For Law enforcement, as the \u2018New Year 2021\u2019<\/strong> opened with tragedy, it also closed with tragedy. For the second time in the year, the bell had been tragically tolled. Firstly, it was tolled for a committed, loyal peaceful and non-violent Police officer \u2018No. 500 Corporal Clifton Common\u2019 [February 11, 2021].<\/strong> In spite of constant hovering dangers, his tragic death has left many of his family and community members grief-stricken, as well as his professional colleagues in \u2018shock and awe.\u2019 With tragic repetition, the bell has also tolled for a \u2018Suspected Mentally-Deranged\u2019 <\/strong>elderly citizen, \u2018Leroy Caesar 64.\u2019<\/strong> The bell tolled when, in all unlikely places, another \u2018Police Detention Cell\u2019 <\/strong>where death reportedly, violently visited upon him [December 29, 2021].<\/strong><\/p>\n

INSULT TO INJURY<\/strong><\/p>

\"\"<\/a><\/div>\n

Then adding \u2018Insult to Injury,\u2019<\/strong> both deceased met their demise at the hands of two \u2018Suspected Mentally Deranged Detainees.\u2019 <\/strong>This, undoubtedly, has not only left his family, loved ones and friends shattered, but also Law enforcement high command in administrative, supervisory and procedural spots of bother. Incidentally, institutionalized and judicially-known murder accused \u2018Ziggy Beazer 30,\u2019<\/strong> a previously certified \u2018Mentally Deranged\u2019 murder-accused had been hastily charged with the latter\u2019s murder. Even so, it is a requirement of existing law that a \u2018Coroner\u2019s Inquest\u2019 shall be held to determine the circumstances under which the deceased came to his tragic death\u2019 [Coroner\u2019s Act: Chapter 105: Section 10]. It prompted the critical question; \u2018Who shall care for the mentally challenged seen wandering at-large?\u2019<\/strong><\/p>

FIGMENT OF IMAGINATION<\/strong><\/p>\n

Given the primary function of \u2018Law Enforcement,\u2019 in the absence of a structured \u2018Psychiatric System\u2019 it should be considered \u2018Figment of Imagination,\u2019<\/strong> for anyone to believe that these services can be obtained from Law enforcers when \u2018Suspected Mental Defectives\u2019 are detained<\/strong> for want of psychiatric attention. Most public officials are aware or would be reckless not to be so aware that \u2018Police Detention Cells\u2019<\/strong> are specifically intended for temporary confinement of \u2018Criminal Suspects.\u2019 <\/strong>Thus, a simple procedural lapse could see an Ambulance or a Hearse making its way to a Police Station. This has recently manifested itself at the main \u2018Criminal Suspects Detention Facility\u2019<\/strong> at the St. John\u2019s Police Station.<\/p>

PERSPECTIVE<\/strong><\/p>\n

This Commentary <\/strong>reflects upon: (a) \u2018…Two recent tragic incidents in the \u2018Police Detention Cells\u2019 that saw the lives of<\/strong>: (i) \u2018\u2026No. 500 Corporal Clifton Common: and (ii) \u2026Leroy Caesar being tragically snuffed out:<\/strong> (b) \u2026The peculiar role and dangers faced by Law enforcement:<\/strong> (c) …The dramatic end to a \u2018Murder Trial\u2019<\/strong> that saw the acquittal of murder-accused \u2018Dwayne<\/strong> \u2018Littleman\u2019 Joseph;<\/strong> and (d) …The unexplained release from Prison remand of then Co-murder accused \u2018Ziggy Beazer 30.\u2019<\/strong> Both were jointly-charged with the apparent senseless, vengeful mafia-style and coldblooded murder of former Pointe resident, \u2018Germaine \u2018Six Months\u2019 Destin\u2019<\/strong> [March 18, 2013].<\/p>

