The Nation\u2019s Youth were often stigmatized as; (a)<\/strong> \u2018\u2026Lazy and unproductive: (b)<\/strong> \u2026Unenterprising and unindustrious.\u2019 Society, along with some public officials, were not so kind to these unfortunate youth. Thus, neither in thought, word nor deed have they seen the way to reach out to them. It may have been for the latter reason that the Constitution speaks to a fundamental principle. The principle states; \u2018\u2026The people of Antigua and Barbuda respect the principle of social justice and, therefore, believe that the operation of the economic system should result in the material resources of their community being so distributed as to; (a)<\/strong> \u2018\u2026Serve the common good: and (b) \u2026There shall be adequate means of livelihood.\u2019 Most importantly, the Constitution clearly states; \u2018There should be opportunity for advancement\u2019 <\/strong>[CO: 1981: Principle: B]. This is a constitutional responsibility placed upon public administrators.<\/p>\n

ROBBERS AND THIEVES<\/strong><\/p>

\"\"<\/a><\/div>
\"\"<\/a><\/div>\n

Not infrequently, some of these \u2018Youth\u2019<\/strong> have been labelled as \u2018Robbers and Thieves.\u2019<\/strong> There have been others that have often been called: (a)<\/strong> \u2018\u2026Burglars and Gunslingers: (b)<\/strong> \u2026Drug dealers and drug pushers.\u2019 Then those without gainful employment who constantly sits idly and unproductively at street corners, were often accused of being \u2018Hooked on Marijuana.\u2019<\/strong> Still, there has been a category of persons that were often seen drifting aimlessly and hopelessly on the streets of St. John\u2019s. They were often observed scavenging in garbage bins or plastic bags and other receptacles for a \u2018Hungry Bite.\u2019<\/strong> These people were often referred to as either \u2018Crack-heads.\u2019<\/strong> Their homes were the streets, while the means of sustenance came from \u2018Pitch-In\u2019 to strategically-located garbage bins. The lot of \u2018The Parham 5,\u2019 <\/strong>though filled with misery, uncertainty and frustration, yet was incomparable.<\/p>

\"\"<\/a><\/div>\n

PERSPECTIVE<\/strong><\/p>\n

Showing industry and enterprise, \u20185 ambitious and self-motivated Youth,\u2019<\/strong> endeavoring to carve out a legitimate livelihood in the nation\u2019s struggling economic system, sought and obtained from the relevant authority permission to set up and conduct \u2018an Ital Food Shop.\u2019<\/strong> They were greatly revered for their enterprising spirit. \u00a0Then apparent institutionalized adversity struck. This commentary, therefore, looks at the \u2018Might of the DCA\u2019<\/strong> and \u2018Plight of \u20185.<\/strong> They had reportedly embarked upon a business venture that appeared to have provoked the envy of residential bigots and the wrath of a \u2018Backhoe operator.\u2019<\/strong> He was said to have been acting under the authority of an apparent merciless agency of the State, the \u2018Development Control Authority (DCA).<\/strong>\u2019<\/p>

\"\"<\/a><\/div>\n

RULE OF LAW<\/strong><\/p>\n

None may deny that both \u2018Government and People\u2019<\/strong> are governed by the \u2018Rule of Law.\u2019<\/strong>\u00a0 When one speaks to this concept, one shall understand that such is \u2018\u2026A rule of law, made by some superior by which an inferior is bound to obey\u2019<\/strong> [Law Enforcement Training]. The \u2018Physical Planning Act\u2019 <\/strong>has made it sufficiently clear, that even \u2018Second Form Students\u2019<\/strong> of the \u2018Sir Novell Richards Academy (SNRA)\u2019 <\/strong>and his grandchildren shall enjoy effortless comprehension.<\/p>

