constitutions to support mandatory vaccination laws as the sub-region continues the battle to curb the spread of COVID-19 that has infected hundreds of their citizens and killed a significant number of others since March last year.<\/p><div id=\"antig-1712031556\" class=\"antig-content_5 antig-entity-placement\"><a href=\"https:\/\/www.facebook.com\/ablpag\" Grenadines, St Kitts-Nevis and Montserrat, have been informed that there are corresponding jurisprudence and medical data to support the position of mandatory vaccination.<\/p>\n<div id=\"antig-529759282\" class=\"antig-3rd-placement-inside\"><\/div>\n<p>The position to the OECS governments has been outlined in a 16-page confidential brief, titled \u201cThe Legal Dimensions of Mandatory\/Compulsory Requirements for COVID-10 Vaccinations, August 2021\u201d undertaken by two prominent Caribbean-born internationally respected jurists.<\/p><div id=\"antig-3257910524\" Caribbean Community (Caricom) grouping where governments have been urging their nationals to be vaccinated as part of the efforts to curb the spread of the virus that has led to closure of borders, a crippling of economies and stringent policies such as curfews and states of emergencies (SOE).<\/p><div id=\"antig-1860061571\" class=\"antig-content antig-entity-placement\"><a href=\"https:\/\/www.facebook.com\/ReggaeInTheParkAntigua\" aria-label=\"lucanio\"><img src=\"https:\/\/mlavawteztbj.i.optimole.com\/w:864\/h:1080\/q:mauto\/f:best\/https:\/\/antiguanewsroom.com\/wp-content\/uploads\/2020\/12\/lucanio.jpeg\" alt=\"\"  srcset=\"https:\/\/mlavawteztbj.i.optimole.com\/w:864\/h:1080\/q:mauto\/f:best\/https:\/\/antiguanewsroom.com\/wp-content\/uploads\/2020\/12\/lucanio.jpeg 1080w, socialMedia\"><\/div>\n<p>The document submitted to the OECS leaders, a copy of which has been obtained by the Caribbean Media Corporation (CMC), notes that the sub-regional countries would be on firm legal grounds in pursuing mandatory vaccination laws even in the face of counter-arguments alleging violations of rights.<\/p>\n<p>\u201cHaving demonstrated \u2026that mandatory vaccination is constitutionally appropriate given the leeway granted in favour of public health imperatives, it is submitted that employers could justify a requirement in a pandemic context, at minimum where the workplace is a high-risk environment, such as health-care, or essential services, or for workers more at risk at the workplace, such as frontline workers interacting with the public.<\/p><div id=\"antig-3175937201\" class=\"antig-content_2 antig-entity-placement\"><a href=\"https:\/\/www.courts.com\/antigua\/\" aria-label=\"500X500 (1)\"><img src=\"https:\/\/mlavawteztbj.i.optimole.com\/w:500\/h:500\/q:mauto\/f:best\/https:\/\/antiguanewsroom.com\/wp-content\/uploads\/2026\/03\/500X500-1.jpg\" alt=\"\"  srcset=\"https:\/\/mlavawteztbj.i.optimole.com\/w:500\/h:500\/q:mauto\/f:best\/https:\/\/antiguanewsroom.com\/wp-content\/uploads\/2026\/03\/500X500-1.jpg 500w, width=\"500\" height=\"500\"   \/><\/a><\/div>\n<div id=\"antig-2042936326\" class=\"antig-content_2\"><\/div>\n<p>\u201cIt is unlikely that employers would be held to a higher standard than a constitutional standard. Those core principles will be what justifies actions as being reasonable and proportionate as required, and what will ultimately persuade a court.\u201d<\/p><div id=\"antig-1788559520\" class=\"antig-content_6 antig-entity-placement\"><a href=\"https:\/\/discoverflow.co\/web\/antigua\" aria-label=\"ANU CVP Digital Broadband 1200x400_1\"><img src=\"https:\/\/mlavawteztbj.i.optimole.com\/w:1201\/h:401\/q:mauto\/f:best\/https:\/\/antiguanewsroom.com\/wp-content\/uploads\/2025\/11\/ANU-CVP-Digital-Broadband-1200x400_1-1.jpg\" alt=\"\"  srcset=\"https:\/\/mlavawteztbj.i.optimole.com\/w:1201\/h:401\/q:mauto\/f:best\/https:\/\/antiguanewsroom.com\/wp-content\/uploads\/2025\/11\/ANU-CVP-Digital-Broadband-1200x400_1-1.jpg 1201w, https:\/\/mlavawteztbj.i.optimole.com\/w:300\/h:100\/q:mauto\/f:best\/https:\/\/antiguanewsroom.com\/wp-content\/uploads\/2025\/11\/ANU-CVP-Digital-Broadband-1200x400_1-1.jpg 