It has been the knowledge that nothing good ever comes from leaders that harbor a \u2018Sense of fear and insecurity.\u2019 <\/strong>When the Lord cautions about \u2018Fear and Trembling,\u2019<\/strong> \u2018He\u2019<\/strong> may have been speaking to \u2018Commissioner of Police, Atlee Rodney QPM.\u2019<\/strong> Thus, says \u2018He;<\/strong>\u2019 \u2018\u2026Work out your own salvation\u2019<\/strong> [Philippians 2: 12]. When the \u2018Lord\u2019<\/strong> spoke to those whose hearts appearing to \u2018Him\u2019<\/strong> as full of evil and wickedness,\u2019<\/strong> \u2018He\u2019 may have been speaking to a few members on the \u2018Police Service Commission (PSC).<\/strong>\u2019 Ensuring that they turned from their evil and wicked ways, frighteningly, \u2018He\u2019<\/strong> warns; \u2018\u2026I will punish you for all your iniquities\u2019 [Amos 3: 2]. <\/strong><\/p>\n

PERSPECTIVE<\/strong><\/p>

This commentary looks briefly at the recent \u2018Media and Parliamentary\u2019 exchanges between the \u2018Police Welfare Association (PWA)\u2019<\/strong> and Justice and Legal Affairs: Chief Legal Adviser to the Government; Police and Public Safety and Labour Minister, Steadroy \u2018Cutie\u2019 Benjamin.<\/strong>\u2019 It further looks at certain \u2018Administrative Difficulties\u2019<\/strong> said to have bedeviled \u2018Commissioner of Police, Atlee Rodney QPM.\u2019 <\/strong>In his capacity of \u2018Commissioner,\u2019<\/strong> with the super-imposition of the will of the \u2018Police Service Commission (PSC)<\/strong>\u2019 on his administrative and operational functions, it appears to be a struggle and a challenging dilemma. Still, whether or not his administrative difficulties were due to \u2018Ministerial or other Causation,\u2019<\/strong> likened to rank and file members, the \u2018Commissioner,\u2019 <\/strong>must Bawl.\u2019<\/strong> There has been no better way than to begin this commentary with the disappearance and fate of \u2018King Obstinate Hog.\u2019<\/strong><\/p>

HUMAN SURVIVABILITY<\/strong><\/p>\n

Well known for its grunting and wallowing in mud, those domesticated or hunted, humans have found the \u2018Pig\u2019<\/strong> a useful and life-saving animal. Though it has been scripturally-declared \u2018unfit for human consumption,\u2019<\/strong> none may deny its commercial, consumption, scientific and medical value. For \u2018Human Survivability,\u2019 <\/strong>its flesh has been on the table of the wealthy and indigent. Most interestingly, t<\/strong>oday, \u2018Medical Science\u2019<\/strong> has shown other useful purposes. Through the precisional skills of Surgeons and a surgical procedure called \u2018Xenotransplantation,\u2019 <\/strong>a genetically-treated \u2018Pig\u2019s Heart,\u2019<\/strong> was reportedly implanted into the human body. The intended purpose has been the prolongation of human life\u2019 [WEF: January 7, 2022]. For legendary social commentator \u2018Sir Paul Richards,\u2019<\/strong> more popularly known as \u2018King Obstinate,\u2019<\/strong> he had very good reasons to \u2018hold his head and bawl.\u2019 <\/strong><\/p>

ADMINISTRATIVE TROUBLES<\/strong><\/p>\n

Universally, for members of \u2018Police Services\u2019, theirs has never been, and will never be an easy lot. For \u2018Commissioner of Police, Atlee Rodney QPM,<\/strong>\u2019 likened to \u2018King Obstinate,\u2019<\/strong> he must \u2018Bawl.\u2019<\/strong> Amidst all the confusion and seeming imposition of its will upon him, it was not difficult to conclude that much of his \u2018Administrative Troubles\u2019<\/strong> have emanated from the behavioral pattern of the \u20187-member Police Service Commission.\u2019<\/strong> Confusion seems to reign as to who or what constitutional body, shall give administrative directions to the holder of the office of \u2018Commissioner of Police.\u2019<\/strong> In this connection, such directions pertain to matters of; (i) \u2018\u2026Promotion; and (ii) \u2026Transfer.\u2019\u2019<\/strong> Those familiar with the \u2018Constitution Order and Police Act,\u2019<\/strong> must know that the person appointed \u2018Commissioner of Police,\u2019 commands and controls the \u2018Police Service\u2019 [Section 6: Police Act: Chapter 330].<\/strong><\/p>