\"\"<\/a><\/div>\n

OBEDIENCE TO LAW<\/strong><\/p>

\"\"<\/a><\/div>\n

Invariably, some public officers and public officials harbor the belief that the \u2018State\u2019<\/strong> can do no wrong. Some also believe that \u2018State Agencies\u2019 are at their disposal to be used against the citizenry at will. This is clearly not the case. If only for the benefit of the citizenry and those public officers and officials in want of sensitivity training and compassion, it was considered useful to refer to the \u2018Founding Constitution Principle.\u2019<\/strong> It reads; \u2018Whereas the people of Antigua and Barbuda recognize that the Law symbolizes the public conscience, every person owes to it an undivided allegiance: and that the \u2018\u2026State is subject to the Law.\u2019 <\/strong>What this means is that those placed in administrative or enforcement positions, shall not only be compliant, but also show \u2018Obedience to Law.\u2019<\/strong><\/p>\n

FEW DO WELL \u2013 MANY CATCHES HELL<\/strong><\/p>\n

Framers of the Constitution anticipated that: (a)<\/strong> \u2018\u2026Governing Administrations: (b)<\/strong> \u2026Statutory Bodies or State agencies and agents, including \u2018Physical Planners,\u2019<\/strong> may exercise powers arbitrarily or wield such power acrimoniously or punitively or in a victimizing way, they prudently inserted this seemingly frequently \u2018Overlooked or Ignored Clause.\u2019<\/strong> It states; \u2018\u2026The State is subject to the Law\u2019 [CO: 1981: Principle: D]. <\/strong>What this particular Clause is in effect saying, is that a State that makes laws, shall itself obey the said laws. Thus, likened to the citizens, this shall be done by its agencies, agents and employees. Incidentally, the framers also anticipated that some administrations may create investments climate, whereby those investing capital shall \u2018Do Well,\u2019<\/strong> while indigenous citizens, shall encounter innumerable \u2018Bureaucratic Challenges,\u2019<\/strong> whereby many indigent citizens were made to feel resign to \u2018Catch hell.\u2019 <\/strong><\/p>\n

GOVERNMENT AND PEOPLE<\/strong><\/p>\n

Concerning the \u2018Law,\u2019<\/strong> few citizens need to be reminded that the small twin-island nation of \u2018Antigua and Barbuda\u2019<\/strong> is founded upon the \u2018Principle of Law.\u2019<\/strong> Unlike other societies, where societal lawlessness is rampant, the great majority of the citizenry has recognized this principle. In so doing, they are generally seen as law-abiding. While a small minority has displayed an unruly propensity, they shall know there are consequences for acts or omissions not in keeping with the law. This is true of any act of defiance to \u2018Enforcement Notices or Orders\u2019<\/strong> legitimately issued by the competent \u2018Authority- Development Control Authority (DCA)\u2019 [Physical Planning Act: No.6 of 2003].<\/strong><\/p>\n

FLY-BY-NIGHT INVESTORS<\/strong><\/p>\n

Many local and regional social commentators had long anticipated such developments. When prophetic social commentator, \u2018Sir MacLean Emmanuel, Mighty Monarch, King Shortshirt\u2019<\/strong> sought to impress upon the mind of the nation\u2019s youth; \u2018\u2026Teenagers take it cool; \u2026We go build you technical school,\u2019<\/strong> he had obviously had seen the difficulties adult citizens had in eking out a decent living for themselves and families. Moreover, he wanted every able-bodied teenaged male and female to be well-positioned to eke out a legitimate living in their beloved island-nation \u2018Antigua and Barbuda.\u2019<\/strong> Thus, he wanted no citizen, matured and youthful to be mere \u2018Hewers of wood and carriers of water\u2019 <\/strong>[Song: Technical School]. He also expressed serious concerns over the way the nation\u2019s \u2018Land Asset\u2019<\/strong> was being distributed and\/or exploited by soc-called \u2018Fly-By-Night Foreign Investors.\u2019<\/strong><\/p>\n