\"\"<\/a><\/div>\n

DANGEROUS UPPERCUT<\/strong><\/p>

\"\"<\/a><\/div>\n

Finally, it looks at a \u2018Dangerous Uppercut\u2019<\/strong> unleashed by an apparent treacherous \u2018Chief Prosecution Witness, Ingram Carson Matthew,\u2019 <\/strong>ironically, more popularly known as \u2018Uppercut.\u2019 <\/strong>Though not necessarily criminally perjurious, his evidence abruptly and effectively brought the \u2018Dis-joined Murder Indictment\u2019 <\/strong>and the trial of \u2018Murder-accused \u2018Dwayne \u2018Littleman\u2019 Joseph\u2019<\/strong> to a shocking and disappointing end. Instructively, the \u2018Dis-joined Trial\u2019<\/strong> allowed for a one-accused trial, as his co-accused \u2018Ziggy Beazer\u2019<\/strong> was psychiatrically certified and judicially ordered \u2018Unfit\u2019 to plea<\/strong> at their joint-murder trial [July 16, 2019].<\/p>\n

CMHA- CHANEIL IMHOFF<\/strong><\/p>\n

Firstly, however, it looks at the compassionate and persevering efforts of \u2018Community and Mental Health Advocate, Chaneil Imhoff,\u2019<\/strong> as she voluntary seeks to sensitize the public and Health officials of the gravity of the condition called \u2018Mental Illness.\u2019 Speaking to set goals, she has ear-marked for establishment, a \u2018Mental Health Association\u2019 [Observer News: December 31, 2021].<\/strong> Prompted by seemingly greater national emphasis and preventable tragedies, it was considered useful to look at her efforts in seeking to see more coordinate approach in bringing some measure of respite to those afflicted and institutionalized, or left to be at-large in the community.<\/p>\n

MENTAL HEALTH ADVOCACY<\/strong><\/p>\n

Even without the benefit of statistical data, it has been suggested that a growing population of \u2018Mentally Deranged\u2019 <\/strong>people have not benefitted from \u2018State Resources.\u2019 <\/strong>Many have argued that vast sums have been expended in controlling the spread of the two-year-old infectious, contagious and deadly \u2018Covid-19 Pandemic.\u2019 Yet persons said to have been afflicted by \u2018Mental Illness,\u2019<\/strong> have yet to see improvements affecting their wellness, safety and security. This is particularly so, for the at-large mentally-challenged. Seemingly moved by \u2018Compassion\u2019<\/strong> and a demonstrating a firm \u2018Resolve,\u2019<\/strong> in a private capacity, \u2018Mental Health Advocate<\/strong> \u2018Chaneil Imhoff,\u2019 <\/strong>has been seeking to engage the attention of officialdom. Such engagement is intended to cause some measure of respite to be brought to those so afflicted.<\/p>\n

GROSS NEGLECT\/GRAVE INADEQUACIES<\/strong><\/p>\n

Demonstrating a personal resolve in assisting the mentally challenged, she has taken her observations and concerns to both mainstream and social media. There have been innumerable appeals to those with responsibility for \u2018Health and Wellness\u2019 <\/strong>to give administrative attention to the situation that seems to be producing more tragedies, mourning and funerals, than caused by the \u2018Pandemic.\u2019 <\/strong>That which was viewed with grave concern and capable of being described as \u2018Gross Neglect\u2019 <\/strong>and \u2018Grave Inadequacies<\/strong>\u2019 had been the unavailability or inadequacy of psychiatric care of those suspected or known to have been afflicted. This was often evident by exhibited behaviors associated with psychiatric disorders.<\/p>\n

SPIRIT OF PERSEVERANCE<\/strong><\/p>\n

Conscious of behaviors that have the potential for devastating consequences by persons so afflicted with mental health issues, with risk to themselves and members of the wider society. Even contending with frustration and futility of efforts, she has shown a \u2018Spirit of Perseverance.\u2019<\/strong> Though with vain attempts, she continues in her desire to exert influence on \u2018Health Authorities.\u2019<\/strong> She remains adamant that among other considerations, urgent attention is of absolute necessity in arresting a potentially dangerous situation. Sadly, in spite of public \u2018Sensitization and Appeals,\u2019<\/strong> she, likened to members of the wider society shares the view that more of the \u2018At-large psychiatrically-troubled\u2019 are likely to die before the achievement of administrative attention.<\/p>\n

