It could never be said that \u2018A Life\u2019<\/strong> lost in a traffic accident, is worth \u2018A House.\u2019<\/strong> If such is the view of those that enforce law and of those that administrate and dispense justice, then all are destined to hell. Suffice to say that no \u2018Police Service\u2019<\/strong>may earn the respect and confidence of a citizenry, if by its action or inaction, it is perceived to be; (a) \u2018\u2026Brutally punitive; or (b) \u2026Selectively discriminatory; or (c) \u2026Prosecutorally bias.\u2019 When law-abiding citizens speak to the concept \u2018Justice,\u2019<\/strong> they are in fact been speaking to a grievous wrong, civilly committed against them. Consequently, the aggrieved person may litigiously cause the \u2018Judiciary\u2019 <\/strong>to be visited upon the wrongdoers.<\/p>\n

ACTS OF CRIMINALITY<\/strong><\/p>

From another perspective, when or informally are formally brought to the investigative attention of Law enforcement, know that the responsibilities statutorily imposed upon a \u2018Commissioner of Police\u2019 <\/strong>and general membership\u2019 of the \u2018Police Service,\u2019 <\/strong>require every member to discharge their fundamental duties. This shall not only be done in the manner consistent with the \u2018Oath of Office,\u2019 <\/strong>but also to the expectation and satisfaction of the law-abiding [Sections 6, 17: 22 & 23: Police Act: Chapter 330]. Thus, every member shall know that the general public have often expressed outrage in the manner certain matters have been handled. The tragic death of \u2018Andrea Hughes 32,\u2019<\/strong> and cold-blooded, brutal and senseless murder of \u2018Customs officer Nigel Christian\u2019<\/strong> were no exception [April 30, 2014 and July, 2020].<\/p>

PERSPECTIVE<\/strong><\/p>\n

Though some readers may find this commentary intensely distressing, it primarily focuses on; (i) \u2018\u2026The tragic death of Andrea Hughes;<\/strong> (ii) \u2026The questionable intervention and involvement of \u2018former General Manager of Bryson\u2019s Shipping, \u2018Nathan Dundas;\u2019 (iii) \u2026His apparent dubious intent; <\/strong>and (iv) \u2026Representation made on behalf of her children by him. It also looks at; (a) …The inordinate delay in bringing Judicial Closure\u2019 to the tragedy; (b) \u2026The crime of Perverting the Course of Justice; (c)<\/strong> \u2026Statute of Limitation; and (d)<\/strong> \u2026The apparent pathetic attitude of traffic accident and criminal investigators.\u2019<\/p>

RULE OF LAW<\/strong><\/p>\n

Enforcement of law necessarily means the protection of society and ensuring that the \u2018Rule of Law\u2019 <\/strong>prevails over all other considerations. The days of the captivating, yet \u2018fanciful political bantering or jesting\u2019<\/strong> that \u2018Justice is slow, <\/strong>but Justice is Sure,<\/strong>\u2019 have long been passed into political history [Former Prime Minister Baldwin Spencer]. More pragmatic and decisive leadership never engaged in such whimsical expressions. Such leadership have made its intentions, albeit \u2018Pregnant with Acrimony,\u2019<\/strong> very clear. It is to the knowledge that every aggrieved litigant or victim of crime, expects those with responsibility for enforcement of the law as well as those responsible for the administration of justice shall have been fairly and equally dispensed.<\/p>

\"\"<\/a><\/div>\n

LAW ENFORCEMENT \u2013 CORE VALUES<\/strong><\/p>

\"\"<\/a><\/div>\n

By the \u2018Oath of Office\u2019<\/strong> every law enforcement officer has been under microscopic scrutiny of the citizens.\u00a0 The citizenry not only expects to see them as acting professionally, but also lawfully and fairly. When Law enforcement personnel subscribed to such \u2018Oath,\u2019<\/strong> each was sworn to \u2018\u2026Well and truly serve Our Sovereign Lady the Queen without; (a) \u2018\u2026Favor or affection; and (b) \u2026Malice or ill-will\u2019<\/strong> [Section 17: Police Act: Chapter 330].\u2019 Implicit in these \u2018Core Values\u2019<\/strong>are three fundamentals; (i) <\/strong>\u2018\u2026Serving and protecting the citizens from the criminal elements; (ii) <\/strong>\u2026Apprehending perpetrators of crime; and (iii) \u2026Bringing lawless and reckless citizens to justice.\u2019 <\/strong>More importantly, criminal investigators shall not only endeavor to the utmost of their power in bringing perpetrators to justice, but also to maintain the \u2018Rule of Law.\u2019<\/strong><\/p>\n