PLIGHT OF OBSTI\u2019S HOG <\/strong><\/p>

Benefitting from the vigilance of a neighbor, \u2018King Obstinate\u2019<\/strong> regarding his \u2018Hog,\u2019<\/strong> curiously he asked; \u2018So Police Tief an nyam me Hag?\u2019<\/strong> Describing its \u2018Plight\u2019<\/strong> and the manner it was concealed and conveyed, he sang; \u2018\u2026Police wrap up the \u2018Hag\u2019 in a crocus bag.\u2019 <\/strong>Vexingly, he accused the \u2018Commissioner of bragging that he nyam (eat) me Hag\u2019 [2015: YouTube]. <\/strong>Today, though not about \u2018Hog,<\/strong>\u2019 head, feet, ham or rice pudding,\u2019 the \u2018Executive of the PWA\u2019<\/strong> had been forced to \u2018Snarl.\u2019<\/strong> Making the concerns of the membership public, \u2018Public Safety and Police Minister, Steadroy Cutie\u2019 Benjamin\u2019 <\/strong>made its members \u2018Bawl.\u2019 <\/strong>Still, greater \u2018Bawling\u2019<\/strong> was said to have been caused by the \u2018Police Service Commission (PSC).<\/strong><\/p>\n

SNARL AND BAWL<\/strong><\/p>\n

Before man\u2019s transition to the \u2018Place of Milk and Honey\u2019<\/strong> or where \u2018Sulphuric Fire and Brimstone, <\/strong>\u2018waits, there comes a time when humans shall \u2018Snarl and Bawl.\u2019<\/strong> It has been widely known that the \u2018Police Welfare Association (PWA)\u2019 <\/strong>has often taken issue with \u2018Ministerial Promises.\u2019 It was also known that when \u2018Matters of Welfare,\u2019 the \u2018PWA\u2019 <\/strong>growls like a \u2018Tiger<\/strong>,\u2019 while the Minister <\/strong>roars like a \u2018Lion.\u2019 That which has caused \u2018Growling and Roaring,\u2019 <\/strong>has been the vexed issue of \u2018Medical Insurance\u2019 <\/strong>for its membership. There has still been \u2018More Bawling\u2019<\/strong> by rank-and-file members of the Police Service. This time, \u2018Bawling\u2019<\/strong> reportedly caused by the \u2018Police Service Commission (PSC).\u2019<\/strong><\/p>\n

INSURANCE- ALLOWANCE \u2013 LAND<\/strong><\/p>\n

First, seen as ill-advised, the \u2018PWA\u2019 <\/strong>made startling revelations of; (i) \u2018\u2026Existing untenable and unsanitary working conditions; (ii) \u2018\u2026Inadequacy of Medical Insurance;<\/strong> (iii) \u2026Unavailability of uniform; (iv) \u2026Non-approval of \u2018Risk Allowance; and (v) Inaccessibility to land\u2019 [Observer February 12, 2022]. This was said to have provoked a measured, unthinkable and inept response by an irate \u2018Police Minister Steadroy \u2018Cutie\u2019 Benjamin.\u2019 <\/strong>Seizing a \u2018Privilege Parliamentary Moment,\u2019 he <\/strong>spared no effort in countering claims, suggestively and spuriously made. Ill-advisedly, the \u2018PWA,\u2019 <\/strong>had made startling media revelations, levelled against the \u2018Authorities, untenable unsanitary working conditions, inadequacy of medical insurance, unavailability of uniform, risk allowance and inaccessibility to land\u2019 [Observer February 12, 2022].<\/p>\n

PRIVILEGE PARLIAMENTARY MOMENT<\/strong><\/p>\n

Measured as may have been, and as unthinkable and inept a response it may also have been, an irate \u2018Police Minister Steadroy \u2018Cutie\u2019 Benjamin,\u2019 <\/strong>seized a \u2018Privilege Parliamentary Moment,\u2019 <\/strong>spared no effort in countering claims suggestively spuriously made. Then likened to a \u2018Caged Tiger,\u2019 <\/strong>he viciously attacked the \u2018Executive\u2019 <\/strong>of the \u2018PWA.\u2019<\/strong> Then he made the \u2018Executive\u2019 \u2018Stranger to the truth\u2019 [ABS: February 15, 2022]. <\/strong>He dismissed claims of \u2018Ministerial Neglect\u2019 <\/strong>of matters said to have affected \u2018Police Welfare.\u2019 <\/strong><\/p>\n