SAVAGELY DEVOURED<\/strong><\/p>\n

Conscious of the situation and the negative impact on their socio-economic well-being and the quality of life, he spoke in songs to the policy-makers, the pitfalls of their desire for \u2018Foreign Investments.\u2019<\/strong> These he identified as; (i) \u2018\u2026Over-lease of land; (ii) \u2026Starvation: and (iii) \u2026Frustration.\u2019 <\/strong>\u00a0He was reportedly kicked off \u2018Halcyon Beach,\u2019 <\/strong>he was said to have been operating the \u2018Shortshirt Bar-B-Q\u2019 Bar and Restaurant.<\/strong>\u2019 Supplementing his cultural income, he was also said to have engaged in a thriving \u2018Water Taxis Business.\u2019 <\/strong>He was offering visitors to these shores \u2018Glass Bottom Boat\u2019 <\/strong>excursions around the island. Then, instead of him being \u2018Empowered,\u2019 <\/strong>his business was said to have been \u2018Savagely Devoured.\u2019 <\/strong><\/p>\n

SELLING BLACK BIRTH RIGHT<\/strong><\/p>\n

He was kicked off the \u2018Beach at Halcyon\u2019 <\/strong>where he conducted his business [1980s]. In one of his social commentaries, he called upon all sitting administrations to \u2018Share The Honey\u2019 [1992]. <\/strong>Then singing on adverse conditions in the country, he belted out, \u2018\u2026I love Antigua; \u2026Way beyond measure: \u2026If honey in the land; \u2026All Antiguans want their share\u2019<\/strong> [YouTube]. He was adamant and made it known that \u2018Nobody Go Run Me,\u2019<\/strong> because, as he puts it; \u2018Me Momma: \u2026Poupa: \u2026Pickney: and \u2026Me Woman must Nyaam\u2019<\/strong> [Song: Nobody Go Run Me]. Today, he might be fuming mad with similar fate suffered by \u20185- Entrepreneurial Youth.\u2019<\/strong> Likened to \u2018Sir MacLean Emanuel,\u2019 another social commentator \u2018Sir Paul Richards,\u2019<\/strong> dubbed the most thought-provoking and \u2018Obstinate Calypsonian\u2019<\/strong> had serious concerns about what the \u2018Black Politicians\u2019<\/strong> was likely to do.<\/p>\n

NO LAND TO OWN<\/strong><\/p>\n

Eventually, the administration appeared to have given him good reasons to grumble. When he could not \u2018Get a piece of land to own,\u2019 <\/strong>seemingly out of frustration, anger and despondency, he sang to then \u2018Prime Minister Sir Vere Cornwall Bird,\u2019<\/strong> \u2018\u2026If you only know half the things Lester does do: \u2026Ah coming down to talk to you.\u2019 <\/strong>Singing accusingly, he let the nation know that; \u2018\u2026They sell out me black birth right.\u2019 <\/strong>Then sensitizing the citizens, he sang; \u2018\u2026With all the money me and me pickney have, me can\u2019t get a piece to buy.\u2019 Today\u2019s citizens and today\u2019s youth continue to sing the same song.<\/p>\n

PRODUCTIVELY OCCUPIED<\/strong><\/p>\n

Seemingly troubled by impoverishment, under-employment and\/or lack of employment, they reportedly pooled whatever limited financial resource they acquired. Thus, entering into partnership with each other and embarked upon their own business. The youth, identified as; (i) \u2018\u2026Malcolm Reid 27: (ii) \u2026Davontee Joseph 26: (iii) \u2026Kimani Gardner 26: (iv) \u2026Tyree Smith 26; and (v) \u2026Dequan Peters 26,\u2019<\/strong> showed a resolve in becoming resourceful and acting legitimately. Though they were not otherwise gainfully employed, they seemingly had a resolve to be \u2018Productively Occupied.\u2019<\/strong> Hence, they had reportedly displayed no propensity toward being involved in acts of criminality.<\/p>\n

