On Monday, Purcelle appeared before Chief Magistrate Joanne Walsh after being accused of dumping garbage on land near Royalton Resort in February.<\/p>

The prosecutions very first witness, a litter warden by the name of Judy Roberts, took the stand and gave sworn testimony.<\/p>\n

 <\/p>

\"\"<\/a><\/div>\n

But it was when Attorney Wendel Robinson cross examined her, that a crucial piece of evidence was revealed.<\/p>\n

 <\/p>

\"\"<\/a><\/div>\n

That is that Purcelle was an independent contractor of Royalton and the land he dumped the garbage on belonged the same resort.<\/p>

\"\"<\/a><\/div>\n

 <\/p>\n

The prosecution decided to offer no evidence against Purcelle and withdrew the case because Purcelle could not have been engaged in illegal dumping since the garbage and the land belonged to the hotel.<\/p>\n

 <\/p>\n

The Litter control and Prevention Act of 2019 states that, “a person commits an offence if that person deposits and leaves any litter or waste in any premises owned or occupied by another”-one can illegally dump unto his own property.<\/p>\n

 <\/p>\n

It was just about a month ago that construction worker has been slapped with the maximum fine of $3000 for dumping garbage in a similar areas in Five Islands.<\/p>\n

Purcelle could have faced a similar fate.<\/p>\n