JUDICIAL CLOSURE<\/strong><\/p>\n

Guided by knowledge of law and without fear of contradiction an aggrieved or bereaved person may say with some degree of dissatisfaction, there has been miserable failure in bringing \u2018Judicial Closure\u2019 <\/strong>to the \u2018Andrea Hughes\u2019 <\/strong>tragic death. Frequently, there are those that would seek to exploit or frustrate either the investigative process or derail the administration and dispensation of justice. This is usually the bidding of those with societal prominence or in possession of vast amount of wealth. It has been the knowledge that not many people are familiar with the crime, \u2018Perverting the Course of Justice.\u2019 <\/strong><\/p>\n

PUBLIC JUSTICE<\/strong><\/p>\n

While some law enforcement personnel appear oblivious to the meaning of this criminal act, most investigators know that, \u2018Perverting the Course of Justice\u2019<\/strong> is an offence at \u2018Common Law.\u2019 <\/strong>Though not necessarily attributing blame to law enforcement for lack of \u2018Judicial Closure\u2019 to<\/strong> the tragic death of the female pedestrian, citizens shall not see their \u2018Core Values\u2019 as inapplicable to certain high-society people. Thus, investigators shall never see the road fatality victim as a \u2018Nonentity\u2019<\/strong> and a reason not to follow-up to ensure that final closure\u2019 is brought to the widely publicized tragedy. Viewed from the perspective of the conduct of \u2018former Bryson\u2019s Shipping General Manager, Nathan Dundas\u2019 (deceased),<\/strong> if \u2018Public Justice\u2019<\/strong> is to be served, the questions that seem most appropriate to be asked are; (i)<\/strong> \u2018\u2026Did he commit the crime \u2018Conspiracy to Pervert the Course of Justice?<\/strong> And (ii)<\/strong> \u2026If so, who are the co-conspirators?\u2019<\/p>\n

HAS JUSTICE BEEN PERVERTED?<\/strong><\/p>\n

In this particular case it begs the all-important question; \u2018\u2026Has justice been perverted?\u2019 <\/strong>Consequent upon the apparent timely intervention and involvement voluntarily or persuasively or otherwise, the adept criminal investigators may have been suspicious of his positional relationship as; (i) \u2018\u2026General Manager of Bryson\u2019s Shipping with shareholdings in the Group of Companies; and (ii) \u2018\u2026His apparent non-relationship with the traffic accident fatality<\/strong> \u2018Andrea Hughes.\u2019 <\/strong>Thus, in spearheading the drive in providing a specially constructed \u201840×25 two-bedroom wooden dwelling house\u2019<\/strong> to the surviving \u2018nine children of the deceased,\u2019 <\/strong>shall have caused the investigators to look \u2018Beneath the Surface\u2019<\/strong> as obtained in radio programme.<\/p>\n

DAMNING CIRCUMSTANCES<\/strong><\/p>\n

Early on Law enforcement training instructors had inculcated in the minds of prospective investigators certain quotes. One such quote was; \u2018\u2026Commit a crime, and the world is made of glass.\u2019<\/strong> Tit was explained that no matter the criminal act committed, some \u2018Damning Circumstances\u2019 <\/strong>always exist. This he instructed is the \u2018Nexus\u2019<\/strong> that connects the perpetrator to the crime alleged to have been committed. In the case of a \u2018Hit and Run Fatal Traffic Accident,\u2019<\/strong> while debris of stripped paint or broken glass or parts of a motor vehicle were often found strewn across the road from the \u2018Point of Impact,\u2019<\/strong> there is no better \u2018Nexus\u2019<\/strong> than immediate seizure and to impound the vehicle. The driver in the \u2018Andrea Hughes Hit and Run\u2019<\/strong> traffic accident had nowhere to hide.<\/p>\n

