Researching for this commentary, the quotes contained herein are the chilling words of a distraught and grieving partner\/father \u2018Dane Hamilton.\u2019<\/strong>\u00a0 In a common law union that reportedly produced three sets of twins and offspring numbering nine, the only \u2018humbug\u2019 for the family of \u2018Andrea Hughes\u2019 and partner, was \u2018Poverty\u2019<\/strong> and living conditions that speak to \u2018Squalidity.\u2019<\/strong> Yet the family of eleven survived on what meager means was accessible to them.<\/p>\n

POOR AND DOWTRODDEN<\/strong><\/p>

There appears to be no end in sight when \u2018Injustice\u2019<\/strong> may not be seen as the lot of the \u2018Poor and Downtrodden.\u2019<\/strong> The citizens have reasonably high expectations of those charged with the administration of justice to show manifestations that justice is dispensed within a reasonable time, fairly and justly. Such have been the \u2018Harbored Expectations\u2019<\/strong> of an aggrieved \u2018Dane Hamilton,\u2019<\/strong> partner and father of seven children, now being \u2018mothered and fathered by him, following the tragic loss of \u2018Andrea Hughes\u2019<\/strong> [April 30, 2014]. Though she has been long gone, not only has her demise continues to occupy the living memory of her nine children and partner, but also many people in the wider society.<\/p>

TRAGIC DEATH: JUDICIAL OUTCOME<\/strong><\/p>\n

Confusion seemed to reign over the \u2018Judicial Outcome\u2019<\/strong> of; (i) \u2018\u2026A duly conducted Coroner\u2019s Inquisition; (ii) <\/strong>\u2026Granting of a \u2018Stay Order,\u2019<\/strong> consequent upon an application for \u2018Judicial Review.\u2019<\/strong> While there has been a prolonged closure to the \u2018Tragic Death of Andrea Hughes,\u2019 <\/strong>it may still be said that it may not necessarily have been due to an inefficient Court system. It begs the question what \u2018Judicial officer\u2019 shall ignore the \u2018Founding Constitution Principle\u2019<\/strong>that states; \u2018\u2026People of Antigua and Barbuda recognize that the law symbolizes the \u2018Public Conscience.\u2019<\/strong> Given the apparent unconfirmed \u2018Stay Order Claim,\u2019<\/strong> curious and concerned citizens beseech those with judicial knowledge to so confirm and inform.<\/p>

PERSPECTIVE<\/strong><\/p>\n

The discussion focuses on (i)<\/strong> \u2018\u2026Tragic traffic accident that saw a female pedestrian ran over and likened to mongoose, left bleeding profusely at the side of the road until good Samaritan motorists sent by \u2018Divine Spirit\u2019<\/strong> to render assistance; (ii)<\/strong> \u2026Provision of wooden dwelling house, disguisedly intended to \u2018Pervert the Course of Justice; (iii)<\/strong> \u2026Verdict of a Coroner\u2019s Jury; (iv)<\/strong> \u2026Impediment to the administration of justice and (v) \u2026Inordinate delay in bringing closure\u2019 to a case, this nation has been watching for the past seven (7) years<\/strong> [2014 – 2021].<\/p>

DECEPTIVELY CONJURED<\/strong><\/p>

\"\"<\/a><\/div>\n

From professional knowledge and practical experience, this appeared not to be consistent with that normally obtains in \u2018Coroner\u2019s Inquisition.\u2019 <\/strong>That which was said to have prompted the application for a \u2018Stay Order\u2019<\/strong> appeared not to have been disclosed to the media. As readily acceptable this may have been, in all respects, and to all intents and purposes, this not only lacked merit, but may also have been calculatedly conjured with deception. In situation like this, the objective has often been to misinform and mislead an unsuspecting public. Lest it might be unreasonably inferenced, attorneys known or unknown and involved in the instant case, shall not be considered among those with a depraved disposition.<\/p>\n

ABSOLUTE NONSENSE<\/strong><\/p>\n

An application reportedly made to the \u2018High Court of Justice\u2019 was said to have placed restrictions on the Police from initiating action geared toward the institution of criminal proceedings against the identifiable motorist. It reeks of \u2018Absolute Nonsense\u2019<\/strong> that the \u2018High Court of Justice,\u2019 shall place restrictions upon these agencies to adversely affect their responsibilities in protecting the society, and in the instant Case, the safety of all road users and by extension, members of the wider society. Thus, if this does not require \u2018Judicial Examination,\u2019 then it might be fair to say that the \u2018Odebrecht Corruption Scandal\u2019 <\/strong>and alleged \u2018Forgery of the Prime Minister\u2019s signature\u2019<\/strong> needs no \u2018inquiry and criminal investigation.<\/p>\n

