Chief Magistrate Joanne Walsh has recused herself from a case involving St. Peter MP Asot Michael.<\/p>

\"\"<\/a><\/div>\n

On Friday the Chief Magistrate said that, as requested by Michael and his legal team, she will be recusing herself from his case,\u00a0Observer Radio<\/strong>\u00a0reported.<\/p>\n

Michael\u2019s lawyer Hugh Marhsall Jr, in a letter dated September 14, 2020, asked Walsh to \u201cimmediately recuse yourself from these proceedings.\u201d\u00a0\u00a0Antigua Breaking News (ABN) has obtained a copy of the letter.<\/p>

<\/div>\n

The matter Marshall Jr referred to is\u00a0Chuka Lewis v Asot Michael<\/strong>, which was adjourned to September 21, 2020.<\/p>

\"\"<\/a><\/div>\n
<\/div>\n

Ahead of Monday\u2019s hearing, Marshall Jr told Walsh \u201cit is no longer appropriate for you now to continue to exercise any judicial function in this matter going forward.<\/p>\n

Walsh issued a bench warrant for Michael last week even though he had a letter from his doctor showing that he was ill. Michael\u2019s lawyer argues that the Chief Magistrate had no legal authority to issue the warrant under the circumstances.<\/p>

<\/div>\n

In addition, he argues that \u201cyour actions undermine the necessary objective perception of the administration of justice as independent and untainted by bias whether conscious or unconscious bias.\u201d<\/p>\n

The proceedings will now continue on Monday with a different magistrate.<\/p>
