In their existence, some were known to have brought trials and tribulations for parents and woe unto themselves. The defiant, worthless and lawless were known to have caused many to fuss and frown. Then the bell tolled. They have left nothing but pain and sorrow, weeping and mourning. The distraught and traumatized mothers are overwhelmed with sadness and grief. These are not only part of the everyday human experience, but also speaks to the inevitability of that which shall occur in human socialization and existence.<\/p>\n

DEADLY SHOOTINGS\/KILLINGS<\/strong><\/p>

\"\"<\/a><\/div>\n

Frequently, there are \u2018Gun Battles.\u2019<\/strong> These are the doings of the lawless, retaliatory and \u2018Trigger-Happy Gunmen.\u2019<\/strong> Many were widely known to have sustained livelihood, albeit, without justification, by \u2018robbing the innocent, unsuspecting and defenceless citizens. Accompanied by aggravation, there is wounding, maiming, revengeful and coldblooded killings. In most instances, unknown gunmen have targeted rivals or those involved in gangsterism. These suggest two inferential and contributory factors: (i) \u2018\u2026The proliferation of firearms:<\/strong> and (ii) \u2026Easy accessibility.<\/strong>\u2019 Then there are the \u2018Deadly Shootings and Killings\u2019<\/strong> by overzealous agents of the State. The time may have arrived to scrutinize their \u2018Operational Behavior.\u2019<\/p>

PERSPECTIVE<\/strong><\/p>\n

Firstly, this commentary looks at the \u2018St Lucia Experience.\u2019<\/strong> Then it reflects upon that which daily \u2018Stares, Scares and Fears,\u2019 <\/strong>of the law-abiding citizen. It also reflects that which confronts the \u2018Security Forces.\u2019<\/strong> In the instant case, that which \u2018Police\u2019 <\/strong>reported was possessed by the deceased prison escapee, \u2018Shanell \u2018Malice, Mabz, Silence,\u2019 <\/strong>appeared not to have been recovered. That which now seems inexplicable, may be the apparent \u2018Imaginary Perceptions\u2019 <\/strong>of \u2018Unidentified Objects.\u2019<\/strong> It also looks at several \u2018Cases,\u2019 <\/strong>as they relate to recent \u2018Police\u2019<\/strong> reported \u2018Confrontational Killings.\u2019<\/strong> These are viewed from the perspective of consequential results of \u2018Gun Battles\u2019 <\/strong>reportedly ensued between; (a)<\/strong> \u2018\u2026Criminal Suspects; (b) \u2026Prison Escapees; <\/strong>and (c) \u2026Members of the Security Forces.\u2019 <\/strong>It is representative of well-known occurrences and researched information. Comprehensive, troubling and frightening, but worth reading.<\/p>

STRETCH OF IMAGINATION<\/strong><\/p>\n

By any \u2018Stretch of Imagination,\u2019 <\/strong>it could never be said that \u2018Prison Farm Escapee, Shanell Thomas\u2019 (deceased), <\/strong>ever went in search of a \u2018Police Search or Hunting Party,\u2019 <\/strong>to combatively engage them in \u2018Gun Battles or Shootouts.\u2019<\/strong> Neither can it be officially said that he was lying in wait to ambush any such party. Given the adequacy of \u2018Fire Power,\u2019 it would be considered idiocy or lunacy, to seek to engage these \u2018Criminal Combatants.\u2019<\/strong> As far as was universally known, it was always the duty of the Security Forces to search for \u2018Criminal Suspects or Escapees\u2019<\/strong> from \u2018Legal Confinement.\u2019<\/strong> Seeking out their whereabouts when at-large, was always dependent upon (a)<\/strong> \u2018\u2026Criminal Intelligence; (b) \u2026Public trust, confidence and support;<\/strong> and (c) \u2026Cooperation of the civic-minded and law-abiding citizens.\u2019<\/p>