KNOWLEDGE AND EXPERIENCE<\/strong><\/p>\n

From professional \u2018Knowledge and Experience,\u2019<\/strong> this appeared not to be consistent with that normally obtains in \u2018Coroner\u2019s Inquisition.\u2019 <\/strong>That which was said to have prompted the application for a \u2018Stay Order\u2019<\/strong> was the word \u2018Guilty.\u2019<\/strong> As factual this may have been accepted by media personnel and reported for public information, in all respects, and to all intents and purposes, this not only lacked truth and merit, but may also have been \u2018Deceptively Conjured\u2019<\/strong> to mislead an unsuspecting media.<\/p>\n

SPIRIT OF PERSEVERENCE<\/strong><\/p>\n

Incidentally, her demise came not as the result of \u2018Visitation of God,\u2019<\/strong> but under tragic circumstances. The harrowing account speaks to her being mowed down by a motor vehicle on the \u2018Weatherill\u2019s\u2019<\/strong> main public road under cover of darkness.\u2019 An apparent frightened male motorist was said to have fled the scene, but reportedly returned later after informing relatives of the tragic accident. For the thirty-two-year-old deceased \u2018Andrea Hughes,\u2019<\/strong> though life may have been an uphill struggle, she appeared to have shown great resilience and a \u2018Spirit of Perseverance,\u2019<\/strong> strengthened by a will to live. Though faced with adversities socially and financially, it was evident that in her relatively short-life span, she had not shirked parental responsibility of their \u2018eleven-member family.\u2019 <\/strong><\/p>\n

CHILLING WORDS<\/strong><\/p>\n

Except for the close relatives, they were virtually unknown until tragedy struck and \u2018Cruise Tourism Association (CTA) President and General Manager of Bryson\u2019s Shipping, Nathan Dundas,\u2019 reasonably inferred to have been sent by someone, other than \u2018God,\u2019<\/strong> in rendering social assistance to the bereaved. Reminiscing his relationship with his deceased partner, \u2018Andrea Hughes 32,\u2019<\/strong> media personnel quoted him as saying; (a) \u2018\u2026Since she died, I have to work harder; (b) \u2026I have to go to work and take care of bills and still make sure they have food, clothes and shoes\u2019<\/strong> [Observer: August 23, 2017].<\/p>\n

DELAYED -DENIED JUSTICE<\/strong><\/p>\n

In tragic circumstances, bringing comfort to the bereaved is one thing, but extending their grief is another. This may have been the experiences of the offspring and common law partner of \u2018Andrea Hughes\u2019<\/strong> who was tragically killed in a traffic accident some seven years ago [April 30, 2014]. When transparency of closure was not judicially or prosecutorally known or publicized, likened to her distraught family, law-abiding citizens continue to ask; \u2018\u2026If such is not Justice delayed and justice denied, then what is? <\/strong>Today, not only the collective voices of her children been heard querying, but also her restless Soul cries, \u2018\u2026Where are their voices now?\u2019 <\/strong><\/p>\n

PECULIAR COURTSHIP<\/strong><\/p>\n

The two deeply concerned citizens that have been constantly and stridently made their voices heard were; (i) <\/strong>\u2018\u2026Prominent businessman Sir George Ryan KCN;<\/strong> and (ii) <\/strong>\u2026Well-known social justice activist and \u2018Voice of the People,\u2019 James \u2018Tanny\u2019 Rose.\u2019 <\/strong>The former\u2019s involvement with the provision of a dwelling house was reportedly due to a \u2018Peculiar Courtship\u2019<\/strong> initiated by \u2018President of the Antigua and Barbuda Cruise Tourism Association, Nathan Dundas.\u2019 <\/strong>He was reportedly persuaded by the apparent glib talking \u2018Nathan Dundas\u2019<\/strong> to partner him in a particular venture. Such was to render assistance to the nine children left to grieve and struggle, following the tragic death of their mother and provider \u2018Andrea Hughes.\u2019<\/strong> \u00a0<\/strong><\/p>\n