WEALTH AND RESOURCES<\/strong><\/p>\n

Likened to nations not starved for \u2018Wealth and Resources,\u2019<\/strong> impoverished nations struggling to grow and sustained their economies, shall not only contend with the \u2018Covid-19 Pandemic,\u2019<\/strong> but also allocate resources for housing, treatment and care for those \u2018Mentally Deranged.\u2019<\/strong> This shall be the case, whether or not persons are so psychiatrically certified. These are the socially-neglected ones that have been scientifically considered as \u2018Mental Defectives.\u2019<\/strong> Law enforcement training speaks to this as; \u2018\u2026Mental illness or disability which requires or is susceptible to medical or other specialist care or treatment\u2019<\/strong> [1978; Criminal Law: Police Promotion Handbook: Page 104].<\/p>\n

ZIGGY BEAZER- SCHIZOPHRENIC<\/strong><\/p>\n

When State-contracted non-resident \u2018Psychiatric Consultant Dr. Griffin Benjamin\u2019<\/strong> testified before \u2018His Lordship, Justice Iain Morley\u2019<\/strong> and professionally opined that murder-accused \u2018Ziggy Beazer\u2019<\/strong> was \u2018Mentally unstable.\u2019 <\/strong>Guided by his scientific knowledge and practice, the expert considered him to be \u2018Schizophrenic.\u2019 <\/strong>From \u2018Criminal Psychology Training,\u2019 <\/strong>this was said to be a condition that affects; (a) \u2018\u2026Feelings: (b) \u2026Beliefs: and (c) \u2026Behavior.\u2019 <\/strong>\u00a0He had judicially-positioned the \u2018Trial Judge\u2019 to make an informed \u2018Court\u2019s Order\u2019 that the accused was \u2018Mentally Unfit\u2019<\/strong> to offer a plea or to stand joint trial with co-accused \u2018Dwayne \u2018Littleman\u2019 Joseph\u2019 [ANR: July 16, 2019].<\/strong><\/p>\n

PRACTICE DIRECTIONS<\/strong><\/p>\n

As has often been the case, stranger things than fiction often happen. His eventual release appeared \u2018Shrouded in Mystery.\u2019 <\/strong>When the name of murder-accused \u2018Ziggy Beazer,\u2019<\/strong> surfaced as being detained for \u2018Disorderly Conduct,<\/strong>\u2019 officers may have been reckless not to have known his criminal background and psychiatric condition. However, given the judicially-established \u2018Practice Directions,\u2019 <\/strong>to all intents and purposes, he was reportedly judicially ordered to be released from Her Majesty\u2019s Prison\u2019 [ABS TV: March 2: 2020].<\/strong> Not only was such an Order shall have considered, but \u2018Public Safety\u2019 <\/strong>demanded that he shall have remained in \u2018Psychiatric Confinement.\u2019 <\/strong>Thus, he shall have been securely kept at the \u2018Clarevue Psychiatric Hospital.\u2019<\/strong><\/p>\n

HARSHNESS OF PRISON LIFE<\/strong><\/p>\n

Concerning his apparent ill-advised release, that which may have factored prominently in the \u2018Judge\u2019s mind, may have been; (i) \u2018…Frustration and Misery; (ii) …Lack of coping mechanism: (iii) \u2026Being mentally afflicted; and (iv) …Acute psychological disorientation.\u2019<\/strong> Reasonable inferences may also have been drawn that \u2018His Lordship, Justice Iain Morley\u2019<\/strong> may have given serious considerations to his lengthy remand and inordinate delay for trial. He may also have considered the extreme \u2018Harshness of Prison Life.\u2019 <\/strong>This will have been compounded by the poor quality of meals; inadequacy of beds and the existed intolerable unhygienic conditions. He was aware that the accused had been on \u2018Prison Remand\u2019<\/strong> for over seven years. Though not necessarily at \u2018Bar,\u2019 he may have further given judicial consideration to; (a) \u2018…The constitutional presumption of innocence: (b) \u2026Right to a fair trial; and (c) \u2026Within a reasonable time\u2019<\/strong> [CO: 1981: Section 15].<\/p>\n

