman within the region. Though it may not have been for reasons of \u2018Education,\u2019<\/strong> applied to driving a motor vehicle, none may deny that \u2018Illiteracy and Stupidity\u2019<\/strong> continue to impact the way motorists drive on the roadway and the seeming non-conformity to certain \u2018Vehicular Traffic Regulations.\u2019<\/strong> Police statistical data may show that some drivers, due to lack of knowledge and non-conformity with these \u2018Regulations\u2019 have caused unnecessary inconvenience to many road users.<\/p>\n

FATAL CRASH- MISADVENTURE<\/strong><\/p>\n

Consequent upon the manner of driving and moving violations, many have been deemed liable for extensive damages to the motor vehicles of third parties. In addition, many have also sustained serious or life-threatening injuries, that invariably ended in road fatalities. Considered as \u2018Misadventure,\u2019<\/strong> several vehicular accidents have reportedly resulted in the loss their own lives. The most recent \u2018Fatal Crash\u2019<\/strong> of a motorcyclist on the \u2018Bethesda Public Road,\u2019<\/strong> makes the point [ANR: March 9, 2022]. There may be no doubt that a good number of motorists appear to have found themselves in a sorry \u2018State of Confusion.\u2019<\/strong><\/p>\n

THREE-WAY-TRAP<\/strong><\/p>\n

Such confusion has seen many drivers being constantly hauled before the \u2018Magistrate\u2019s Court\u2019 <\/strong>to answer charges of \u2018Dangerous Driving.\u2019 <\/strong>Not infrequently, these were reportedly occasioned by either \u2018Reckless; \u2026Dangerous; or \u2026Careless driving; or for \u2018Exceeding the Speed Limit\u2019 <\/strong>applicable to the vehicle. Instructively, the charge that has often been laid against the motorists has not necessarily been for the \u2018Minor Ticketable offence\u2019<\/strong> of \u2018Failing to Comply with the Traffic Signal Lights\u2019 <\/strong>as contained in the \u2018Vehicles and Road Traffic (Enforcement and Administration) Act\u2019 [Chapter 461: Section 29],<\/strong> but for the most serious offence of \u2018Dangerous Driving,\u2019 <\/strong>under a different \u2018Act\u2019<\/strong> [Vehicles and Road Traffic Act: Chapter 460: Section 55].<\/strong> Thus, frequently, motorists are inescapable caught in a \u2018Three-Way-Trap.\u2019<\/strong> The third being the \u2018Traffic Court.\u2019<\/strong><\/p>\n

PROSECUTORIAL HORROR<\/strong><\/p>\n

Many motorists were said to have caused \u2018Prosecutorial Horror\u2019<\/strong> to be visited upon them, due to grave misunderstanding of the \u2018Amber Traffic Light.\u2019<\/strong> Incidentally, even as the most prevalent moving traffic violations has been \u2018Failing to Conform to Traffic Signals,\u2019 <\/strong>motorists have been regularly slapped with a \u2018Non-Ticketable Offence.\u2019<\/strong> Many drivers appear to have taken the view, albeit erroneous, that when the \u2018Green Traffic Light\u2019 <\/strong>turns to \u2018Amber,\u2019 <\/strong>this means throwing caution to the wind, simply accelerate and continue driving. That which was said to have been frequently obtained, was that the legally unrepresented defendant having no protection from the Court, were said to have been doomed to that which constantly and \u2018Perilously Looms.\u2019<\/strong><\/p>\n

LEGISLATIVE WISDOM<\/strong><\/p>\n

It has been the knowledge that it matters not the type of vehicular accident or speed in of driving, to the \u2018Copy-cat\u2019<\/strong> law enforcers and among some adjudicators, all driving is considered Dangerous. Their concept of driving invariably bears no logic or fact, and often seen as far removed from that which is contained in the law. Guided by \u2018Legislative Wisdom,\u2019<\/strong> Parliamentarians anticipated that some persons may not only expose road users to danger that may result in serious injuries and extensive damages, but also cause the death of innocent persons.<\/p>\n

