In reference to the article in The Daily Observer, page 3, Re: \u2018Chief Magistrate\u2019s sentence raises more questions<\/u>\u2019, published on Monday, January 08, 2018, the Chief Magistrate wishes to state categorically, the inaccuracies stated by the author of the said article.<\/p>\n

The Firearms (Amendment) Act 2017 No. 27 of 2017 was only printed and published in the Official Gazette on Tuesday, 9th<\/sup>January, 2018.\u00a0 Let it be known that until that time, the Act was not formally law.\u00a0 The Court can only make reference to that which is currently on the law books.\u00a0 Further, it is left to the discretion of the Magistrate as to the Sentence to be passed down to a convicted person based on, among other things, the Probation of Offenders Act.<\/p>

Therefore, please be hereby informed and further advised that a Magistrate is not \u2018Deemed to Know\u2019, that which is Law, until it has been printed and published in the Official Gazette.Kindly be guided accordingly.<\/p>