NARRATIVE \u2013 CONFRONTATION WITH POLICE<\/strong><\/p>

\"\"<\/a><\/div>\n

Seemingly out of an abundance of caution, the \u2018Prison Farm Escapee Shanell \u2018Malice, Mabz, Silence\u2019 Thomas\u2019<\/strong> reportedly requested the assistance<\/strong> of a religious leader, \u2018Bishop Charlesworth Browne.\u2019 <\/strong>A preacher is more trusted, than a \u2018Police officer\u2019<\/strong> holding a \u2018Bible.\u2019<\/strong> He may have been aware of the only \u2018Known Narrative\u2019<\/strong> was that he had a \u2018Confrontation with the Police\u2019 <\/strong>[Press Association: June 21, 2014]. <\/strong>In spite unfounded and misleading media reports, in the instant case, \u2018Police\u2019 have yet to confirm; (i) \u2018\u2026A violent confrontation: (ii) \u2026Exchange of gunfire; and (iii) \u2026Recovered \u2018Perceived Object\u2019 <\/strong>they saw the deceased removed from his waist\u2019 [ANR: February, 9, 2022].<\/strong><\/p>\n

GLOBAL STATISTICS<\/strong><\/p>\n

Startlingly and frighteningly, \u2018Global and National Gun Deaths\u2019<\/strong> showed numbers surging and fluctuating yearly. For instance, \u2018Global Statistics\u2019<\/strong> show some \u2018250, 000 Gun Deaths<\/strong>\u2019 annually, while nationally, \u2018Gun Deaths\u2019 statistically numbered for the \u2018Years 2000 \u2013 2017,\u2019 <\/strong>stood at 79\u2019 [Gun Policy.org].<\/strong> Grief-stricken \u2018Mothers\u2019<\/strong> were often forced to turn to the \u2018Heavens,\u2019 seeking \u2018Divine Intervention.\u2019<\/strong> Most cried, \u2018\u2026Lord, why me: \u2026Give me strength to overcome tragedies and associated pain, sorrow and punishing grief.\u2019<\/strong><\/p>\n

  1. LUCIA EXPERIENCE<\/strong><\/li>\n<\/ol>\n

    That which had telling effect were suspension of training and other assistance, while \u2018Senior Police officers\u2019<\/strong> had their \u2018Non-Immigrant Visas\u2019 cancelled. <\/strong>That which the Officers appeared not to have appreciated or reckless not to know, was that when they would have; (a) \u2018\u2026Trained; (b) \u2026Developed killing instinct; and (iii) \u2026Deployed them with such \u2018Aims and Objectives,\u2019 <\/strong>while the \u2018Crime Statistics\u2019 <\/strong>and criminal population may decrease, statistics for \u2018Extra-Judicial Killings,\u2019 will increase. Research has shown that \u2018between 20 10 and 2011\u2019<\/strong> the \u2018Killer Unit\u2019 eliminated eleven (11) Criminal Suspects\u2019 [SL News Online:].<\/strong> When no administrative action appeared not to have been taken to control their \u2018Killing Instinct,\u2019<\/strong> while prosecutorial proceeding appeared remote from Courts of Law, then \u2018US Assistant Secretary of State, Ambassador William R. Brownfield\u2019 <\/strong>spoke to the issue of unaccountability.<\/p>\n

    PROTECTION OF LIFE\/LIBERTY<\/strong><\/p>\n

    Not infrequently, tragedy suddenly strikes. This often comes at the hand of people charged with responsibility for the \u2018Protection of Life, Limb and Liberty.\u2019 <\/strong>That which the \u2018International Security Sector Advisory Team (ISSAT), <\/strong>has advised those that govern. In its \u2018Executive Profile Summary\u2019<\/strong> that Government shall \u2018\u2026Ensure the Police Force is both transparent and accountable [Geneva: ISSAT: February 1, 2015].<\/strong> Given the \u2018St. Lucia Experience,\u2019<\/strong> those that govern and\/or have responsibility for security, may wish to heed such advice. Consequent upon such, this nation may never be deemed a \u2018Pariah State\u2019<\/strong> [The Telegraph: March 9, 2015: PM, Dr. Kenny Anthony: St. Lucia].<\/strong><\/p>\n

