None could have readily said that \u2018No. 500 Corporal Clifton Commons\u2019<\/strong> died of the \u2018dangerous, infectious and deadly disease called \u2018Covid-19.\u2019 Had that been the case, given the \u2018Public Health Act\u2019 and provisions contained therein for immediate burial, he would have been speedily laid to rest [PHA: Section 119 (d): Chapter 353\u2019. Why? The \u2018Cause of Death\u2019<\/strong> would have been quickly determined and made known.\u00a0 A cop is dead. His corpse lies on ice. In the meantime, a family, traumatized over the tragic incident, has been left to mourn and grieve. Even as law enforcement administrators speak satisfactorily to his \u2018reliability and dependability\u2019 in the performance of duties, the treatment of his corpse and the urgency of attention to cause it to be peacefully laid to rest, appeared to have left much to be desired.<\/p>\n

PERSPECTIVE<\/strong><\/p>

\"\"<\/a><\/div>\n

This commentary looks at horrors facing two families and the apparent inordinate delay in conducting a \u2018Post Mortem Examination\u2019 on the body of \u2018No. 500 Corporal Clifton Common\u2019<\/strong> to determine the \u2018Cause of Death,\u2019<\/strong> necessarily to determine; (a) <\/strong>\u2018\u2026Culpability or criminal liability; (ii) \u2026Issuance of a Coroner\u2019s Warrant to Bury; (iii) <\/strong>\u2026Enabling the Filing of the relevant documentation; and (iv) <\/strong>\u2026Securing the Issuance of a Death Certificate\u2019 from the \u2018Registry of Births and Deaths. <\/strong>This is not readily obtainable if the \u2018Cause of Death\u2019 <\/strong>is not known and so registered with the competent authority- \u2018Registrar of the High Court of Justice.\u2019<\/p>

WHEN A MAN DIES<\/strong><\/p>\n

It has been no idle talk that \u2018When a man dies, he is done.\u2019<\/strong> This speaks true of the experiences of the bereaved family of \u2018Corporal Clifton Common.\u2019<\/strong> However, the Scripture assures that; \u2018\u2026God will wipe every tear from their eyes; \u2026And there shall be no more death; \u2026Neither sorrow; \u2026Neither shall there be any more pain, for the former things are passed away\u2019 [KJV: Revelations 21: 4]. These are the \u2018Divine Words\u2019<\/strong> of the \u2018Holy Bible,\u2019 <\/strong>of which the faithful shall believe. Thus, lest they relinquish or forfeit their own salvation, they shall all believe. This may not necessarily have been the understanding of family members of the deceased who has departed this life to be disappointingly and eternally placed on \u2018\u2026Ice Preservation\u2019<\/strong> [February 11, 2021].<\/p>

\"\"<\/a><\/div>\n

VICTIM OF THE UNEXPECTED<\/strong><\/p>\n

Incidentally, when tragedy struck, \u2018Corporal Clifton Common\u2019 <\/strong>became \u2018Victim of the Unexpected.\u2019 <\/strong>A brutal assault by a youth believed to have become disillusioned or demented had reportedly turned deadly. Barely made his way to the lowly rank of Corporal, his untimely death in the \u2018Police Holding Cell,\u2019<\/strong> brought shock and awe to immediate colleagues and deep sorrow and painful grief to his family, loved ones and friends. Equally as much, the tragic incident had dismayed the whole nation. Whatever may have been the surrounding circumstances, his life had been snuffed out\u2019 [February 11, 2021].<\/p>

\"\"<\/a><\/div>\n

JUMPING TO CONCLUSIONS<\/strong><\/p>

\"\"<\/a><\/div>\n

In the developed brouhaha over the delay in bringing procedural closure, \u2018Chief Magistrate Joanne Walsh,\u2019<\/strong> acting in the unique capacity of \u2018District Coroner\u2019<\/strong> has made it sufficiently clear, that neither the \u2018Coroner nor the five (5)-member Jury\u2019<\/strong> accept responsibility for any delay in \u2018professional practices\u2019 not residing with the office of, or functions of Coroner. This is undeniably true. For instance, when law enforcement investigators hastily arrested \u2018Verel Simon 20 years\u2019<\/strong> for the crime of Murder, they have in fact \u2018Wrestled from the Coroner\u2019 <\/strong>and 5-member Jury further inquisition into the circumstances surrounding his death. Instructively, to all intents and purposes, but seemingly \u2018Jumping to Conclusions,\u2019<\/strong> they had determined that he died at the hands of the accused.<\/p>\n