INDUSTRY AND ENTERPRISE<\/strong><\/p>\n

The movable structure in which business was conducted was never seen as an eyesore. Neither to community residents, nor drive-through visitors. They were clearly not squatters. It was lawfully erected at a locale, several yards westward from the \u2018Parham Seventh Day Adventist Church.\u2019<\/strong> It was within close proximity of the residence of a well-known Parham family. Nationally known for their intellect, education, public service and governance,\u2019 a person of lowly status could easily become a \u2018Cockroach in a Fowl Coop.\u2019<\/strong> While they have been reportedly approached by nearby resident another \u2018Youthful\u2019<\/strong> community member \u2018Dr. Courtney Lewis,\u2019<\/strong> concerning the noise level, they have not taken aught against him.<\/p>\n

TOTAL DESTRUCTION<\/strong><\/p>\n

It was no illusions when Jamaican and internationally acclaimed reggae icon \u2018Robert Nestor Marley,\u2019 <\/strong>more fondly and widely known as \u2018Bob Marley\u2019 <\/strong>sang; \u2018Ambush in the Night.\u2019 <\/strong>The lyrical content showed clearly that evil forces were at work to eliminate humanity. Conscious of their evil deeds, \u2018Bob\u2019 <\/strong>sang these particular lines for \u20185 Parham Youth<\/strong>; \u2018\u2026They fighting for power; \u2026But they know not the hour\u2019 [YouTube: 1979]. <\/strong>Incidentally, in spite of reported \u2018DCA Warnings\u2019<\/strong> and a timeline to remove the offending structure, it was they who knew not the \u2018Hour of Demolition.\u2019 <\/strong>Their business enterprise was facing total destruction.<\/p>\n

AMBUSHED IN THE MORNING<\/strong><\/p>\n

The youth were \u2018Ambushed in the Morning\u2019<\/strong> [Friday 14, January, 2022].\u00a0 According to eye-witness\u2019 reports, the painted \u2018Black, gold and green colour structure,\u2019 surreptitiously came under the machine-wrath of the \u2018Country Planners\u2019 <\/strong>and the State\u2019s agency called the \u2018Development Control Authority (DCA). <\/strong>On that fateful morning, for these youth, it was all over. In \u2018One Fell Swoop,\u2019<\/strong> \u00a0the approximately \u201810×14\u2019 <\/strong>wooden and galvanize corrugated sheets \u2018Ital Food Shop\u2019<\/strong> was backhoed to the ground. It was reduced to a pile of debris. In spite of its legally enforceable powers, many family and community members, public officials, attorneys-at-law and empathizers, have asked two fundamental questions; (i) \u2018\u2026Where is the humanity in the DCA Board? and (ii) \u2026Where is the youth empowerment?\u2019<\/strong><\/p>\n

BIGOTRY AND NEPOTISM<\/strong><\/p>\n

Then, as reported on social media, \u2018Bigotry and Nepotism\u2019<\/strong> surfaced as being at the center and reasons for the \u2018Demolition Order.\u2019 <\/strong>The \u2018Notice of Demolition\u2019 <\/strong>was said to have provided \u2018Seven (7) Business Days\u2019<\/strong> to remove the illegal structure.\u2019 If the \u2018Principle of Justice\u2019<\/strong> was to prevail, then such Notice may also have been guided by provisions that allow for a \u2018High Court Appeal.\u2019<\/strong> Seemingly acting under pretext for the demolition, there had been speculative suggestions that residents in the immediate surroundings had complained to the \u2018DCA\u2019<\/strong> of loud noises being emanated from the premises, while \u2018Spurious Allegations\u2019<\/strong> of criminal activities being committed within the structure.<\/p>\n