UNDISPUTED FACTS<\/strong><\/p>\n

The undisputed facts are; (i) \u2018\u2026The deceased \u2018Andrea Hughes\u2019<\/strong> was said to be virtually unknow<\/strong> to persons of whatever position or capacity, concerned or associated with the operations of; (i) \u2018\u2026George W. Bennett Bryson Group of Companies;<\/strong> (ii) \u2026She was also not known to, or by Nathan Dundas,<\/strong> then \u2018General Manger of Bryson\u2019s Shipping;<\/strong>(iii)<\/strong> \u2026Not only had he vested interests, but reportedly had shareholdings in that Group of companies; (iv)<\/strong> \u2026 Patrick Ryan <\/strong>was identified as the Chairman of said Group of Companies [Observer: January 24, 2021]; (v)<\/strong> \u2026The driver found by a \u2018Coroner\u2019s Jury\u2019 to be culpable for the death of \u2018Andrea Hughes was Mark Ryan; (vi) <\/strong>\u2026He was said to be the son of the Chairman of the Group of Companies.\u2019<\/p>\n

MOTHER\/FATHER ROLES<\/strong><\/p>\n

With clearly no relations between both deceased \u2018Andrea Hughes and Nathan Dundas,\u2019<\/strong> her partner \u2018Dane Hamilton,\u2019<\/strong>father of seven of the nine children, baring ulterior motive, it begs the question; \u2018\u2026What may have prompted \u2018Nathan Dundas\u2019<\/strong> to embark upon such initiative almost immediately after the shocking fatal traffic accident? Even with the gesture in providing new dwelling, a despondent partner retorted; (a) \u2018\u2026I have to be mother and father to them; (b)<\/strong>\u2018\u2026Because they have their money and their business, we are too small for them to deal with us<\/strong>; and (c)<\/strong> \u2026The guy still on the road and still driving; (d)<\/strong> \u2026Everyday he is in Cedar Grove playing tennis on the court; and (e)\u2026The kids see him every day\u2019<\/strong> [Observer: August 23, 2017].<\/p>\n

SHROUDED IN SECRECY<\/strong><\/p>\n

A news portal reported identified practicing attorney \u2018Hugh Marshall Jr,\u2019<\/strong> had mounted a legal challenge to the \u2018\u2026Findings and publication of the Inquest Report in August last year\u2019 <\/strong>[Observer: August 23, 2017]. As local news portal reported that a \u2018High Court Stay Order\u2019 <\/strong>remains in place to prevent the Police from bringing criminal proceedings against \u2018Mark Ryan,\u2019<\/strong> the motorist then under investigation in the fatal case [Observer: August 23, 2017]. Following a \u2018Coroner\u2019s Inquisition,\u2019<\/strong> a \u2018Coroner\u2019s Jury\u2019 reportedly-found him \u2018Culpable of the death of \u2018Andrea Hughes\u2019 <\/strong>appeared to have been \u2018Shrouded Deeply in Secrecy.\u2019<\/strong><\/p>\n

BIBLICAL PERSPECTIVE<\/strong><\/p>\n

Most citizens scripturally know that \u2018Sin is a disgrace to a nation.\u2019<\/strong> Conversely, a citizenry that acknowledges the \u2018Supremacy of God\u2019 [CO: 1981]<\/strong> knows that \u2018Righteousness exalts a nation.\u2019<\/strong> The Scripture edifies that \u2018Justice not only exalts nations,\u2019<\/strong> but also indulgence in sin make nations miserable\u2019 [KJV: Proverbs 14: 34]. Relate \u2018Justice and Injustice\u2019 <\/strong>to people, both have brought miseries to the indigent. \u00a0From a recent conversation with \u2018Christian Assembly Ministries Pastor, Paul Andrew,<\/strong>\u2019 he provided a profound \u2018Biblical Perspective.\u2019<\/strong> He was firm in the belief and conviction that there can be no \u2018Righteous nation<\/strong> without justice for its people\u2019<\/strong> [April 22, 2021].<\/p>\n

ELUSIVE JUSTICE<\/strong><\/p>\n

Though not from the pulpit, to those that were not \u2018hedonistic, eccentric or egoistic,\u2019 the religious leader was in fact preaching the \u2018Gospel Truth.\u2019 <\/strong>Relate the concept \u2018Justice\u2019<\/strong> to grieving children of \u2018Andrea Hughes,\u2019<\/strong> none may deny that \u2018Justice\u2019<\/strong> has not only been \u2018Elusive\u2019<\/strong> to them, but also caused despondency and despair to members in every strata of society. Frequently a heart is caused to throb uncontrollably. It aches and pains. As they mourn and grieve. Their miseries are multi-fold and were known to have been caused by a handful of depraved professionals that invariably seize opportunities to \u2018deceive, exploit and fleece\u2019<\/strong> the unsuspecting. Thus, those \u2018Affluently-Awash,\u2019<\/strong> for reasons of running afoul of the law, called upon the opportunists to be counseled, are as much victims of their own folly.<\/p>\n