SANE AND INSANE<\/strong><\/p>\n

Whether or not persons are \u2018Sane or Insane,\u2019<\/strong> the unpredictable and erratic behavior of humans have often revealed man\u2019s true nature and propensity. The calculated and unrestrained actions of many, suggests that the pages of the \u2018Annals of History\u2019<\/strong> continues to be filled with grotesque stories of tragedies of one kind or another. They will also reveal to posterity or future generations, the cruel, brutal and deadly acts perpetrated against fellowmen. Moreover, it speaks to violence often unleashed upon the innocent, thereby bringing upon them their untimely demise. In these situations, though fraught with danger, the civil societal role and functions of Law enforcement, are as costly as they are of absolute necessity.<\/p>\n

CALL TO DUTY<\/strong><\/p>\n

Not infrequently, Law Enforcement personnel are called upon to perform various tasks. Not infrequently that which they are called upon to perform is mundane and way outside the scope of professional training and knowledge. Not infrequently they have come under close public scrutiny for some questionable or roguish behavior. However, that which is of grave administrative concern are usually serious acts or omissions. Thus, failing to respond to the \u2018Call To Duty\u2019<\/strong> not only exposes them to public ridicule, but also to be cited for \u2018Neglecting Duty.\u2019<\/strong> Though a remote possibility, negligent personnel run the risk of being criminally charged for serious neglect. Then there is the odd case when a Law enforcer never made it back home after reporting or responding to \u2018Duty\u2019s Call.\u2019 <\/strong>The experiences of \u2018Constable Wentworth Darroux\u2019 [Antigua Sun: August 18, 2002]<\/strong> and \u2018Corporal Clifton Common\u2019 <\/strong>vividly speaks to this.<\/strong><\/p>\n

LOST THEIR WAY<\/strong><\/p>\n

It is the professional knowledge that \u2018Police Services\u2019<\/strong> that appear to have \u2018Lost Their Way,\u2019<\/strong> often have to contend with personnel not only in want of discipline and effective supervision, but also often seen as chronically-prone to making grave professional and\/or procedural mistakes. There may have been lessons from two recent incidents of death that reportedly occurred in a \u2018Police Detention Cell.\u2019 <\/strong>Instructively, Cells built for temporarily securing \u2018Suspected Criminal Detainees\u2019 <\/strong>have now become the \u2018Cells of Death.\u2019 <\/strong>Incidentally, these involved two psychiatrically-challenged males. Unfortunately, these incidents saw the violent deaths of a Police officer and a suspected mentally-challenged male detainee, lawfully held for the safety of the public and that of his own.<\/p>\n

DETENTION AND ARREST<\/strong><\/p>\n

If for any modern-instructional reasons, \u2018Law Enforcers\u2019<\/strong> did not know, they shall now know that at all material times, whether or not it pertains to the \u2018Prevention or Detection of Crime,\u2019<\/strong> their duty is not only to \u2018Protect and Serve\u2019<\/strong> the citizenry, but also all manner of persons- \u2018Sane or Insane.\u2019<\/strong> Therefore, those that enforces the criminal law, shall know that it entails much more than \u2018Detention or Arrest.\u2019 <\/strong>They shall also know that they are not, and ought not to consider their function as rendering favors to those in crisis, but a duty legally imposed upon them. It is insufficient and inexcusable for law enforcers to inform aggrieved citizens that nothing can be done when the services of law enforcers are urgently needed. Moreover, enforcers run the risk of being perceived as being incompetent or as being seen to be professionally ignorant and useless.<\/p>\n

