Director of Public Prosecutions (Ag), Shannon Jones-Gittens, has responded to Senator Shawn Nicholas of the United Progressive Party regarding the alleged statements made by Prime Minister Gaston Browne on Pointe FM Radio.
In her reply, the DPP acknowledged the receipt of Senator Nicholas’ letter and stated that, in her respectful opinion, the purported statements alone are insufficient to warrant a criminal investigation.
The controversy surrounding the Prime Minister’s alleged statements emerged when Senator Nicholas addressed a letter to the Director of Public Prosecutions on May 4, 2023, expressing concerns about remarks made by Prime Minister Gaston Browne during a radio show.
In response, the DPP acknowledged the receipt of the letter and expressed her opinion that additional substantial and credible evidence is necessary to support any request for a criminal investigation.
In her letter, Director Shannon Jones-Gittens thanked Senator Nicholas for bringing the matter to her attention promptly. However, she emphasized the importance of evidence in establishing the basis for initiating a criminal investigation.
She stated, “In my respectful opinion, these purported statements, without more, cannot properly ground a request for a criminal investigation.”
She further encouraged Senator Nicholas to provide any other substantial and credible information he may possess to support the allegations, which would facilitate a more comprehensive consideration of the matter.

Why doesn’t the acting DPP go and look for them physical evidence? Asking Shawn Nicholas to provide more evidence is ridiculous. That’s your job.
No that is not the job of the DPP. That is the job of the Police. So, if Shawn has evidence that warrants an investigation, she should bring that to the police. And when and if charges need to be brought the DPP will review the evidence and proceed accordingly.

Gaston may have made certain utterances on the radio, but that does not mean, for instance, that he’s not telling a fib.
As such, so long as there’s not more, but that utterance on the radio, there’s nothing more the office of the DPP can do
Here’s an example. You done a man dead, after being shot. Anyone can say that they add hot, and killed him, just for bragging rights. However, unless you can find evidence to suggest that the bragger did kill that dead person, you don’t have a case.

My suggestion to you Ms. DPP is that you can’t provide evidence unless you first investigate. Investigation must be done by the appropriate Law Enforcement agencies. You cannot expect anyone from the public to investigate the runnings of ABEC to ascertain whether there were any irregularities during the election campaign based on the PM’s statements on his radio station. The onuses is on you yo instruct the police to investigate any matter based on the complaint made by anyone from the public. What happen, no one in this country in such high position has the guts to fo their work without fear or favour anymore?
I love that letter, wish they apply that same reasoning to the numerous people charged for serious crimes where no evidence (clear or convincing) existed to establish probable cause that a crime occurred but these individuals were still charged, unlawfully detained for months and then the evidence presented in court was not even sufficient for the lower standard of reasonable suspicion or probable cause.
You have to apply the legal reasoning in every case, and not just when dealing with the Honorable Prime Minister. He deserves fairness and do does the other humans in the Island.

Gaston has long made clear his statements are being taken out of context. There have always been persons who legally reside in one constituency but vote in another because they have not gone through the transfer process (eg Harold Lovell, Trevor Walker …). Nothing prevents a politician to try to convince them to go and effect the transfer (once no bribery involved)
I heard Gaston’s utterance on Pointe FM. He said he did not transfer any one into his constituency, in fact he transferred them out. He also did not allow people to be transferred into his constituency to help other candidates. Tenman the tape is out there for all to hear, or I am sure you will find his statement on Pointe FM. I am sure you heard it. Gaston said what he said and meant what he said. He can say and do as he pleases because he knows he can get away with it. He knows his people in law enforcement and people like you won’t challenge him and we have an acting DPP who would probably be kicked out if she does her job. Tenman, you sound very pathetic. Please stop trying to dumb down the people in Antigua even more.

The evidence stares her in the face, and she wants others to provide evidence. Is this not reminiscent of Lorna Simon, another ALP plant. Come on! In Mathematics they call it extrapolating. Drawing logical conclusion from the data in front of you. Others have been hauled in by the cops for less on either social media or the airways. Threats have been levied publicly at people with videos to support; allegations of UPP operatives burning down stuff and all kinds of crimes were voiced on the Rumshop; teachers were threatened for standing up for what was rightfully owed to them. Do you see anyone been hauled in and questioned?
I say again, our judicial system is in shambles and this woman just adds to the degradation.
Gaston Browne’s mouth runs like Niagara Falls and he needs to be stopped. Our country has descended into lawlessness because it precipitates from the top. Lawlessness is being perpetrated with impunity here because that which was designed to control it, is dysfunctional.