ANYTHING BUT STRAIGHT<\/strong><\/p>\n

It was widely known that some people thrive on the innocence and intellect of those considered inferior to theirs. Not infrequently a few practitioners have brought the \u2018Noble Legal Profession\u2019<\/strong> into disrepute. Invariably, they are allowed to continue in practices starved of honesty and truth. There have not only been suggestions, but also within professional knowledge that a very small minority of members of the legal fraternity were \u2018Anything, but Straight.\u2019<\/strong> This minority was often seen displaying conduct consistent with the shape of a \u2018Cork Screw.\u2019 <\/strong><\/p>\n

CORK OR SCREW<\/strong><\/p>\n

While a noble-minded and well-intended \u2018Chief Justice, Her Ladyship, Dame Justice Dame Janice Pereira\u2019 has been promoting the jurisdictional Courts as the \u2018Bastion of Hope,\u2019<\/strong> many people have now come to the inescapable realization that these have done nothing more than replacing \u2018Hope with Hopelessness.\u2019<\/strong> \u00a0Interestingly, \u2018Cork or Screw,\u2019<\/strong> that which shall be commended has been the \u2018female attorney\u2019<\/strong> said to be currently under inquisition of the \u2018Antigua and Barbuda Bar Council.\u2019<\/strong> Some aggrieved \u2018Barbudan Client,\u2019<\/strong> may either breathe a sigh of relief, or forced to cause visitation of the \u2018Judiciary\u2019<\/strong> upon the unscrupulous. This has been the experiences of many clients who would have seen their attorneys caused the straightness of an arrow to be shaped like a \u2018Cork Screw.\u2019 <\/strong>Then there are those that opportunistically and religiously abuse the process of the Courts.<\/p>\n

ALLEGIANCE\/OBEDIENCE<\/strong><\/p>\n

Framers knew that some citizens and some authorities may do the unthinkable. Consequently, they inserted a clause that imposes a duty, an obligation and responsibility upon all persons to show undivided \u2018Allegiance,\u2019<\/strong> while subjecting the \u2018State,\u2019<\/strong> its institutional machinery, agencies and agents to its \u2018Obedience.\u2019 <\/strong>Even as the \u2018Constitution Order\u2019<\/strong> [1981] provides no person or authority in fettering Judges in performance of their judicial functions, with a deep sense of urgency, there are very serious questions to be addressed, either by the \u2018Judicial and Legal Services Commission,\u2019<\/strong> or by the \u2018Chief Justice Dame Janice Pereira.\u2019<\/strong><\/p>\n

ALL IS NOT WELL<\/strong><\/p>\n

While the Constitution provides guarantees and protection of certain \u2018Fundamental Rights\u2019 of the individual. In fact, as it relates to the \u2018Law,\u2019<\/strong> this is what the people of \u2018Antigua and Barbuda\u2019<\/strong> proclaimed in the \u2018Constitution,\u2019<\/strong> widely accepted by the citizenry and its institutions, including the Judiciary and its Courts as the \u2018Supreme Law\u2019<\/strong> of the nation [CO: 1981: Section 2]. Not only shall every law-abiding citizen recognize and respect the \u2018Rule of Law,\u2019<\/strong> also hold in high esteem, and in those charged with responsibility for the administration of justice, shall give good reasons that citizens will hold high expectations\u2019 that they will do so \u2018Expeditiously, Fairly and Justly.\u2019<\/strong> Through this medium, \u2018Her Ladyship\u2019<\/strong> shall know that within the Judiciary\u2019 <\/strong>and in some Court Registry,<\/strong> \u2018\u2026All Is Not Well\u2019<\/strong> [Trevor King: Social commentator \u2018King Zachary\u2019<\/strong>].<\/p>\n

PROFESSIONAL PERSPECTIVE<\/strong><\/p>\n

Guided by professional criminal investigative skills and practice, that which is contained herein, speaks to \u2018Facts\u2019 <\/strong>thatbear no contention. Lest it might be unreasonably inferenced, attorneys known or unknown and involved in the instant case, shall not be considered among practitioners of any discipline, with a disposition that speaks to depravity. Though publicly known and considered useful to the discussion, there shall be no imputation of improper motive as to how the matter of her tragic demise has been or being handled. However, if ever it was felt that \u2018Corn was thrown, no fowl is called\u2019<\/strong> [Robert Nestor \u2018Bob\u2019 Marley].<\/p>\n