DISCIPLINARY PENALTIES<\/strong><\/p>\n

From a disciplinary perspective, for the purposes of guiding the administrative knowledge and procedure of a \u2018Commissioner of Police\u2019 and to ensure compliance by subordinates, the \u2018Disciplinary Code\u2019<\/strong> states; \u2018\u2026If a member of the Police Force neglects without good or sufficient cause omits \u2018Promptly and Diligently\u2019 to attend to, or carry out anything which is his duty as a Police officer to do, commits an offence\u2019<\/strong> [Police Act: Chapter 330: Regulation D]. The stipulated \u2018Disciplinary Penalties\u2019<\/strong> for any such breach of the several disciplinary offences, range from the severity of \u2018Dismissal\u2019<\/strong> from the Police Service to a less punitive but \u2018Severe<\/strong> Caution.\u2019<\/strong> This however, is dependent upon the gravity of the neglect.<\/p>\n

PROMPTLY AND DILIGENTLY<\/strong><\/p>\n

Now, given the concept, \u2018Protect and Serve,\u2019<\/strong> law enforcers can neither shirk their responsibilities, make excuses, nor escape punitive criminal or disciplinary action. Dependent upon the disciplinary foundation of the \u2018Police Service\u2019 and the gravity of neglect, neglectful members may face disciplinary proceedings for \u2018Neglecting Duty.\u2019<\/strong> For instance, duties to be performed under the \u2018Small Charges Act\u2019<\/strong> (minor offences), states: \u2018\u2026Any Constable or Peace officer who shall neglect his duty in anything required of him by this Act, shall be liable to a fine not exceeding five hundred dollars\u2019 <\/strong>[SMA: Chapter 405: Section 37]. Most of today\u2019s law enforcers, and by extension, members of the public appeared wanting of professional and academic knowledge of these irrefutable \u2018Facts and Truths.\u2019<\/strong><\/p>\n

DETAINED OR ARRESTED<\/strong><\/p>\n

It has been a universal phenomenon that some persons \u2018Detained or Arrested\u2019<\/strong> of Law enforcement, never returned to tell stories of their brief or extended stay. Occasionally when released from detention, it is usually from \u2018Funeral Homes\u2019<\/strong> with a Coroner\u2019s authority that states \u2018Warrant To Bury\u2019<\/strong> where either; (a) \u2018…Inquest is Unnecessary:<\/strong> or (b) …Inquest Is Necessary.\u2019<\/strong> In the case of the former, this is where death has occurred from \u2018Natural Causes\u2019<\/strong> resulting from underlying health conditions. Conversely, in the case of the latter, this is where the \u2018Cause of Death\u2019<\/strong> would have been allegedly hastened by \u2018Detention or Arresting Officers.\u2019<\/strong><\/p>\n

GRAVE MISTAKE<\/strong><\/p>\n

In the most recent tragedy, Law enforcement personnel reportedly became aware that two men that shall have been separately held separately, were inadvertently or ill-advisedly caged in the same cell. Whether or not persons possesses the propensity to kill, it may have been a \u2018Grave Mistake\u2019<\/strong> in mating detained \u2018Suspected Lunatic Leroy Caesar 64,\u2019<\/strong> in a \u2018Police Detention Cell\u2019 <\/strong>with \u2018Mentally-deranged Murder-accused, Ziggy Beazer.\u2019<\/strong> Incidentally, one of the \u2018Mentally Deranged Detainees\u2019<\/strong> was reportedly found lying in a state of unresponsiveness. By the time startled personnel sought medical assistance, \u2018Lesroy Caesar\u2019 unwittingly caged with \u2018Ziggy Beazer,\u2019<\/strong> was pronounced dead. It was revealed that during a violent tussle he was overpowered by the more physically-abled \u2018Cell-Mate Ziggy Beazer\u2019<\/strong> [January 3, 2022].<\/p>\n

HOSTILE ENVIRONMENTS<\/strong><\/p>\n

One never knows how \u2018vicious or which dog will bite\u2019<\/strong> or \u2018which cat will scratch,\u2019<\/strong> until one crosses its path. Conversely, \u2018Vicious Men\u2019<\/strong> never know when other \u2018Vicious Men\u2019<\/strong> may strike. It is well known to law enforcement that in \u2018Hostile Environments,\u2019<\/strong> there are, but two basic principles; (i) \u2018…Vicious Men\u2019 shall not lose their wit as to be seen as dropping their guards; and (ii) \u2018Vicious Men\u2019<\/strong> shall not provoke other \u2018Vicious Men\u2019<\/strong> to anger, for wrath may descend without notice or warning. Thus, the provocative actions, expressions, sight or presence of a \u2018Vicious Man,\u2019<\/strong> in any place where \u2018Vicious Men\u2019<\/strong> resort, not only have potential to provoke anger, but also the possibility for their wrath to be visited upon them. Not infrequently such wrath when visited, either came with painful or deadly consequences.<\/p>\n