MANNER OF DRIVING<\/strong><\/p>\n

Thus, keenly desirous in ensuring \u2018Public Safety\u2019<\/strong> on the roadway, Legislators have inserted into the \u2018Vehicles and Road Traffic Act\u2019<\/strong> several serious driving offences. Among these are; (i) \u2018\u2026Reckless: (ii) \u2026Dangerous: and (iii) \u2026Careless Driving; and (iv) \u2026Exceeding the Speeding Limit.\u2019<\/strong> They were very mindful that the \u2018Manner of Driving\u2019<\/strong> may also bring upon the lawful road user, pain, sorrow and grief. Thus, the have inserted the more serious offence of \u2018\u2026Causing Death by Dangerous Driving.\u2019 <\/strong>This is a separate and distinct offence and relates only to the tragic loss of life. Frequently, this was attributed to the manner and speed and other factors relating to the road on which the motorist drove, as to be seen as contributory to the vehicular accident\u2019 [VRTA: Chapter 460: Section 57].<\/p>\n

RECKLESS-DANGEROUS DRIVING: <\/strong><\/p>\n

In a prosecution for the offence of \u2018Dangerous Driving,\u2019<\/strong> Parliament expected those that; (i) \u2018\u2026Enforce the law: (ii) Conduct criminal prosecutions; <\/strong>and (iii) \u2026Those that sit on Magisterial Bench and at High Court Bar,\u2019 <\/strong>to be fully au fait or familiar with the \u2018Elements\u2019<\/strong> that constitute this particular offence. Legislators were very clear in their collective thinking and wisdom, of the evidence that shall be presented to \u2018Magistrates and Judges.\u2019<\/strong> Consequently, for evidential guidance, they have provided this interpretation; \u2018\u2026Any person who drives a motor vehicle on a road; (a) \u2018Recklessly, or (b) \u2026At a speed; or (c) \u2026In a manner that is dangerous to the public\u2019 <\/strong>commits an offence [Section 55].<\/p>\n

EVIDENTIARY ELEMENTS<\/strong><\/p>\n

Parliament not only believed that some law enforcers may subject motorist to abuse, but also some adjudicators may not even stop to consider if the evidence adduced, substantiates the offence. Hence, they inserted these as the \u2018Evidentiary Elements.\u2019<\/strong> It is these that the \u2018Prosecution\u2019<\/strong> shall adduce at trial. Such shall not only satisfy adjudicators, but also prove their cases \u2018Beyond Reasonable Doubt.\u2019<\/strong> Evidentially, the \u2018Act\u2019 dictates that, adjudicators shall admit; \u2018\u2026All the circumstances of the Case.\u2019 These shall include; (a) \u2018\u2026The nature: (b) \u2026Condition and use of the road: (c) \u2026Amount of traffic which is actually on the roadway at the time; <\/strong>and (d) <\/strong>\u2026Amount of traffic which might reasonably be expected to be on the road at the time of the offence\u2019 [VRTA: Chapter 460: Section 55].<\/strong><\/p>\n

HYBRID OFFENCE<\/strong><\/p>\n

The Legislators considered this particular offence to be \u2018Hybrid.\u2019<\/strong> In other words, they have provided an option to the \u2018Director of Public Prosecutions (DPP)\u2019<\/strong> whereby a person so charged may be tried; (a) \u2018\u2026Summarily by Magistrates; or (b) \u2026Indictably by Judge and Jury.\u2019 <\/strong>Given the speed that this particular offence has reached before, now \u2018Acting Chief Magistrate, His Worship Dexter Wason,\u2019 <\/strong>it has been made sufficiently clear that a single officer is; (i) \u2018\u2026A law enforcer: (ii) \u2026Arresting officer: and (iii) \u2026The DPP.\u2019 <\/strong>Such officer often appears<\/strong> to have taken the unilateral decision, that the \u2018Dangerous Driving Charge\u2019<\/strong> shall be \u2018Summarily tried by a Magistrate.\u2019<\/strong><\/p>\n

THE PENALTIES<\/strong><\/p>\n

Reasonable inferences might be drawn from that which obtains daily. Thus, the prosecution opting for this mode of trial, places an offending motorist, if found guilty or pleaded guilty, to be fined \u2018EC$2, 500\u2019 <\/strong>and to imprisonment for \u20186 months\u2019 for <\/strong>the first offence. Ensuring that \u2018Road Safety Violations\u2019 <\/strong>were to be treated with some degree of severity and harshness, for a second, and every subsequent offence, the convicted, self or tried and found guilty, shall be liable to a fine of \u2018EC$5, 000\u2019 <\/strong>with an additional sentence of \u2018imprisonment for a term of 12 months\u2019 [Section 55 (1) (a & b)]. <\/strong><\/p>\n