QUOTED SUM- EC$200, 000<\/strong><\/p>\n

Seizing the right moment, with \u2018Ministerial Conviction,\u2019<\/strong> he read from a letter, purportedly authored by \u2018Manager Janice Hodge.\u2019<\/strong> The contents speak to provisions of \u2018Medical Insurance Coverage.<\/strong>\u2019 The \u2018Executive\u2019<\/strong> was made to be seen as being \u2018Stranger to the Truth\u2019 [ABS: February 15, 2022].<\/strong> Members of Parliament were informed that contained in the letter was the quoted sum of \u2018EC$200, 000\u2019 represents \u2018Medical Insurance Coverage\u2019 for members of the \u2018Security Forces and Prison Services.\u2019 In his parliamentary capacity, th<\/strong>e Minister informed the \u2018Speaker and Members of the House\u2019<\/strong> that such coverage exists from \u20181994\u2019<\/strong> [Observer News: February 15, 2022].<\/p>\n

MINISTERIAL RESPONSE<\/strong><\/p>\n

In spite of this, the \u2018PWA\u2019<\/strong> remains firm and steadfast that mere reading of a letter to an accommodating \u2018House Speaker, Sir Gerald Watt KCN QC,\u2019 <\/strong>made him complicit to the \u2018Ministerial Response.\u2019<\/strong> The Executive shared the view that the issues were never part of the \u2018Parliamentary Order Paper.\u2019 <\/strong>Then likened to an enraged \u2018Caged Tiger,\u2019 <\/strong>the \u2018Executive\u2019 <\/strong>of the \u2018PWA\u2019 <\/strong>came under vicious attack. Its members were made to be seen as being \u2018stranger to the truth\u2019 [ABS: February 15, 2022].<\/strong> He refuted claims of official and \u2018Ministerial Neglect\u2019 <\/strong>of matters said to have affected \u2018Police Welfare.\u2019 <\/strong>Seizing \u2018Bragging Rights,\u2019<\/strong> he read from a letter, purportedly authored by \u2018State Insurance Manager, Janice Hodge\u2019<\/strong> of provisions long made of \u2018Medical Insurance Coverage<\/strong>\u2019 for members of the \u2018Security Forces.\u2019<\/strong><\/p>\n

UNCHARACTERISTIC RESPONSE<\/strong><\/p>\n

Even so, the \u2018PWA\u2019<\/strong> appeared adamant that mere reading of such letter to an accommodating \u2018House Speaker, Sir Gerald Watt KCN QC\u2019 <\/strong>when the issue was not on the \u2018Order Paper,\u2019<\/strong> made him manipulatively complicit to the \u2018Ministerial Response.\u2019 <\/strong>Even with such accommodation, unmoved and unconvinced, the \u2018PWA\u2019<\/strong> remains adamant that mere reading to an accommodating \u2018House Speaker Sir Gerald Watt KCN QC\u2019 <\/strong>when obligatory \u2018Matters of Police Welfare\u2019<\/strong> were given negative parliamentary and non-negotiable venting when such matters were not contained on the \u2018Order Paper.\u2019 <\/strong>Such accommodation, they believed, made him complicit to the \u2018Uncharacteristic Response.\u2019 <\/strong><\/p>\n

ASSOCIATION WITH PWA<\/strong><\/p>\n

In Service, those then associated with \u2018PWA\u2019s<\/strong> efforts were; (i) \u2018\u2026James Hill, former Deputy Commissioner; (ii) \u2026Cosmos Marcelle, former Superintendent and; (iii) \u2026Claudette Brathwaite-Mason,\u2019 <\/strong>Inspector.\u2019 Instructively, during her membership, the lone female held representative positions on the \u2018Association.\u2019 T<\/strong>hey have been most supportive of the efforts of the \u2018Police Welfare Association.\u2019<\/strong> They have rallied for inter alia, improved accommodation and working conditions of service, increased remuneration and fringe benefits, opportunities for career development and upward mobility within the structured ranks from \u2018Police Constable to Commissioner of Police.\u2019<\/strong> Now, in a different capacity, they have left much to be desired.<\/p>\n

