  1. Yes it was good to test the matter in Court just like the Anthony Smith case which will establish the meaning of Independence pursuant to section 41 (1) (e) of the Constitution. In your voter picture list case the problem is that while section 15 (1) of the 2004 Freedom of Information Act gives a person the power to obtain information notwithstanding any contrary law, the 2011 amendment to the Representation of the People Act (RPA) provides that there should be a voter picture list and it should be used by ABEC only in the polling booth. The 2011 amendment to the RPA is later in time than the 2004 Act and is in conflict with it, therefore, the provision of the 2004 Act is impliedly repealed by the 2011 amendment to the RPA. That is the hurdle you will have to get over and I don’t believe that you can. Just a bit of legal advice.