PARLIAMENTARY ANTICIPATION<\/strong><\/p>\n

With an obvious increase in the number of motor vehicles, drivers and density of vehicular and pedestrian traffic on the public roads, \u2018Parliament\u2019<\/strong> saw the need to keep abreast with these developments. Legislators appeared to have viewed the situation from two perspectives; (i) \u2018\u2026Enhance and encourage safe driving; and (ii) \u2026Punish non-conforming motorists.\u2019<\/strong> Consequent upon these, they gave legislative consideration to an Act, shortly titled; \u2018The Vehicles and Road Traffic (Enforcement and Administration) Act\u2019 [1984: VRTA: Chapter 461]. <\/strong><\/p>\n

ENFORCEMENT AND ADMINISTRATION<\/strong><\/p>\n

The two operational aspects of the \u2018Act\u2019 being; (i) \u2018…Enforcement; and (ii) \u2026Administration.\u2019<\/strong> The Legislators, focusing upon \u2018Punishment,\u2019<\/strong> inserted these as its \u2018Objects.\u2019 It states; (i) \u2018\u2026An Act to provide for the punishment of motorists; and (ii) \u2026Without the necessity for Court appearance.\u2019 <\/strong>In respect of \u2018Enforcement,\u2019<\/strong> this shall be done by issuance of \u2018Fixed Penalty Tickets.\u2019 As it pertains to \u2018Administration,\u2019<\/strong> ticketed motorists have the option to pay the \u2018Fixed Penalty,<\/strong>\u2019 without facing trial by a Magistrate,\u2019 thus avoiding the imposition of the statutory fine, if convicted.<\/p>\n

LEGALLY FICTIONALIZED<\/strong><\/p>\n

The Legislators had seen the prevalence of certain \u2018Parking and Moving Traffic Violations,\u2019<\/strong> and have listed \u201831 Regulations.<\/strong>\u2019 Administratively, the \u2018Act\u2019 provides for ticketed motorists to pay to the \u2018Magistrate\u2019s Courts\u2019<\/strong> the \u2018Fixed Penalties\u2019<\/strong> for the \u2018Regulations\u2019<\/strong> alleged to have been violated with an option to do so \u2018within 10 days of issuance\u2019 [Sections 3 and 4].<\/strong> \u00a0Moreover, it provides for legal challenges to the offence ticketed \u2018in another 21 days.\u2019 <\/strong>The \u2018Act\u2019 firstly provides for enforcement of the \u2018Regulations\u2019<\/strong> by the \u2018Police\u2019 by<\/strong> issuance of \u2018Fixed Penalty Tickets.\u2019 S<\/strong>ubsequently, the establishment of the \u2018Statutory Corporation\u2019<\/strong> called the \u2018Antigua and Barbuda Transport Board (ABTB)\u2019 <\/strong>a peculiar development.<\/p>\n

LEGAL FICTION v LEGAL STATUS<\/strong><\/p>\n

Parliamentarians has given hired civilian employees, with the designation \u2018Traffic Wardens,\u2019 \u2018Legally Fictionalized Power of Enforcement\u2019 [ABTB: No. 13 of 1995: Section 7A]. <\/strong>\u00a0Then for all intents and purposes, they were made to function parallel with the \u2018Police Service,\u2019<\/strong> issuing \u2018Fixed Penalty Tickets\u2019 <\/strong>for minor traffic infractions. Instructively, even as they perform this particular duty, they do so at grave risk. Interestingly, unlike members of the \u2018Police Service,\u2019<\/strong> having no membership, denies those currently serving with the \u2018Legal Status\u2019<\/strong> contained in the \u2018Police Act\u2019<\/strong> for the enlisted and formally trained Police officers.<\/p>\n