THE CCJ\u2019s<\/strong><\/p>\n

As far as the nation\u2019s jurisprudence was concerned, there must have been good reasons for the nation\u2019s rejection of membership on the \u2018Caribbean Court of Justice (CCJ).\u2019<\/strong> \u2018None may argue over the constitutionality of the \u2018PSC.\u2019<\/strong> None may also argue over the composition of its membership. However, as regards to its recent behavior, its membership may have given, members of the \u2018Police Service\u2019 to feel discontented. Rightly or wrongly, either individually or collectively, the body had been accused of blatantly rejecting recommendations referred to it by the \u2018Commissioner of Police, Atlee Rodney QPM.\u2019 <\/strong>To all intents and purposes, \u2018Claudette, Cosmos and James (CCJ),\u2019 <\/strong>have reportedly made the \u2018Police Promotion Board\u2019 <\/strong>looks wishy-washy, the \u2018Commissioner \u2018Snarl\u2019 <\/strong>and those with reasonable expectations, \u2018Bawl.\u2019<\/strong><\/p>\n

DISAPPOINTED \u2013 DEMORALIZED -DISILLUSIONED<\/strong><\/p>\n

Likened to current serving members of the \u2018PSC,<\/strong>\u2019 each would have had their fair share of woes, trials and tribulations. Yet few may have descended to the depths of despair. Many personnel have not only been overlooked, but also left worryingly \u2018Disappointed, Demoralized and Disillusioned.\u2019 <\/strong>Not only has the general membership of the \u2018Police Service,\u2019<\/strong> but also personnel close to the chain of command, seemed to have anxieties about their stagnated positions within the Police Service. Seemingly, the main \u2018bone of contention,\u2019<\/strong> has been the making of promotions of personnel that appeared to have been influenced by the environment. Such practice may have been compounded by apparent personal preferences to personnel seen as starved of \u2018Merit and Professional Competence.\u2019<\/strong><\/p>\n

PROFESSIONAL INCOMPETENCE<\/strong><\/p>\n

Speaking from an organizational and administrative perspective, there may be no doubt in the mind of the citizenry, members of the \u2018Police Service\u2019<\/strong> appears to have entered a phase that speaks to \u2018Professional Incompetence.\u2019<\/strong> This may have been due to the reported \u2018non-consultative way\u2019 in which personnel are elevated to positions within the \u2018Police Service.\u2019<\/strong> Research has revealed that personnel not so considered to be elevated ranks, without \u2018Administrative Referrals\u2019<\/strong> to the \u2018Police Service Commission (PSC)\u2019<\/strong> by the \u2018Commissioner of Police,\u2019 <\/strong>are often found wanting of \u2018Professional Competence.\u2019 <\/strong><\/p>\n

ACRIMONIOUS SUSPENSION<\/strong><\/p>\n

It shall be known that appointment to the office of \u2018Commissioner,\u2019<\/strong> resides only with, and contingent upon the approval of the sitting \u2018Prime Minister\u2019 [Section 105 (3)].<\/strong> The latter may have been evident as has been the cases for \u2018Ex-patriate Commissioner Gary Nelson\u2019 [Canadian] <\/strong>and \u2018Former Commissioners Vere Browne and Wendell Robinson\u2019 [Pride: January 21, 2015: April 5, 2018]. <\/strong>While the former was removed from office: 2008-2010: BBC News: May 24, 2008], the<\/strong> latter was cited for \u2018Dereliction of Duty and Irresponsibility,\u2019 (Failing to publish Promotion List), <\/strong>was suspected to have been \u2018Acrimoniously Suspended\u2019<\/strong> by the \u2018Police Service Commission (PSC)\u2019<\/strong> [BBC: 2010-2015: Jamaica Observer: January 16, 2015].<\/strong>\u2019<\/p>\n