IMPEDE OR DEFEAT<\/strong><\/p>\n

Endeavoring to unearth \u2018Documentary Evidence\u2019<\/strong> that the \u2018High Court of Justice\u2019 <\/strong>had ordered restrictions upon the Police from so doing, has proved futile. Incidentally, the Police themselves were not au fait that such an order was in fact made, let alone exists. However, it has often been said that if something smells \u2018Fishy,\u2019<\/strong> then it has to be \u2018Fish.\u2019<\/strong> That which appeared most intriguing, if not cagey, was the news portal report that further states; \u2018\u2026Marshall did not state what\u2019s next for the case, just to confirm that the Court Order still has effect\u2019 [Observer News: August 23, 2017]. <\/strong>Some legal luminaries contended that certain courses of action may have been orchestrated to \u2018Impede\u2019<\/strong> the administration or \u2018Defeat\u2019<\/strong> the ends of justice.<\/p>\n

AGENCIES: CANNOT BE FETTERED<\/strong><\/p>\n

That which bears irrefutable truths, is that there are two governmental agencies that \u2018Cannot be Fettered,\u2019 <\/strong>neither by the Executive nor the \u2018Judiciary.\u2019<\/strong> A Case on point is that of \u2018\u2026Commissioner of Police and Attorney General v Steadroy \u2018Cutie\u2019 Benjamin\u2019 [JCPC\u201d 2011\/0083]. <\/strong>These agencies are; (i)<\/strong> \u2026The Police Department in its enforcement of the \u2018Criminal Law\u2019 <\/strong>in bringing perpetrators of crime to justice\u2019 [Sections 22 & 23] Police Act: Chapter 330]<\/strong>; and (ii)<\/strong> \u2026The holder of the office of Director of Public Prosecutions (DPP)\u2019 [CO: 1981: Section 88]. In the performance of their respective assigned \u2018Statutory and Constitutional Duties;\u2019<\/strong> (i) \u2018\u2026Investigative; and (ii) \u2026Prosecutorial.\u2019<\/strong> Likened to the \u2018Director of Public Prosecutions (DPP),\u2019<\/strong> the Police are subject to \u2018Judicial Review\u2019<\/strong> for enforcement already done, and not for contemplated enforcement of the \u2018Criminal Law.\u2019<\/strong><\/p>\n

BEHAVIOR OF THE JUDICIARY<\/strong><\/p>\n

Incidental to the death of \u2018Andrea Hughes,\u2019<\/strong> a \u2018Coroner\u2019s Inquisition\u2019<\/strong> held by \u2018Chief Magistrate Joanne Walsh,\u2019<\/strong> then acting in the capacity of \u2018District Coroner\u2019 heard from the \u2018Foreman of the five-member Jury,\u2019 attributed \u2018Culpability\u2019<\/strong> in their \u2018Verdict,\u2019<\/strong> to the driver \u2018Mark Ryan\u2019<\/strong> [2016]. In such case no exercisable powers of arrest and institution of criminal proceedings reside with Law enforcement. Such power of arrest resides only with the Coroner [Section Coroners Act: Chapter 105], while the institution of criminal proceedings by indictment is the sole function of the \u2018Director of Public Prosecutions (DPP).\u2019<\/strong><\/p>\n

PROCEDURAL FUNCTIONS<\/strong><\/p>\n

In respect to such inquisition, the Coroner shall, at the first sitting of the Inquest, examine on Oath touching the death of all persons who under their evidence respecting the facts and all persons having knowledge of the facts whom he\/she thinks it expedient to examine\u2019 [Coroners Act: Section 25 (1)]. \u00a0The law states; \u2018\u2026After hearing the evidence the Jury shall give their verdict. They shall certify it by an inquisition in writing, setting forth, as far as such particulars have been proved to them ; (i)<\/strong> \u2026Who the deceased was; (ii)<\/strong> \u2026How; (iii)<\/strong> \u2026When; and (iv)<\/strong> \u2026Where the deceased came by his\/her death; (v)<\/strong> \u2026If he\/she came by death by (vi)<\/strong> \u2026Murder; (vii)<\/strong> Manslaughter; (viii) …The persons, if any, the Jury find to have been \u2018Guilty\u2019 of such Murder or Manslaughter,<\/strong> or of being accessories before the fact of such murder\/manslaughter\u2019 [Coroners Act: Section 25 (4)].<\/p>\n