NIGHT TRAGEDY STRUCK<\/strong><\/p>\n

A Pointe resident had either walked on the wrong street; or rubbed someone the wrong way. Whatever the reason, he appeared to have found himself at a \u2018pre-determined place\u2019 where<\/strong> he shall die. On the Night Tragedy Struck\u2019<\/strong> the Villa Community. Gunshots reportedly rang out in rapid succession on the street.\u2019 Aware of what such sounds meant, panicked residents, including \u2018…Ingram Carson Matthew,\u2019 <\/strong>incidentally answers to the alias \u2018Uppercut,\u2019 <\/strong>scampered like hares\u2019 [March 18, 2013]<\/strong>. They were accustomed to hear gunshots ring out in their community at various hours at night. Consequently, most kept themselves out of harm\u2019s way.<\/p>\n

GRUESOME DISCOVERY<\/strong><\/p>\n

As the sound of gunshots subsided, curious residents in the immediate vicinity reportedly visited the scene. Inferentially, to ascertain if anyone had been left bleeding and wincing in pain or gasping for breath or not at all breathing.\u2019 They were reportedly not surprised at the \u2018Gruesome Discovery.\u2019<\/strong> The apparent \u2018gangsterism-style attack, left \u2018Jermaine \u2018Six Months\u2019 Destin\u2019<\/strong> fatally wounded. In the \u2018Dis-Joined Trial,\u2019 neither the viewing and certifying medical practitioner had been given the opportunity to testify to his on-scene visitation, nor the pathologist of his \u2018<\/em>Findings and Cause of Death.\u2019 <\/strong>Nonetheless, sufficient privilege and credible information provided knowledge of the incident. It was an extraordinary \u2018Graphic Account.\u2019 <\/strong>It appeared that he had been shot at point blank range. Thus, death was as swift as the incident was tragic.<\/p>\n

SHATTERED CRANIUM<\/strong><\/p>\n

With his \u2018Cranium Shattered\u2019<\/strong> like glass, it meant instant death. Where he motionlessly lay, brain matter had reportedly oozed from the gaping opening at the back of the deceased\u2019s head. The street covered with his curdled blood, as he struggled helplessly with blood profusely oozing from the \u2018head, ears, nose and mouth. Gasping for breath, though an execution, it may still be said \u2018He gave up the Ghost.\u2019<\/strong> His life had been painlessly, but effectively snuffed out. For family, loved ones and friends, there was weeping and gnashing of teeth and mourning and grieving. For the Police, theirs was the responsibility for bringing the culpable perpetrators \u2018Dwayne \u2018Littleman\u2019 Joseph and Ziggy Beazer\u2019<\/strong> to criminal justice. These are not only associated with vicious gun crimes, but also considered \u2018Vicious Men.\u2019 <\/strong>The only man who was said not to have harbored fear of them, was \u2018Prime Minister Gaston Browne.\u2019 <\/strong>\u00a0He was said to have been always ready to \u2018Fight fire with fire.\u2019<\/strong><\/p>\n

CARDINAL PRINCIPLE<\/strong><\/p>\n

Invariably, there is a \u2018Score,\u2019<\/strong> and besides monetary debt, some other darn thing has to be settled. Thus, in these communities, only the toughest survives. Even as residential populations were frequently reduced by tragic and frightening incidents, life goes on. Thus, residents, gripped by fear, are often tight-lipped. Thus, residents shall be compliant with the \u2018Cardinal Principles: \u2018…See nothing; …Hear nothing;\u2019 and …Say nothing.\u2019<\/strong><\/p>\n