    MOST DAMNING<\/strong><\/p>\n

    Sensing international repercussions as they affect \u2018Violations of Human Rights,\u2019<\/strong> a \u2018Commissioned Report\u2019<\/strong> documented facts that unreasonable suspected criminals numbering, \u2018\u20265 was shot dead in a single operation.\u2019<\/strong> The \u2018Most Damning\u2019<\/strong> had been the \u2018roguish behavior of the Unit. The Report states, \u2018\u2026The officers staged a dozen shootings and reported them as murders by unknown assailants, planting weapons at the scenes.\u2019<\/strong> Additionally, \u2018Fake encounters were staged by the Police to legitimize their actions.\u2019<\/strong> These revelations were not only startling, but also compelled \u2018Prime Minister Dr. Kenny Anthony\u2019<\/strong> to in addressing his nation, that the \u2018\u2026Report is extremely damning\u2019<\/strong> [The Telegraph: March 9, 2015].<\/p>\n

    THRESHOLD OF JUSTICE<\/strong><\/p>\n

    Lest this nation\u2019s \u2018Police Service\u2019<\/strong> be viewed and treated like neighboring \u2018St. Lucia,\u2019<\/strong> the time has, perhaps come for review of the operational behavior, actions and activities of the \u2018Special Services Unit (SSU). <\/strong>Prime Minister \u2018Gaston Browne\u2019<\/strong> shall never be so positioned as to be coerced by the international community to mount inquiry into the \u2018Operational Behavior\u2019<\/strong> of the nation\u2019s \u2018Security Forces.\u2019 <\/strong>Luckily, in the case of the suspected kidnap\/killing of \u2018Falmouth resident \u2018Bruce Greenaway,\u2019 <\/strong>the alleged perpetrators have been brought to the \u2018Threshold of Justice\u2019 [ANR: June 5, 2020].<\/strong><\/p>\n

    DEADLY CONSEQUENCES<\/strong><\/p>\n

    Likened to every other regional and international jurisdiction, when gunshot rang out on the streets and communities, frequently tragedy strikes. Invariably, it not only comes with shocking and lightning speed, but with serious or \u2018Deadly Consequences.\u2019 Frequently, s<\/strong>ome innocent, or not so innocent person, is gunned down. Someone lay seriously or fatally wounded. A son\u2019s or daughter\u2019s life has been tragically snuffed out. Invariably, this often comes by the retaliatory, revengeful and merciless \u2018Gunmen.\u2019<\/strong><\/p>\n

    ESCAPE TO DIE<\/strong><\/p>\n

    Though not necessarily so expected, several \u2018Convicts and Criminal suspects\u2019<\/strong> have all \u2018Escaped to Die.\u2019 <\/strong>Instructively, most victims of \u2018Police Fire Power,\u2019 <\/strong>have either died instantaneously, or as has often been reported, \u2018when being transported to the hospital.\u2019<\/strong> The latter has been the account of officers with \u2018Fingers\u2019<\/strong> that knows nothing, but \u2018Gun Happiness.\u2019<\/strong> Such happiness often comes when conducting \u2018Special Operations,\u2019 either in in the course of apprehension of \u2018Criminal Suspects\u2019 <\/strong>or Escapees from legal confinement.\u2019<\/strong> Shrewed investigation into circumstances surrounding these killings, may very well show that some may either beg for \u2018Reality or Justification\u2019<\/strong> for \u2018Use of Lethal Force.\u2019<\/strong><\/p>\n

    PROSECUTORIAL CONSEQUENCES<\/strong><\/p>\n

    Even as \u2018Combative Policemen and Gunmen\u2019<\/strong> know that fire shall be fought with fire, Law enforcement shall know when to suppress their over exuberance and apparent \u2018Killing Instinct,\u2019 under the guide of \u2018Crime Fighting.\u2019<\/strong> Thus, they shall employ professional restraint. Failing which, may lead to all kinds of operational, inquisitional and possible prosecutorial difficulties. The experience of \u2018former Police Constable Keville Nelson\u2019 <\/strong>makes the point\u2019, Being reckless and not foreseeing \u2018Prosecutorial Consequences,\u2019<\/strong> he was charged with, prosecuted for murder, tried by Jury and so convicted. He was slapped a 22-year term of imprisonment; had it reduced by two by the \u2018Eastern Caribbean Supreme Court (ECSC),<\/strong>\u2019 and slapped back on by the \u2018London Privy Council\u2019<\/strong> [UK: jcpc: No. 0021 of 2014].<\/p>\n