COPIES OF DEPOSITION<\/strong><\/p>\n

Procedurally, the law mandates that; \u2018\u2026A person against whom a \u2018Coroner\u2019s Jury\u2019 have found a verdict of; (a) \u2018\u2026Murder; (b) \u2026Manslaughter; and (c) \u2026Infanticide,\u2019<\/strong> shall be entitled to have from the person having for the time being the custody of the of the Inquisition or of the Depositions of the witnesses at the Inquest, copies thereof\u2019 [Section 36: Coroners Act: Chapter 105]. Guided by specific courses of action, and in contemplation of further courses of action, the law expressly provides that; \u2018\u2026All Inquisitions and records of proceedings at any Inquest shall be transmitted to the \u2018Director of Public Prosecutions (DPP) within seven days at the latest after the Inquest is closed\u2019 [Section 46].<\/p>\n

WARRANT OF DETAINER<\/strong><\/p>\n

The law has made it sufficiently clear that \u2018\u2026Where a Coroner\u2019s Inquisition charges any person with; (a) \u2018\u2026Murder; (b) \u2026Manslaughter; or (c) \u2026Infanticide,\u2019 the Coroner shall, if the person is at large issue his \u2018Warrant\u2019 for his apprehension and committal to prison, or, if he be already in Prison, the Coroner shall issue a \u2018Warrant of Detainer\u2019<\/strong> addressed to the \u2018Keeper of the Prison\u2019<\/strong> in which the accused is confined\u2019 [Section 33: Coroners Act; Chapter 105].<\/p>\n

NIGHT OF TRAGEDY<\/strong><\/p>\n

On the \u2018Night of Tragedy,\u2019<\/strong> Tuesday April 29, 2014, when \u2018Cedar Grove resident Andrea Hughes 32<\/strong> set foot on the Weatherill\u2019s public road, she had not the slightest idea, that it would have been her last walk on that particular road or other roads in her community. It was not only the night that tragedy had struck, but also the last time she would have been actually called \u2018Mother\u2019 by her nine children. That had been that last day the children who comprised \u2018three sets of twins\u2019 <\/strong>then ranged from \u2018age 5 to 12 years\u2019 had seen her [ABS TV: June 2014].<\/strong> Medical evidence suggested that the traffic accident victim \u2018Andrea Hughes,\u2019<\/strong> succumbed to bodily injuries sustained [April 30, 2014].<\/p>\n

SUSTENANCE AND SURVIVABILITY<\/strong><\/p>\n

As tragedy struck, her common law partner \u2018Dane Hamilton\u2019<\/strong> was not only left to continue the struggle, but also to provide for their \u2018Sustenance and Survivability\u2019<\/strong> and for \u2018Criminal Justice.\u2019 <\/strong>That which speaks to their parental commitment and will in providing for these children, was that four of the children were reported to have been students at the \u2018Princess Margaret Secondary School (PMSS).\u2019<\/strong> Three others were said to have been students at the Cedar Grove Primary School\u2019 [Web Page: Rotary Club: Antigua and Barbuda]. <\/strong><\/p>\n

DEAFENING SILENCE<\/strong><\/p>\n

Even after seven years, the \u2018Deafening Silence\u2019<\/strong> and unending judicial closure through possible institution of criminal proceedings against \u2018Mark Ryan\u2019<\/strong> deemed culpable for the death of the deceased, continues to provoke controversial discussions and widespread speculation that the matter may have been laid to rest following the provision of a home to her common law husband Dane Hamilton\u2019<\/strong> and their nine semi-orphaned children. That which is also known is that it has been causing tremendous anxieties in the life of her offspring and a watchful citizenry.<\/p>\n

SOCIAL JUSTICE ADVOCATE<\/strong><\/p>\n

Moved by the tragedy and awareness of conditions of \u2018Indigence and Squalidity,<\/strong>\u2019 facing the children of the deceased \u2018Andrea Hughes,\u2019<\/strong> research revealed that \u2018Sir George Ryan\u2019<\/strong> was influenced by \u2018Nathan Dundas\u2019<\/strong> to put his humanity and resources where they were most urgently needed. Conversely, social justice advocate, \u2018James \u2018Tanny\u2019 Rose,\u2019<\/strong> moved by compassion of the plight of the children and the insensitivity, inconsistency and tardy attitude shown by law enforcement, was most consistent with his voice. Likened to the rest of the citizens, he had chosen not to relent in expressing hope that \u2018Criminal Justice\u2019<\/strong> shall be visited upon the \u2018Coroner Jury-found Culpable Driver Mark Ryan.\u2019 <\/strong>Incidentally, seven years later, Justice\u2019<\/strong> have been evasive, while the advocate\u2019s voice and pleadings have not been heard.<\/p>\n