ORDER OF BUSINESS<\/strong><\/p>\n

It is to be clearly understood that when; (a)<\/strong> \u2018…Areas are demarcated and controlled, dominions and dominance are established; (b)<\/strong> …Fear is then injected; and (c) …Interlopers or encroachers are targeted and eliminated.\u2019 <\/strong>Universally, and in depressed urban communities, these have been the \u2018Order of Business.\u2019<\/strong> There is a \u2018…Strict Code of Silence.\u2019<\/strong> Penalties for breaches are to be imposed swiftly and mercilessly exacted upon transgressors. These have not only been predestined and inescapable, but also continue to be among the harsh realities of life.<\/p>\n

DECEITFUL EYEWITNESS<\/strong><\/p>\n

It has been said that a person can hide from a thief, but cannot hide from a notorious liar.\u2019 Undoubtedly, it was an apparent \u2018Deceitful Eye-Witness Account\u2019<\/strong> of a gruesome murder and the apparent pitiful simplicity of criminal investigators, in believing the unsupported account\u2019 that may have caused psychological stress to two possible ruthless and brutal guilty murder-accused. In a particular case, it has been the apparent \u2018Deceitful Denial\u2019 <\/strong>that saw a murder trial ended dramatically and disappointingly. The self-proclaimed \u2018illiterate,\u2019<\/strong> but known convicted felon appeared to have out-foxed both criminal investigators and an unsuspecting Crown Prosecutor.<\/p>\n

IMPUGNING INTEGRITY<\/strong><\/p>\n

Likened to a sudden jolt by an earthquake, and buildings came tumbling down, likened to a collapsed pack of cards, the ending of the trial of \u2018Dwayne \u2018Littleman\u2019 Joseph\u2019 came when chief prosecution\u2019s witness \u2018Ingram Carson \u2018Uppercut\u2019 Matthew,\u2019<\/strong> denied implicating the accused in a heinous crime of murder. Sworn on Oath to tell the \u2018Truth,\u2019<\/strong> he seemed not to have encountered difficulties in not doing so. Not only did he seek to \u2018Impugn the Character and Integrity\u2019<\/strong> of criminal investigators, but also sought to tarnish the reputation of the Police Service. He testified before \u2018His Lordship, Justice Iain Morley\u2019<\/strong> and an empaneled 12-member Jury that it was the Police that had \u2018Lied.\u2019<\/strong> Thus, when they wrote what he had not \u2018…Seen; or …Said to them\u2019 <\/strong>in the non-judicial binding \u2018Unsworn Police-written Statement,\u2019 <\/strong>they had neither been correct, nor truthful.<\/p>\n

SMARTING UNDER ILLITERACY<\/strong><\/p>\n

In the Case \u2018Queen v Dwayne Joseph\u2019 [2013],<\/strong> it may have been seen as a \u2018Cardinal Error\u2019<\/strong> for \u2018Criminal investigators and Crown Prosecutors\u2019 to have relied solely on \u2018…possible and reasonable suspected<\/strong> eyewitnesses accounts.\u2019<\/strong> A witness of some notoriety and well-known \u2018ex-con Carson Matthew,\u2019<\/strong> reportedly provided the sole eyewitness account of the mafia-style killing. TRICKERY OR TREACHERY<\/strong><\/p>\n

After causing two possible innocent or guilty accused, \u2018Dwayne \u2018Littleman\u2019 Joseph and Ziggy Beazer\u2019<\/strong> to languish agonizingly on remand for more than half a decade, a single \u2018Uppercut<\/strong>\u2019 to the \u2018Prosecution\u2019s Evidence,\u2019 saw the end of the murder trial. Seemingly with a magical trick conjured up his sleeve, by an act of \u2018Trickery or Treachery,\u2019<\/strong> he dashed the hope of the Prosecution and any reasonable prospect of conviction his evidence may have assured [March 2, 2020]. Thus, murder-accused \u2018Dwayne \u2018Littleman\u2019 Joseph\u2019<\/strong> walked free. This came when Trial Judge, \u2018Justice Lain Morley\u2019<\/strong> directed the 12-member mixed Jury to return a verdict favorable to him. In a previous visit to the prison facility, it was reported that \u2018His Lordship\u2019 had been overwhelmed with complaints.<\/p>\n