    SANCTITY OF LIFE<\/strong><\/p>\n

    Law enforcers shall be reminded of three things. They shall know; (i) \u2018\u2026For what purpose the Police exists; (ii) \u2026Its purpose; and (iii) \u2026Overriding Goal.\u2019 <\/strong>From these perspectives, it could never be said to; (a) \u2018\u2026Search for; (b) \u2026Shoot on sight; and (c) \u2026Kill with impunity.<\/strong>\u2019 The terminology \u2018Sanctity of Life\u2019<\/strong> is contextually used. It has been the universal understanding that \u2018Life\u2019 precious, sacred and holy\u2019 [Wikipedia]. <\/strong>The \u2018Constitution Order\u2019<\/strong> speaks to due regard to such \u2018Sanctity.\u2019 <\/strong><\/p>\n

    MARCH TO CEMETERY<\/strong><\/p>\n

    In recent times, Law enforcement seemed to have developed a frightening \u2018Trigger-Crazy\u2019<\/strong> pattern of behavior. This may have been evident by clearly telegraphed \u2018Messages\u2019 <\/strong>to those deemed \u2018Wanted by Police,\u2019 or<\/strong> when declared \u2018Armed and Dangerous.\u2019 <\/strong>Inferentially, this necessarily means that \u2018Gun Death\u2019 <\/strong>was looming. Therefore, it means \u2018surrender voluntarily and peacefully\u2019 or be prepared for a slow \u2018March to the Cemetery.\u2019<\/strong> There are \u2018Cases on Point:\u2019<\/strong> Most recently, there has the killing of \u2018Prison Farm Escapee, Shanell \u2018Malice, Mabz, Silence\u2019<\/strong> [ANR: February 9, 2022].<\/p>\n

    3 OTHERS WIPED OUT<\/strong><\/p>\n

    Then there were the apparent \u2018Hunted Robbers;\u2019<\/strong> (i) \u2018\u2026<\/strong> Ronald Bloodman 28: (ii) \u2026Kendall Joseph 34.\u2019 <\/strong>News portal reports states; \u2018\u2026Both men were shot multiple times about their body in a confrontation with Police\u2019 [Freedom FM: 106.5: February27, 2015]. <\/strong>Then a third robber suspect, \u2018Chad Bloodman\u2019 reportedly, suffered similar demise. \u00a0<\/strong>The robbery-suspects were alleged to have been involved in the \u2018Antigua Public Utilities Authority Credit Union\u2019<\/strong> hoist.\u2019 Then within 24 Hours,\u2019<\/strong> the trio were completely \u2018Wiped out.\u2019 <\/strong>When third suspect-robber \u2018Chad Bloodman\u2019 <\/strong>was \u2018Gunned Down,\u2019 <\/strong>the said news portal reported; \u2018\u2026Bloodman was shot during a confrontation with the Police at a house in Hatton\u2019<\/strong> [721 News: March 20, 2021]. <\/strong><\/p>\n

    GUN WRATH- ANOTHER 3<\/strong><\/p>\n

    Then an operation conducted under cover of darkness, saw the \u2018Double Killing\u2019<\/strong> of \u2018Suspected Robbers;\u2019<\/strong> (iv)<\/strong> \u2018\u2026Travis \u2018Ten Pound\u2019 Martin-Bailey;<\/strong> and (v) \u2026Jamelle \u2018Marlo\u2019 Hurst\u2019 [Wic News: October 6, 2017]. <\/strong>Their \u2018bullet-riddled bodies,\u2019 <\/strong>speaks to the \u2018Gunny Wrath\u2019<\/strong> of the Police. Additionally, in a reported \u2018Gun Battle\u2019<\/strong> at his \u2018Carlisle\u2019s Apartment,<\/strong>\u2019 disputed by residents, it saw the killing by Police of; (vi)<\/strong> \u2026Bail absconder \u2018Kurt \u2018Shabba\u2019 James.\u2019 <\/strong>He was also reported to have been wanted for an allegation of rape\u2019 [Commonwealth of Dominica:<\/strong> January 3, 2016: Q95FM News]. <\/strong>If these killings do not now give rise to official concern, then what will?<\/p>\n