SERIOUS TO FATAL<\/strong><\/p>\n

None may deny that \u2018Andrea Hughes\u2019<\/strong> was accidentally run over by a motor vehicle. The accident that reportedly occurred on the \u2018Weatherill\u2019s public road,\u2019 <\/strong>speaks to a very \u2018Harrowing Story.\u2019<\/strong>\u00a0 The fateful night was \u2018April 29, 2014.\u2019<\/strong>While she was walking along the public road tragedy struck. The driver reportedly kept on driving, leaving the accident victim on the roadway. She reportedly bled from the \u2018head, nose and mouth and other parts of the body.\u2019 <\/strong>Helplessly, she lay on the roadway writhing in pain, but \u2018slowly and surely dying.\u2019<\/strong> Several hours after, the traffic accident turned from \u2018Serious to Fatal.\u2019<\/strong> She succumbed one day later to injuries sustained [April 30, 2014]. As it was gruesomely told, tears fell from the eyes of her children; \u2026her partner Dane Hamilton; \u2026her family and friends and those who knew her.<\/p>\n

STRUCK: BATTERED AND BRUISED<\/strong><\/p>\n

This was the result of the tragic traffic accident that had robbed the former \u2018Cedar Grove resident\u2019<\/strong> of her life; caused immense grief and sorrow to be visited upon her partner \u2018Dane Hamilton and left their nine children motherless.<\/strong>\u2019 They included \u2018three sets of twins.\u2019<\/strong> Their ages then ranged \u2018from 5 years to 12 years.\u2019<\/strong> With metal forcefully striking the human body, \u2018Andrea Hughes\u2019<\/strong> was reportedly struck by a motor vehicle and by the impact, left \u2018Battered and Bruised.\u2019<\/strong>\u00a0 The driver, subsequently identified by investigators was \u2018Mark Ryan.\u2019 <\/strong>When tragedy strikes, it is natural for humans to take flight. He appeared to have been too overwhelmed with fright to stop immediately at the scene of the accident.<\/p>\n

CORONER\u2019S INQUISITION<\/strong><\/p>\n

Generally, the law provides for a \u2018Coroner\u2019s Inquisition\u2019 <\/strong>into circumstances surrounding tragic deaths [Section 12 (2) (d): Coroners Act: Chapter 105]. Thus, at the conclusion of such Inquisition, a \u2018five-member Jury\u2019<\/strong> may find a motorist \u2018Culpable of the Death.\u2019 <\/strong>This so whether or not the deceased person was; (a)<\/strong> \u2026An occupant in a motor vehicle; or (b)<\/strong>\u2026A pedestrian on the public road.\u2019 After such verdict, a Coroner is empowered to issue a \u2018Warrant of Arrest\u2019<\/strong> for \u2018Manslaughter.\u2019<\/strong> [Section 33: Coroners Act: Chapter 105]. The Coroner is also empowered to grant bail to the \u2018Culpable Driver.\u2019<\/strong> This allows for subsequent \u2018Committal Proceedings\u2019<\/strong> on a charge of \u2018Manslaughter,\u2019 <\/strong>and if indicted by the \u2018Director of Public Prosecutions (DPP),\u2019 <\/strong>fit for criminal trial by a Jury [CA: Section 34].<\/p>\n

VERDICT OF CULPABILITY<\/strong><\/p>\n

Seven years<\/strong> have elapsed since the tragedy that resulted in the loss of life of \u2018Andrea Hughes,\u2019<\/strong> the mother of nine children and her partner Dane Hamilton [April 30, 2014].<\/strong> Most significantly, it has been just over five years<\/strong> since a \u2018Coroner\u2019s Jury\u2019<\/strong> returned a \u2018Verdict of Culpability\u2019<\/strong> against the driver \u2018Mark Ryan\u2019<\/strong> [March 2, 2016].<\/strong> If it doesn\u2019t seem an awfully long time to those that; (a) \u2018\u2026Enforces law; (b) \u2026Prosecute offenders; and (c) \u2026Administrate justice,\u2019 <\/strong>then just what is? It has been seven years after the untimely death of \u2018Andrea Hughes\u2019 [April 30, 2014].<\/strong>Likened to the silent critics, including law enforcement personnel and public officials, the public\u2019s interest would be better served to bring closure to this vexing fatal traffic accident.<\/p>\n