DWELLING HOUSE VENTURE<\/strong><\/p>\n

Interestingly, the person behind the \u2018Dwelling-House Venture\u2019<\/strong> was President of the \u2018Antigua and Barbuda Cruise Tourism Association (ABCTA)\u2019 and General Manager of \u2018Bryson\u2019s Shipping, Nathan Dundas (deceased)\u2019 <\/strong>[Observer: January 24, 2021]. From a professional investigative perspective, it may or may not have been coincidental of the involvement of \u2018Nathan Dundas,\u2019<\/strong> then \u2018General Manager of Bryson\u2019s Shipping,\u2019<\/strong> under the Chairmanship of \u2018Patrick Ryan.\u2019<\/strong> These enterprises are clearly not social organizations, that often provide needful social services to the poor, destitute and desperate. Instead, they were widely known as profit-making enterprises with elbow-pounding to share negligible portions of their profits.<\/p>\n

VOLUNTARY\/SPUR OF MOMENT<\/strong><\/p>\n

It may also have been coincidental that he had been so moved that \u2018Mark Ryan\u2019<\/strong> had been unfortunately involved in a most deadly accident that resulted in the tragic loss of life. However, coincidental or not, \u2018Nathan Dundas\u2019<\/strong> in his either voluntary or spur of the moment initiative was lauded for his humanitarian gesture. In a \u2018Rotary Club-<\/strong>published statement it was highlighted that; \u2018\u2026What began as a passionate plea in April [2014] by \u2018Cruise Tourism Association (CTA) \u2018President Nathan Dundas\u2019<\/strong> for a plot of land to place the house being built by \u2018Mr. George Ryan and Ryan Group of Companies<\/strong>\u2019 has resulted in not only a house, but a home for the family\u2019 [Web Page: Rotary Club; September 6, 2014].<\/p>\n

UNIQUE RELATIONSHIP<\/strong><\/p>\n

Given \u2018Nathan Dundas\u2019<\/strong> \u2018Unique Relationship\u2019<\/strong> with these enterprises and identifiable Chairpersons, it was obvious that likened to a \u2018Laser-Guided Missile,\u2019<\/strong> his role was to target; (a) \u2018\u2026Certain prominent persons; (b) \u2026Entities; and (c) \u2026Carefully selected members of the corporate community.\u2019<\/strong> A criminal tribunal looking at the evidence contained in the \u2018Depositions\u2019<\/strong> from the \u2018Coroner\u2019s Inquest\u2019<\/strong> and properly directing itself, could have reasonably inferred that his relationship with certain companies and the voluntary provision of a dwelling house to the children of the deceased, speak not only to an attempt at deflecting from the \u2018Tragic Accident,\u2019 <\/strong>but also conspiratorially designed to \u2018Obstruct Justice.\u2019<\/strong>He seemed to have been successful in doing so for the \u2018last seven (7) years.\u2019<\/strong><\/p>\n

SOCIAL ACTIVISM<\/strong><\/p>\n

Guided by professional investigative practice, to all intents and purposes, very carefully inserted among these, were two \u2018Particular Companies;\u2019<\/strong> (i) \u2018\u2026Antigua and Barbuda Cruise Tourism Association (ABCA); and (ii) \u2026Staff of Bryson\u2019s Shipping\u2019 [Web Page: Rotary Club: September 6, 2014]. <\/strong>In fact, neither \u2018Nathan Dundas\u2019<\/strong> nor associated \u2018Group of companies\u2019 were known for \u2018Social Activism.\u2019<\/strong> In spite of the family\u2019s conditions of squalidity, recognized only after the tragic demise of \u2018Andrea Hughes,\u2019<\/strong> the elven -member family was said to have been competing for space with \u2018rodents and pestering crawling insects\u2019 pitilessly for many years.<\/p>\n