SQUABBLES AND DELAYS<\/strong><\/p>\n

Amidst the \u2018Squabbles and Delays,\u2019<\/strong> distrust by family members and a desire for a non-governmental pathologist appeared to have dogged \u2018Police investigators and the Coroner,\u2019 the \u2018Corpse of Corporal Clifton Common,<\/strong>\u2019 remains in the \u2018Dead House\u2019<\/strong> of an Undertaker. This was further said to have been compounded by certain investigative demands that neither has anything to do with family, nor pathologist. Those that are familiar with investigation, criminal or otherwise shall know that information unearthed, received or voluntarily obtained shall not be divulged except at institutionalized proceedings, namely: (i) <\/strong>\u2018\u2026Magistrates Courts; (ii)<\/strong> \u2026Judge and Jury trials; (iii) \u2026Coroners Inquisitions;<\/strong> (iv)<\/strong> \u2026Tribunals; or (v)<\/strong> \u2026Commissions of Inquiry\u2019<\/p>\n

SCIENTIFIC AIDS<\/strong><\/p>\n

On the subject of \u2018Scientific Aids,\u2019<\/strong> it is stated that the Pathologists determine inter alia; (a) \u2018\u2026Cause of Death; (b) \u2026Manner brought about; and (c) \u2026Expert opinion on findings.\u2019 Such persons are considered Surgeons, Doctor and Specialist combined\u2019<\/strong> [1972: Page 183: Criminal Law: Crime Investigations: Police Promotion Handbook]. Except in circumstances where a body found in \u2018an advanced stage of decomposition\u2019 and a Pathologist was not available, this has often resulted in delays, chaotic scenes and confused minds. Situationally, \u2018\u2026(i)<\/strong> \u2026Where the identity of a deceased person was not known; or (ii)<\/strong> \u2026Where family members were also not known.\u2019 This has not been the case of the deceased.<\/p>\n

CART PULLING HORSE<\/strong><\/p>\n

Incidentally, the continued holding of the body has never been; (a) \u2018\u2026The incompletion of a Coroner\u2019s Inquisition; nor (b) \u2026The unavailability of resources for burial.\u2019<\/strong> The inordinate delay has been strictly for want of an autopsy or to be anatomically examined by a Government-designated or contractually-arranged pathologist. That which they may have been ignored or appeared to have been \u2018Gross Negligence\u2019 was not to have given careful consideration to the role of a\u2018Pathologist\u2019 <\/strong>and importance of his\/her \u2018Report and Findings.\u2019 <\/strong>In the first instance, that which appears intriguing was that criminal investigators may have placed a \u2018Cart to Pull Horse\u2019<\/strong> when they arrested and charged \u2018Verel Simon 20,\u2019<\/strong>with murder. In the instant case, there has been no shortage of persons who knew, and are well-positioned to identify the body of the deceased \u2018Corporal Clifton Common\u2019<\/strong> to a Pathologist.<\/p>\n

PERSONS KNOWN<\/strong><\/p>\n

That which is undeniable and unchallengeable are that; (a) <\/strong>\u2018\u2026The whereabouts of his father Curtis Common<\/strong> are known;(b) <\/strong>\u2026That of the deceased\u2019s wife Velma Common<\/strong> are also known; while (c)<\/strong> \u2026The deceased was no stranger to \u2018Commissioner of Police Atlee Rodney,\u2019<\/strong> under whose command and control he last served in the \u2018Police Service\u2019<\/strong>[February 11, 2021]. Given these truths, there may be no reason for continued icing of the corpse of the deceased for want of identification, nor \u2018Police-recorded Statements.\u2019 These have not and have never been determinants for the \u2018Cause of Death.\u2019<\/strong> Therefore, the findings and professional opinions of any pathologist shall not be reduced to advance reading of any Police-recorded Statements.<\/p>\n