    FOREVER SILENCED<\/strong><\/p>\n

    Undeniably true, with no independent eyewitnesses or verifiable sources,\u2019 as the dead is \u2018Forever Silenced,\u2019<\/strong> only the living may tell tales. Since Police Services have been charged with responsibility for the \u2018Protection and Preservation of Life,\u2019<\/strong> civilized societies, necessarily expects those so responsible to be mindful of; (i) \u2018\u2026Incivility; (ii) \u2026Insensitivity: and (iii) \u2026Excessive or avoidable lethal or deadly use of force.\u2019 <\/strong>Concerning; (a) \u2018\u2026Accountability; (b) \u2026Transparency; and (c) \u2026Rule of Law,\u2019 <\/strong>justice dictates that acts that have resulted in the calculated, senseless and reckless loss of life, and appear \u2018Starved for Justification,\u2019<\/strong> such acts shall be dealt with \u2018Full Severity of Law.\u2019<\/strong><\/p>\n

    STRANGER THAN FICTION<\/strong><\/p>\n

    Dependent upon who presented the \u2018Narratives,\u2019<\/strong> some accounts or stories often seemed \u2018Stranger Than Fiction.\u2019<\/strong> The latest, being the \u2018Tragic Killing\u2019<\/strong> of escaped prison inmate \u2018Shanell \u2018Malice, Mabz\u2019 Thomas.\u2019<\/strong> As dead men tell no tales, under cover of darkness \u2018Police\u2019 reported that he pulled \u2018an Object from his waist. Consequent upon which, it followed that there were deadly consequences. \u00a0<\/strong>That which seemed \u2018Stranger Than Fiction,\u2019<\/strong> was that on a dark night, in a frightening deserted bushy irregularly-used roadway, he encountered an unspecified number of \u2018Police officers\u2019<\/strong> that reportedly, \u2018\u2026responded to a report.\u2019<\/strong><\/p>\n

    CONSTITUTIONAL EXCEPTIONS<\/strong><\/p>\n

    With some \u2018Constitutional Exceptions,\u2019 <\/strong>it states; \u2018\u2026No person shall be deprived of his\/her life intentionally,<\/strong> save and except as may be authorized by law in any of the following cases: (a) <\/strong>\u2018\u2026Defence of the person\/property; (b) \u2026In effecting a lawful arrest\/prevent escape of lawful detainees<\/strong>: (c) \u2026Suppression of insurrection (coupe-de-tat): and (d) \u2026Lawfully preventing a serious crime <\/strong>or act of war\u2019 [CO: 1981: Section 4]. <\/strong>\u00a0In the event of fatality, it has been the \u2018Judicially-Noticed\u2019 <\/strong>pre-requisites that where situations demand or circumstances dictate, that whether or not \u2018Defensively or Protectively,\u2019<\/strong> where persons shall be deceased, there shall be; (a) \u2018\u2026Due process of law; <\/strong>while (b) \u2026The principle of natural justice shall be given judicial regard.\u2019 <\/strong><\/p>\n

    PRESUMPTION OF SANITY<\/strong><\/p>\n

    In most democracies, it has been accepted that good policing practices are essential to developing and garnering public support. These are further strengthened by trust and confidence in the \u2018Administration of Justice.\u2019 <\/strong>Thus, as judicial systems allow all persons, including members of the \u2018Security Forces,\u2019<\/strong> the \u2018Presumption of Sanity,\u2019 <\/strong>none shall, with reckless abandon descend his\/her wrath upon any person, neither emotionally nor impulsively. In recent times, \u2018Escaped convicts and Criminal Suspects,\u2019<\/strong> appeared to have always come under the receiving end of \u2018Police Marksmanship.\u2019<\/strong><\/p>\n