PARLIAMENTARY MOCKERY<\/strong><\/p>\n

Neither have there been provisions in this \u2018Act\u2019<\/strong> that offer; (a) \u2018\u2026Security of tenure; (b) \u2026Administrative protection; (d)<\/strong> \u2026Enjoyment of rights, privileges and immunities contained therein; nor (d)<\/strong> \u2026Fringe or retirement benefits\u2019 as guaranteed for \u2018Police officers.\u2019<\/strong> In fact, making \u2018Parliamentary Mockery,\u2019<\/strong> the \u2018Traffic Wardens\u2019 are not subject to \u2018Police Discipline,\u2019 neither do they exercise powers under the \u2018Police Act\u2019 [PA: Chapter 330: Sections 17 – 23: 68]. <\/strong>These said, the most troubling for some non-conforming motorists, has been apparent ever-frequent abuse associated with the \u2018Power of Arrest\u2019 <\/strong>by assigned members of the \u2018Police Service.\u2019 <\/strong>Not infrequently, many were penalized and left perplexed over their ignorance of law and procedure, and the deceptive exploits of others.<\/p>\n

REGULATIONS: TRAFFIC SIGNS<\/strong><\/p>\n

. So too, some apparent overzealous officers continue to arrest violators, not only with impunity, but also under the guise that those motorists have been driving through the \u2018Red and Amber Lights.\u2019 <\/strong>Given the \u2018Regulations\u2019<\/strong> relating to \u2018Traffic Signs,\u2019<\/strong> it was considered informationally useful to identify those provided in the law. These were said to include; (i)<\/strong> \u2018\u2026All signals: (ii)<\/strong> \u2026Warning; (iii)<\/strong> \u2026Sign posts; (iv)<\/strong> \u2026Direction posts; (v)<\/strong> \u2026Lines; (vi)<\/strong> \u2026Marks; or (vii)<\/strong> \u2026Other devices for the guidance of persons using the roads.\u2019 The law interprets \u2018Road\u2019<\/strong> as; \u2018\u2026Any street or open space to which the public are granted access and any bridge over which a road passes; and includes any privately-owned street, road or open space to which the public are granted access, either generally or conditionally\u2019 [VRTA: Chapter 460: Section 2].<\/strong><\/p>\n

CONCLUSION<\/strong><\/p>\n

Given the statutory offences and penalties contained in the parent \u2018Act -Vehicles and Road Traffic\u2019 [VRTA: Chapter 460], <\/strong>adjudicators not sufficiently familiar with the statutory provisions contained therein, could make \u2018Mockery of law and Procedure.\u2019 <\/strong>For instance, even when no trial was conducted, they could erroneously order \u2018Suspension of Driver\u2019s Licence,\u2019<\/strong> when such power resides only with the \u2018Traffic Commissioner\u2019<\/strong> [Section 70]. <\/strong>Conversely, the self-convicted motorists could also be ordered \u2018Disqualified\u2019 <\/strong>from driving for: (i) \u2018\u2026A Stated period; or (ii) \u2026Permanently from holding a \u2018Driver\u2019s Licence\u2019 <\/strong>as contained in the \u2018Act.\u2019 This, however, is only to the extent that adjudicators know that such a power resides in the \u2018Magistracy\u2019 [Section 69]. <\/strong>Moreover, should a \u2018Guilty Plea\u2019<\/strong> or self-convicted motorist be favored with luck, he could be \u2018Disqualified\u2019 <\/strong>from driving a motor vehicle for \u2018One Week\u2019 [PointeXpress: March 20, 2022].\u00a0 <\/strong>This, as specified in the \u2018Act,\u2019<\/strong> legitimately speaks to a \u2018\u2026Stated Period.\u2019 \u00a0<\/strong>Most importantly, unless it is considered unsafe to \u2018STOP\u2019<\/strong> in the middle of the junction, only a \u2018Jack Donkey\u2019<\/strong> may bray if a motorist proceeds with \u2018Extreme Caution.\u2019 <\/strong>If that motorist was to be taken before a \u2018Traffic Court\u2019<\/strong> in \u2018Australia,\u2019<\/strong> then only a \u2018Kangaroo\u2019 <\/strong>that behaves like \u2018Russian President, Vladimir Putin,\u2019<\/strong> may drop a \u2018Bomb of Conviction.\u2019<\/strong> Finally, all are wished \u2018Happy Easter Motoring.\u2019 <\/strong>\u00a0Still, it will be much happier conforming to the \u2018Three Traffic Signal Lights\u2019 <\/strong>and avoid the \u2018Perils of Arrest.\u2019 <\/strong>\u00a0*** <\/strong><\/p>\n