DESPAIR – DISTRUST<\/strong><\/p>\n

Seemingly harboring fears, real or imaginary, there was said to exists some degree of \u2018Despair and Distrust\u2019<\/strong> among one family. Conversely, another family, driven into despondency, remains anguished over the \u2018suspected demented behavior of a youth,\u2019 seemingly has as much concerns over the hasty slapping of a \u2018Murder Charge\u2019 <\/strong>against the family member accused of committing the serious criminal act. The family of the \u2018suspected-murder accused,\u2019 was said to have revulsed over the incident that resulted in the possible tragic loss of life. That which appeared to have compounded the incident, have been uncertainties surrounding that which may or may not have resulted in the death of the law enforcement officer.<\/p>\n

PATHOLOGIST REPORT<\/strong><\/p>\n

There shall be no doubt that the \u2018Pathologist Report\u2019<\/strong> is most critical to an authority acting in the capacity of \u2018Coroner.\u2019 Undoubtedly, it guides a \u2018Coroner\u2019 as to whether or not a \u2018\u2026Coroner\u2019s Inquest\u2019 <\/strong>shall be held. Moreover, such report is of vital importance to; (i) \u2026Issues of Culpability; <\/strong>and (ii) \u2026Issuance of a \u2018Warrant to Bury.\u2019 <\/strong>In the case of\u2018Culpability or Non-culpability,\u2019 <\/strong>it helps to determine the way forward. While these issues remain unresolved, anxieties and uncertainties continue to fester in the minds of those that have been painfully left to grieve and mourn. Given this \u2018Investigative Blunder,\u2019 no documentation can be filed with the \u2018Registrar of Births and Deaths\u2019<\/strong> and likened to a \u2018Warrant to Bury,\u2019<\/strong> no \u2018Death Certificate\u2019<\/strong> can be issued.\u2019<\/p>\n

CORONER\u2019S INQUISITION<\/strong><\/p>\n

Dependent upon the \u2018Cause of Death,\u2019<\/strong> a full \u2018Coroner\u2019s Inquisition\u2019 <\/strong>may very well have returned a \u2018Verdict of Manslaughter.\u2019 <\/strong>It all started on the morning of Thursday, February 11, 2021. To all persons and of all places, tragedy struck at a \u2018Holding Cell\u2019<\/strong> for both suspected criminals and\/or persons reasonably suspected to be losing or have lost touch with reality. Distraught over what shall be done, or that which shall have been done, the family becomes even more mortified. While pathologist and police squabble, the bereaved remains disagreeable. The dead can neither; \u2018\u2026Hear anything; \u2026See anything; \u2026Say anything; \u2026Do anything; nor \u2026Stop anything.\u2019<\/p>\n

DEPRIVATION OF OPPORTUNITIES<\/strong><\/p>\n

In fact that which criminal investigators appeared to have effectively done, was the removal of all opportunities from the \u2018Coroner and Jury to; (i)<\/strong> \u2018\u2026To hear witnesses accounts; (ii) \u2026To look thoroughly into the circumstances touching the death of the deceased; and (iii)<\/strong> \u2026Retire to consider a verdict and depriving the \u2018Coroner\u2019s Jury\u2019<\/strong> of the opportunity in deciding upon one of the following Verdicts; (a)<\/strong> \u2018\u2026Natural Causes; (b)<\/strong> \u2026Misadventure; (c)<\/strong> \u2026Justifiable homicide; (d)<\/strong>\u2026Murder; or (e)<\/strong> \u2026Manslaughter.\u2019 Guided by the principle; \u2018\u2026The Greater includes the Lesser,\u2019<\/strong> even where there may have been no malice aforethought, whether expressed or implied, investigators have charged the youth with the most serious crime of \u2018Murder.\u2019<\/strong><\/p>\n

CUSTODY AND CONTROL<\/strong><\/p>\n

That which the professional investigators and practicing pathologists shall know is simply that which is provided for \u2018Investigative Guidance.\u2019<\/strong> They may know if only, they make some time to read. Given the nation\u2019s derivative laws and jurisprudence,\u2019 a \u2018Home office Circular\u2019<\/strong> states; \u2018\u2026Where it appears desirable in the interests of justice to obtain an analysis in connection with any death concerning which an Inquest has not been held, the Coroner should be consulted, as by law, he\/she has the \u2018Custody and Control\u2019<\/strong> of the body. This should be done even when the material proposed to be analyzed is not part of the body, as it is important that the Coroner should have control of anything which may throw light on the manner in which the deceased came to his\/her death\u2019 [PPHB: Crime Investigation: Page 183].<\/p>\n