    CIRCUMSTANCES OF SUSPICION<\/strong><\/p>\n

    Likened to those institutionalized, as well as those in the wider society, there has been as much \u2018Danger\u2019 <\/strong>as there have been \u2018Tragedies.\u2019<\/strong> These not only come suddenly upon the citizenry, bringing to them devastating consequences, but also \u2018Circumstances of Suspicion.\u2019 <\/strong>Not infrequently, \u2018Gullible Media Personnel\u2019<\/strong> appear to have always been fed information that those engaged in \u2018Police Gun Battles\u2019 <\/strong>had \u2018Confrontational Encounters\u2019 <\/strong>with criminal suspects. \u00a0<\/strong>These reporters would wish listeners and readers of the news that these \u2018Special Unit Officers\u2019<\/strong> were endowed with more skills than those they kill in \u2018Dodging Bullets.\u2019<\/strong><\/p>\n

    MEDIA GULLIBILITY<\/strong><\/p>\n

    Instructively, \u2018Media Gullibility,\u2019<\/strong> invariably appears compounded by mediocrity and reeks of professional incompetence. For in these reported \u2018Combative Incidents,\u2019<\/strong> neither the Police have reported casualties among themselves regarding gunshot injuries or loss of life. Seemingly \u2018Protected by Grace,\u2019<\/strong> they have always escaped either \u2018Gun Battle; \u2026Early Morning Gunfire; \u2026Nighttime Encounters <\/strong>or from a \u2026Hail of bullets.\u2019 <\/strong>True or false, these \u2018Battles\u2019 have always raised serious concerns and questions. None appears more troubling for both an aggrieved, distraught and traumatized woman \u2018Winifred Thomas,\u2019 mother of \u2018Prison Farm-Escapee, Shanell \u2018Malice, Mabz, Silence\u2019 Thomas 34.<\/strong><\/p>\n

    ESCAPE ARTISTS<\/strong><\/p>\n

    In some \u2018Gun Battles,\u2019<\/strong> likened to \u2018Escape Artist Harry Houdini,\u2019<\/strong> members of the \u2018Security Forces,\u2019 <\/strong>often came out unscathed and without loss of life. Instructively, the \u2018Prison Farm Escapee\u2019<\/strong> was not only aware of his religious background, but also his position as \u2018Chairman of the Prison Visiting Committee.\u2019<\/strong> His assistance was to guide safe passage back into the penal institution. Reportedly, he had been in communication with his mother, arranging his return to \u2018Legal Confinement.\u2019<\/strong> In that conversation he had reportedly refuted \u2018Police Claims\u2019 <\/strong>that he was seen armed with a \u2018Firearm\u2019<\/strong> in the \u2018New Winthorpes Community.\u2019 <\/strong>Logic dictates, that his second encounter may have revealed or confirmed such possessed weapon as opposed to \u2018an Unidentified Object\u2019 [ANR: February 9, 2022]. <\/strong><\/p>\n

    SHADOW OF DOOM<\/strong><\/p>\n

    Seemingly given special privilege to be on the \u2018Diamond Prison Farm Gang.\u2019 <\/strong>Savoring an apparent unsupervised opportunity, to dash for his liberty, had eventually turned out to be fatal. Privileged information revealed that the \u2018Escapee\u2019<\/strong> was not only fearful of the \u2018Lethal Weapons\u2019 expected to be possessed by members of the \u2018Security Forces.\u2019<\/strong> but also of the personnel who possessed them. Thus, he may have had very good reasons to have harbored feelings and beliefs, that the \u2018Shadow of Doom\u2019<\/strong> was hovering.<\/p>\n

    EXTRAJUDICIAL ACT<\/strong><\/p>\n

    From professional knowledge, clearly a troubled youth seized an opportunity to regain his liberty. He was reportedly serving a lengthy prison sentence. Judicially, he was convicted for; (i)\u2019<\/strong>\u2026Kidnapping two females, ages 42 and 24: (ii) \u2026Aggravatedly robbed them; and (iii) \u2026Attempted to murder them\u2019 [March 3, 2017]. <\/strong>Today, prima facie evidence has suggested an apparent \u2018Extrajudicial Act\u2019 <\/strong>may have been perpetrated against him.