PARADING FOR PUBLICITY<\/strong><\/p>\n

Even as social justice activist \u2018James \u2018Tanny\u2019 Rose\u2019 <\/strong>the \u2018Living Voice of Andrea Hughes\u2019<\/strong> and prominent businessman \u2018Sir George Ryan\u2019<\/strong> continue to speak to the issue, those responsible for the administration and dispensation of justice,<\/strong>continue to treat her tragic death with indifference. Then adding to their misery, have been the \u2018Self-Serving Road Safety Groups.\u2019 <\/strong>With clearly peculiar interests they have constantly shown hypocrisy, \u2018Parading for Publicity\u2019<\/strong> on State and social media speaking to the issue of \u2018Road Safety.\u2019 <\/strong>Yet they have seemingly found it convenient to remain in deafening silence in this particular tragic traffic accident.<\/p>\n

CORONER\u2019S COURTESY<\/strong><\/p>\n

Then there was the odd statement by an attorney. Accorded \u2018Coroner\u2019s Courtesy,\u2019<\/strong> he was quoted as informing mainstream media that the \u2018High Court of Justice\u2019<\/strong> issued a \u2018Stay Order\u2019<\/strong> preventing the Police from instituting criminal proceedings against his client, know that such statement is capable of being described as \u2018deceitful.\u2019 [Observer: August 23, 2017].<\/strong> That which shall be known is this, except as a deponent, law enforcers have \u2018No Locus Standi\u2019<\/strong> in \u2018Coroner\u2019s Inquisition.\u2019<\/strong> They neither make determinations, nor decides who shall or shall not be charged or committed for \u2018Jury Trial\u2019<\/strong> for the crime of \u2018Manslaughter.\u2019<\/strong><\/p>\n

MISGUIDE \u2013 MISLEAD – MISINFORM<\/strong><\/p>\n

Such is the function of, and a power that resides only with the \u2018Coroner.\u2019 Then acting in<\/strong> the reversed role of\u2018Committing Magistrate\u2019<\/strong> and the \u2018Director of Public Prosecutions (DPP)\u2019 <\/strong>who serving the public interest, may indict and prosecute. Thus, from the perspective of criminal prosecution, know that such statement represents a brazen attempt to; (i) \u2018\u2026Misguide clients; (ii) \u2026Mislead the media; and (iii) \u2026Misinform the general public.\u2019<\/strong> In the instant case, a practicing attorney runs the risk of being seen as intending to \u2018Pervert the Course of Justice.\u2019 <\/strong>Investigators shall have taken cue from this very statement.<\/p>\n

AUDIENCE OR REPRESENTATION<\/strong><\/p>\n

Invariably, it has been statements such as this that those with responsibility for administrating and dispensing justice were often forced to draw unfavorable inferences as to the professional conduct of such attorneys. Instructively, a discretionary power resides with a \u2018Coroner.<\/strong>\u2019 Thus, an attorney upon application, may be allowed an appearance at the Inquisition [Section 24: Coroners Act: Chapter 105]. Even so, there is neither a right of; (a) \u2018\u2026Audience; or (b) \u2026Representation; nor (c) \u2026To be heard.\u2019<\/strong> It is not a criminal trial. Such attorney is precluded from active participation in the proceedings. Thus, he sits quietly and uninterruptedly, listens attentively and observes the proceedings.<\/p>\n

HOUSE PRESENTATION CEREMONY<\/strong><\/p>\n

Long before a five-member \u2018Coroner\u2019s Jury\u2019 <\/strong>had returned their \u2018Verdict of Culpability,\u2019<\/strong> \u2018Nathan Dundas,\u2019<\/strong> then \u2018General Manager of Bryson\u2019s Shipping\u2019<\/strong> appeared to have been \u2018Instrumental or Influential\u2019<\/strong> in wooing several high-profile innocent citizens to attend a \u2018House Presentation Ceremony.\u2019<\/strong> Among those persons was \u2018Governor General, His Excellency, Sir Rodney Errey Williams GCMG, MBBS.\u2019<\/strong> Innocently, but patronizingly, he made his presence felt and his expressions of sympathy and satisfaction heard.<\/p>\n