NON-CONSULTATIVE PROMOTIONS<\/strong><\/p>\n

With scant respect to the \u2018Commissioner of Police,\u2019<\/strong> these were said to have been made by the \u2018PSC\u2019 \u2018Non-Consultatively.\u2019 <\/strong>Instructively, these and without \u2018Referrals\u2019 <\/strong>for its consideration. That which shall be said of this constitutionally-established body, is that its members comprise reasonable, decent and honorable. The most contentious of functions of the \u2018PSC,\u2019<\/strong> have been the; (i) \u2018Removal from office; and (ii) \u2026Exercise of disciplinary control\u2019 of members of the rank of Sergeant to Commissioner.\u2019<\/strong> Those below these ranks, fall within the constitutional and statutory authority of the \u2018Commissioner of Police\u2019<\/strong> [CO: 1981: Section 105 (5): Section 6: Police Act: Chapter 330].<\/p>\n

CONSTITUTIONAL POWERS<\/strong><\/p>\n

The \u2018Constitution,\u2019<\/strong> states; \u2018\u2026The power to: (a) \u2018\u2026Appoint persons to hold or act in offices in the Police Force (including appointments on promotion and transfer and the confirmation of appointments); (b) \u2026To remove from office; and (c) \u2026Exercise disciplinary control over persons holding or acting in such offices, shall vest in the Police Service Commission\u2019<\/strong> [CO: 1981]. That which the \u20187-member Police Service Commission (PSC)<\/strong>\u2019 shall understand, is that neither the \u2018Constitution,\u2019 nor the provisions stipulated in the \u2018Police Act,\u2019 <\/strong>make a \u2018Commissioner of Police\u2019<\/strong> subordinate to the \u2018Police Service Chairman\u2019<\/strong> and its membership.<\/p>\n

STATUTORY\/CONSTITUTIONAL<\/strong><\/p>\n

There has never been doubt as to who is \u2018Commissioner of Police\u2019 <\/strong>and who are \u2018Police Service Commissioners.\u2019 <\/strong>Both the \u2018Statutory and Constitutional Provisions\u2019 <\/strong>make it explicitly and sufficiently simple and easy for \u2018Students of the Adele School\u2019 <\/strong>to understand who has been duly appointed to take charge of the \u2018Royal Police Force of Antigua and Barbuda\u2019<\/strong> and the \u2018Police Service Commission.\u2019<\/strong> In the case of the latter, the statutory provision states; \u2018\u2026The Commissioner of Police shall have the command and shall be responsible for the \u2018Superintendence of the Force\u2019 [Police Act: Section 6: Chapter 330].<\/strong><\/p>\n

DABBLING AND DICTATING<\/strong><\/p>\n

Not only has the \u2018Police Service Commission\u2019 <\/strong>been accused of repeatedly \u2018Dabbling and Dictating\u2019<\/strong> where personnel shall be transferred, but also decided who shall be promoted or transferred. These practices seem rooted in organizational culture. It has been the organizational knowledge that even when \u2018Commissioners of Police,\u2019<\/strong> neither recommended promotions or transfers of personnel under their command, they are so promoted or transferred. Such practice not only breathes contempt, but has also seen as counter-productive to functional cooperation. Not only shall respect for their organizational or institutionalized positions be accorded, but also there shall be no usurpation of power or administrative authority.<\/p>\n

PROGRESS AND PROSPERITY<\/strong><\/p>\n

Not infrequently the docile abdicates his\/her administrative responsibility to those in need of professional development, yet hold reasonable expectations for their upward mobility, Many, have failed to offend those that connivingly and vindictively, seek to retard \u2018Progress and Prosperity\u2019<\/strong> of the competent, dependable and reliable. Even as a \u2019Commissioner\u2019<\/strong> may feel doubtful or fearful, whenever the time comes, and without being consequentially reckless, whatever it takes, a \u2018Commissioner\u2019<\/strong> shall halt the retrogressive and domineering at the line of demarcation. Invariably,\u2019 Chairpersons and Police Service Commissioners\u2019 <\/strong>have shown contemptuous disregard to the office of the Commissioner of police. <\/strong>Whenever, this happens, it seems to reduce the holder of such office to be seen as subordinate or subservient to the body.<\/p>\n