DIS-JOINED INDICTMENT\/TRIAL<\/strong><\/p>\n

From where \u2018His Lordship\u2019 then sits and adjudicates, it would have been within his judicial knowledge, that there had been discontent and mounting complaints by prison residents. Before his visitation, these were previously well publicized by \u2018Prison Reform Advocate Jessica Thompson.\u2019 <\/strong>The most recent of such complaints has been the \u2018Hygiene Factor\u2019 [ABN: April 26, 2021]. <\/strong>Whatever \u2018His Lordship\u2019<\/strong> may have impressed upon the minds of \u2018Crown Prosecutors\u2019<\/strong> the \u2018Joint-Murder Indictments and Trial of \u2018Dwayne \u2018Littleman\u2019 Joseph and Ziggy Beazer\u2019<\/strong> were \u2018Dis-joined\u2019<\/strong> from his co-accused, \u2018Ziggy Beazer.\u2019<\/strong> He had reportedly encountered difficulties associated with psychiatric disorders.\u2019 Consequently, he was considered not to have been in \u2018Mental State,\u2019 neither<\/strong> to enter a plea of \u2018Guilty\u2019 nor \u2018Not Guilty.\u2019<\/strong><\/p>\n

UNDER ILLITERACY<\/strong><\/p>\n

Seemingly \u2018Smarting Under Illiteracy,\u2019 <\/strong>at trial, as quickly as he may have volunteered \u2018an eyewitness account\u2019, as quickly the murder trial abruptly and disappointingly aborted. Whether or not by calculation, the \u2018Chief Witness\u2019 <\/strong>for the Crown added more insult to injury, by testimony, claiming that he was \u2018Too illiterate to Tell Police Lies.\u2019<\/strong> His testimony not only startled the \u2018Trial Judge and the 12-member Jury,\u2019<\/strong> but also grievously wounded the Case for prosecution. Public reaction then was swift and negative. Today, when it was revealed that the previously certified \u2018Mentally Deranged\u2019<\/strong> murder-accused \u2018Ziggy Beazer\u2019<\/strong> struck again, the nation has taken aught against those that had caused his release and those that shall have known of his condition and danger posed to \u2018detainees,<\/strong> public Safety<\/strong> and by extension, member of the wider society.<\/p>\n

CONCLUSION<\/strong><\/p>\n

When death visited upon \u2018Corporal Clifton Common,\u2019<\/strong> he had reportedly visited the \u2018Police Detention Cell\u2019 to render assistance toa youth said to have been mentally challenged. The detainee \u2018Verel Simon 20,\u2019 <\/strong>was reported to have inflicted violence to a building owned by the \u2018St John\u2019s Masonry Lodge.\u2019 Seemingly with apparent casual approach, he reportedly unlocked the Cell door. In a violent mode, a violent thrust of the door by him knocked the unsuspected Corporal into a \u2018State of Unconsciousness.\u2019<\/strong> Investigators accounts suggested that he lay helplessly and unresponsively on the concrete floor. In such mode, the apparent psychiatrically-troubled unrestrained detainee, further brutally attacked him about the head and body. The eventual rending of assistance saw agitated colleagues quickly subdued the raging detainee. Even as the injured Corporal was hurriedly rushed to the then \u2018Mount St. John\u2019s Medical Center (MSJMC),\u2019 <\/strong>he appeared to have been on the other side of life. Unable to extract an explanation as to what had transpired, and before administering life-saving medical attention, his \u2018Life and Career\u2019<\/strong> were all over. He was pronounced dead [December 29, 2021]. The same was said to have been the fate of \u2018Leroy Caesar.\u2019<\/strong> While there are still many important ones, it begs<\/strong> the fundamental question \u2018\u2026Should the mentally deranged be kept in Police criminal suspects detention cells without psychiatric referrals and\/or intervention?\u2019 ***<\/p>\n