300w, https:\/\/mlavawteztbj.i.optimole.com\/w:1024\/h:342\/q:mauto\/f:best\/https:\/\/antiguanewsroom.com\/wp-content\/uploads\/2025\/11\/ANU-CVP-Digital-Broadband-1200x400_1-1.jpg 1024w, https:\/\/mlavawteztbj.i.optimole.com\/w:768\/h:256\/q:mauto\/f:best\/https:\/\/antiguanewsroom.com\/wp-content\/uploads\/2025\/11\/ANU-CVP-Digital-Broadband-1200x400_1-1.jpg 768w\" sizes=\"(max-width: 696px) 100vw, 696px\" width=\"1201\" height=\"401\"   \/><\/a><\/div>\n<p>The two prominent jurists also argue that medical ethics support mandatory vaccination, noting that the legal position mirrors the position emanating from medical ethics, as enshrined in the Nuffield Report, which is relied upon by the World Medical Health Organisation (WHO) that \u201cMandatory vaccination \u201ccan be ethically justified if the threat to public health is grave, the confidence in safety and effectiveness is high, the expected utility of mandatory vaccination is greater than the alternatives, and the penalties or costs for noncompliance are proportionate\u2026\u201d<\/p>\n<p>The authors of the report say their paper is intended to provide legal support for the policy direction of OECS governments and that by choice \u201cit avoids excessive legal jargon and a preponderance of case-law, as one would generally find in a legal brief, although the principles and positions outlined are informed by comprehensive research.<\/p>\n<p>\u201cRather, the paper attempts to provide a clear and concise narrative upon which decisions may be based,\u201d they said, adding that \u201cit is emphasised that mandatory COVID-19 vaccination, like so many other subject-areas emerging because of the pandemic, brings forth some grey areas for law, especially Labour Law\u201d<\/p>\n<p>The report notes that the issue is, of course, untested in the region despite the fact that some employers and to some extent, universities, like the University of the West Indies (UWI) have already begun mandating vaccination as a policy.<\/p>\n<p>The question of who pays for quarantine leave, for example is a brand new labour law issue, the authors wrote, adding \u201cwe can extrapolate from existing jurisprudence in analogous situations \u2013 HIV pandemic etc \u2013 but in some instances we will have to wait and see what the courts decide if challenged.\u201d.<\/p>\n<p>But they agree, notwithstanding and perhaps ironically, considering the wide debates, the vaccine issue is one of the clearer legal issues, in terms of existing legal norms.<\/p>\n<div id=\"antig-152637577\" class=\"antig-after-first-paragraph\"><\/div>\n<div id=\"antig-2887551296\" class=\"antig-in-comments_2 antig-entity-placement\"><a href=\"https:\/\/www.facebook.com\/@hadeedmotorsltd\" aria-label=\"Hadeed_WEB_Banner_MG-2\"><img src=\"https:\/\/mlavawteztbj.i.optimole.com\/w:1000\/h:250\/q:mauto\/f:best\/https:\/\/antiguanewsroom.com\/wp-content\/uploads\/2024\/12\/Hadeed_WEB_Banner_MG-2.png\" alt=\"\"  srcset=\"https:\/\/mlavawteztbj.i.optimole.com\/w:1000\/h:250\/q:mauto\/f:best\/https:\/\/antiguanewsroom.com\/wp-content\/uploads\/2024\/12\/Hadeed_WEB_Banner_MG-2.png 1000w, https:\/\/mlavawteztbj.i.optimole.com\/w:300\/h:75\/q:mauto\/f:best\/https:\/\/antiguanewsroom.com\/wp-content\/uploads\/2024\/12\/Hadeed_WEB_Banner_MG-2.png 300w, https:\/\/mlavawteztbj.i.optimole.com\/w:768\/h:192\/q:mauto\/f:best\/https:\/\/antiguanewsroom.com\/wp-content\/uploads\/2024\/12\/Hadeed_WEB_Banner_MG-2.png 768w\" sizes=\"(max-width: 696px) 100vw, 696px\" width=\"1000\" height=\"250\"   \/><\/a><\/div>","protected":false},"excerpt":{"rendered":"<p>Leaders of the Organisation of Eastern Caribbean States (OECS) have been told that there is \u201cample provision\u201d in their constitutions to support mandatory vaccination laws as the sub-region continues the battle to curb the spread of COVID-19 that has infected hundreds of their citizens and killed a significant number of others since March last year.