ILLUSION OF POWER<\/strong><\/p>\n

In its relationship with the \u2018Police Service,\u2019<\/strong> none may argue or dispute the; (i)<\/strong> \u2018Constitutional Position\u2019 <\/strong>of the \u2018Police Service Commission (PSC)\u2019 [CO: 1981: Section 15].<\/strong> Conversely, (ii)<\/strong> \u2018\u2026From the \u2018Superintendence; \u2026Administrative <\/strong>and Operational perspective,\u2019 <\/strong>except the \u2018power-drunken,\u2019 <\/strong>\u2018and those that possess an insatiable appetite for, and to wield power with impunity, none may argue over the \u2018Statutory Position\u2019<\/strong> of the \u2018Commissioner of Police,\u2019 [Section 6: Police Act: Chapter 330].<\/strong> For a \u2018PSC Chairman,\u2019 <\/strong>however legally bright and members, however docile, daft or stupid, to harbor contrary beliefs, then all, most certainly will have been harboring \u2018Illusions of Power.\u2019<\/strong><\/p>\n

COMMITMENT AND TESTAMENT<\/strong><\/p>\n

There are several recent \u2018Cases on Point.\u2019 <\/strong>Apparently, imposing its will upon \u2018Commissioner of Police Atlee Rodney QPM,\u2019<\/strong> the \u2018Summary Transfer\u2019<\/strong> of a female officer, \u2018Superintendent of Police Louisa Quashie,<\/strong> speaks of his horrors with the \u2018Police Service Commission.\u2019<\/strong> Instructively, this female officer has not only demonstrated her loyalty and devotion to duty, but also an unmatched and undivided allegiance to the \u2018Police Service.\u2019 <\/strong>Even as she pursues an online academic course of studies in \u2018National Security and Strategic Management\u2019 [Mona Campus<\/strong>], she held responsibility for the \u2018Criminal Investigations Department\u2019 <\/strong>and the \u2018Professional Standards Unit.<\/strong>\u2019<\/p>\n

CLOBBERED INTO SUBMISSION<\/strong><\/p>\n

Even with these then assigned areas of responsibility, it was revealed that she had successfully utilized, balanced and managed the time, and had acquitted herself exceedingly well. Such time was devoted to the \u2018Call of Duty,\u2019<\/strong> family life and academic studies.\u2019 Then seemingly smarting under disguised acrimony, yet under \u2018Pretext of Hypocrisy,\u2019<\/strong> its membership reportedly advised \u2018Commissioner of Police, Atlee Rodney QPM,\u2019 <\/strong>verbally \u2018Clobbered <\/strong>into Submission\u2019<\/strong> by the \u20187-member PSC,\u2019 <\/strong>they contended that adequacy of time was essential to her continuing studies.<\/p>\n

PSC RULES AND DECIDES<\/strong><\/p>\n

Interestingly and commendably, these assignments, she reportedly accepted, thereby allowing for multi-tasking, strengthening resolve and building character. Now, even with the availability of several high-ranking officers, those apparently lacked competence, administrative knowledge and leadership and communication skills, saw a loyal, competent and efficient female officer of the \u2018Gazetted Rank\u2019 <\/strong>for whatever reasons, and without an opportunity to be heard as the \u2018Principle of Natural Justice\u2019 <\/strong>always dictates, unceremoniously and seemingly aided by the \u2018Commissioner\u2019s docility, the \u2018Police Service Commission (PSC)\u2019<\/strong> decided upon her removal from the \u2018Sir Wright F. Instructively, almost 50%<\/strong> of its members comprises of three \u2018Police Retirees.\u2019 <\/strong>Through the eyes of serving members,\u2019 the great majority have reportedly seen the small minority of members of the \u2018Commission\u2019 as morally depraved, evidenced by an attitude and behavior that speak to <\/strong>treachery, acrimony and retrogressive punishment. Serving members not only expect the \u2018Retirees\u2019<\/strong> to distinguish themselves, by providing leadership, but also in making a difference among the \u20187-member PSC.\u2019 <\/strong><\/p>\n

PROSPERING AND SUFFERING<\/strong><\/p>\n

Undoubtedly, these retired officers shall not only have been seen as \u2018taking something to the \u2018Police Service Commission.\u2019<\/strong> They have not only been seen as a disappointment too many, but also brought many to the point of despair. Thus, while the incompetent \u2018Prospered,\u2019<\/strong> the competent were reportedly \u2018Suffered.\u2019 <\/strong>This was said to have provoked angst in the membership of the \u2018Police Service.\u2019<\/strong> Unlike the \u2018Commissioner,\u2019 members of the \u2018PSC\u2019 <\/strong>would rather have personnel exposed to the \u2018Covid-19 Pandemic,\u2019 <\/strong>than providing them with opportunities for career advancement, based upon; (a) \u2018\u2026Merit: (b) \u2026Ability; and (c) \u2026Integrity\u2019 [Constitution Order: 1981: Principle: \u2018B\u2019]. <\/strong><\/p>\n