TWINKLE OF AN EYE<\/strong><\/p>\n

In the \u2018Twinkle of an Eye,\u2019 they have seen their investments destroyed. Thus, they have seen their hope dwindled, dreams shattered and aspirations blown into the atmosphere like the ash emitted from the recent explosive eruption of the \u2018Tonga Volcano\u2019<\/strong> [SPACE Com: January 15, 2022]. That which was professionally and nationally known, is that the maintenance of \u2018Public Order\u2019<\/strong> and the \u2018Rule of Law\u2019<\/strong> within the wider community remains the functions of Law enforcement. Hence, these have never been the responsibility, neither of; (a) \u2018\u2026Town and Country Planner Frederick Southwell:<\/strong> (b)<\/strong> \u2026DCA Board Chairman, attorney-at-law, Senator Gail Christian:<\/strong> nor<\/strong> (c)<\/strong> \u2026The law-degreed background, intelligent and youthful Parliamentarian, and Minister with responsibility for the \u2018Authority,\u2019 \u2018Maria Bird-Browne.\u2019<\/strong> For the five \u2018Youthful Entrepreneurs,\u2019 <\/strong>they were not only gripped by dismay, but also plunged to the depth of despair.<\/p>\n

DIFFERENT PERSPECTIVE<\/strong><\/p>\n

From a \u2018Different Perspective,\u2019 and<\/strong> that which appeared to have been at work were or have caused their woes may have been; (i) \u2018\u2026Ignorance of regulations contained in the Physical Planning Act: (ii) \u2026Apparent vexatious Enforcement; (iii) \u2026Being non-compliant with Notice\/Order:(iv) \u2026Grievous misunderstanding: and (v) \u2026Serious omission on the part of both Country Planner and Development Control Authority (DCA) to guide the developers on their \u2018Right of Appeal.\u2019 <\/strong>Consequent upon this perspective, it was considered useful to look at certain aspects of the law governing all parties: (i) \u2018\u2026Land users\/developers: (ii) \u2026Country Planner and agents: (iii) \u2026DCA; (iv) \u2026Portfolio Minister: and by extension (iv) \u2026General public.\u2019<\/strong><\/p>\n

FUNCTIONS AND POWERS<\/strong><\/p>\n

The Act makes it sufficiently clear that the \u2018Authority\u2019<\/strong> means the \u2018Development Control Authority\u2019<\/strong> established under Section 5 of this Act.\u2019 It also provides for the \u2018Authority\u2019 to employ; (a) \u2018\u2026A Town and Country Planner:<\/strong> (b)<\/strong> \u2026A Secretary; and (c)<\/strong> \u2026Such officers and employees as the Authority considers necessary for the purposes of carrying out the functions of the Authority\u2019 [PPA: Section 6]. Likened to the \u2018Board of Education Act\u2019 that provides for a \u2018Secretary,\u2019 the same is obtained under the \u2018Physical Planning Act.\u2019 It states; \u2018\u2026The Town and Country Planner shall be the Chief Executive Officer of the Authority, and shall exercise the powers and duties specified in the Act.\u2019<\/strong> For the avoidance of doubt or misunderstanding, among these are Administration and Operation and Planning\u2019 [Section 6 (2)].<\/p>\n

ADMINISTRATIVE PROVISIONS<\/strong><\/p>\n

The \u2018Physical Planning Act (PPA) <\/strong>imposes a duty upon the Minister with responsibility to know what it entails and be guided by the provisions. For ease of reference, it states; \u2018\u2026In exercising his or her functions, the Minister shall be guided by the principle that the provisions of this Act shall be applied; (a) \u2018\u2026Uniformly: (b) \u2026Fairly; and (c) \u2026Equally to ALL persons\u2019 [Section 4 (3)].<\/strong> There appears to have been \u2018Public Confusion\u2019 as to who is who. In the currency of the situation, Mr Southwell is NOT the \u2018DCA,\u2019 and the Statutory Body is not \u2018Frederick Southwell.\u2019<\/strong> Frequently, however, the \u2018Town and Country Planner\u2019<\/strong> shall be given \u2018Basket to carry water.\u2019<\/strong> In given situations, that he\/she shall do.<\/p>\n

