The Antigua and Barbuda Workers<\/span>\u2019\u00a0<\/span>Union is aware of a release from of the Office of Labour Commissioner regarding Christmas Day, Boxing Day and New Years Day holiday.<\/span><\/p>

The Union sort further clarity from the Labour Commissioner having had differing views as it pertains to Saturday\u00a0<\/span>December 25th\u00a0<\/span>not being\u00a0<\/span>recognized and\u00a0<\/span>observed\u00a0<\/span>as a public holiday.<\/span><\/p>\n

The Union further consulted with the Labour Minister, who agreed wholeheartedly with the position of the Labour Commissioner.<\/span><\/p>

The Antigua and Barbuda Workers<\/span>\u2019\u00a0<\/span>Union has consulted with\u00a0<\/span>C<\/span>ounsel and\u00a0<\/span>is<\/span>\u00a0of the opinion that Saturday December 25<\/span>th<\/span>, 2021, should be\u00a0<\/span>recognized<\/span>\u00a0as a public holiday,\u00a0<\/span>and employees who work on that day should be paid accordingly\u00a0<\/span>due to the fact that<\/span>Christmas Day is\u00a0<\/span>and has always been\u00a0<\/span>a common law holiday and is considered part of the sacred\u00a0<\/span>C<\/span>hristian calendar of Common Law holidays and is recognized in The Public Holidays Act Cap 354 as<\/span>\u00a0such,<\/span>\u00a0along with Good Friday and Sundays.<\/span><\/p>

The\u00a0<\/span>Explanatory Note to the\u00a0<\/span>Public Holidays\u00a0<\/span>(<\/span>Amendment<\/span>)<\/span>\u00a0Bill of 2019 sort to clarify the\u00a0<\/span>rationale for the amendments being sought\u00a0<\/span>and further stated that if Christmas Day and Boxing falls on a Saturday or Sunday the following Monday and Tuesday will be holidays and if Boxing Day falls on a Sunday, the following Monday and Tuesday are declared as holidays.\u00a0<\/span><\/p>\n

No where does it state that Christmas Day was being abolished as a common law holiday. And the Bill was made law without any changes to its statutory provisions.<\/span><\/p>

We at the Antigua and Barbuda Workers Union are of the firm view that<\/span>\u00a0employees who work on<\/span>\u00a0Saturday\u00a0<\/span>December 31, 2021\u00a0<\/span>should be paid\u00a0<\/span>for work on<\/span>\u00a0a public holiday<\/span>. <\/span><\/p>\n

We have advised the\u00a0<\/span>Hon. Attorney General and\u00a0<\/span>Minister\u00a0<\/span>of Labour\u00a0<\/span>that\u00a0<\/span>given our<\/span>\u00a0differ<\/span>ing\u00a0<\/span>views, we shall be seeking a<\/span>n interpretation<\/span>\u00a0of the\u00a0<\/span>Public Holidays (Amendment) Act, 2019 from the Courts.<\/span><\/p>

\u00a0O<\/span>nce<\/span>\u00a0found correct<\/span>,<\/span>\u00a0we will be\u00a0<\/span>demanding<\/span>\u00a0that\u00a0<\/span>employers pay employees\u00a0<\/span>proper\u00a0<\/span>compensation for work done on Saturday December 25<\/span>th<\/span>, 2021.<\/span><\/p>

We further urge the\u00a0<\/span>Hon. Attorney General<\/span>\u00a0to rethink and review\u00a0<\/span>his<\/span>\u00a0position\u00a0<\/span>against the background of the legislation\u00a0<\/span>because Good Friday, Christmas Day and Sundays\u00a0<\/span>have always been<\/span>\u00a0considered as part of the\u00a0<\/span>Christian<\/span>\u00a0calendar of holidays representing the death,<\/span>\u00a0birth and resurrection of Christ, our risen Savior.\u00a0<\/span>And there is no legislative provision which alters or revokes that common law position.<\/span><\/p>\n