ADMINISTRATIVELY DEFICIENT<\/strong><\/p>\n

In recent times, however, particularly, the post tenure of; (i) \u2018\u2026Sir Wright Fitzhenly George KCN: MVO, QPM:<\/strong> (ii)<\/strong> \u2026Edric K. Potter QPM: (iii)<\/strong> \u2026Alvin Goodwin QPM; (iv)<\/strong> \u2026Truehart O.M. Smith QPM: and (v)<\/strong> \u2026Elton Martin QPM,\u2019 the \u2018Chairman\u2019 and members of the \u2018Police Service Commission (PSC),\u2019 have been accused of manipulating that which may have been detected as \u2018Administratively Deficient.\u2019 <\/strong>Given the understanding of the behavioral tendencies of the \u2018Police Service Commission,\u2019 reasonable inferences might be drawn that the members of the \u2018Police Service\u2019<\/strong> have harbored beliefs that among the membership of the \u2018PSC\u2019<\/strong> are members that have been seen as \u2018disdainful and vindictive.\u2019<\/p>\n

EMBARRASSMENT AND HUMILIATION<\/strong><\/p>\n

Showing intrusive inconsistency, a recent administrative move by \u2018Commissioner of Police Atlee Rodney\u2019<\/strong> seeking to position a male \u2018Gazetted Police officer,\u2019<\/strong> was said to have been aborted. The intention, was to provide exposure of the officer to actuality of \u2018Police Duties.\u2019 <\/strong>The primary objective, was to provide him with \u2018On-the-Job\u2019<\/strong> opportunity that he may have enhanced his knowledge and professional competence.\u2019 <\/strong>Whatever may have been the \u2018PSC\u2019s reasons, stiff resistance was said to have been encountered by \u2018Commissioner of Police Atlee Rodney QPM.\u2019<\/strong> Somehow, likened to a bullet-train leaving its track, the \u2018Police Service Commission (PSC)\u2019 <\/strong>was said to have made a timely \u2018Sheltered Intervention.<\/strong>\u2019 Thus, he may have been rescued from \u2018Embarrassment and Humiliation.\u2019<\/strong> Those familiar with the axiom, must know that shines as it may, the \u2018Moon could never hide from the Day.\u2019<\/strong><\/p>\n

DABBLING AND DICTATING<\/strong><\/p>\n

Even as some Chairpersons seemed to have believed,\u2019 no \u2018Police Service Commissioner\u2019<\/strong> has responsibility for; (i) \u2018Law Enforcement\u2019 <\/strong>and the \u2018Rule of Law.\u2019<\/strong> Members of such body that truly feel that way, may seek positional exchange with a \u2018Commissioner of Police.\u2019<\/strong> The apparent besetting difficulty <\/strong>facing \u2018Commissioners of Police, Atlee Rodney\u2019<\/strong> has been apparent \u2018Dabbling and Dictating\u2019<\/strong> by \u2018Police Service Commissions.\u2019<\/strong> Lack of appreciation for the responsibility, role and function of \u2018Commissioners of Police,\u2019<\/strong> have not only been statutorily stipulated, but also have been well defined [Sections 6, 22 & 23]. <\/strong><\/p>\n

FEAR – TREMBLING – INSECURITY<\/strong><\/p>\n

But even with organizational support and encouraging prompts, particularly by members of the officer corps, some \u2018Commissioners of Police\u2019<\/strong> appear unwilling to stand up to, rebuff or challenge those eloping and interfering with their administrative responsibilities.\u2019<\/strong> In conversations with past and currently serving members, most are convinced that \u2018Commissioner of Police, Atlee Rodney QPM,\u2019 seems resigned in accepting whatever was dished out upon him by the \u2018Police Service Commission (PSC).\u2019 From professional knowledge, a \u2018Commissioner of Police,\u2019<\/strong> taking this position, always runs the risk of being seen by subordinates as wimp, manipulatively vulnerable, docile and stupid.<\/p>\n