PROMINENCE INFLUENCE OR WEALTH<\/strong><\/p>\n

There was the involvement of several other \u2018Prominent Persons\u2019 <\/strong>of \u2018Influence or Wealth.\u2019 These included \u2018Jill Fernandez and Vanessa Maria Bird-Browne.\u2019 <\/strong>They also made their presence felt, contributions and future contributions publicly known [Rotary Web Page: September 6, 2014]. <\/strong>It was not clear how \u2018Rotary Club Vice President Paul Ryan\u2019<\/strong> got involved, but the organization had presented a \u2018Cheque\u2019 to cover costs of \u2018School\u2019s Registration\u2019 of at least four of the \u2018Motherless Children\u2019<\/strong> left behind following the tragic death of \u2018Andrea Hughes\u2019 <\/strong>[July 22, 2015: Rotary Club Web Page].<\/p>\n

GENTLE REMINDERS<\/strong><\/p>\n

If it shall be gently reminded, \u2018Nathan Dundas\u2019<\/strong> business colleague \u2018Patrick Ryan,\u2019<\/strong> is the undisputed father of \u2018Mark Ryan.\u2019 Incidentally, <\/strong>he is the driver that the \u2018Coroner\u2019s Jury\u2019 <\/strong>attributed \u2018Culpability\u2019<\/strong> for the death of \u2018Andrea Hughes.\u2019<\/strong> His \u2018Watching Brief Attorney\u2019<\/strong> was identified as \u2018Hugh Marshall Jr.\u2019<\/strong> Whatever the verdict of the \u2018Coroner\u2019s Jury,\u2019<\/strong> except misrepresentation of the verdict, in which an attorney may be at liberty to seek \u2018Judicial Review\u2019<\/strong> by a Superior Court.<\/p>\n

DUBIOUS INTENT<\/strong><\/p>\n

Disguising an apparent \u2018Dubious Intent,\u2019<\/strong> former \u2018President of the Cruise Tourism Association (CTA) \u2018Nathan Dundas\u2019 <\/strong>succeeded in providing the children of \u2018Andrea Hughes.\u2019<\/strong> They were bereaved by the unfortunate traffic accident [April 30, 2014]. Incidentally, evidence suggested that he had eked out from Corporate citizens funds said to have been expended toward a dwelling house. He had spearheaded fundraising efforts in securing assistance for construction of a wooden tenement to the value of \u2018EC$150, 000.\u2019<\/strong> This he presented to the \u2018Motherless children of the deceased\u2019 [Rotary Club: September 6, 2014].<\/strong><\/p>\n

UNSOLICITED GENEROSITY<\/strong><\/p>\n

It matters not the status of persons fingered this is an offence that has often inspired public interest. Yet, traffic accident and criminal investigators appeared not to have the feintest of idea of that which may have prompted Nathan Dundas \u2018Unsolicited Generosity\u2019<\/strong> to virtual unknowns. There are those in society that often wield power of influence or affluenceon those professionally starved of competence or for reasons of expediency or docility.<\/strong>\u2019 Whether or not for one or more of these reasons, while Law enforcement investigators appeared to have taken a \u2018Kitty Napping\u2019 <\/strong>(cat asleep), \u2018Nathan Dundas\u2019 <\/strong>was a \u2018Samaritan on a Mission.\u2019<\/strong><\/p>\n

SOLICITING ALMS<\/strong><\/p>\n

He had traveled from Antigua and Barbuda to Miami and New York \u2018Soliciting Alms\u2019<\/strong> from nationals in the Diaspora for his housing initiative. Interestingly, before he was called to a place of \u2018Glory or Misery,\u2019<\/strong> though not necessarily a man of straw or meager means, he had caused prominent businessman and building contractor \u2018Sir George Ryan KCN,\u2019<\/strong> making media appeals to him to settle \u2018an Outstanding Debt\u2019<\/strong> of \u2018over EC$50, 000\u2019<\/strong> [OMG]. Sir George shall know that a Claim for settlement might lawfully be made against his \u2018Estate.\u2019<\/strong><\/p>\n