WARRANT OF CORONER<\/strong><\/p>\n

Anticipating that some Medical Practitioners might be starved of scruples, and do the unthinkable, Parliamentarians inserted a particular Section to prevent; (a) \u2018\u2026Inappropriate Conduct; or (b) \u2026Detect malpractice\u2019 by those that would seek to deceive Coroners or bereaved families and by extension, members of the wider society. [Section 38: Coroners Act: Chapter 105]. The law was not only made purposefully, but also sufficiently clear that; \u2018\u2026No Minister or other person shall knowingly bury or allow to be buried, the body of any person who died an unnatural death or under circumstances calling for the interposition of a Coroner, without the production at, or before the time of the funeral a \u2018Warrant of the Coroner\u2019<\/strong> authorizing such burial.\u2019<\/p>\n

CAUGHT NAPPING<\/strong><\/p>\n

It may have been for this very reason that the mortal remains of \u2018Corporal Clifton Common,\u2019<\/strong> continue to be \u2018Kept on Ice,\u2019 <\/strong>as opposed to the accordance of a decent \u2018Covid-19 Restrictive Burial.\u2019<\/strong> Scandalously, if not embarrassingly, this was reportedly due to the\u2019 (a) \u2018\u2026Non-performance of an autopsy by a pathologist; and (b)<\/strong> \u2026No determination as to the \u2018Cause of Death.\u2019<\/strong> Investigators appeared to have been \u2018Caught Napping.\u2019<\/strong> The law has made it sufficiently clear that; \u2018\u2026No Certificate of the Cause of Death shall be issued by any Medical practitioner in any case where to his knowledge, the deceased died \u2018an Unnatural Death,\u2019<\/strong> or where such death shall have occurred under circumstances which require a report to be made to the Coroner, or where the Coroner is informed of a sudden death where the \u2018Cause of Death\u2019<\/strong> is unknown\u2019 [Coroners Act: Section 39].<\/p>\n

UNWAVERING AND UNDIVIDED<\/strong><\/p>\n

In his life as well as in the Police of the \u2018Royal Police Force of Antigua and Barbuda,\u2019 Corporal Clifton Common\u2019 <\/strong>was described as a veteran Police officer. Enlisted into the \u2018Police Service\u2019 [January 15, 1992], even as other police personnel who had reportedly enlisted long after became his superior, he had not complained, showed animosity or sought to sow seeds of discord or caused disaffection among his colleagues. Though some reportedly sought to push their weight around, that which he reportedly knew were; (a) \u2018\u2026Respect for his superiors; (b) \u2026Obedience to orders and call of duty; and (c) \u2026Ever compliant with lawful instructions.\u2019<\/p>\n

UNDIVIDED ALLEGIANCE<\/strong><\/p>\n

His devotion to duty and dependability, speaks primarily to his \u2018Unwavering Loyalty\u2019<\/strong> and \u2018Undivided Allegiance\u2019<\/strong> to the Police Service. He was ever mindful of his chosen career- Law Enforcement. It may have been evident to all a sundry, that he had been a deep commitment to the \u2018Rule of Law.\u2019 <\/strong>In the eyes of his fellow-colleagues, he was a \u2018Model Police Officer.\u2019<\/strong> To Commissioner of Police, Atlee Rodney, disingenuously sparse as it may have been viewed, he described him as being \u2018\u2026quiet and dependable\u2019<\/strong> [Observer: February 12, 2021]. Now, just over two months after his death, his remains at a \u2018City Funeral Home.\u2019<\/strong> There may be no further incurred costs to the tax-paying population, neither for \u2018Holding nor Icing\u2019<\/strong> of his corpse.<\/p>\n

CONCLUSION<\/strong><\/p>\n

From professional training, knowledge and experience, particularly where persons die tragically, unnaturally or under circumstances where the \u2018Cause of Death\u2019<\/strong> is not known, the function of pathologists is to conduct anatomical examinations on the bodies of persons declared dead by a medical practitioner-governmental or private. While they fuss fight, \u2018Pathologists\u2019 shall know that they are neither \u2018Magistrates nor Coroners.\u2019<\/strong> Yet they provide a most important function to \u2018Criminal investigators, Criminal Courts and Coroners.\u2019 This is particularly so, as it affects the administration of justice. Equally as important have been their professional services to members of the wider society and by extension, the nation as a whole. Thus, they shall not only be perceived as being overly concerned about ego, remuneration or wealth acquisition. ***<\/p>\n