DICTA OF LORD DENNING<\/strong><\/p>\n

Notwithstanding its triple-constitutional function, as they inferentially affect \u2018Referrals\u2019 <\/strong>by the \u2018Commissioner of Police,\u2019 for; (i) \u2018\u2026Promotion: (ii) \u2026Transfer: and (iii) Disciplinary control,\u2019 <\/strong>by the dicta of \u2018Master of the Roll, Lord Alfred Thompson \u2018Tom\u2019 Denning [1899-1999],<\/strong> it has been settled law that<\/strong>; \u2018\u2026No Minister of the Crown and no Police authority shall dictate for the Commissioner of Police how he shall deploy his personnel, neither in enforcement of law, nor where they shall be posted\u2019 [1968: Regina v Metropolitan Commissioner of Police, Raymond Blackburn ex parte: 2 QB: 118, 134-136].<\/strong> Even with such authoritative position, widely referred to within the \u2018British Commonwealth,\u2019<\/strong> likened to many others across the region, \u2018Commissioner Atlee Rodney\u2019 <\/strong>not only appears apprehensive, but also mortally afraid of the \u2018Police Service Commission.\u2019<\/strong><\/p>\n

ELIGIBILITY AND SUITABILITY<\/strong><\/p>\n

Logic dictates that framers of the \u2018Constitution Order\u2019<\/strong> could never have intended the \u2018Police Service Commission\u2019 to usurp the authority of the Commissioner of Police, nor share his administrative and operational functions\u2019 by dictating who shall be promoted<\/strong> or who shall be transferred within the \u2018Police Service\u2019 or seconded elsewhere. Therefore, the \u2018PSC\u2019<\/strong> shall wield no power and authority or dictate to the appointed \u2018Commissioner of Police.\u2019<\/strong> Moreover, while, the membership may refuse to consider an appointment, administratively, the determination of \u2018Eligibility and Suitability,\u2019 <\/strong>reside with him\/her that commands and superintends the \u2018Police Service\u2019 [Section 6: Chapter 330]. The Constitution never intended another person or authority.<\/p>\n

EXPLOITATION AND MANIPULATION<\/strong><\/p>\n

Moreover, a \u2018Commissioner of Police\u2019<\/strong> shall know the \u2018Statutory Provision\u2019<\/strong> that states that he\/she is only; \u2018…Subject to the general directions of the Minister\u2019 [Section 6 (2)]. Logic therefore, dictates that likened to the \u2018Public Service Commission (PSC), while it is vested with authority to make; (a) \u2018\u2026A<\/strong>ppointments; (b) \u2026Transfers; and (c) \u2026Exercise disciplinary control,\u2019 should there be no \u2018Referrals or Recommendations\u2019 <\/strong>made by the \u2018relevant holder of the particular office, the Chair person and his members shall not interfere with the administrative functions of the \u2018Commissioner of Police.\u2019 <\/strong>Failing which, he shall face the inevitability of \u2018Exploitation\u2019 <\/strong>of his tolerance and docility or \u2018Manipulation\u2019 <\/strong>of his ignorance, simplicity and stupidity.<\/p>\n

FUNCTIONAL COOPERATION<\/strong><\/p>\n

Even as the functions of the \u2018Police Service Commission (PSC)\u2019<\/strong> are constitutionalized, it could never be said its chairman and membership have autonomous control over the Commissioner of Police and the Police Service. Given this fact, no Commissioner shall encourage their disruptive intrusion and divisive exploits. Though a \u2018Commissioner of Police\u2019 shall always be mindful of <\/strong>his \u2018Security and Longevity of Tenure,\u2019<\/strong> he\/she shall neither be perceived by his subordinates as being impotent nor incompetent. Though he is not a \u2018Frog,\u2019<\/strong> \u2018Commissioner of Police, Atlee Rodney QPM\u2019<\/strong> is yet to \u2018Croak.\u2019<\/strong> Ensuring that there shall be \u2018Functional <\/strong>Cooperation\u2019 and a desire for a stable \u2018Police Service,\u2019<\/strong> he sends no \u2018Message\u2019 <\/strong>that speaks to animosity, neither has he requested any to be delivered.<\/p>\n

CONCLUSION<\/strong><\/p>\n