CAREFULLY TARGETED<\/strong><\/p>\n

There have always been public concerns over appeals for public funds without transparency and public accountability. Seemingly, in a tragedy, these are waved. The apparent very \u2018Carefully Targeted\u2019<\/strong> persons, non-governmental and corporate citizens included; (i) \u2018\u2026Sir George Ryan KCN:<\/strong> (ii)<\/strong> \u2026Social activist and self-styled \u2018Minister of Help\u2019<\/strong>Eugene Humphrey; (iii) \u2026Rotary Club President Lorraine Joseph Brazier;<\/strong> (iv) \u2026Central Planning Housing Authority (CHAPA) Accountant Pretzel Joseph (deceased);<\/strong> (v)<\/strong> \u2026Central Board of Health (CBH); (vi)<\/strong> \u2026Antigua Public Utilities Authorities (APUA) Electricity and Water Divisions; (vii)<\/strong> \u2026Romeo Plumbing; (viii)<\/strong> \u2026Belmont Clinic; (ix) \u2026Ewart Harney;<\/strong> (x)<\/strong> \u2026Gigi Industries; (xi)<\/strong> \u2026First Domestic Industry Company Limited; (xii)<\/strong> \u2026SHAADE Distributors Limited; and (xiii) \u2026Antiguans in the Diaspora- Miami and New York\u2019<\/strong> [Web Page: Rotary Club].<\/p>\n

NINE MOTHERLESS CHILDREN<\/strong><\/p>\n

It was not clear what may have influenced then \u2018General Manager of Bryson\u2019s Shipping, Nathan Dundas\u2019 in embarking upon such venture. However, reasonable inferences may have been drawn that he may have been prompted by the \u2018Tragic Traffic Accident\u2019<\/strong> that has \u2018left 9 motherless-children.\u2019<\/strong> By seeking to appease the minds of the aggrieved, a \u2018cost-free and fully furnished dwelling house\u2019 appeared to have been the best option. Even so, it was a venture that appeared \u2018Reek of Deception.\u2019<\/strong> For instance, there was clear deceit in wooing the participation of the unsuspecting. This clearly was designed to deflect attention from the \u2018Gravity of the Tragedy.\u2019 <\/strong><\/p>\n

CREATING ILLUSIONS<\/strong><\/p>\n

The person or persons who were responsible for the provision of the dwelling house to the bereaved and semi-orphaned children, appeared to have skillfully and successfully \u2018Created the Illusions\u2019<\/strong> not only of genuine concern for their welfare, but also the \u2018Condition of Squalidity\u2019 in which they existed. Consequent upon which, the unsuspecting not only appeared to have been hoodwinked, but also moved to generously, substantially and meaningfully contributed of; (a) \u2026Their time; (b) \u2026Cash or kind; and (c) \u2026Patronage and Presence,\u2019<\/strong> toward an apparent well-schemed venture.Moreover, an astute criminal investigator looking at the circumstances and non- relationship and non-appeal to \u2018Nathan Dundas\u2019<\/strong> for assistance, may very well have been considering that the venture was a disguised attempt to \u2018Pervert the Course of Justice.\u2019<\/strong><\/p>\n

CAREFULLY PLANNED \u00a0<\/strong><\/p>\n

From a professional investigative perspective, there was absolutely no doubt, that initiator of the venture \u2018Nathan Dundas\u2019<\/strong> (deceased), had spun a \u2018Web of Deception\u2019<\/strong> upon those contributed to the initiative. Carefully planned and cleverly executed, they may have been given the impression that the heart-wrenching act to the children of the deceased \u2018Andrea Hughes,\u2019 <\/strong>came from his heart. All appeared to have been unsuspectingly duped. Not least among them were; (i) \u2018\u2026His Excellency, Governor General Sir Rodney Errey Lawrence Williams KCN, GCMG; (ii) <\/strong>Member of Parliament Maria Vanessa Bird-Browne; (iii) <\/strong>\u2026A representative of parliamentary colleague \u2018Charles \u2018Max\u2019 Fernandez\u2019 wife Jill Fernandez; (iv) \u2026Sir George Ryan; and (v) \u2026Bishop Charlesworth Browne.\u2019 <\/strong><\/p>\n

MIXED FEELINGS<\/strong><\/p>\n

They were all attended the \u2018House Presentation Ceremony.\u2019<\/strong> Some spoke to the humanitarian gesture of General Manager of Bryson\u2019s Shipping, \u2018Nathan Dundas.\u2019<\/strong> Some cut ribbons and some offered blessings. Speaking at the \u2018Momentous Occasion\u2019<\/strong> Governor General, His Excellency, \u2018Sir Rodney Errey Williams GCMG, MBBS,\u2019 <\/strong>with all sincerity, speaks to \u2018Mixed Feelings.<\/strong>\u2019 He said; \u2018\u2026I am here with mixed feelings because this family suffered a loss; \u2026We empathize with you; \u2026I am also happy on the other hand that we have people in our community and our nation that have come forward to give real assistance to the family.\u2019<\/strong><\/p>\n

HELPING HAND<\/strong><\/p>\n

Member of Parliament, \u2018Maria Vanessa Bird-Browne\u2019<\/strong> reportedly expressed her delight.