AUTHORITY TO SIGN<\/strong><\/p>\n

In the recent demolition exercise reportedly ordered by the \u2018Authority,\u2019<\/strong> confusion appeared to reign as to who provided and signed certain documentation. That which shall eliminate any harbored doubts is contained in the \u2018Physical Planning Act.\u2019 It states; \u2018\u2026The Town and Country Planner shall sign all; (i) \u2018\u2026Development permits; (ii) \u2026Refusal of Development permission: (iii) \u2026Enforcement Notices: and (iv) \u2026Other documents authorized by the Authority to be issued under this Act\u2019<\/strong> [Section 6 (5): No. 6 of 2003]. Additionally, the Act states \u2018\u2026The Town and Country Planner has the powers conferred upon him by this Act and the duties that he is required by: (a) \u2018\u2026This Act: and (b) \u2026By the direction of the Minister: or (iii) \u2026The Authority to perform\u2019 [Section 6 (6)].<\/p>\n

HARSH OR ACRIMONIOUS DECISIONS<\/strong><\/p>\n

Realizing that a \u2018Town and Country Planner\u2019<\/strong> is no \u2018Superman,\u2019 Parliament provided authorized assistance by any \u2018Planning Officer.\u2019<\/strong> The Act further states; \u2018\u2026The functions assigned to the Town and Country Planner by, or under this Act, other than those mentioned in \u2018Subsections 5 and 6\u2019<\/strong> may be exercised by any \u2018Planning Officer\u2019 authorized by the \u2018Town and Country Planner in writing,\u2019<\/strong> either generally or specifically, in that behalf\u2019 [Section 6 (7)]. Parliament anticipates that either; (i)<\/strong> \u2018The Town and Country Planner: (ii)<\/strong> \u2026Other officers: or (iii)<\/strong> \u2026The Minister\u2019 may bring grief upon developers, either by extremely harsh or decisions or arbitrary enforcement of the provisions of the \u2018Physical Planning Act\u2019 [No. 6 of 2003].<\/p>\n

APPEALS TO JUDICIARY<\/strong><\/p>\n

In such anticipation, the \u2018Act\u2019<\/strong> also provides an avenue outside of the Administration whereby the \u2018Aggrieved Developers\u2019<\/strong> may file Appeals against adverse decisions or insensitive, discriminatory or overzealous enforcement. Thus, in seeking redress or revisitation of any considered adverse decisions, it states; \u2018\u2026A person aggrieved by the giving of a \u2018Notice\u2019 under \u2018Section 61\u2019 of the Act, may appeal to the High Court of Justice.\u2019<\/strong> The Act effectively removes any administrative review by the \u2018DCA\u2019<\/strong> and placed for the consideration of the Judiciary. However, either by calculated deception or negligent omission, the \u2018Enforcement Notice\u2019<\/strong> to vacate the strip of land was said to have failed to include \u2018Section 62\u2019 of the \u2018Physical Planning Act\u2019<\/strong> that provides for such appeal.<\/p>\n

AGGRIEVED DEVELOPERS<\/strong><\/p>\n

It therefore states, \u2018\u2026On appeal under this Section the Court shall; (a) \u2018\u2026If it determines that the Authority was entitled to give Notice, confirmed the such Notice; and (b) \u2026In any other case, give the Authority a direction to withdraw the Notice\u2019<\/strong> [PPA: Section 62 (i) (a & b)]. Not infrequently, \u2018Aggrieved Developers\u2019<\/strong> either knows nowhere to turn or frequently turns to the political directorate. Dependent upon the side of the fence the aggrieved sits or the side of the road he\/she travels, they are most likely to fall into potholes. This must never be experienced by any developer, including the \u20185 Youth of Parham.\u2019 Not with the manifestoed \u2018Strategic Vision to Rebuild and Empower.\u2019 <\/strong>Critical to decisions or actions that may be deemed arbitrary or without lawful authority, the \u2018Act\u2019 also provides for \u2018Compensatory Claims\u2019 <\/strong>to the \u2018Minister\u2019 <\/strong>on the \u2018Development Control Authority\u2019 [Section 64].<\/strong><\/p>\n

CONCLUSION<\/strong><\/p>\n

It was then Opposition-hopeful and present Prime Minister Gaston Browne who gave earnest \u2019Assurance\u2019<\/strong> that, \u2018\u2026The ABLP brings to government a team of enlightened, competent and dynamic leaders who have excelled in their own business.