COMPENSATORY BENEFITS<\/strong><\/p>\n

Conversely, an attorney so engaged and instructed to represent the interests of the bereaved may have litigated against the \u2018Culpable driver and Insurance Company\u2019<\/strong> for \u2018Compensatory Benefits.\u2019 <\/strong>That which is in issue was the questionable role of \u2018Nathan Dundas.\u2019 <\/strong>It speaks to nothing short of a cunning attempt at \u2018Perverting the Course of Justice.\u2019 <\/strong>Traffic and criminal investigators shall know that which is of critical importance to; (a) \u2026Public confidence; (b) \u2026Road Safety; and (c) …Rule of Law,\u2019 <\/strong>undoubtedly, is bringing \u2018Judicial Closure\u2019<\/strong> to the tragedy that resulted in the loss of life of a mother \u2018Andrea Hughes\u2019 <\/strong>and her 9 grieving children.<\/p>\n

EMPATHY AND COMPASSION<\/strong><\/p>\n

While it remained unconfirmed \u2018an Escrow or Sub-Account<\/strong>\u2019 was said to have been established some financial institution to the benefit of the children of the deceased \u2018Andrea Hughes.\u2019 <\/strong>Even as criminal investigators may not have suspected him as a co-conspirator in the criminal act of \u2018Perverting the Course of Justice,\u2019<\/strong> they shall experience no difficulties in; (a)<\/strong> \u2018\u2026Identifying co-conspirators; or (b)<\/strong> \u2026Unearthing Documentary Evidence\u2019 <\/strong>as to the holders of such account. Such might be accessible at some financial institutions. This may very well provide some insights necessary to determine whether or not \u2018Nathan Dundas\u2019<\/strong> was moved by \u2018Empathy and Compassion\u2019<\/strong> or by third parties with vested interests in order to escape criminal prosecutions.<\/p>\n

STATUTE OF LIMITATION<\/strong><\/p>\n

While some criminal acts cannot be prosecuted if criminal proceedings were not instituted within six months of commission, there are those serious acts of criminality that do not. That which shall be known is that there are some serious acts or omissions or courses of conduct that are classified as crime. None therefore, may advance arguments on the issue of \u2018Statute of Limitation.\u2019 <\/strong>\u00a0Thus, none shall be so professionally daft or intellectually crass as to suggest that; (a) \u2018\u2026Manslaughter\u2019 (Verdict of Coroner\u2019s Jury); or (b) \u2026Causing Death by Dangerous Driving\u2019 (when charged by the Police)<\/strong> is \u2018Statute Barred\u2019 <\/strong>[Sections 37: Coroners Act: Chapter 105: and Section 57: Vehicles and Road Traffic Act: Chapter 460].<\/p>\n

PRIMA FACIE EVIDENCE<\/strong><\/p>\n

From a criminal perspective, credible prima facie evidence may have been left behind by \u2018Nathan Dundas.\u2019 <\/strong>He appeared to have been the executing agent of that which shall attract criminal investigation into what is seen as a disguised attempt at \u2018Perverting the Course of Justice\u2019 <\/strong>with persons known. The astute investigator shall not only seek to solve the particular crime, but shall always endeavor to find \u2018The Nexus.\u2019<\/strong> This may have been evident in the recent \u2018Regional News\u2019<\/strong> that speaks to a \u2018Jamaican child-rapist\u2019<\/strong> who hastily fled the scene leaving behind; (i) \u2018\u2026His clothes; (ii) \u2026A knife; and (iii) \u2026A cellular phone\u2019 [ANR: April, 2021].<\/strong> This reportedly occurred after a distraught mother made a hue and cry, and incensed residents moved into do either the imaginable or unimaginable.<\/p>\n

SMARTING UNDER ADVICE<\/strong><\/p>\n
